The city Council is requested to reconsider the sketch plan located in Section 24-32-24 as requested by Dave Harris. The sketch plan was reviewed by the City Council at their December 6, 1994 meeting with concerns. The developer, Dave Harris, has reconfigured Lots 11 and 16. In reviewing this drawing, the driveway that is proposed does cross the existing wetland which will be a violation of the Wetland Conservation Act. It is very unlikely the Local Government Unit (LGU), Coon Creek Watershed District, will allow any filling activities ) because the violation can be avoided. There appears to be 3 options for the City Council to consider. They are as follows: 1. Require Lot 11 acreage to be attached to either Lot 15 or Lot 16. 2. Allow Lot 16 to front on University Avenue (collector street) which would require a variance from Ordinance 10, Section 9.02 C. 3. Allow the planning and zoning Commission to consider the variance and make a recommendation to the City Council which is normal procedure of the platting ordinance. Note: Ordinance 10, Section 17 discusses variance hardships and procedure (see attached). Mr. Harris would like to receive a commitment from the City Council prior to spending alot of money on the preliminary plat and then possibly receive a denial. The Council may grant a variance from the requirements of this Ordinance as to specific tracts of land where it is shown that by reason of topography or other physical conditions strict compliance with these requirements could cause an exceptional and undue hardship to the enjoyment of a substantial property right; provided, that a variance may be granted only if the variance does not adversely affect the adjacent property owners and Comprehensive Development Plan or the spirit and intent of this Ordinance. (lOC, 10-17-78) 17.02 procedure. written application for a variance shall be filed with the Clerk, and shall state fully all facts relied upon by the applicant. The application shall be supplemented with maps, plans or other data which may aid in an analysis of the matter. The application shall be referred to the Planning Commission for its recommendation and report to the Council. 17.03 Council Action. No variance shall be granted by the Council unless it shall have received the affirmative vote of a majority of the full Council. SECTION 18. VIOLATION AND PENALTY. Any person, firm or corporation violating any of the provisions of this Ordinance shall be guilty of a misdemeanor, and'upon conviction thereof shall be punished as defined by state Law. (lOC, 10-17-78) The platting, replatting, subdividing or conveyance of land not in accordance with the requirements of this Ordinance may be enforced by mandamus, injunction, or any other appropriate remedy in any court of competent jurisdiction. REPEAL. All Ordinances the provisions of this or portions thereof in Ordinance are hereby SECTION 19. conflict with repealed. SECTION 20. EFFECTIVE DATE. Westlund Discussion ~. Virgil Westlund (14183 Heather street NW) appeared before the Council during resident forum at the December 6, 1994 meeting. Mr. Westlund requested an extension of time to allow a family of eight (8) to reside in the upper level of his home as they have yet to secure suitable and affordable housing. The Council, at their September 20, 1994 meeting, agreed to allow the Onchanu family to reside on the premises until November 30, 1994, unless a letter was received by the City from the Anoka County Social Services indicating it was simply impossible to find housing. The City has not received that letter. The Council is aware of the fact that Mr. Westlund's upper level of his home has been turned into an apartment and has its own private cooking facilities. Mr. westlund was directed by the Council to revert his home to a single family residence by November 30, 1994. To date, this has not been done. The Council on September 20, 1994, also specified that all other ordinance violations must be corrected. Staff inspected the property on December 14, 1994. A junk vehicle is still located on the property and needs to be brought into compliance with Ordinance No.8, the zoning Ordinance. (612) 755-5100 REGULAR CITY COUNCIL MEETING - DECEMBER 6, 1994 MINUTES The Regular Bi-Monthly Meeting of the Andover City Council w called to order by Mayor Jack McKelvey on December 6, 1994, 7:0 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andov , Minnesota. He has noticed pub c information signs in other cities and felt that a good place to 'st announcements would be at the corner of Hanson and Bunker Lake Bo evards. He also questioned the legality of making appointments to th Commissions for 1995 at this time because there will be a new Cou~ il seated in 1995. Mr. Veiman also thanked the Council for their ~k this past year, expressing appreciation for all they have done. Virqil Westlund, 14183 Heather - asked for an extension of time to move the Russian family which has been living in his house. They have been unable to find suitable, affordable housing. Ideally the family would be allowed to remain at his house until September, 1995, at which time they would have a house built. Councilmember Perry recalled the Council had said an extension would be considered upon receipt of a letter from Anoka County Social Services that they were unable to locate other housing. Mr. Carlberg noted the stipulations were spelled out in a letter to Mr. Westlund dated September 20. The City has not received a letter from Anoka County. Mayor McKelvey stated he has received calls from neighbors that the items to be taken care of as a part of the request have not yet been done. He would like time to check into the matter and suggested the item be placed on the December 20 agenda. Mr. Westlund - thought he had complied and asked for more clarification. He does not have to remove the dirt pile for one year from the date of the building permit. He did remove dirt right up to the frost. Mr. Carlberg reviewed the letter and the conditions, specially that a letter is received from Anoka County supporting Mr. Westlund's statements. MOTION by Jacobson, Seconded by Perry, that we allow the matter to remain as it is until the next regularly scheduled Council meeting until such time as we have a report or make a decision on this matter. Residents did not feel they would have been charged for thi~/assessment if it had been charged to the developer as it should 99~been at the time of platting. Mayor McKelvey stated he had so~/questions he would like to research and asked that it be tabled of two weeks. by Perry, to table this item. DISCUSSION: Council 10:32; reconvened at 10:40 p.m. Mayor Kelvey read into the record another letter objecting to the asse sment from Chad and Jane Becker, 14327 Vale Street. Motion carried _on a 4-Yes, 1-Absent (Jacobson) vote. @ WESTLUND DISCUSSION , Virqil Westlund, 14183 Heather Street - presented a petition from neighboring residents agreeing with a variance to allow the Russian family to remain living with them until they can get a house built next spring. His church has sponsored the family, and their contribution was to provide a place for them to live until they could find permanent housing. When the family was on welfare, they received a rent allowance from the county, which they gave to him. It was only enough to barely pay the heat and electric bill. At this time he has two rent checks from the Onchanu family, though he has not cashed either one of them. He is not trying to use his home for financial gain. They have looked but have been unable to find an affordable apartment for a family of eight; and to require that now would put a financial burden on the family. Councilmernber Perry suggested a reasonable period of time be set in which the family could be relocated. She also wanted it clearly understood by Mr. Westlund that rental property in a single family residential area is not allowed and is not acceptable. Once the Onchanu family is relocated, there would be no more double usage of the property. Mr. Westlund agreed. John Noard, 14216 Heather Street - presented a letter and pictures to the Council. He has lived there for 20 years. He feels sorry for the Russian family, but this was brought about from complaints from residents in the immediate area because of the mechanical work done in front of the house, cars taken apart and kept in the front yard for long periods of time, constant construction of the house, no driveway except for the last three months, etc. The issue of the family was only discovered when the Code Enforcement Officer responded to the other complaints. From the pictures it can be seen the Westlund yard is full of obstacles. One of the neighbors asked Mr. Westlund to clean up the Regular Andover City Council Meeting Minutes - September 20, 1994 Page 16 (Westlund Discussion, Continued) back yard so it is more presentable to look at and was told the person licensing the day care has said he doesn't have to do anything in the back yard he doesn't want to do. He asked how would the Council feel if they saw that dirt pile every time they looked out their window, or how would they like to look at the pieces of cars sitting outside. The whole thing started with the visual blight and has now turned into a sympathy issue for the Russian family. He charged this is a boarding house. Larrv Indv. 2949 142nd Avenue - agreed with Mr. Noard that it is a mess on the Westlund property. He related problems with other boarders of Mr. Westlund working on cars in the front yard. He also noted his letter to the Council and requested the residence be brought back to a single family dwelling. , C Llovd Wittacker, 2947 142nd Avenue NW - stated he talked with his neighbors at 2917 142nd Avenue who signed the petition for Mr. Westlund, and they were not told all of the information. After hearing it all, they have asked to have their name removed from the petition, as have the residents at 2916 l42nd. No one approached the gentleman across from him; so he feels the people who signed the petition did not have all of the accurate information. It was his opinion that Mr. Westlund is living in an apartment house; as ever since the house was built, other people have been living there. He assumed they were relatives, but Mr. Westlund has said he started renting to college students after his children moved out. Two people from the Onchanu family have been on welfare, plus the county is paying for two people to go to school and two for housing. He felt the family could have rented some of the duplex housing along Bunker Lake Boulevard since Anoka County was paying for it. The people signing the petition do not have to live next to this residence; they just drive by the area. It has to change and the City's rules must be followed. In a year and a half the Onchanu' s should have had some ability to find housing, as they do have family in the area. , I I \. '- Mr. Westlund - explained the Onchanu family will be building their house in the spring and plan to do much of the work themselves. He was confident the mortgage will be approved and anticipated it will take several months to complete. That is the reason for the request of the one-year extension, as there isn't time to begin construction yet this fall. He stated the church has been looking very hard for housing for the Onchanu's this past month, but it is difficult to find housing for a family of eight. He admitted his place has not been in the best condition. He's now under construction adding a utility garage, so he had to dig out four feet of black dirt. It was stockpiled, and he is allowing others to take it free of charge if they wish. He just needs a small amount after his construction is completed. They built onto the day care facilities so it would all be downstairs. Their home is in the upper level which is now being used by the Russian family temporarily. He's not intending to make this house a permanent duplex. He felt he and the City can work together so he doesn't have to take alternative methods such as adopting the family. Regular Andover City Council Meeting Minutes - September 20, 1994 , Page 1 7 (Westlund Discussion, Continued) Mr. Wittacker - stated Mr. Westlund continually violates regulations of Andover, as he keeps borders with two private cooking facilities. He stated if anyone files for housing with Anoka County, the county will find them a place to live and will pay for it. Mr. Indv - stated it took Mr. Westlund about two years to get a garage door installed; and when it was installed, it was a used one. It didn't make the neighborhood look very good. Council discussed options regarding the Onchanu family. Mr. Fursman suggested a specific time frame be set and no extension given unless there is written proof that they have exhausted all efforts of the Anoka County or the request is being considered. The Council also specified that all other ordinance violations must be corrected. -, LJ Mr. Westlund - agreed proof should be brought in, as the family has been looking for housing. He also noted he has a one-year permit on the current construction; but he could not guarantee the black dirt will be out of there even after the one year. There are many lots that have piles of black dirt with tarps over them. He guaranteed the pile will reduce in size, but it is no different than others having a tarp over their piles of black dirt. He needs one truck load of black dirt for his own use, and he hopes to be spreading it next summer. He disagreed that there have been others working on cars outside of the garage in past years. He is in the process of putting in a concrete driveway, but it has taken time because of lack of funds and his undergoing several back surgeries. Councilmember Knight argued that waiting for volunteers to clean the yard is unacceptable. People either clean it themselves or hire someone to do it. The neighbors cannot be blamed for not liking the mess or the cars in various stages of disrepair. The problem is these things are going on much longer than normal. MOTION by Perry, Seconded by Knight, that the time period within which the residents have been advised that it must revert to a single family residence be extended until the 30th of November of 1994, and that we accept the suggestion of the City Administrator that if Anoka County Social Services should advise that it is simply impossible to find housing for this family within that time frame that we would at that point consider extending the time. But at no point will the time be extended unless we get that kind of information that there simply is absolutely no alternative housing available. Motion carried on a 4-Yes, 1-Absent (Jacobson) vote. The City Council is requested to declare two dogs owned by Terris Blesi, 831 Crosstown Boulevard N.W., as biting dogs because of an incident where they attacked a dog owned by Sharon Thompson, 838 Crosstown Boulevard N.W. causing extensive injuries. This attack took place on December 9, 1994. The City Council is then requested to declare these two dogs as nuisances due to another attack on the same dog on December 13, 1994. If declared nuisances, the dogs either must be destroyed or removed from the city permanently within 48 hours. Attached are copies of the police reports and copies of reports from the veterinarian. With that information, I made a copy of City Ordinance #53 which specifically deals with dogs and animals. I responded to the dog owner's address at 831 Crosstown Blvd. NW in Andover. I made contact with the owner Terris Lee Blesi, DOB: 12/18/51. In speaking with the Blesi's, it was explained that the dogs had gotten out for only a short time and that it was an accident. They would attempt to prevent the problem in the future. I provided to them the ordinance where specific areas were highlighted; these areas being dog nuisances, dogs running at large, and the biting dog sections of the ordinance and I suggested to them that they attempt to keep the dog within their property so that an incident like this would not continue. I cleared my contact with the Blesi's. It should be noted that later in my shift I received a radio call of a dog at large where the complainant at 838 Transcriber: lori -03 Action Date-Time: 12/13/94 09:52:20 ( '5stown Blvd. was reporting that the Blesi's dogs were running at large again. It should also be noted that the complainant at 838 Crosstown Blvd. was the same complainant and owner of the dog that was viciously attacked by the Blesi's dogs. Upon responding to that location, aside from the other dog at large at large complaint, which is under ICR *94-220765, the complainant Sharon Thompson had explained to me that she does not know if her dog was going to survive and that the dog had sustained quite serious injuries as a result of the attack. She was concerned that if the Blesi's dog continues to run at large, that perhaps a small child may get seriously injured. I expressed to her that once the vet clinic had completed their surgeries, reports and evaluations, that I would like a copy of the vet report which could be added or forwarded with the original biting dog report. It should also be noted that I had checked the ACSO Records in an attempt to locate any other previous dog at large calls involving the Blesi's dog. This person explained that the dogs are usually in the fenced backyard but must have somehow gotten loose. A second call of service regarding dog at large was on 2/18/94 where Deputy Doheny had taken a report from a Brigette Chase, same complainant believed to be on my initial call of service back in '93. She reported two dogs running loose in the neighborhood where the dogs lived at the 831 address and where she stated that this was a continual problem. Deputy Doheny had apparently also spoke to the owner and verbally warned him about the city ordinance of dogs running at large. Mr. Blesi stated that the dogs must have somehow got out of the pens and he'd take care of the problem. It should also be noted that when I was speaking with Ms. Thompson regarding the second dog at large that again this dog at large report is under 94-220765, she had explained to me that she had spoke to the Blesi's regarding the vicious attack of their dog where that the dogs had been out for some time or quite a length of time versus the five minutes that was initially reported to me by the Blesi's. I have no further information. End of supplement. According to Thompson, her dog which is in surgery now had approximately 10 - 15 puncture wounds from the attack. Thompson states the dogs belong at 831 Crosstown Blvd. N.W., the Blesi residence. Blesi had been spoken to last night by a friend of Thompson's but Thompson wanted the Sheriff's Office to speak with them also. I was unable to contact Blesi but passed the informa- tion onto my relief. Where the dog owner living at 831 Crosstown Boulevard. I made contact with the complainant. Sharon Kay Thompson, DOB: 9/16/48. who does reside at 838 Crosstown Boulevard. Where she explained to me that she had went out into her garage where she had observed the neighbor's dogs. these being a Samoye type dog owned by the Blesi at 831 Crosstown Boulevard, in her garage. She explained to me that she had contacted the Blesi and they did, in fact, corral the 2 dogs after approximately a 20 minute battle of getting the dogs corralled. Ms. Thompson explained to me that this is a reoccurring problem and that in the past she has not specifically reported it, however, due to the fact that her dog was viciously attacked by the Blesi's dogs within the past 24 hours that she would begin calling the Sheriff's Office regarding the dog at large. The dog bite report is filed under 94-220624 and I did also approximately 1 hour prior to this specific dog at large call of service. I had made contact with the Blesi where I had explained to them the dog at large ordinance. It appears that perhaps the Blesi are having a difficult time keeping the dogs within their boundaries. Upon arrival at 838 Crosstown Boulevard, I spoke with the complainant, Sharon Thompson, and her neighbor, Lisa Marie Kotval. Thompson had explained to me that Kotval had originally been the one that placed the call because she had witnessed the attack upon the complainant's dog while she was at Thompson's residence. Both Thompson and Kotval were very upset with the attack and indicated that both of the neighbor dogs had come over into the complainant's yard. Upon seeing the complainant's dog and had started viciously tearing at the dog. The complainant at this time showed me to the dog, which was a small sized Lab mix that still had wet spots on its coat where the dogs had grabbed a hold of it and been pulling on it. The complainant stated to me that they were able to scare away the dogs before they did further damage to the dog but indicated that they were sure the dogs would have killed the dog if they had been given more time. I was advised by Thompson that Terry Blesi, the owner of the dogs, witnessed the attack on her dog on this date and I later contacted Blesi at his residence at 831 Crosstown Boulevard. At this time he had both dogs in the rear of his vehicle and was just pulling into his driveway. I later contacted the complainant, Sharon Kay Thompson, and advised her that I would be issuing a citation to the owner of the dogs for allowing a dog to run at large. Advised her that Terry Blesi had assured me that he would be getting rid of the animals. I also spoke with Lisa Kotval, who was still at the complainant's address, and she reinterated how upset she was over the situation and expressed that I must take some sort of action to eliminate the problem. I spoke with her for a length of time and assured her that I would do as much follow-up on the situation as possible and also advised her that I would be in contact with Sharon Thompson to advise her of the status of the dogs and if in fact they had been put to sleep. Later on that date, I contacted the Blesi residence and talked with Terry's wife and she indicated to me that he was in the bathroom and that I could call back later. I addressed an envelope and mailed the citation to his address. On 12/14/94 I contacted Terry Lee Blesi and advised him that I had mailed a citation to him and he stated to me that he had taken a half day off of work to contact an agency that would take care of the dogs for him. He also stated that he had found the Hennepin County Human Society would take the dogs from him. He stated to me that he would be in contact with me to advise me where the dogs were disposed of. I also completed a biting dog report concerning this issue and it should also be noted that the Blesi dogs also attacked another one of Sharon Thompson's dogs in a much more vicious attack on 12/9/94 and that Deputy Sievert responded on this date and took a report concerning the dog bite, case *94-220624. In this previous incident with the Blesi dogs that Deputy Sievert handled, the dogs did very extensive damage to a 3 legged dog that had also been out in the Thompson yard. It should also be noted that there are several other dog related issues showing on our computer between 1993 and 1994. Other case numbers that may be referenced are 93-061932, 94-026169, 94-202640 and 94-220765. No further information at this time. BACKGROUND The City Council set priorities and goals for City programs and service delivery for 1995. Through a series of meetings the Council reviewed the operating budgets, the staffing requirements and salary plan, the property tax levy and other various revenues needed to support the delivery of the city services in 1995. The various study sessions conducted by the Council with staff established the proposed budgets and tax levy presented to the citizens of Andover at a public hearing on December 8, 1994. Fifteen residents were present at the public hearing, along with various staff, local newspaper coverage and broadcast coverage via cable television. The summary budgets, the salary plan for non-union employees and the organization chart are attached for your reference. Three separate developers, Gary Gorham (Fox Woods Development), Andy Himley (Woodland Ponds 2nd Addition) and Contractor Property Developers Company (Foxberry Farms/Jonathon Woods) have submitted requests to waive the requirement of the first lift of asphalt being installed prior to occupancy permits being issued by the City. The requests are being submitted based on Article five (5) of the development agreement which reads, "No Certificate of Occupancy permit shall be issued for any house in the plat until the first one and one-half (1-1/2) inches of bituminous has been placed. The Council may, at its discretion, delete or change this one and one-half (1-1/2) inches blacktop provision if requested by a Developer who can prove exceptional circumstances beyond his control which makes it unable for them to meet such construction requirements." The developments of Fox Woods, Woodland Ponds 2nd Addition and Jonathon Woods have had the utilities, concrete curb and gutter and gravel base installed at the locations they are requesting certificates of occupancy be permitted. The utilities are currently being inspected and tested to prepare them for use. The developer has noted that they would assume the responsibility and cost of pumping the sanitary line until the sewer connection is made next spring. (Please see attached letters) All lots fronting on 146th Lane, 146th Ave. and Zilla St. are curbed and graveled. They are Lot 1 thru 9 Block 1, Lots 1 thru 15 Block 2, Lots 1,2,3,8,& 9 of Block 3, Lots 2,~,& 4 of Block 4 and Lot 1 & 2 of Block 5. All other lots in the- plat would not have occupancy permits until the streets are completed with 1 1/2" of bituminous. We now have nine models under construction that are entered in the upcomi ng Spri ng Previ ew whi ch opens February 25th and runs through March 19th. I feel that because of the good weather conditions this fall, the Fox Woods plat could have been done in its entirety. It was an exasperating experience trying to control the timely installation of sewer, water, storm sewer, streets, and curbs to the addition, when I really have no control, because it is a City Project. I am sure TKDA will attest to this experience. I am attaching a schedule you can see the amount of time when nothing was being done at the project. On November 29th, 1994 I met with John Davidson, Rick Odlund of TKDA, Scott Eri ckson, Todd Hass, and Frank Stone of the Andover Staff, and Scott Weidema of S.R. Weidema. At that meeting, a discussion was held as to what would need to be done by S.R. Weidema in order for the staff to support occupancy permits on the lots referred to above. He then contacted Scott from S.R. Weidema, and he informed him he didn't know. Nov. 4th I found out that Schmidt Curb was to do the curbs, so I called Tom Schmidt directly and asked him when they were starting. He informed me he knew nothing about it, and the General Conractor S.R. Weidema would have to contact him to schedule. I asked him if he had ever been contacted that the project was ready since Oct. 21st. He informed me he had never been called. Nov 4th I contacted John Davidson TKDA to infprm him of the delays and problems. He said he would look into it, and he did. Nov. 11th Schmidt curb started, did one street and left. / Nov. 15th Schmidt curb came back and did another street, but did not finish the project. Nov. 18th S.R. Weidema installed gravel on one street and left. ~ Nov. 21st TKDA called them to come back to finish. Nov. 22nd S.R. Weidema informed Toby from TKDA they would be at Fox Woods first thing Wednesday to gravel. Nov23rd Toby from TKDA waited all day long, no one showed up. Contacted John Davidson, he said he would try to see why they were not at the job site according to our agreement. A list of specific lots is attached. We feel our projects have exceptional circumstances that were definitely beyond our control, thus all the construction requirements for occupancy were not met. "'i These two projects were grouped together for the city street and utility work due to their proximity. We had many meetings with the city staff and TKDA regarding the timing of the plans and specs and of the project construction. In these meetings we reached agreement for areas on which construction work could focus in order to guarantee delivery of paving this year. Exhibit A shows the areas agreed upon for both projects. At the pre-con, October 25, we again looked at this issue and emphasized the importance of reaching paving for this section. During this discussion, CPDC offered an alternative completion of Drake Street and not full completion of the cul-de-sac on 144th, (as shown in Exhibit B) with the same work to be completed for Jonathan Woods, if this was easier to construct. Every party at the table felt that this work could be accomplished in it's entirety barring an early arrival by winter. As the site sits today, the actual amount of work completed to class 5 is about half, as shown in Exhibit C. At the time of the bid opening, we did question the capability of We idem a to handle our projects, in addition to all the other work on their plate. (i.e. the Super America station and Fox Woods.) This issue was addressed with the contractor by the city and assurances of their capabilities were i made. We did not see these assurances played out in their performance of this project. They did not exhibit serio,usness in their efforts to complete this project. They made decisions to complete less of the project than required without any notice to the Developer. The City Council is requested to approve the feasibility report and order a public hearing (January 17, 1995) for Project 94-16, Tulip street NW. At the July 5, 1994 City Council meeting Council ordered the feasibility report for Project 94-16, Tulip Street. The consulting firm of BRA was retained to provide the feasibility report for this project. The approximate limits of this project are 161st Avenue NW to the south and 168th Lane NW to the north. The existing street surface is sand and gravel with drainage ditches collecting the storm water run-off. This section of roadway is currently designated as a municipal state aid street and is eligible for municipal state aid funds. The proposed construction would include the installation of a new sub-grade, new bituminous surfacing, concrete curb and gutter and storm drainage facilities as necessary to collect the storm water run-off from the street. The geometries of the streets would require a 66 foot wide right- of-way, a 32 foot wide street with a design speed of 30 MPH. Only a portion of the right-of-way for this project currently exists. One aspect of the project will consist of obtaining the necessary street right-of-way from the adjacent property owners. CONTINUED MOTION BY: SECOND BY: TO: , / The estimated cost to construct this project is $769,000 of which we estimate the Municipal state Aid Office would participate in $651,400 leaving approximately $117,600 to be funded by other means. It is proposed to fund the non-participating costs through assessments to the adjacent property owners. The assessment method which appears most equitable to all parties involved is a proposed assessment based on a per lot basis. This assessment procedure has been used on numerous projects in the city and provides a equitable distribution of the costs. Six (6) of the assessed lots are currently being farmed. The Personnel Committee met December 6, 1994 and approved a recommendation by the City Administrator to implement a program whereby increases in salary are tied to merit as well as longevity. During the budget process the Council set parameters for maximum salaries for 1995 for each of the individual positions in the City. The extent of the raises would be dependent on performance. This policy is designed to recognize those individuals who do outstanding work and contribute with a positive attitude throughout the year. MOTION BY: SECOND BY: TO: POLICY NO. 23 - SALARY INCREASES \ Year end salary adjustments, as determined by the City Council during the budget process, will be dependent upon a personnel review at the end of the year. Each person will receive one of the rankings as follows: 1. Exceeds Minimum Standards (Excellent) 2. Meets Minimum Standards (Average) 3. Does Not Meet Minimum Standards (Unsatisfactory) Those who exceed minimum requirements or an overall excellent performance will receive 100% of the salary increase. Employees who meet the absolute minimum requirements to stay in good standing will receive 1/2 of the increase as determined by the city Council. Those employees who do not meet minimum standards will not receive a raise. An employee who feels that they have not received a fair personnel review may request an additional review from the department head. If after the second review they feel they still have not received a fair review, they may request a third review from the City Administrator. Any employee who receives a less than satisfactory review shall set up a program with the supervisor to bring performance levels up to meet or exceed minimum requirements. The employee shall meet with the department head to set a strategy to attain that level for a subsequent 3 and 6 month review. The commission. an independent gov- ernment body that rules on rate changes. denied a sweeping Postal Service request to raise rates 10.3% across all classes of mail. As expected, it backed a smaller Increase for first-class mail and recom- mended that second, third and fourth-class mail rates - mostly used for packages. magazines and so-caUed junk mail - rise an average of 14%. The project is located in the south half of Section 8 and north half of Section 17, Township 32N, Range 24W in the City of Andover, Minnesota (see Figure 1). ,.., u n u ,.., u Existing Conditions ,..., u Tulip Street N.W. from 161st Avenue N.W. to about 300 feet north of 168th Lane N.W. is an unimproved gravel roadway which is presently on the City of Andover's Municipal State Aid (MSA) system. Drainage is generally poor, maintenance is difficult, and erosion has been a problem. Development in the area has increased traffic volume on Tulip Street N.W. n u ,.., U ....., u Proposed Improvements ,..., :..J 1. Roadway - The proposed roadway would be a 9-ton design with a 30 mph design speed constructed to Andover City Standard of 32-foot width (face to face of curb) and concrete curb and gutter. The roadway design would also meet current MNDOT State Aid Standards and be reviewed by the Minnesota Department of Transportation. It is proposed to use B618 concrete curb and gutter in lieu of surmountable curb and gutter because a large portion of the project is undeveloped and the existing homes on Tulip Street N.W. have in place driveways. WHEREAS, two husky type dogs owned by Terris Blesi were allowed to run at large; and WHEREAS, the two dogs entered the property of a neighbor on December 9, 1994 and attacked the neighbor's dog causing serious injury; and WHEREAS, these same two dogs on December 13, 1994 again. were at large and entered the neighbor's property once again causing serious injury to another of her dogs. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Andover hereby declares the two husky type dogs owned by Terris Blesi of 831 Crosstown Boulevard N.W. as "biting dogs". Hiring February 95'7 Two or three members of the Department can be on the interview/selection committee along with Dick and Daryl Sulander the City Finance Director. Qualifications have yet be written. Getting examples from other cities. Fire Department will be able to review the qualifications before they are advertised. At the present time Sunday liquor is not an option in Andover. After talking with the Liquor Control Board, I found that a city needs to hold an election so that the voters can approve or deny Sunday liquor. This would apply to any future restaurant development in the city that serves alcohol. If Council chooses to authorize the election I would suggest that it be held on Friday, February 3, 1995. (This is the earliest it can be held as we need to notify the County Auditor 45 days before an election is held.) The estimated cost of the election is $2,500.00 which includes the ballots and salaries for election judges and the City Clerk. On Wednesday, Decem~er 14, 1994 I witnessed a brutal attack on my neighbor's family dog, Amy. I observed two dogs traveling with a purpose, up my neighbor's driveway. They attacked Amy in a "pack like" behavior. The attack happened "in the blink of an eye" and lasted no more than a couple of minutes. It was the systematic method in which the dogs teamed up to attack Amy that was really horrifying. They really appeared to by wolves rather than domestic pets as they bit her and shook her around like a rag doll. I had been visiting with Sharon Thompson at her house when we saw the dogs running up the driveway towards Amy and Sofie (another family dog). Sharon let out a scream and ran out the door to try and protect her pets. I followed quiCkly behind her. We knew that another one of her dogs, Jessie, an old dog that gets around on three legs, had been attacked by these same dogs only days earlier and was almost killed by them. Sharon's screams and movement towards the attacking dogs seemed to startle them. As they backed off down the driveway, Sharon followed them. I grabbed Sofie and ushered Arnie back to the safety of Sharon's house. Both dogs were visibly shaken. At that time I phoned the pOlice to report the attacl~. In the meantime, Sharon went across the street to reason with the owners of the dogs. After ensuring that both Sophie and Amy were safe, I joined Sharon across the street with the owners of the attacking do~s. All parties agreed that something needed to be done with the do~s. The owners proceeded to load both dogs into the back of their car and assured us that they would get rid of the dogs. Further, I heard them tell Sharon that they would pay the vet bills incurred in the treatment of Jessie's earlier attack. Unfortunately, the situation has not been remedied. The dogs remain in the neighborhood. Action must be taken before the situation gets worse. I am afraid that the next attack will involve a child. If either the attack on Jessie or on Amy had been on a child, the child would be dead. This opinion can be corroborated by the vet who treated Jessie or anybody that saw Jessie's wounds. . I built my dream house in Andover because of the quality of life that I believed Andover could offer. I am a law-abiding, tax paying citizen who would like to be able to raise my family in a safe environment. As long as these vicious dogs remain in the neighborhood I will not feel safe. Is this fair?
