NW REQUEST The City Council is asked to review the Special Use Permit request of Dick and Brad Povlitzki, owners of Pov'S Sports Bar to allow for the placement of advertisement signs to be used in conjunction with fencing for two (2) ba1lfields on the property located at 1851 Bunker Lake Boulevard NW, legally described on the attached resolution. BACKGROUND For background information please consult the attached staff report presented to the Planning and zoning Commission and the minutes from their October 25, 1994 meeting. PLANNING & ZONING COMMISSION REVIEW The Planning and zoning Commission, at their October 25, 1994 meeting, reviewed the request and recommends to the City Council that Dick and Brad Povlitzki be granted a Special Use Permit to utilize advertisement signs in conjunction with fencing for the ball fields on said property. R -94 A RESOLUTION GRANTING THE SPECIAL USE PERMIT REQUEST OF DICK AND BRAD POVLITZKI TO ALLOW FOR THE PLACEMENT OF ADVERTISEMENT SIGNS IN CONJUNCTION WITH FENCING FOR TWO (2) SOFTBALL FIELDS LOCATED AT 1851 BUNKER LAKE BOULEVARD NW. WHEREAS, Dick and Brad Pov1itzki have requested a Special Use Permit to allow for the placement of advertisement signs in conjunction with fencing for two (2) softball fields on the property located at 1851 Bunker Lake Boulevard NW, legally described on Exhibit AI and WHEREAS, the Planning and zoning Commission has reviewed the request and has determined that said request meets the criteria of Ordinance 8, Sections 5.03 and 8.07; and WHEREAS, the Planning and zoning Commission finds the proposed use will not be detrimental to the health, safety and general welfare of the occupants of the surrounding lands; the use will not cause serious traffic congestions or hazardsl the use will not depreciate surrounding property values and the use is in harmony with the Comprehensive planl and , I WHEREAS, a public hearing was held and there was opposition regarding said requestl and WHEREAS, the planning and zoning Commission recommends to the City Council approval of the Special Use Permit requested. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Andover hereby agrees with the recommendation of the Planning and zoning Commission to grant the Special Use Permit request of Dick and Brad povlitzki to allow for the placement of advertisement signs in conjunction with fencing for two (2) softball fields on said property with the following conditions: 1. The Special Use Permit will be subject to annual review and site inspection. 2. The Special Use Permit will be subject to a sunset clause as defined in Ordinance No.8, Section 5.03(D). 3. vegetative screening shall be required on the west side of the property as determined by Staff. 4. Advertisement signage in conjunction with fencing shall be limited to the outfield fences of the softball fields. PUBLIC HEARING: SPECIAL USE PERMIT - ADVERTISING SIGNS IN CONJUNCTION . WITH FENCING FOR RECREATIONAL FACILITIES (BALL FIELDS), 1851 BUNKER LAKE BOULEVARD NW, POV' S SPORTS BAR, RICHARD AND BRAD POVLITZKI . '\ ) ) 7:01 p.m. Mr. Carlberg reviewed the request of Dick and Brad Povlitzki to place advertisement signs on the fencing for two ball fields at Pov's Sports Bar. He reviewed the ordinance amendment recently approved by the City Council to allow this use and noted other applicable ordinances to granting Special Use Permits. The proposal is to place signage on the outfield walls that are 8-foot fences plus an 80-foot section that would be 20 feet high. The advertising signs are 4x8, 32-square-foot signs. Mr. Carlberg also noted the issue of adjacent residential property as stated in the amendment. The legal limit of the Special Use Permit and for the liquor license is the southern portion of the property owned by the Povlitzkis'. The only adjacent residential property is five to six houses to the northwest, and the signage is not visible from those houses. There are two or three houses along Bunker Lake Boulevard that are some distance to the west that can see a portion of the facilities' fields. The City owns the large wetland that is between Pov's Sports Bar and these residences, which is zoned General Business. The trees are quite sparse to the west of the facility to screen from these residents. He drove to the cul-de-sac; and from ground level, one can see a portion of the fence. One can also see all of the development along Bunker Lake Boulevard to the south, which are the junkyards and other commercial properties. The question is interpretation. By definition the signage is not visible from adjacent property which abuts the parcel where this facility is located. Regular Andover Planning and Zoning Commission Meeting '\ Minutes - October 25, 1994 ) Page 2 } (Public Hearing: Special Use Permit, Advertising Signs, Pov's Sports Bar, Continued) Commissioner Dehn realized the City owned the parcel between the houses and Pov's Sports Bar, but she interpreted the amendment as the adjacent or residential area in close proximity. At this point she had a concern with the signs being visible to adjacent residents. MOTION by Dehn, Seconded by Apel, to open the public hearing. 'the back very well from her back yard. If he had left some of the trees in there, there wouldn't have been much of a problem; but they cleared all the trees and now there is a clear view from her back yard. Yes, they live next to the junkyards; but they knew those yards were there when they moved in. They didn't know they would have a big fence with advertising in their back yard when they built their home. She had no problem with businesses, but she had a problem with brightly colored or lighted advertising in her back yard until 1 o'clock in the morning: She didn't have a problem with advertising, but does it have to be to the top of those tall fences? She stated it is really bad from her back yard and she is very unhappy about the situation of people playing ball out there until midnight with the lights and advertising. She also alleged there will be no more wildlife in that area once the business gets in there because this is a loud, colorful business for someone's back yard. '\ / ) Randall Haoen, 13763 partridoe - stated from his back yard he can see both of the hugh fences. Almost all the trees are now gone; and with most of the leaves. off the trees, those fences can be clearly seen. Before the fields were being developed he had a permit to construct a deck off his bedroom because it was a beautiful area. He thought the advertising, loud noises and lights will destroy that. Just because they can see all the other eye sores across the street doesn't mean they should settle for any more. He felt this is going to be bad. , Paul Lundahl, 2094 137th - can also see all of these things across the swamp, and he is really not looking forward to seeing the signs and lights next spring. In the spring the leaves will block it somewhat, but not enough. In the fall with all the leaves gone, they can see the facilities very plainly; and he doesn't feel like looking at this one bit. He had no idea there would be a softball field across the swamp. Also, because he lives "right off of Bunker Lake Boulevard, people coming out of the sports facility can easily turn to his back yard and maybe into the back of his house. He can drive to his back yard with his truck right now from Bunker Lake Boulevard. What will happen if someone comes smashing into the back of his house? He's also not looking forward to all the bright lights and the noise echoing across the swamp because he has to get to bed early and wake up early. Commissioner Apel felt some of these items should have been raised at the hearing for the Special Use Permit for the liquor license. At this time the interest is solely in the advertising signs. The advertising signs are on the fence itself . Mr. Lundahl - asked if something can be put up between the last row of trees and the rest of the property so they don't have to look at that. It didn't matter to him whether his property is adjacent or not; he's not in favor of this and doesn't want to have to look at it. Mr. Carlberg stated they could require additional planting of trees. The question is-if-thisis visible from-adjacent residential property. By definition, their property is not adjacent to this. Dick Povlitzki, Pov's Sports Bar - didn't know they were causing that much harm and couldn't believe the comments here. Other communities have this type of facility with people very close, and there are no problems. In this case the residents are 1500 feet away, so far that they couldn't even read the signs. He thought the lights for the ball fields have to be shut off at 11 o'clock at night. \ Commissioner Dehn asked if other types of screening could be required. )J Since vegetative planting would take a long time to screen, would other types of fencing be appropriate. She thought the developer was asked to do his utmost ability to save those trees. Mr. Carlberg questioned constructing a fence to screen another fence. To requiring additional plantings of fast-growing trees may be a solution and could be a condition of this Permit. More trees were moved than originally thought because of trying to make things fit and the wetland regulations. Mr. Povlitzki - stated they were told what to do in the wetland area. They wanted to keep the trees; but there are fast-growing trees in that area which will screen the facility within two years. Commissioner Putnam stated since the ability to see the signs through the fall and winter is the problem, he asked if it is possible to cover the signs during the off-season as a temporary measure until the trees grow to screen it. Mr. Povlitzki - didn't think that was feasible. These residents can't read the signs from that distance. He thought that would be ridiculous. Commissioner Ape1 disagreed that these residents can be considered adjacent residential properties. If that is the case, the scenario could be applied to the residents in Hidden Creek to the south, which is the nearest residential area in that direction, as to whether or not they could view the signage from the highest hill. If the definition of adjacent is abutting property, than this issue is moot. . '\ , J Ms. Duevrnever - is not arguing about the signs. Her problem is do the ) signs have to be 20 feet high? If they are only six feet high, she won't even know they are there. She acknowledged she wouldn't be able to read the signs, but it is the bright colors that are not natural that are offensive. (Public Hearing: Special Use Permit, Advertising Signs, Pov's Sports Bar, Continued) Mr. Povlitzki - stated they have invested almost $2 million in this facilities and are trying to make a nice facility. No one can get to the fields without going through the bar area. He felt they did a good job putting this project together, and the advertising is an important part to making it work. MOTION by Dehn, Seconded by Jovanovich, to close the public hearing. Motion carried on a 5-Yes, I-Absent (Pease) vote. 7:34 p.m. \ ;' ) "~hairpersonSqtiiresfeltthe rirst'issue is reaching a consensus on the issue of adjacent residential property. If it is determined the residential properties are not adjacent, there is no issue. If they are adjacent, then perhaps the issues of screening, etc., should be considered. There was a lengthy Commission debate on the issue. It was noted that the swamp between the facility and the residents in question is designated wetland, is owned by the City and probably would never be developed. There may be development to the north and northwest, but that is not City property. Several Commissioners argued the residences abut the City property, not the facility. Those residents that, by definition, do abut the property cannot see the signs, only the back of the fences. They also noted that when applying the word "adjacent" in other situations such as variances and setbacks, it applies to other properties that touch the one in question. In that strict interpretation, the residences in question are not adjacent to this facility. The other Commissioners then agreed. Commissioner Peek suggested if the Povlitzki's want to be good neighbors, they can plant additional trees to the west for screening. . \ J ) Commissioner Peek noted the Council adjusted the amendment removing the requirement that the signs not be visible from a public right of way. He stated there will be some sections of the 20-foot high fence that will be visible from Bunker Lake Boulevard. He doesn't support the action of the Council, and he wouldn't support the granting of this Permit without addressing that issue. This is a unique fencing because it is scaled. If the fencing surrounding the field was six or eight feet high, that would be one thing. But because some of the fencing is 20 feet high and will be visible from the right of way, he'd support some action that addressees that concern. Commissioner Apel stated the Commission is an advisory committee, and the City Council chose not to follow their recommendation on that aspect. He did not think recommendations could be made as a part of the Permit simply to get around an ordinance. Chairperson Squires agreed that while the Commission may not agree with the Council's decision, they are faced with a task which is different than what they would have adopted. Commissioner Peek argued the ordinance doesn' t address the scale of fencing and that that can be addressed specifically for the Special Use Permit process. On any Permit, the City applies conditions based on the specific nature of the application. Regular Andover Planning and Zoning Commission Meeting \ Minutes - October 25, 1994 j Page 5 } (Public Hearing: Special Use Permit, Advertising Signs, Pov's Sports Bar, Continued) Discussion was then on requiring some screening on the west boundary of the facility, noting the third criteria for granting Special Use Permits, that is the effect on the values of property and scenic views in the surrounding area. Commissioner Dehn noted for wind breaking in agriculture they use a fast-growing popular in combination with conifers behind it. \ ; ) MOTION by Apel that the Andover Planning and zoning Commission recommend to the Council the approval of a Special Use Permit request from Dick and. Brad .Povlitzki' involved with the ball park to erect signs as permitted by the recent change in the Sign Ordinance. The public hearing was held. There were three neighbors who spoke against the signage as being intrusive on their property. Still recommend the approval of the Special Use Permit because it does not have any effect on the four criteria that we use for granting Special Use Permits. The Commission finds the request meets the criteria established in Ordinance No.8, Section 5.03, including: the use will not be detrimental to the health, safety, morals or general welfare of the community; the use will not cause serious traffic congestions or hazards; the use will not depreciate surrounding property; and the use is in harmony with the Comprehensive Plan. Add no conditions, but ask that the people involved talk with the neighbors who are interested in doing something to make the signs less intrusive and maybe come up with a reasonable solution such as putting up screening. Motion dies for lack of a Second. MOTION by Dehn, Seconded by Peek, using the majority of Commissioner Apel's motion except add a condition in the motion indicating screening, particularly on the west side to insure those residents in that area that it is now visible, that area of the cul-de-sac on Partridge Street, that some sort of fast-growing vegetative screening be required, to be determined by Staff. Restrict the signage to the fencing located at the outfield of the softball diamonds. Subject to an annual review. DISCUSSION: Commissioner Dehn suggested to Mr. Povlitzki that he talk with the concerned residents, to keep the lines of communications open to resolve problems. Mr. Povlitzki agreed the signage would be on the outfield fences only and agreed to the restriction. Commissioner Peek asked if the maker of the motion would accept limiting the signage on the 20-foot sections of fencing to eliminate the sign visibility from Bunker Lake Boulevard at that specific location. Commissioner Dehn would not accept that amendment. Motion carried on a 5-Yes, I-No (Peek), 1-Absent (Pease) vote. APPLICABLE ORDINANCES , , J O~dinance No.8, Section 5.03, regulates the Special Use Permit process. Ordinance No.8, Section 8.07, regulates signs within the City of Andover. Advertising signs used in conjunction with fencing for recreational facilities (ballfie1ds) are allowed by the granting of a Special Use Permit. Section 8.07(D)(2)(j), states, "Advertising signs by Special Use Permit when used in conjunction with fencing for recreational facilities (ballfields) that are not visible from adjacent residential property as viewed from ground level". In granting a Special Use Permit, the following criteria shall be examined. 1. The effect of the proposed use upon the health, safety, morals and general welfare of occupants of surrounding lands. 2. The existing and anticipated traffic conditions, including parking facilities on adjacent streets and land. 3. The effect on the values of property and scenic views in the surrounding area. 4. GENERAL REVIEW The City Council on October 4, 1994 approved an amendment to the Zoning Ordinance regulating advertisement signs for recreational facilities (ballfields). The proposed signage will be very similar to the village Inn in White Bear Lake. The applicant will be attending the meeting to discuss the signage. COMMISSION OPTIONS 1. The Planning and Zoning Commission may approve the Special Use Permit requested by Dick & Brad Povlitzki to place advertisement signs in conjunction with fencing for two (2) bal1fields on the property located at 1851 Bunker Lake Boulevard NW (PIN 34-32-24- 13-0001), legally described on Exhibit A. i j The Commission finds the request meets the criteria established in Ordinance No.8, Section 5.03, including: the use will not be detrimental to the health, safety, morals or general welfare of the community; the use will not cause serious traffic congestions or hazards; the use will not depreciate surrounding propertYl and the use is in harmony with the Comprehensive Plan. 2. Public Works and Engineering have discussed this item with the Platz's on a couple occasions in the past couple years. The existing storm sewer has been cleaned recently and rip rap repaired by Public Works which was done very well and done in accordance to the original plan approved by the City in 1987. unfortunately, the developer and/or builder did not appear to give any information about drainage and utility easements, storm sewers and sanitary sewer that existed on the property. Obviously the City cannot take any blame for information that was not provided to the buyer as the City was not involved in the sale of the lot. Options to consider are as follows: Option 1. Extend the storm sewer to the low area of Lot 10 for removal of sedimentation and debris. The City will need to apply for a permit from the Coon Creek watershed District. If the City Council finds option 1 acceptable, it will be necessary to determine how the project would be financed, either by a assessment or general fund. Option 2. Extend storm sewer and construct a sedimentation pond prior to discharge into the low area (likely a wetland) of Lot 10. Most likely the Coon Creek Watershed District will require a permit and may require this option rather than option 1. Again, the City Council will need to determine how the project will be financed. Option 3. Do nothing and continue to maintain the system as it currently exists. In 1990 I purchased lot 11 and was unaware that there was a storm sewer on the property since it was covered with underbrush and sand fill and was not indicated on the plat map. After building an expensive home on the property we discovered the storm sewer and the storm sewer easements. At the time we were not overly concerned because it was a very dry period of time. " ) As time went by the outlet (which is very close to my house) kept filling with debris and sand. All of the back half of lots 9, 10, and 11 flood because of the volume of water coming in from the sewer. There is no outlet and at times it floods all of our backyard lawn area. As such three property owners can not enjoy the use of the back part of our lots. The water builds up, debris from the streets creates a stinky, algae loaded mosquito sewer pond. The flooding also has caused me to loose some very mature birch and oak trees that were originally present and one of the reasons I bought the lot. '...; I have spent a great deal of time and money to keep my lawn in superior condition and take a great deal of pride in my home. Every time the sewer needs cleaning which is at least once a year and sometimes twice, the machinery tears up a good portion of my yard. In addition the floodwater causes a real eyesore with underbrush and weed growth which can't be maintained because of constant flooding. My tax assessment has not been lowered because of this obvious eyesore caused by a two street storm sewer that was improperly installed. After doing considerable research on this matter we now know that dumping water in this , fashion is not allowed. The developer obviously was able to get this one through at a time when he had a direct conflict, since he was a former mayor. We have been watching channel 16 and are aware of some of the problems he has been causing the city because of similar incidents. I can assure you that the problems and complaints won't disappear until the problem is fixed. There are alternatives. One would be to build a holding pond and extending the culvert as is now required. The pond would have an over flow into Coon Creek which is directly adjacent. A temporary fix might be to extend the outlet 50 - 100 feet and tile the low lying area to the creek. I already have talked to Tim Kelly at the Coon Creek watershed office and he indicated that both alternatives are feasible. All we as affected property owners are asking is to have the problem fixed right so that we too can enjoy our homes. All of the property owners who are connected to the sewer should pay their pro rata share of the costs associated with the problem. (on behalf of Anoka-Hennepin School District ill) to consider the assessable acreage as only those areas under development, or 34.93 acres. Attached is a letter from Adolfson & Peterson, Inc. This request is similar to that of Pov's Sports Bar located on Bunker Lake Boulevard NW in which the City Council did not assess the connection charges for the water because the fields were sprinkled by a well. REQUEST The Andover Economic Development Committee (EDA) is asked to review the lot sale proposal in the Andover Commercial Park (Block 3, Lot 2) to Chuck Greenwood for the construction of a 10,000 square foot commercial building (Greenwood Graphic Arts). / The size of the lot to be acquired is 1.2 acres valued at $.55 a square foot. The price of the lot is $28,820.00 which does not include connection charges which are estimated to-oe approximately $6,000.00. Mr. Greenwood would like to finance the land acquisition costs over a two year period (5.25% interest rate per year or an interest rate to be approved by the EDA), and will pay the connection charges upon the issuance of a building pe rmi t. Mr. Greenwood would agree to begin paying monthly payments to the City January 15, 1994, and construction of the building would be completed no later than January 15, 1996. We have also talked to the City of Ramsey about the possibility of joint sweeping with their City, they show great interest in this prospect. If there is a change in plans, I have to advise Ramsey as soon as possible. REQUEST The City Council is requested to adopt the attached resolution amending the 1994 budgets for the General Fund, P.I.R., Water, Sewer and Central Equipment Funds. BACKGROUND The increased activity in City operations throughout 1994 in the areas of: j 1) higher than budgeted new home construction, 2) increasing from six to seven voting precincts, 3) the addition of the City Engineer position, and 4) higher than budgeted legal expenditures, require various amendments to individual operating budgets. In addition, reallocation of personal services (payroll) budgets is requested to properly account for the assignment of payroll charges throughout the Public Works Maintenance operations. Also requested, is permission to replace the 1984 and 1985 Chevrolet staff cars assigned to the Planning and Engineering Departments. The appropriation would transfer the funding from the General Fund to the Central Equipment Fund for the acquisition and trade-in transactions. This amendment will recognize additional permit revenue from the greater than budgeted construction of new homes, higher than expected sales of water and water meters, and repeal the 1994 subsidy transfer budgeted in the Sewer Fund from the Sewer Trunk Fund and designate additional reserves in the Equipment Fund for future replacement of vehicles and/or equipment. The letter dated November 14, 1994, describes the change in the water table elevation in the southwest corner of the plat. The letter dated November 23, 1993, states that mottled soil was not encountered and that the water table elevation is the only controlling factor in establishing floor elevations. Since the water table has been significantly lowered by the grading operations, the lowest floor elevation of the corresponding lots can be lowered. The enclosed revised development list shows the revised lowest floor elevations of lots 1-10 block 1, lots 1-10 block 2, lots 16-17 block 2 and lots 1-7 block 4. The lowest floor elevation is at least three feet above the new water table or two feet above the 100 year flood elevations of the adjacent ponding area, whichever is greater. Please review this with your building department and include on the agenda for the November 15, 1994 council meeting so pending building permits can be approved.
