The City Council is requested to execute the following:
1. Approve the resolution for hearing on the proposed revised
asSessment for the improvement for Project 92-29, Commercial
Boulevard NW.
2. Hold a public hearing at 7:00 PM and to approve the
resolution adopting the revised assessment roll for the
improvement of sanitary sewer, watermain, street and storm
drain for Project 92-27, Commercial Boulevard NW.
The assessment amount is $338,213.30.

to adopt the following:
A RESOLUTION FOR HEARING ON PROPOSED REVISED ASSESSMENT FOR THE IMPROVEMENT
FOR PROJECT NO. 92-27
WHEREAS, by a resolution passed by the City Council on September 20,
19 94 , the City Clerk was directed to prepare a proposed assessment of the
cost of improvements for Project No. 92-27; and
WHEREAS, the Clerk has notified the Council that such proposed
assessment has been completed and filed in her office for public
inspection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Andover, MN:
1. A hearing shall be held the 1st day of November, 1994 in
the City Hall at 7:00 P.M. to pass upon such proposed assessment and
at such time and place all persons owning property affected by such
improvements will be given an opportunity to be heard with reference to
such assessment.
2. The City Clerk is hereby directed to cause a notice of the hearing
on the proposed assessment to be published once in the official newspaper
at least two weeks prior to the hearing, and she shall state in the notice
the total cost of improvement. She shall also cause mailed notice to be
',given to the owner of each parcel described in the assessment roll not less
Ithan two weeks prior to the hearings.
3. The owner of any property so assessed may at any time prior to
certification of the assessment to the County Auditor, pay the whole of the
assessment on such property, with interest accrued to the date of payment
to the City Treasurer, except that no interest shall be charged if the
entire assessment is paid within 30 days from the adoption of the
assessment. He may at any time thereafter pay to the City Treasurer the
entire amount of the assessment remaining unpaid, with interest accrued to
December 31 of the year in which such payment is made. Such payment must
be made before November 15 or interest will be charged through December 31
of the succeeding year.

A RESOLUTION ADOPTING THE REVISED ASSESSMENT ROLL FOR THE IMPROVEMENT
OF SANITARY SEWER, WATERMAIN, STREET AND STORM DRAIN
PROJECT NO. 92-27, COMMERCIAL BOULEVARD NW
WHEREAS, pursuant to proper notice duly given as required by law,
the council has met and heard and passed upon all objections to the
proposed assessment for the improvements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ANDOVER,
MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto
and made part hereof, is hereby accepted and shall constitute the
special assessment against the lands named therein, and each tract of
land therein included is hereby found to be benefited by the proposed
improvement in the amount of the assessment levied against it.

2. Such assessment shall be payable in equal annual installments
extending over a period of 10 years, the first of the
installments to be payable on or before the first Monday in January,
19 95 and shall bear interest at a rate of 7.0 percent per
annum from the date of the adoption of this assessment resolution.
3. The owners, of any property so assessed may, at any time prior
to certification of the assessment to the County Auditor, pay the
whole of the assessment on such property, with interest accrued to the
date of payment, to the City Treasurer.

Anoka County, Minnesota will meet at the Andover City Hall, 1685
Crosstown Boulevard N.W., in the City of Andover, on November 1,
1994 at 7:00 P.M. to pass upon the proposed assessment for the
improvement of. sanitara sewer, watermain, street and storm drain
in the following descr~be area:

The amount to be specially assessed against your particular lot,
or parcel of land is $ . You may at any time prior to
certification of the assessment to the County Auditor, pay the entire
assessment on such property, with interest accrued to the 9ate of
payment to the City Treasurer. No interest shall be charged if the
entire assessment is paid within 30 days from the adoption of this
assessment. You may at any time thereafter, pay to the City
Treasurer the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is

REQUEST
The city Council is requested to approve the attached
resolution adopting the assessment roll after the Council
has met and heard and passed upon all objections for delinquent
sewer, water and street lighting service charges.
The assessment roll will be presented to the Council at the meeting
Tuesday evening.
BACKGROUND
The owners of the parcels with delinquent
street lighting service charges have been

The proposed assessment roll is on file for public inspection at
the City Clerk's office. The total amount of the proposed
assessment roll is $931.20. Written or oral objections will be
considered at the meeting. No appeal may be taken as to the
amount unless a signed, written objections is filed with the
Clerk prior to the hearing or presented to the presiding officer
at the hearing. The council may upon such notice consider any
objection to the amount of a proposed individual assessment at an
adjourned meeting upon such further notice to the affected
property owners as it deems advisable.
An owner may appeal an assessment to the District Court pursuant
to Minnesota Statutes Section 429.081 by serving notice of the
appeal upon the Mayor or Clerk of the City within 30 days after
adoption of the assessment and filing such notice with the

WHEREAS, Rob-Lyn and Tim Hiltz have requested a Special
Use Permit for a kennel license on the property located at 16541
valley Drive NW, legally described as follows:
That part of the south 504.77 feet of the Southwest Quarter of
the Southwest Quarter of Section 8, Township 32, Range 24, Anoka
County, Minnesota, which lies East of the center line of county
Road No. 58 as the same is now laid out and travelled; Subject to
easements of record if any; and
WHEREAS, the Planning and zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance 8, Sections 5.03 and 7.03; and

The Commission noted the beautiful mature oak tree~,on the parcel and
asked about protecting as many as possible through the Tree Preservation
Plan. It would be especially helpful to save as many as possible in the
back to provide a natural screen to the southern residential area. Mr.
Carlberg noted some trees must be removed~r the buildings and parking
lots; but hopefully some of the trees to~rd the rear of the lots can be
saved. Staff will look at that iss~
There was also concern Commission on whether Lot 2 can
realistically be developed be use of its size. Mr. Carlberg explained
the "window of development" that area left for the building and parking
areas once all the setb s are considered. He thought it would be
tight but there should e enough room for a small office building. The
Commission suggeste the developers demonstrate that Lot 2 can be
developed meeting 1 the requirements, which would be used as the test
of whether or at a variance would be granted to the lot width.
Commissioner D n understood the reason for the lot split but would have
preferred t day care to utilize the entire parcel to keep as many of
the trees s possible and because of the concerns with traffic and the
develo le area on Lot 2. Mr. Carlberg noted the sketch plan with the

7:20 p.m. Mr. Carlberg reviewed the request of Rob-Lyn and Tim Hiltz
for a kennel license at 1654l Valley Drive NW. The property is zoned R-
1 and consists of approximately ten acres. The applicable ordinances
and criteria to be examined were outlined. The petitioners own four
dogs and would like a hobby kennel license to keep up to eight adult
dogs and to breed one or two litters per year. They do not intend to do
commercial boarding of dogs. They have a purchase agreement on the
parcel contingent upon City approval of the kennel license.
MOTION by Dehn, Seconded by Jovanovich, to open the public hearing.

Rob-Lvn Hiltz - is an animal control officer for New Hope, and she and
her husband are active in the Twin Cities St. Bernard Club. Her husband
presented a handout with pictures of their four dogs; copies of their
licenses, awards and advertisements; a layout of the lot showing
buildings, stands of trees and sh=ubs and the dog run, plus pictures of
the buildings on the lot and the housing for the dogs. Ms. Hiltz
reviewed the background of each dog as to the type of dog, age,
training, and accomplishments. Accomplishments included winning
obedience awards on a national level, appearing in many advertisements,
etc. All four dogs are certified as being good citizens, which includes
having a good temperament, showing no aggressive behavior, being
obedient, etc. The three big dogs are kept outside, but always either

in the run or on a leash. They want the Special Use Permit to be legal
and to live in Andover. They would like to breed the St. Bernard when
it is old enough; but because of the work, they do not want to do more
than one or two litters a year. Nor do they intend to keep more than
eight adult dogs at a time. They don't plan to board any dogs; only have
their own dogs. Because of the time factor when they take possession of
the property, they would use the existing kennel run on the north side
of the garage which is made out of a six-foot solid wood privacy fence.
They would like to add an additional 12' x 24' to the existing kennel to
make the area longer. It would be commercial kennel fencing, and there
would be no way a dog would get out of the run. The dogs have their own
dog house and electric water buckets in the winter. The kennels are
cleaned twice a day, with the refuse double bagged and taken out with
the weekly garbage.
Ms. Hiltz went on that their dogs are important to them and they spend
great deal of time training. Being in animal control, the last thing
she wants is her dogs to be a nuisance to someone else. If someone
comes to the property, the dogs bark. The yellow dog wears a bark
collar whenever they are not home because barking has been a problem.
A bark collar rests on the vocal cords of the dog and sends a small
electrical jolt to the dog if there is vibration from barking. When she
is home, she takes care of any bar~ing.
Chairperson Squires asked about the lots shown on the map to the north
of this parcel. Mr. Carlberg stated Fire Station No.2 is to the north.
There is some confusion on the smaller parcels which were created prior
to the adoption of the platting ordinance. There are houses to ~he west
and to the south, plus another kennel license which was issue for four
to six dogs to the west on l65th. Commissioner Dehn noted to the east
of the parcel is all agricultural land which is flood plain and low.
Ms. Hiltz - stated the dogs never run free unattended. She does take
them off the leash to work with them on obedience, but the dogs are not
just allowed to run free because she has invested too much time and
energy to take that risk. Mr. Carlberg also pointed out the ordinance
addresses adult dogs, that is six months or older. There are no
regulations on the number of puppies.
Chairperson Squires read into the record a letter of opposition dated
October lO, 1994, from Julia and Ronald Fisher, 3977 165th Avenue.
Chairperson Dehn asked if Ms. Hiltz thought the dogs would be disturbed
by the noise from the Fire Station or by the wildlife.

Ms. Hiltz - stated they currently live on a busy street in ~t. Louis
Park and fire trucks go back and forth. The dogs get used to i~ and do
not howl. The dogs would bark if someone came to the house and they
were not home; but not if they are at home. They have a lot of raccoons
and stray cats in the City, so she didn't think the dogs ';JOuld be
disturbed by the wildlife. They maintain strict control on the barking.

Noting the letter of opposition and not wanting to create a problem for
the neighbors, the Commission expressed concern over the number of dogs
being requested.
Ms. Hiltz - explained they now have four dogs, and they want to breed
the young St. Bernard. The average life of a St. Bernard is eight
years, and one is already five years old and retired from competition.
They would like to keep one from the litter to replace the older adult,
which would mean five adult dogs for a period of time. Normally puppies
will be sold and off the premises before they are ten weeks old. She
already has the litter sold and the dog isn't even bred yet.

Chairperson Squires noted the City Council disagreed with the
Commission's recent recommendation to deny a kennel license on Andover
Boulevard. He suggested this Permit limit the number of dogs; and if
the applicant wishes, they can ask for an amendment to increase that
number at some time in the future assuming there are no problems. He
also suggested other criteria be established and followed when
considering kennel license requests such as the ability to handle dogs,
the lot size, proximity of the neighbors, and ownership of the dogs
versus commercial boarding of them.
In this application, the Commission was comfortable with limiting the
number of adult dogs to five, tha~ the applicants had demonstrated an
ability to handle dogs, that the ~en-acre parcel is of sufficient size
for five dogs; that the neighbors are some distance away and should not
be adversely affected; and that the dogs will be those of the property
owner which usually is not as much of a problem as the commercial
boarding operations.
Ms. Hiltz - agreed to start with limiting the adult dogs to five. When
they can prove themselves and if there is a need to have more, they will
come back for an amendment. The Commission noted many problems can be
avoided if they would get to know their neighbors.

MOTION by Peek, Seconded by Jovanovich, the attached Resolution be
forwarded to the City Council with the recommendation for approval; and
adjust all of the underlined phrases to reflect that. In the fourth
paragraph, amend that to note that we did receive one letter in
opposition to the Special Use pe=mit. Under the contingency, Number 3,
that the number of dogs shall be limited to five. Change Item 4, the
granting of this special Use Permit is contingent on the purchase of the
property by the applicant. Motior. ca==ied on a 4-Yes, l-Abstain (Dehn,

REQUEST
The City Council is asked to review the Special Use Permit request
of Lynne Olson and Charles Buckman-Ellis for a kennel license at
3122' 153rd Avenue NW, legally described on the attached
resolution.
APPLICABLE ORDINANCES

Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.
Ordinance No.8, Section 7.03, establishes those uses allowed by
Special Use Permit. In an R-1, Single Family Residential
District, dog kennels are allowed by the granting of a Special Use
Permit.
Planning & Zoning Review
The Planning and Zoning Commission, at their October 11, 1994
meeting, recommended approval of the Special Use Permit request.
Attached for your review are the minutes and the staff report from
the meeting.
Attached is a proposed resolution for Council review and adoption.

A RESOLUTION APPROVING THE SPECIAL USE PERMIT REQUEST OF LYNNE
OLSON AND CHARLES BUCKMAN-ELLIS FOR A KENNEL LICENSE LOCATED AT
3122 153RD AVENUE NW, LEGALLY DESCRIBED AS LOT 2, BLOCK 1, KADLEC
ESTATES.
WHEREAS, Lynne Olson and Charles Buckman-Ellis have
requested a Special Use Permit for a kennel license on the
property located at 3122 153rd Avenue NW, legally described as
Lot 2, Block 1, Kadlec Estates; and
WHEREAS, the Planning and zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance 8, Sections 5.03 and 7.03; and
WHEREAS, the Planning and zoning Commission finds the
proposed use will not be detrimental to the health, safety and
general welfare of the occupants of the surrounding lands; the use
will not cause serious traffic congestions or hazards; the use
will not depreciate surrounding property values; and the use is
consistent with the Comprehensive plan; and
WHEREAS, a public hearing was held and there was a letter
requestung information and Staff received a phone call opposing
said request; and
/
WHEREAS, the Planning and zoning Commission recommends to
the City Council approval of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning and zoning Commission to approve the Special Use Permit
for a kennel license requested by Lynne Olson and Charles Buckman-
Ellis on said property with the following conditions:
1. The Special Use Permit shall be subject to annual review
by Staff.
2. The kennel license shall be subject to annual renewal.
3. The number of dogs shall be limited to six (6).
Adopted by the City Council of the City of Andover on this
1st day of November , 1994.

7:55 p.m. Mr. Carlberg reviewed the request by Lynne Olson and Charles
Buckman-Ellis for a Special Use Permit for a kennel license at 3122
l53rd Avenue NW, Lot 2, Block l, Kadlec Estates. The property is zoned
R-l and is 2 l/2 acres in size. He pointed out the applicable
ordinances and criteria to be examined. The applicants are seeking
permission to keep six dogs as pets to be housed in either the garage or
the house. Mr. Carlberg noted he received a phone call from Ed Fields,
who expressed an objection to that number of dogs in the residential
area. This is a relatively new subdivision with few other homes
constructed yet.
MOTION by Peek, Seconded by Dehn, to open the public hearing. Motion
carried on a 5-Yes, 2-Absent (Apel, Pease) vote. 8:05 p.m.
Chairperson Squires read a letter for the record dated October 6, 1994,
from Lorraine Malamen, 15167 Round Lake Boulevard NW asking several
questions on the request.

Lvnne Olson - stated she and her husband moved to Andover from St. Paul
and want to be in compliance. They have four dogs as pets, all either
J neutered or spade. They are not going to board or breed dogs. They have
fenced a little under two acres of their lot, plus the lot is very
wooded around the perimeter. The average life expectancy of the Irish
Wolfhound is six to eight years. They would like to get a replacement
before it dies and would like to get two puppies because they play well
with each other. It is better to have two puppies together, and that is
why they are asking permission f'::>r six pets. For sanitation, they
double bag and place it in the trash, which is removed once a week. The
Whippets are kept inside the house at all times, where they have a crate
to sleep in. The Irish Wolfhound ~as a large crate which is now in the
basement, but will be moved to the garage. They are also planning to
build an 8' x 10' dog shelter in the woods for the large dogs. She
works away from the home during the day; but her husband is a wr~ter and
is home most of the time, so there is no problem with the dogs being
unattended. The dogs are allowed to run only on their property in the
four-foot fenced area. They are not let loose in the front, but are only
on a leash. The dogs are really home-bodies, quiet and not wanting to
run. They will bark if someone comes into the yard, but are more likely
to lick a burglar than bark! They do bark if another dog comes into the
yard, but the barking is not out of control. She also noted the houses
that have already been built in the neighborhood. They have done quite
a bit of landscaping with berming, trees, and shrubs, to seclude the
rest of their property.
\ Commissioner Putnam stated that area is extremely heavily wooded.
/ Commissioner Dehn asked if the dogs are obedient.
Ms. Olson - stated they are. One has gone through obedience training,
and the others are very obedient. The Irish Wolfhound was being showed
by the people who had her previously. So far the dogs have not been

disturbed by the wildlife in the area, but they have only lived there
since the end of June. The Whippets are hunters. They hunt small game
by site; and when they get exci'=.ed, they run, not bark. The two
puppies will be ready for' placement in the home in December. They will
be neutered and spade because they do not want to breed dogs.
Mr. Buckman-Ellis - stated they would not be asking for a kennel license
except for the fact that the number of pets they have is an issue. This
is really about pets, not an intent to have a dog kennel in the
commercial sense of the word. They are asking for six because of the
replacement; they will never want more. He stated it is infinitely
better to have two puppies at one time because they are social animals
who prefer to be with their friends.
MOTION by Peek, Seconded by Dehn, to close the public hearing. Motion
carried on a 5-Yes, 2-Absent (Apel, Pease) vote. 8:18 p.m.
Using the same criteria applied to the previous permit, the Commission
was comfortable with the number of dogs limited to six, that the
applicants had demonstrated an ability to handle the dogs, that the lot
\ size was sufficient for six adult dogs as well as screened with
(, ) considerable natural vegetation and fenced, the use should not disturb
adjacent neighbors plus the fact that there are few developed lots at
this time, and the dogs are owned by the applicants and considered pets,
not a commercial operation, are neutered or spade and are better behaved
when in pairs. Commissioner Dehn suggested the applicants make an
effort to meet their neighbors as they move in and communicate what they
are doing to alleviate concerns. Commissioner Jovanovich asked the
applicants how they would feel if another neighbor moved in and asked
for a Special Use Permit for six dogs.

have a problem with it. The Commission also noted the letter from Ms.
Malamen was not an objection but a request for information on the kennel
license. They suggested Staff sent her a copy of the Minutes '=.0 answer
those questions. Mr. Carlberg agreed.
MOTION by Dehn, Seconded by Putnam, to present the Resolution approving
the Special Use Permit request for Lynne Olson and Charles Buckman-Ellis
for a kennel license located at 3122 l53rd Avenue with the appropriate
designation for an approval. In paragraph 4, indicate there was a
letter requesting information and Staff received one phone call in
opposition. As to the number of dogs in Number 3, it should be limited
to six. Eliminate Number 4 in the Resolution. Motion carried on a 5-

The Andover Planning and zoning Commission is asked to review the
application for a special Use Permit requested by Lynne Olson
and Charles Buckman-Ellis for a kennel license on the property
located at 3122 153rd Avenue NW. The property is legally
described as Lot 2, Block 1, Kadlec Estates.
The property is zoned R-l, Single Family Rural.
APPLICABLE ORDINANCES
Ordinance No.8, Section 3.02, Definitions, defines a "Dog Kennel"
as "any place where four or more dogs over the age of six months
are boarded, bred and/or offered for sale, except a veterinary
clinic".
Ordinance No.8, Section 7.03, lists those uses allowed by Special
Use Permit. In an R-1, Single Family Rural District, dog kennels
are allowed under a Special Use Permit.
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.
In granting a Special Use Permit, the following criteria shall be
examined.
1. The effect of the proposed use upon the health, safety, morals
and general welfare of occupants of surrounding lands.
2. The existing and anticipated traffic conditions including
parking facilities on adjacent streets and land.
3. The effect on the values of property and scenic views in the
surrounding area.
4. The effect of the proposed use on the Comprehensive plan.
The Commission should consider these criteria when making a
decision to recommend to the City Council approval or denial.

The City Council on August 2, 1994. discussed with Jim Larson,
Engineer and Planner for the Metropolitan Council Water Management
Unit; the biennial inspections of on-site septic systems as
required by the Metropolitan Council. Staff Met with Mr. Larson
on August 25, 1994 as directed by ~he City Council at the August
2, 1994 meeting. Attached is a le~ter from Mr. Larson as a result
of that meeting. The letter basically reaffirms Met. Council's
standing on the biennial inspection of on-site septic systems.
Staff has attached the amendment to Ordinance No. 37 adopted on
April 20, 1994 which complies with Met. Council inspection policy.
The Council should decide whether ~he City should uphold and
enforce Ordinance 37 as written and adopted or to amend the
Ordinance and require biennial pumping. staff asks for direction
from the Council at this time.

Metropolitan Council staff has reviewed the city's on-site sewage disposal system maintenance
report form and supporting operation and maintenance information summary that you presented
during our August 25, 1994 meeting. The following modifications to the city's current on-site
sewage disposal system management program are necessary to bring it into conformance with the
Council's Wastewater Treatment and Handling Policy Plan.
The Council's Polic.:y Plan states that on-site systems should be inspected on a regular basis, and
no less than biennially. In early 1992, the Council directed its staff to more aggressively apply the
Policy Plan's on-site sewage system management requirements, due to a number of concerns.
Those concerns include the need to maintain the Council's rural area density policy of no more
than 64 units per 640 acres, the affirmation that metropolitan wastewater facilities should serve
only lands inside the metropolitan service area, that metropolitan services will not be extended to
the rural service area, and that any pollution problems resulting from development activity or
inadequate management of existing wastewater facilities must be resolved and financed by the
local governments involved. On-site systems can degrade both ground and surface water quality if
either inadequately operated or maintained. The possibility of failure without any appearance of
deficient operation is highest when the systems are sited in coarse, excessively drained soils, which
are common in the city.

The Council also clarified its position that individual homeowners would not, under most
circumstances, be sufficiently qualified to perform an "inspection" of their own on-site system.
Currently, the Council considers that on-site facilities should only be inspected by individuals
trained and certified by the Minnesota Pollution Control Agency (MPCA). With an estimated
70,000 individual on-site sewage disposal systems in the seven-county metropolitan area of varying
design, construction materials, age, and operating condition, it is the Council's position that on-
site system inspections should be performed by trained individuals. In addition, the MPCA is
currently responding to the rulemaking mandate of Minnesota Law 1994, ch. 617, the Septic
System Act, which will include new administrative requirements for Minnesota Rules ch. 7080 and
new licensing rules for individual sewage treatment system (ISTS) professionals. These.new

forthcoming rules will impact all local units o(government and ISTS professionals within the state
of Minnesota.
At present, the Council considers the following tasks to be necessary components of a biennial
on-site system inspection:
. Locate and visually inspect the ground surface of each component of the system
including the tank(s), distribution box, drain fieId(s), etc. Look specifically for settlement
that could indicate collapse, or surface ponding due either to plugging or some degree of
system failure.
. Measure settled solids and scum levels in tank(s) through either inspection port(s) or
tank cover. Inquire of owner when the system was last pumped, inquire if number of
system users or loading has changed since last pumped, and determine whether system has
sufficient capacity to retain two additional years of settled solids or scum accumulation.
. Check integrity of tank bottom with rod to verify that inadequately treated wastewater
is not seeping out of the bottom of failed or improperly constructed tank(s).
. Inspect and confirm presence and integrity of both inlet and outlet baffles as possible
through inspection port(s) and tank access cover if tank does not need to be pumped.
Absence of baffles will require pumping of tank and repairs to replace baffles.
. If primary (or only) tank needs to be pumped, or will be unable to retain two more
years' accumulation of solids or scum, remove tank access cover(s) and pump out all
contents of tank(s) through the access hole (not through inspection ports).
. Access distribution box if present and identify which drainage trenches are in use.
. View inspection ports at beginning and end of each trench so equipped to determine if
flow is successfully filling the entire length of each trench in use. Also view inspection
ports of trenches not in use and note presence or absence of any liquid in each trench.
Presence of liquid in trenches not in use could indicate the presence of high ground water
which would preclude the usability of those trenches.
. If present, inspect dosing tank to verify proper operation of pump(s), low level shutoff,
and high water level alarm or warning light.
. If present, inspect the mound distribution system to verify the absence of any existing
surface ponding or evidence of past ponding or leakage at the surface on or around the
mound. Also verify that no heavy traffic occurs over the mound, that there is adequate
ground cover over the mound, that there are no bushes planted on the mound, and that
there are no large trees at the perimeter of the mound.
While this list may seem long, many of the tasks are only simple visual assessments, and if carried
out, will maximize the life and efficiency of operation of an individual on-site sewage system.
Some concern has been expressed that a two-year inspection cycle is unnecessarily frequent to
insure adequate system operation. While considered conservative by some, the Council's policies
were established to promote efficient and pollution-free operation of on-site sewage disposal
systems. The Council has in the past been called upon to provide metropolitan seweyservice to
rural areas when on-site systems had failed. Provision of this service has been extremely costly
however, and the Council wants to minimize the need for this costly experience in the future:

The Minnesota Extension SerVice (Extension) recommends in their Get To Know Your Septic
Tank information brochure (copy enclosed) that sludge and scum should be removed by pumping
every one to three years for a lOOO-gallon tank serving a three-bedroom home with no garbage
disposal unit having four occupants. Additionally, the Extension states that while the frequency of
cleaning is determined by each household, every 24 months is a good estimate for a typical home
without a garbage disposal.
The Council has historically left the management program decision of who would perform system
inspections up to each local government. Some communities utilize municipal staff to inspect all
systems, and others provide a listing of licensed and certified individuals to local residents for
them to individually contract for the service. In addition, other communities have chosen to
require biennial pumping of all individual on-site sewage disposal systems. This type of program
can result in an overall cost savings if inspections indicate that solids also need to be removed for
an additional charge. This type of management program is in accord with Council guidelines if
the individual removing solids from the system is also certified as an inspector by the MPCA, and
will be qualified to carry out the above-listed inspection functions.

SYSTEMS: REQUIRING PERMITS FOR AND LICENSING OF PERSONS ENGAGED
IN THE CONSTRUCTION AND SERVICING THEREOF: PROVIDING FOR THE
INSPECTION OF SUCH SYSTEMS, AND THE ABATEMENT OF NUISANCES:
PROVIDING FOR THE INSPECTION OF PRIVATE WATER SYSTEMS, AND
PRESCRIBING PENALTIES FOR VIOLATIONS THEREOF: IN THE CITY OF
ANDOVER, COUNTY OF ANOKA, STATE OF MINNESOTA.
The City Council of the City of Andover hereby ordains:
Ordinance No. 37 is hereby amended as follows:
SECTION 2. GENERAL PROVISIONS.

a. Each property owner having an on-site sewage
disposal system shall have the system inspected on a

b. The City is divided into two (2) areas for the
purposes of biennial +B~-aRR~a~+ reporting by property
owners. The areas west of CSAH No.9 shall report on
odd years and the area east of CSAH No. 9 on even years.

d. The City requires that each property owner has
his on-site sewage disposal system pumped as often as
required by inspections, as stated in Section2(E),
Subsection 7 d. Failure on the part of the property
owner to have an on-site sewage disposal system cleaned
when said system is found to require cleanIng shall be
cause for the City to provide for the cleaning service
and provide the property owner with an. advance
notification of the date the system will be cleaned.
The cost of this service shall be assessed to the

e. The basis for determining if septic tank cleaning
1S needed is the measurement of the depth of sludge and
scum in the septic tank. when, as a result of such
measurement, the top of the sludge layer in the tank or
any compartment of the tank is found to be less than
twelve (12") inches below the bottom of the outlet
baffle or submerged pipe or if the bottom of the scum
layer is less than three (3") inches above the bottom of
the outlet baffle or submerged pipe, the owner or agent
shall arrange for the removal and sanitary disposal of
the contents of the tank.
f. Individual servicing of septic tanks and soil
absorption units shall require a permit from the City
and shall conform to the Minnesota Department of Health
and Minnesota pollution Control Agency specifications.
Disposal of sludge and scum removed from the system
shall be into a municipal sewer disposal system at a
disposal site approved by the Building Official.
~. Owners of sanitary disposal systems shall be
required to cooperate with and assist the City in taking
water samples, as required, to test the adequacy of such
systems.
SECTION 4. LICENSES.

3. Applicant shall file with the City Clerk policies of
public liability and property damage insurance which shall
remain in force and effect during the entire term of said
license and which shall contain a provision that they shall
not be canceled without ten (10) days written notice to the
City. Public liability insurance shall not be less than one
hundred thousand ($100,000) dollars for injuries including
accidental death to anyone (1) person and subject to the
same limit for each person in an amount of not less than
three hundred thousand ($300,000) dollars on account to any
one (1) accident, and property damage insurance in the amount
of not less than fifty thousand ($50,000) dollars_ for each
accident and not less than one hundred thousand ($100,000)
dollars aggregated. No work shall be done under license
until said insurance policies have been filed and approved by
the City.

4. Licenses shall be renewed annually. The annual license
tee shall be as set by City Council Resolution. Applications
for such license shall be made annually on a form furnished
by the City Clerk. Licenses shall be in effect from January
1 to December 31 of that year. (37C, 11-06-90)
5. Application for licenses shall be filed with the City
Clerk and shall be reviewed and subject to the approval of
the City.
~. Any installation, construction, alteration or repair of
a sewage disposal system by a licensee in violation of any
provision of this Ordinance or refusal on the part of a
licensee to correct such defective work shall be cause for
revocation of or refusal to renew a license. Said license
may be revoked or its renewal refused, the licensee shall be
given a hearing by the City Council to show cause why such
license should not be revoked or refused. Notice of the
time, place and purpose of such hearing shall be in writing.
SECTION 5.
COMPLIANCE, PENALTIES AND VALIDITY.

Section (El? shall be effective as of January 1, 1994, to allow
the City of Andover to establish the implementation and
notification procedure.

Penalties.

1. Any person found to be violating any provision of this
ordinance shall be served by the Building Official with
written notice stating the nature of the violation and
providing a reasonable time limit for the satisfactory
correction thereof. The offender shall within the period of
time stated in such notice, permanently cease all violations.
2. Any person, firm, corporation or voluntary association
which violates any provision of this ordinance shall be
guilty of a misdemeanor, and upon conviction thereof, shall
be punished as defined by State Law. (37C, 11-06-90)

Resolution R172-94) DISCUSSION: A resident asked if they will be
notified when a building permit is pulled for this property, as there
was concern with bQ~Iding in wetlands and in what he was told is a DNR
protected property. Staff explained other agencies control the wetland,
but all or . ance requirements must be met before a building permit is

.(t) DISCUSSION/ORDINANCE 37/SEPTIC SYSTEMS

Jim Larson. Enoineer and Planner of the Metropolitan Council Water
Manaoement Unit - reviewed the policy of the Metropolitan Council that
local governments that allow development using on-site septic systems
within rural areas on less than 4/40 or 10-acre lot sizes have a
comprehensive program in place to deal with those systems after they are
installed. They require inspections at least every other year. Inver
Grove Heights determined it was more cost effective to have the systems
pumped every two years. They send out reminder notices to the residents
and have set up a permit program to provide funding of the part-time
person who sends out the reminders. The intent is to eliminate and
prevent contamination of the groundwater and surface water from septic
systems that are not functioning properly, and to prevent system
failures to avoid costly extension of the municipal sewer system. He
went into some detail on the process of inspecting an on-site septic
system and items the inspector will look for.

Councilmember Knight argued it will not be possible to see everything on
all systems. Mr. Larson stated the systems are required to have
inspection holes over the baffles, but a qualified inspector has other
ways to check the system. All inspectors are required to be certified
by the PCA. He also explained that the Minnesota Extension Service
studies indicate systems should be pumped everyone to five years.
People with garbage disposals should pump every year. It is not
dependant on soil types. Requiring inspections every two years was the
policy chosen by the Metropolitan Council. Other cities,have also
enacted ordinances to meet this requirement.

The Council raised the issues of having to dig up yards every two years
to do the inspections or pumping, that people in the rural area know how
to take care of their septic systems and do not have garbage disposals,
that the City already has a biennial inspection ordinance in place. Mr.
Larson countered the inspectors have good techniques in locating the
tanks and that the expense of digging up yards is one of the costs of
having that type of treatment system. He did not feel homeowners are

to become a certified on-site septic inspector when he was hired. He
explained all on-site septic systems are installed upon installation.
The installers are also licensed. The office also has a detailed
drawing of all the tanks and manholes. Andover has a good system for
on-site system installations and for the on-going maintainance with
inspections every two years, far better than what other communities have
been doing for a long time.
Mr. Larson stated if all 2500 homeowners have been pumping their systems
at least every other year, very little will have to change. But he
argued that most pumpers are not certified to inspect the septic systems
and the drain fields. The two-year requirement has been a policy of the
Metropolitan Council for over ten years, and it is a policy he supports.
By going beyond two years for an inspection, it increases the potential
, for a system to fail.
( Councilmember Perry asked if there were other methods of detecting a
failing system, such as checking the drain fields, rather than having to
dig up lawns to reach the tank. Mr. Larson reviewed how an on-site
septic system functions and the need to inspect the tank every two years
to keep the solids out of the drain field and to eliminate the potential
for a health hazard. Another community had wanted inspections every
three years, but the Metropolitan Council has continued to be firm in
staying with the two-year policy.
Mr. Larson stated he would be willing to meet with the Staff to resolve
whatever differences there are and to get a clear indication of the
City's current program. If the systems have been pumped every two years
arbitrarily, he thought the Metropolitan Council may grant a variance
for Andover. The Met Council has continually stood behind this policy
for rural on-site septic systems and is requiring this policy be
instituted by communities requesting Comprehensive Plan amendments for
MUSA expansion. Councilmember Jacobson suggested if Andover cannot get
future MUSA expansion, a possibility would be to allow one-acre lot
development in the rural areas.
The Council then asked the Staff and Mr. Larson to work together on this
issue. No further action was taken.

TIF lines. with the advent of utilities being extended for the
school district and the relatively light agenda, this seemed to
be an opportune time for discussion.
An option described by Councilmember Jacobson is illustrated on
the map. The configuration would appear to alleviate requests
for projects which are not consistent with TIF funding
priori ties.

In recent months the City Council has discussed probable uses
for excess TIF funds. Continued park development, purchase of
salvage yards, and extension of school utilities have all been
given serious consideration.

The City will be unable to use increment dollars outside of
the present TIF district unless the boundary (see dark shaded
area on map) is changed. Complete park development and utility
ext~nsions are not possible without extending the project area.
A change in the boundary will NOT change the area in which tax
increments will be COLLECTED, however, it WILL change the area in
which it could be SPENT.

Points to consider when establishing a new boundary for eligible
TIF expenditures:
* Any dollars spent in the TIF area will need approval of the
Council.
* TIF laws are likely to change soon. Changes could make
future modifications of the boundary impossible.
* What happens if a new industrial or general business district
is planned and needs assistance?
* What if future redevelopment sites emerge in residential
areas?
* What if utilities are required in rural areas due to massive
septic problems?
* The City may wish to signalize more intersections.

Staff requests Bill Hawkins work with staff to modify the TIF
plan to include those areas as designated by the council. I
urge careful consideration of the aforementioned issues.

The State Legislature h~s enacted a law establishing a uniform
election schedule and providing un~form election procedures for
local elections.
By January 1, 1995, each city, school district and special
district must decide to conduct its general elections in either
the odd-number or the even-number years.
I
Of the 21 cities in Anoka County, Circle pines, Lexington, Lino
Lakes and Columbia Heights have opted to go to odd-number year
elections. School District 11 is also going to odd-number year
elections. They feel that the candidates would get greater
exposure by having odd-~umber year elections. As far as I can
determine, that is the Jnly advantage to odd-number year
elections.
The primary disadvantag2 would be the cost for the election
judges and city staff, 9rinting ballots, and publication charges.
Also, we would have ele:tions every year.
I would recommend that the City Council stay with even-number
year elections.

salvage Yard Update

Bill Hawkins, Jack McKelvey and I met with James Dahlquist
(attorney for salvage yards) on Monday, October 24, 1994 to begin
negotiations on the purchase of salvage yards.
Mr. Dahlquist had contact with and had reviewed the appraisals
with all of the land owners. Four of the six appraised,
indicated a price they wanted for their property and compensation
for relocation expenses. Andover has requested documentation for
moving expenses and any other requests for funds above and beyond
the appraised value.
It will likely be a month before an offer is brought before the
Council for consideration.

The Andover City Council is requested to receive the september
1994 financial statements for the General, water, Sewer and
central Equipment Funds.
SUMMARY COMMENTS:
These statements include the budget amendments authorized by
resolution R219-94, dated september 6, 1994. Projections for year
end revenues and expenditures are as follows:

1) General Fund revenue collections are now ahead of the pace set
in 1993. New home construction permits issued through 9/30/94
total 316 as compared to 407 permits issued as of 9/30/93. The
permit revenue is $48,000 less than last year, but has
surpassed the 1994 budget target by $33,673.
Interest earnings include the first and second quarter
distributions from the Investment Trust Fund. The third
quarter distribution has not been calculated yet.
2) The September 1994 General Fund expenditures compare within
reason to September 1993. To date, 65% of the General Fund
budget has been expended. Through the first nine months of
1993, 63% of the budget had been expended. Departmentally,
there are minor variations, some of which shall require budget
amendment approval prior to year end.

3) Resolution R219-94 amended the General Fund Budget. Along with
recognizing additional revenue, the contingency account was
allocated to various accounts throughout the budget. Future
additional appropriations will need to recognize additional
revenue sources or draw down reserve accounts.
4) The Water Fund revenues are up almost 40% over last year due
to greatly increased volumes of water sold. The increased
customer base was expected to generate approximately 3%
additional volume and revenue. The large increase due to heavy
demand for outdoor watering through August is not expected to
continue. The Sewer Fund revenues and the expenditures for
both the Water and Sewer Funds are comparable to budgeted
expectations. I will present the Council with a resolution
to cancel the budgeted annual rate subsidy from the Sewer
Trunk Fund for service area 'A' at the next meeting as current
operating expenses can and will be funded without the 1994
transfer.
5) The inter-departmental charge for equipment "rental" used to
fund the central Equipment Fund operation is recorded
quarterly. The first three quarterly entries have been
recorded. Expenditures for the first nine months are slightly
higher than expected.

The City Council is requested to approve the final plat for
wittington Ridge as requested by Ashford Development Corporation
in Section 22, Township 32, Range 24, Anoka County, MN.
Comments
The final plat is in compliance with the preliminary plat. There
are some minor corrections that will need to be made on the final
plat. It is recommended that the plat be approved subject to the
following:
1. The City Attorney presenting a favorable title opinion.
2. Security to cover legal, engineering, street sign and
installation costs to be determined by the City Engineer.
3. The developer provide a performance bond or a one-year
warranty escrow as determined for the street and storm sewer
improvement as determined by the City Engineer from the time
construction is complete.
4. The developer escrow for the uncompleted grading and street
construction of the site which is to be determined by the
City Engineer and shall enter into a development contract
with the City. If the site is completed, a letter from the
developer's engineer that lots and streets are graded
according to the grading plan submitted and approved by the
City.
5. street lights costs to be paid to Anoka Electric Cooperative.

WHEREAS, the City Council approved the preliminary plat of
Wittington Ridge ; and
WHEREAS, the developer has presented the final plat of
Wittington Ridge
WHEREAS, the city Engineer has reviewed such plat for conformance
with the preliminary plat; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby approve the final plat of
Wittington Ridge contingent upon receipt
of the following:
1. The City Attorney presents a favorable title opinion.
2. Security to cover legal, engineering, street sign and installation
costs as determined by the city Engineer.
3. The developer provide a one-year warranty escrow or bond for the
, street and storm sewer improvement as determined by the City
) Engineer.
4. The developer escrow for the uncompleted grading of the site which
is to be determined by the city Engineer and shall enter into a
development contract with the City. If the site is complete, a
letter from the developer's engineer that lots and streets are
graded according to the grading plan submitted and approved by the
City.
5. Street light costs to be paid to Anoka Electric Cooperative.
6. A variance be granted for Lot 5, Block 3 for lot frontage from
Ordinance 10, Section 9.06A3 as the lot does not meet the 300 feet
at the building setback lines.
7. A variance be granted for Lot 5, Block 3 for lot area from
Ordinance 10, Section 9.06A3 as the lot does not meet the minimum
108,900 square feet requirement.
8. A variance from Ordinance 10, Section 8.04K as the developer did
not make application for a Special Use Permit in conjunction with
the preliminary plat.
9. The developer provide the City a revised preliminary plat and
grading/drainage/erosion control plan that provides all
information that is required in Ordinance 10 and other applicable
, \ ordinances and comply with the water Resource Management Plan.
, / The final plat is not to be approved until requirements are met.
10. A variance from Ordinance 10, Section 9.03G as the length of the
cul-de-sac exceeds the maximum allowed of 500 feet.

of Project 94-18 located in Section 22-32-24.
The City Council did receive the feasibility report of July 5,
1994 but did not accept the report. It is recommended to accept
the report which allows TKDA to begin preparation of the plans
and specs. It will take approximately 3 months to prepare the
plans and another month for the bidding which puts us into
spring.
This is a significant project because of the depth of sanitary
sewer and also the length (approximately 1/2 to 3/4 mile).
Also, we will need easements from the property owners on the west
side of the Public Works building and we may have to condemn if
they are unwilling to allow the City to trespass on the property.

The City council is requested to approve the attached
resolution adopting the assessment roll after the Council
has met and heard and passed upon all objections for delinquent
sewer, water and street lighting service charges.
The assessment roll has been prepared including transactions
posted through october 31, 1994. payments ~ill be accepted through
December 1, 1994 without interest.
BACKGROUND
The owners of the parcels with delinquent sewer, water and/or
street lighting service charges have been notified of the proposed
assessment and certification process. The delinquent balances for
the proposed assessment totaled $24,077.80 as of October 31, 1994.
Notice of the assessment hearing was mailed to affected property
owners September 30, 1994. payments received through October 31st
have been applied to the delinquent accounts. An administrative
fee equal to 15 percent of the delinquency plus interest at 8% is
added to each delinquent account. Therefore, the total assessment
for delinquent sewer, water and street light services is
$29,904.63.
The resolution adopting the assessment roll is attached.

Dear Mayor and Council Members:
The following is a summary of engineering matters discussed and action taken at the Regular
Council Meeting held Tuesday, October 18, 1994.
1. Consent Agenda:
The Council by single motion approved consent agenda items as follows:
A. Proj. 93-11 - Emerald Glen Addition, Comm. No. 10454
The Council by resolution approved fmal payment to Inland Utility Contracting and
accepting the work. The final contract amount is $194,045.74. The original
contract was $180,952.55 and the feasibility report estimate was $213,493.00,
B. Proj. 93-5 - Winslow Hills 3rd Addition, Comm. No. 10365
The Council by resolution approved fmal payment to C. W. Houle and accepted the
work. The fmal contract amount is $589,949.17. The original contract was
$565,255.16 and the feasibility report estimate was $610,447.00.
C. Proj. 92-27 - Commercial Boulevard, Comm. No. 10340
The Council by resolution officially named Commercial Boulevard from Hanson
Boulevard to Nightingale Street NW.
D. Proj. 93-9 - Xeon Street Storm Sewer, Comm. No. 10403
The Council by resolution approved Change Order No.1 for the above referenced
project to extend the completion date to October 15, 1994.
E. Proj. 93-7 & 94-13 - Commercial Park Grading, Comm. No. 10706
The Cowlcil by resolution approved Change Order No. 1 for the above referenced
project to extend the completion date to June 15, 1995.

2. Proj. 94-27 - 14268 Woodbine Street NW, Comm. No. 9140-940
Mr. Davidson presented the feasibility report and background information for the project.
The original feasibility report dated April 16, 1992 estimated the per lot assessment for
watermain at $4,211.80.
Based upon 1994 connection charges the proposed assessment is $3,587.92 for Lot 4,
Block 6 and Boundary Comm. Plat No. I.
Mrs. SOllsteby indicated she would not appeal the asses::ment.
Council Action:
The Council by resolution adopted the assessment as proposed.
3. Proj. 94-8 - Foxberry Farms, Comm. No. 10673
After discussion, the Council approved the revised grading plan for the above referenced
project.
4. Proj. 94-10 - Jonathan Woods, Comm. No. 10675.
After discussion, the Council approved the revised grading plan for the above referenced
project.

The Council by resolution accepted the low bid from S. R. Weidema, Inc. in the amount of
$857,784.47 and awarded the contract subject to fmal plat and development contracts
being recorded.
6, Proj. 94-3 - 140th Lane NW, Comm. No. 10671
Mr. Davidson did review the storm sewer and drainage plan for 140th Lane NW Project.
Defmed wetland on the property of Mr. Douglas Steele was recommended to be protected
by permanent easement.
Mr. Steele was present and expressed his concerns. He also wants compensation for use of
his wetlands for ponding.

The elevation of water in the wetland area which overlaps properties in Hills of Bunker
Lake 5th Addition to the west and Crown Pointe East Addition to the north will be
controlled through Crown Pointe East to the Coon Creek.
Council Action:
The Council directed the staff to meet with Mr. Steele and the developers affected.
The Council rescinded their previous authorization to condemn easements.
The Engineer was excused at approximately 10:30 P.M,

Dear Ms. Engler:
I have received the letters of october 18 and July 28 indicating a
number of complaints with the developer and with your neighbo~
Mr. Goetsch.
unfortunately, nothing can be done with the pond size or its
configuration at this time~ The issues concerning your neighbor
regarding the park have been addressed for the most part. There are
however, minor grievances between you and your neighbor which
persist.
I have examined the problem and find that the use of a device to
discourage geese from roaming property and defecating on said
property is not a detriment to the City, its residents or to
practical use of the park. .
I will direct staff to take no further action on the park site unless
harmful, dangerous or inhibiting activities affecting the park are
initiated.

DEAR PARK DEPARTMENT,
ATTACHED IS A COPY OF MY LETTER DATED JULY 28, 1994.
TWO AND A HALF MONTHS HAVE PASSED AND THE ONLY THINGS THAT HAVE
CHANGED ARE THE BUSH I GAVE TO THE CITY HAS BEEN TRIMMED TO HALF ITS
SIZE TO ALLOW FOR MR. GOETSCH TO FIT HIS LAWN MOWER BETWEEN IT AND MY
GARDEN AND THE BARRIERS HAVE BEEN PLACED AT POND'S EDGE TO KEEP THE
WILD LIFE OUT OT THE "NATURE PARK". YOU DID REMOVE THESE ONCE BUT AS
YOU KNOW IT HAS BEEN REPLACED.
I HAVE LEFT THREE MESSAGES THAT WERE NOT RETURNED. ONE ON SATURDAY
OCTOBER 15, 1994, ONE OCTOBER 17, 1994 AND THE LAST WAS TODAY TUESDAY
OCTOBER 18, 1994. I WANTED TO KNOW WHEN THIS PART OF THE PARK BECAME
THE PRIVATE PROPERTY OF MR. GOETSCH AND ALSO WHY YOU TOLD HIM THAT
YOU DID NOT PLANT THE BUSH ON WEDNESDAY JUNE 29, 1994 AT 9:30 A.M..
LAST SUMMER MRS. RUSSELL AND I WITHDREW OUR PETINION TO ADOPT THE
PORTION OF PARK PROPERTY BEHIND MY HOME SO ALL OF THE RESIDENTS COULD
ADOPT IT AS A WHOLE. HID WE NOT DONE SO AND BEEN GRANTED PERMISSION
TO GO AHEAD THE AREA IN QUESTION WOULD NOW BE ABLAQE WITH WILD
FLOWERS AND ALIVE WITH THE GEESE AND DUCKS THAT WE AND OUR
GRANDCHILDREN DELIGHT IN WATCHING INSTEAD OF THIS JUNK FLAPPING IN
THE BREEZE.
I FULLY UNDERSTAND MY NEIGHBOR NOT WANTING THE GEESE ON HIS PROPERTY
AND WOULD EXPECT THAT HE WOULD ERECT HIS MESS THERE.

I ATTENDED A PARK BOARD MEETING ON JUNE 2, 1994 TO ASK THAT YOUR
ORDINANCE CONCERNING A 10' NATURAL AREA BE LEFT UNMOWN AROUND THE
POND. SPECIFICALLY THE AREA BEHIND MY PROPERTY. YOU ASSURED ME THIS
WOULD BE TAKEN CARE OF. TO DATE IT IS STILL BEING MOWED TO PONDS
EDGE. YOU HAVE AN ORDINANCE ABOUT NOT FERTILIZING ON PARK LAND. THE
AREA BEHIND MY HOUSE IS BEING TREATED TO PONDS EDGE. THE GROWTH IN
THE POND WAS TO BE LEFT. IT IS STILL BEING REMOVED. NOTHING HAS
BEEN DONE TO STOP ANY OF THESE ACTIVITIES. WHY HAVE ANY OF THESE
RULES?
WE HELD A NEIGHBORHOOD MEETING LAST YEAR WITH A FOLLOW UP MEETING
BETWEEN FOUR OF US RESIDENTS AT THIS END OF THE POND WITH GEORGE
WETTERER AS MEDIATOR. AN AGREEMENT WAS REACHED WHICH OF COURSE WAS
NOT ADHERED TO.
WHEN I PURCHASED THIS PROPERTY I WAS SHOWN THE PLAT PLAN APPROVED BY
THE CITY LAYING OUT THE SHAPE AND AREA THE POND WAS TO TAKE AND FOR
TWO YEARS WAS TOLD THE POND WOULD BE DUG TO COMPLY. IT WAS NOT.
IT IS A SAD COMMENTARY ON THE CITY WHEN A DEVELOPER IS NOT REQUIRED
TO FOLLOW THE APPROVED PLAN THUS CREATING A POSSIBLE PROBLEM OF WHICH
YOU DO NOT WISH TO BE PART OF THE SOLUTION. THE DEVELOPER, ONCE HE
IS DONE WILL NO LONGER GENERATE REVENUE FOR THE CITY WHILE YOUR
RESIDENTS WILL CONTINUE TO DO SO THRU PAYMENT OF TAXES.
A NEIGHBOR AND I TRIED TO WALK AROUND THE POND BUT THERE IS NO ACCESS
ALL THE WAY. SOME IS PRIVATE PROPERTY WITH PARTS OF IT FENCED. HOW
CAN THIS BE CALLED A PARK?

Attorney involved.
UNIFORMS/RADIO/SPECIAL PURCHASES - T. Johnson / T. May
. Person coming to measure for uniforms on October 12th.
. One new T-Shirt available for each member for 1994.
. Persons who need grass coats should talk to their Officers.
SMALL EQUIPMENT/SCBA - T. Johnson
. Station II SCBA's were in bad shape at this month's check. Need to make
sure they are cleaned and checked after each use.
