REQUEST
The City Council is asked to review the Special Use Permit request
of Jim Hughes to operate a repair garage on the property located
at 13624 Thrush Street NW, legally described on the attached
resolution.
APPLICABLE ORDINANCES
Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.

Ordinance No.8, Section 7.03, establishes those uses allowed by
Special Use Permit. In a GB, General Business District, repair
garages are allowed by the granting of a Special Use Permit.
In granting a Special Use Permit, the City Council shall examine
the effect of the proposed use upon the health, safety, morals and
general welfare of occupants of surrounding lands; the effect on
traffic patterns and congestions; the effect on surrounding
property values and the use's consistency with the Comprehensive
Plan.
Planning & Zoning Review
The Planning and Zoning Commission, at their July 12, 1994
meeting, recommended approval of the Special Use Permit request
with conditions. Attached for your review are the minutes and the
staff report from the meeting.
Attached is a proposed resolution for Council review and adoption.

A RESOLUTION GRANTING THE SPECIAL USE PERMIT REQUEST OF
JIM HUGHES TO ALLOW FOR THE OPERATION OF A REPAIR GARAGE LOCATED
AT 13624 THRUSH STREET NW (PIN 34-32-24-32-0012), LEGALLY
DESCRIBED BELOW.
WHEREAS, Jim Hughes has requested a Special Use Permit to
allow for the operation of a repair garage on the property located
at 13624 Thrush Street NW (PIN 34-32-24-32-0012), legally
described as Lot 4, Block 1, Andover Commercial Park; and
WHEREAS, the Planning and Zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance 8, Sections 5.03 and 7.03; and
WHEREAS, the Planning and Zoning Commission finds the
proposed use will not be detrimental to the health, safety and
general welfare of the occupants of the surrounding lands; the use
will not cause serious traffic congestion or hazards; the use will
not depreciate surrounding property; and the use is in harmony
with the Comprehensive Plan; and
WHEREAS, a public hearing was held and there was no
opposition regarding said request; and
WHEREAS, the Planning and Zoning Commission recommends to
the City Council approval of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning and Zoning Commission to allow Jim Hughes to operate a
repair garage on the above described property with the following
conditions:
1. The Special Use Permit will be subject to a sunset
clause as defined in Ordinance No.8, Section 5.03(D).
2. The Special Use Permit will be subject to annual
review and site inspection by City Staff.
3. The applicant shall secure a Hazardous Waste
Generator's License from Anoka County and provide
proof to the City.
4. The site shall be subject to meeting the requirements
of Ordinance No.8, Section 8.08, Parking.
Adopted by the City Council of the City of Andover on this
2nd day of August, 1994.

MINUTES
The Regular Bi-Monthly Meeting of the Andover Planning and Zoning
Commission was called to order by Chairperson Jay Squires on July 12,
1994, 7:00 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, Minnesota.

June 28, 1994:

mnUBLIC HEARING: SPECIAL USE PERMIT - REPAIR GARAGE IN A GB, GENERAL
(dS,hUSINESS DISTRICT - 13624 THRUSH STREET NW - JIM HUGHES
7:02 p.m. Mr. Carlberg reviewed the Special Use Permit request by Jim
Hughes to operate a repair garage Lot 4, Block I, Andover Commercial
Park. He noted the applicable ordinances and criteria to be examined
when granting Permits. The Andover Economic Development Committee
reviewed this item at their meeting last week and is recommending that
the lot be sold to Mr. Hughes. They felt this is an appropriate use in
the Commercial Park, but they were concerned that all exterior storage
be screened. Mr. Carlberg noted the ordinances and restrictive covenants
on the lot will deal with the exterior storage issue. Commissioner Dehn
understood the need to restrict exterior storage, but at the same time
she did not want to hinder the operation such that they cannot function.
Mr. Carlberg stated the control will be to make it aesthetically
pleasing and not depreciate surrounding properties. He also reviewed the
activities on the other lots within the Park.

Commissioner Dehn asked if there was concern by the AEDC with the day
care center to be located immediately north of this lot. Mr. Carlberg
stated they were sent a notice of this hearing. They were also aware of
the uses that could potentially be allowed on this lot, and they chose
Lot 3, Block 1 for visibility and accessibility rather than choosing a
lot abutting the residential area. Staff will contact the day care
center to inform them of the proposal, and they will work with Mr.
Hughes to have a minimal impact on the proposed day care facilities.

MOTION by Apel, Seconded by Dehn, to open the public hearing. Motion
carried on a 6-Yes, 1-Absent (Peek) vote. 7:15 p.m.
Jim Huqhes - explained they are planning to construct a 5,000-square-
. foot building, with two exists from the lot to Thrush and to 136th. The
north side of the building facing the day care center will just be
building with no parking or storage. Inside the building there will be
approximately 2,000 square feet of shop acre with three bays, 1,800
square feet of office space, and 1,200 square feet of cold storage.
They do not plan to have any outside storage. The most vehicles they
have on hand is about four, as most customers do not want their vehicles
tied up for very long.
MOTION by Dehn, Seconded by Jovanovich, to close the public hearing.
Motion carried on a 6-Yes, 1-Absent (Peek) vote. 7:17 p.m.

There was some discussion on the hours of operation. Mr. Hughes stated
they generally work from 8 a.m. to 5:30 p.m., Monday through Friday,
occasionally on Saturdays from 8 to 12. But they also have the county
service contract; and, for example, when there is a snow storm, they
must work whatever it takes to get the equipment repaired. The
Commission felt that because this is in a General Business area away
from residential, there would be no need to set hours of operation. If
noise becomes a factor, it can be handled with the Noise Ordinance. The
Commission also raised the issue of the day care center to the north but
felt the two uses could be compatible. Mr. Carlberg stated Staff will
work with both parties to make sure the uses are conducive for both
lots. Mr. Hughes then noted the day care center will probably have ten
times more traffic than he will.

MOTION by Apel, Seconded by Dehn, to recommend to the City Council that
the Council approve a Special Use Permit request by Jim Hughes. The
Commission finds the request meets the criteria established in Ordinance

REQUEST
The Planning and zoning Commission at its regular meeting on
July 12, 1994, reviewed the request for a lot split/variance by
Fred'Dailey located at 17004 Valley Drive NW. The applicant is
requesting to split an 8 acre parcel into two parcels. The
variance request is for lot frontage on Parcel B. Please consult

WHEREAS, Fred Dailey has requested a lot split and
variance to create two (2) lots for the sale and construction of a
single family home on the property located at 17004 Valley Drive
NW (PIN 08-32-24-24-0016) legally described as Outlot A, valley
View Estates Second Addition: and
WHEREAS, the Planning and zoning Commission has reviewed
the request and has determined that said request meets the
criteria of Ordinance No. 40 and that based on section IV, the
City Council may vary the application of any of the provisions of
the Ordinance; and
WHEREAS, the Planning and zoning Commission finds the
request is consistent with the Comprehensive Plan and would not
have a detrimental effect upon the health, safety, morals and
general welfare of the City of Andover; and
WHEREAS, a public hearing was held and there was
opposition to said request based on the wetland consideration and
traffic, particularly the driveway entering onto valley Drive NW;
and
WHEREAS, the Planning and zoning Commission recommends to
the City Council approval of the lot split and variance as
requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning and zoning Commission to allow the lot split and variance
on said property with the following conditions:
1. That the applicant pay a park dedication fee pursuant to
'Ordinance No. 10, Section 9.07.
2. That the lot split/variance be subject to a sunset clause
as defined in Ordinance No. 40, Section III(E). approval.

LOT SPLIT /VARIARCE - 17004 VALLEY DRIVE NW - FRED

7:23 p.m. Mr. Carlberg reviewed the lot split/variance request of Fred
Daily to split an a-acre parcel into two separate lots of 2.5 acres and
5.5 acres. A variance is also requested from the 300-foot lot frontage
requirement on Parcel B. Parcel B has 253 feet of frontage; therefore,
a 47-foot variance is being requested. The property is zoned R-2,
Single Family Estates; however, because the R-2 zone is no longer
allowed for development, the provisions of the R-l district must apply.
Park dedication is also required on lot splits for each dwelling unit
that could be constructed upon. Parcel A will have structures on it, so
park dedication would be collected for Parcel B only. The driveway for
Parcel B would come onto Valley Drive. There are some wetlands in that
parcel, and soil borings and perk tests will be required before a
building permit is issued for that parcel. The cul-de-sac for 171st
Avenue shown on the map has never been constructed, possibly because of
the wetlands.
Chairperson Squires asked if the lot lines of Parcel A could be
reconfigured so the variance would not be necessary.

Fred Dailev - explained the driveway for Parcel B would run along the
line of Parcel A to the back of the parcel where the house will be
built. That is the only place the driveway can go because of the
wetlands. Commissioner Dehn noted the section of high land through
there is not very wide. Much of the area is swampy, but there is high
ground in the back. She felt what Chairperson Squires is suggesting
would produce a very odd-shaped lot; and looking to the future with the
possibility of subdividing parcels, she felt it is important that the
lots be geometric. Mr. Carlberg also noted the buildable area and
driveway location will be determined through the building permit
procedure.
MOTION by Apel, Seconded by Jovanovich, to open the public hearing.
Motion carried on a 6-Yes, I-Absent (Peek) vote. 7:37 p.m.
Adam Kaplan, 3741 171st Circle NW - explained they were drawn to that
entire area because of the wetland conservation, but five years later
houses are being built there and the conservation of wetland is being
ignored. He felt the proposed location of the driveway for Parcel B
will create a dangerous situation because of the dangerous curve to the
north.
Mr. Dailev - stated he's lived there for 22 years and has seen only one
car in the ditch. He disagreed that it was that dangerous.

Sharon Kuhn, 17017 Valley View Drive NW - talked with Mr. and Mrs.
Dailey at one time about their thoughts to put a road through to the
back. She's glad he isn't doing that because that would take out
between 30 to 40 trees. She likes the seclusion and does not want to
see the trees removed. The house on Lot 19 was built right on the
property line. She is concerned about other houses being built on the

property line. She asked how many homes. can be built on the property.
There is a lot of wetlanG, and she wondered if the City would consider
that property as park land. Mr. Carlberg stated the Wetlands
Conservation Act will apply, and any filling of wetland must be
mitigated two for one. Only one house is being proposed for Parcel B.
This area is not proposed for park land in the Comprehensive Plan. This
area is not being considered for sewer and water within the City's plan
until 2010, if at all.
Ms. Kuhn - couldn' t see how a home could be built back there. Mr.
Carlberg stated there appears to be a buildable area on Parcel B. The
house can be built up to 10 feet from the side property line. There
were some comments from the audience about the proposed driveway for
Parcel B being five feet from the property line and a notation on the
easement for the power line. The Commission noted these items would be
reviewed by the Building Department when application is made for a
building permit. Another resident stated they have seen perk tests done
in the middle of the winter, which causes some concern for them.
Larry Witman, Lot 20 - stated Parcel B is only one lot now with only one
house, but can it be split some day down the road.
( Mr. Dailey - stated he is not intending to split it. Commissioner Dehn
noted because of the wetlands and the configuration of Parcel B,
including the need for a variance for road frontage, it is unlikely the
parcel could be split further.
Mr. Witman - asked how they would be informed of where the high ground
is. He is concerned about the driveway access, as Valley Drive is a
death trap. How will Andover deal with this? He'd like to see the road
issue dealt with before another driveway is put in there. Mr. Carlberg
thought the driveway would be as far south on the parcel as possible.
A resident noted Valley Drive has just been resurfaced by the county.
Mr. Witman - again asked about the wetland issue to make sure it is not
filled in. That is a main drainage area for the whole neighborhood; it
is a natural spring. Mr. Carlberg explained there are a number of
agencies that get involved with the wetlands, including the watershed,
the DNR and the Army Corps of Engineers. He again stated Parcel B in all
a likelihood is a buildable lot. But the buildability issue will be
determined by the Building Department. Also, he did not think the issue
of taking it as park property is valid. The applicant is looking to
subdivide his property, and this does meet ordinance requirements.
Mr. Dailey - knew of someone who is buying the land to the north and
plans to subdivide it into three lots without constructing 171st Avenue.

Mr. Witman - asked how they will be kept informed of what is going on
with this property. Mr. Carlberg stated they can contact the Building
Department for the construction of a home. They would receive written
notification from the City if there is any future subdivision of the
property. The Commission also noted that this is the public hearing, but
the residents can also go before the Council when they hear this item.

and Zoning Commission forward to the Council and recommend approval of
the Resolution granting the lot split as prepared by Staff with the
following changes: Where it says "WHEREAS, a public hearing was held
and there was no opposition", change "no opposition" to "there was
opposition to said request based largely on the wetland consideration
and traffic, particularly the driveway corning out on Valley Drive".
Motion carried on a 6-Yes, 1-Absent (Peek) vote. This will be placed on
the August 2, 1994, City Council Agenda. 7:52 p.m.
OTHER BUSINESS
Mr. Carlberg updated the Commission on the Council action at their July
5, 1994, meeting regarding Planning Commission items. He is also still
receiving information on massage therapy as a home occupation. As soon
as everything is in, he will prepare something for the Commission to
review.

Request
The Planning and Zoning Commission is asked to review the lot
split/variance request of Fred Dailey to split an 8.00 acre parcel
into two (2) separate lots of 2.5 acres and 5.5 acres. The
applicant is requesting a variance from the three hundred (300')
foot lot frontage requirement 9n parcel B (see the attached
diagram). Parcel B has two hundred fifty-three (253') feet of
frontage on Valley Drive NW. Therefore, a variance of forty-seven
(47') feet is requested.
The property is zoned R-2, Single Family Estate.
Applicable Ordinances
Ordinance No. 40 regulates the division of lots. A lot split is
defined as any division of a lot, parcel or tract of land into not
more than two (2) parcels when both divided parcels meet or exceed
the minimum requirements for platted lots in the applicable zoning
district.
Ordinance No. 40 also allows the City Council to vary
from the provisions in the Ordinance.
Ordinance No.8, Section 6.02 establishes the provisions for
minimum lot width, lot depth and lot area in an R-2, zoning
district. However the standards of the R-l zoning district will
apply in this case. The minimum requirements in an R-l district
are as follows:

2.5 acres
Ordinance No. 10, Section 9.07.10 establishes the minimum area of
land dedicated to park and open space. For all subdivisions by
metes and bounds description the subdivider or developer may elect
to pay, in lieu of the park dedication requirements, the sum of
four hundred dollars ($400.00) for each dwelling unit that could
be constructed upon the proposed subdivided property. In the
event the developer elects to pay said four hundred dollar
($400.00) charge, the City may collect additional park fees if the
developer re-subdivides the property in the future.

CRITERIA FOR GRANTING A VARIANCE
In granting a variance, the City Council shall consider the
advice and recommendation of the Planning and zoning Commission,
and:
1. If the request is in keeping with the spirit and intent of
this Ordinance.
2. If it finds that strict enforcement of this Ordinance will
cause undue hardship because of circumstances unique to
the individual property under consideration.
3. If it finds that denying the request does not deny
reasonable use of the property.
4. Economic considerations shall not constitute an undue

Staff has met with school district representatives to discuss the
extension of sewer and water services for the new Andover grade
school and middle school.
The feasibility report by TKDA has estimated the final and
complete cost of extending services to the middle school site at
$565,550. Based on assessment policies, the school district
would be charged $383,000 with the City's share being $458,000.
Clearly, the assessment potential is greater than the total cost.
The assessments do not include those payments which will be
generated by future housing developments. The future housing
developments would add significant acreage (40+) to the
assessment roles.
Finance Options:
Note: When selecting finance options, staff has taken the
position that such options should not be tied directly to
new housing.
1. School finance all - The school district has been asked to
consider financing all costs of utility construction. As
housing is developed in the future, additional hook-ups would
go to pay the City's share of development back to the school.
Under this scenario, the City would have no costs and there
would be no financial impact on the trunk access.
2. City finance with TIF - This is definitely more complicated,
but it also gives the City several opportunities. The City
could expand the TIF District. TIF dollars could be spent in
the district for the entire sewer and water extension.

When the school is assessed for their share of the project, the
money "paid back" could be used for other City needs such as:
* Public Works Building Addition
* Pay down deficit on sewer trunk fund
* Etc.
other Findings and Considerations:
A. City property involved in the expansion is actually 20%
greater than the schools. Yet if assessed, the school could
potentially pay over 100% more than the City for their share.
Depending on the financing option chosen, I would ask the
Council to consider offering the utilities to the school for
$300,000 in exchange for a $10,000 acre offer on the school
site.

B. What is the likely direction of the next utility expansion?
The utility extension is proposed to stop at the southern
boarder of the school site. If the lines are extended
sometime in the future, it is likely ball fields, fences and
a track will be damaged as a result.
The following should be considered:
1. City will be using school ball fields for park
activities.
2. Sometime in the future, it is probable that the utilities
will once again be extended.
4. Established fields and equipment would be damaged and put
out of service. Replaced at a higher cost.
4. Plans could be made now to avoid such future problems.
John Davidson will provide a profile of utility extension
options. The City will want to consider future development
before settling on utility placement.
Schedule:
The extension of the sewer and water will go to public hearing at
the August 9, 1994 Planning Commission meeting. It will go
before the Council on August 16, 1994.

provided in Ordinance No. 95, Boulevard Encroachments. Currently,
the City has not permitted boulevard encroachments as allowed by
permit in Section 3 (attached). However, with the recent problems
that have occurred in requiring the removal of all encroachments,
the City may wish to allow those encroachments that do not pose an
imminent danger.
Staff asks direction from the City Council as to how to proceed
with the enforcement of Ordinance No. 95, Boulevard Encroachments.

ORDINANCE NO. 95
AN ORDINANCE REGULATING BOULEVARD ENCROACHMENTS AND PROVIDING FOR
AN APPEAL PROCESS.
The City Council of the City of Andover hereby ordains:
Section 1.
Purpose
It is hereby declared to be the policy of the City of Andover to
promote and provide unrestricted and safe passage within
boulevard areas in public rights-of-way while at the same time
promoting the betterment of the aesthetic qualities of the
community. The Council recognizes that certain encroachments
located within the boulevard area will impede the safe and free
flow of pedestrian traffic and will cause imminent danger to
vehicular traffic, including bicycles, leaving the paved surface
area. The Council further recognizes that certain improvements
to the boulevard area will neither impede pedestrian traffic nor
create imminent danger to vehicular traffic leaving the street.
The Council also recognizes that certain encroachments which
could constitite an imminent danger to vehicular traffic are
permitted within the boulevard area out of necessity. In an
/ attempt to balance these diverse interests, the Council adopts
the following regulations.
Section 2.
Definitions
A. Encroachment. Encroachment shall mean any object, live or
inanimate, situated within a public right-of-way, including
but not limited to, posts, trees, bushes, rocks, utility
poles and boxes, retaining walls, etc.
B.
Boulevard. Boulevard shall mean

C. Impede. Impede shall mean the interference with pedestrian
traffic to an unreasonable degree.

Permit

Any person who intends to place an encroachment as defined herein
within the public right-of-way shall obtain a permit prior
thereto from the City of Andover unless such encroachment is
excepted pursuant to Section 4 hereof. No permit shall be
granted for encroachments which would be considered nuisances as
defined in Section 5 herein.

A. Mailbox or newspaper delivery box stands, which must meet US
Postal Regulations for their position, height and setback.

The owner or occupant shall at a minimum maintain the lawn and
trees in the boulevard. Any additional improvements made shall
be maintained by the owner or occupant at their own risk and
expense. The City shall not be responsible for the maintenance
of or liable for injury to or from such improvements and the
property owner or occupant agrees to hold the City harmless from
any claims arising out of any injury or damage to or from such
improvements.

Section 8.
Violation
A violation of the Ordinance shall constitute a misdemeanor.

Section 9.
Enforcement
The City Administrator or his duly authorized designee shall be
responsible for the enforcement of the provisions of this
ordinance. Upon determining that a violation of the ~rovisions
of this ordinance exists, the City Administrator or his duly
authorized designee shall, in writing, order the discontinuance
of the nuisance and shall order the action necessary to abate
such nuisance. Such order shall be served upon the owner and/or
occupant of the premises involved, in person or by certified
mail. The City Administrator or his duly authorized
designee shall give the affected parties a reasonable period of
time to abate the nuisance, which time may vary depending upon
the nature of the encroachment. The City Administrator or his
duly authorized designee may extend the time for compliance upon
good cause being shown by the affected party. In no instance
shall the time for compliance be less than seven (7) days nor
more than six (6) months.
Section 10. Abatement of Nuisances
If no appeal is taken, if an appeal is denied or the order
amended, and if the time for compliance or any extension thereof
has expired and the nuisance is not abated, the encroachment
shall be removed by an employee or agent of the City. The costs
of such removal shall be recorded and forwarded to the City
Clerk. The cost of removal together with a reasonable
administrative charge shall be certified to the property taxes
for said property.
Section 11. Appeal
Any party aggrieved by an order of the City Administrator or his
duly authorized designee may appeal such decision to the Andover
Review Committee. The appeal must be taken within seven (7) days
after the receipt of a written order from the City Administrator
or his duly authorized designee, by the filing of a notice of
appeal on forms provided by the City Administrator or his duly
authorized designee. Such notice of appeal shall contain the
names and signatures of all parties aggrieved and the grounds
upon which the appeal is being taken. The matter shall be
reviewed by the Andover Review Committee within seven (7) days.
The applicant shall be notified of the findings in writing.
Section 12. Paramount Public Use
The City or any of its agents and/or any utility company
authorized by law or the City to utilize the boulevard area shall
have a paramount right to use of the boulevard area, subject to
control by the city. Any improvements placed in the boulevard by
the owner or occupant shall be removed at the owner's or
occupant's expense if the boulevard area is needed for a
paramount use. This shall include, but not be limited to, the
installation of new or repair or replacement of existing

designating 'No Parking' from the months of April 1 to July 31
along the south side of 140th Lane NW and the west side of Yukon

This item was tabled from the July 19, 1994 meeting to allow
staff to redraft the resolution.

WHEREAS, the City Council is cognizant of the public nuisance,
traffic hazard, congestion; and
WHEREAS, the Council believes restricting the parking in
the area will be a solution to the problem.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover that those portions of 140th Lane NW and Yukon
Street NW be designated no parking from the months of April 1 to
July 31.
Adopted by the City Council of the City of Andover this 2nd

Woods.
The final plat is in compliance with the preliminary plat.
Drainage and utility easements will be reviewed prior to filing
of plat.
It is recommended that the plat be approved subject to the
following:
1. The City Attorney presenting a favorable title opinion.
2. Security to cover legal, engineering, street sign and
installation costs to be determined by the City Engineer.
3. The developer escrow for the uncompleted grading of the site
which is to be determined by the City Engineer or if the site
is completed, a letter from the developer's engineer that
lots and streets are graded according to the grading plan
submitted and approved or revisions thereof by the City.
4. The final plat not be signed by the Mayor and Clerk until
there is an executed Development Contract, escrow paid (15%
of the total costs for the improvements for the property
{streets, utilities, etc.}) and a contract for the
improvements awarded.
5. Street lights costs to be paid to Anoka Electric Cooperative.
Costs to be determined by Anoka Electric Cooperative.
6. Park dedication is to be cash in lieu of land.
7. Receipt of all necessary drainage and utility easements
outside the plat.
Note: City staff will be working with the developer to ensure
all the necessary drainage and utility easements have been
shown on the final plat. The variance was approved as
part of the preliminary plat.

WHEREAS, the City Council approved the preliminary plat of
Fox Woods ; and
IN SECTION
WHEREAS, the developer has presented the final plat of
Fox Woods
WHEREAS, the City Engineer has reviewed such plat for conformance
with the preliminary plat; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby approve the final plat of Fox Woods
contingent upon receipt of the following:
1. The City Attorney presents a favorable title opinion.
2. Security to cover legal, engineering, street sign and installation
costs as determined by the City Engineer.

3. Park dedication to be cash in lieu of land as determined by
Ordinance 10, Section 9.07.

allows the speed limit to be posted at 40 MPH along University
Avenue Extension from 157th Avenue NW and Constance Boulevard NW.
The speed limits are authorized contingent upon curves and
hazards being signed with the appropriate advance curve or
warning signs including appropriate speed advisory plates.
Warning signs and speed signs shall be in accordance with the
Minnesota Manual on Uniform Traffic Control Devices.
This is a joint speed limit with the City of Ham Lake.

(COUNTY ROAD 60).
WHEREAS, 40 MPH speed limit signs contingent upon curves and
hazards being signed in accordance with the Minnesota Manual on
Uniform Traffic Control Devices; and
WHEREAS, MNDOT has given authorization to lower the speed limit
to 40 MPH; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby approve the 40 MPH speed limit be posted along
University Avenue Extension between 157th Avenue NW and Constance
Boulevard NW (County Road 60).

appropriate signs designating the reasonable and safe speeds on University Avenue NW.

Erection of signs shall be in conformance with the 1991 Minnesota Manual on Uniform
Traffic Control Devices.
Note the contingency on the authorizations. This must be met before the regulatory speed

will not exceed the estimated assessment.

As part of the utility and street improvements, a pump has been
designed for a landlocked pond in the Hills of Bunker Lake 3rd
Addition. This developer, who is also the builder, has built
four (4) homes lower than the approved grading plan which has
required the City to pump periodically when we receive heavier
rainfall. If the homes were built according to the plan, there
would not be a problem. We recommend the developer pay for a
pumping facility.

Ashford Development Corporation, Inc. does hereby petition for
improvements by the construction of water main, sanitary sewer,
storm sewer and streets with concrete curb and gutter with the
costs of the improvement to be assessed against the benefiting
property which is described as:
CROWN POINTE EAST
Said petition is unanimous and the public hearing may be waived.
We request that a feasibility report be prepared as soon as
possible. We have enclosed a check for $1000.00 for the
feasibility report expenses.
(THE $1000 WILL BE CREDITED TOWARD 15% IMPROVEMENT ESCROW).

. 06-01-94 13800B Northwood Dr. N.W. Daytime. Suspect, believed to be a
construction worker who had previously done work at this residence, entered this
home through a porch window and stole a Honda motorcycle from out of the garage.
. 06-05-94 BOOB 161 Ave. N.W. Over the weekend. Suspect(s) cut a lock to enter
this pole barn. The motion alarm system inside of the barn was activated and scared
the suspect(s) away. Nothing appeared to have been taken.
. 06-05-94 13900B Ivywood St. N.W. Over the weekend. Suspect(s) entered this
open garage and stole a set of golf clubs.
. 06-06-94 3200B 139 Ave. N.W. Over the past month. Suspect(s) entered this open
garage and stole a mountain bike.
. 06-07-94 2300B South Coon Creek Dr. N.W. Daytime. Suspect(s) kicked in the
front door to this home and stole various high-tech sound/entertainment equipment, a
TV and VCR, and numerous jewelry items.
. 06-11-94 2700B South Coon Creek Dr. N.W. Over past couple of months.
Suspect(s) entered an unlocked fish house on this property and stole the ice fishing
equipment, propane heater, CD boombox and CD's, and TV from out of the fish
house.
. 06-14-94 2900B Bunker Lake Blvd. N.W. 2230 Hours. Alarm company reported a
burglar alarm at this school. Upon checking the interior of the building the deputy
heard a crash and observed a swinging door swing shut. A perimeter of the building
was established by officers and the interior was diligently checked. It was believed
that the intruder fled out an exterior door. Nothing appeared to have been taken.

toolbox containing assorted tools.

garage to this business by unknown means and removed a cellular phone from a
company vehicle.

parked on the driveway then activated the overhead garage door with the operator
from this vehicle. Once inside the garage, the suspect(s) entered a vehicle parked in

had moved out and is believed to have taken a TV with stand, a Super Nintendo
System, and a diamond ring.

rented a Sega Game from this business and failed to return the rented game. A
complaint for theft was issued to the suspect.

rented three VCR movies from this business and failed to return the rented movies. A
complaint for theft was issued to the suspect.

stereo.
. 06-11-94 2600B Bunker Lake Blvd. N.W. Overnight. This vehicle had been
borrowed by a friend of the owner and the vehicle was inadvertently towed away from
a private parking area. Upon retrieving the vehicle the owner had discovered that the
AM/FM Cassette stereo and cassette tapes had been stolen. It was unknown if the
theft occurred prior to the tow.

Dear Council Members:
The following is confirmation of engineering matters discussed and action taken at the Regular
Council Meeting and Public Hearing held Tuesday, July 19, 1994:
1. Project 94-17 - Quickstrom Addition, Comm. No. 10724
Mr. Davidson did present the feasibility report dated June 30,1994. Water service
extensions to Lots 1 - 10, Block 1 and Lots 1, Block 2, Quickstrom Addition will be
provided with Project 94-2 - Woodland Ponds 2nd Addition.
Council Action:
A cost deferred assessment and resolution was approved by the City Council to order the
improvement as presented.
2. Project 94.6 - Hartfiel's Estates, Comm. No. 10640
Mr. Davidson presented the results of a special meeting with the residents and developers
Gorham and Hartfiel.
The per unit estimated assessments were reduced from the original feasibility estimate of
$5,474.67 to $4,797.50/unit for street and storm sewer costs.
Lot 1 and 2, Block 3 Hartfiel's Addition owners were requesting only one unit of cost. The
Attorney indicated a protective covenant to restrict Linda Evan, owner from further
subdivision could be placed against the property. Ms. Evan indicated agreement.
Council Action:
Council approved proceeding with the project with the condition that prior to the
assessment hearing, Ms. Linda Evan sign a protective covenant to defme one unit (lot).
The Council passed the resolution to proceed with plans and specifications.

THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 8 is hereby amended as follows:
The District Zoning Map of the City of Andover shall be amended
as shown on the attached map, showing the following rezoning:
The property described as follows is rezoned from R-l, Single
Family Rural to R-4, Single Family Urban:
All that part of the Southeast Quarter of Section 26, Township
32, Range 24, lying easterly of the Great Northern Railway
Company right-of-way, Anoka County, Minnesota.
AND
/
That part of the south 689.24 feet as measured along the west
line thereof, of the Southwest Quarter of Section 25, Township
32, Range 24, Anoka County, Minnesota, lying westerly of the
centerline of prairie Road as now laid out and traveled.
Except that part described as follows:
That part of the south 340.00 feet, as measured at right angles,
of the Southwest Quarter of Section 25, Township 32, Range 24,
