Langfeld Addition Sketch Plan

I.
The City Council is requested to review the proposed sketch plan
of Langfeld Addition as requested by Willis Langfeld.
The Andover Review Committee (ARC) has reviewed the sketch plan
and their comments are as follows:
General Comments
* The proposed sketch plan is located in an R-1 Single Family
Zoning District with a minimum lot size of 108,900 square feet.
Six (6) lots are being proposed.
* All lots will front onto City streets except for Lot 1 which
will access 161st Avenue NW which is currently County state Aid
Highway 20.
* The two southerly proposed streets entering at 161st
Avenue NW may be creating a jog. This may be a concern
but the ARC members will continue working with the developer
and the Anoka County Highway Department on this matter.
* The ARC is recommending a street be constructed to the west
property line to allow for future development of adjoining
property. The Fire and Sheriff Departments are concerned with
the one access to the development. See Sketch A recommended by
the ARC. Sketch B is an option the City Council may also want
to consider.
* Outlot A is proposed to be landlocked. Ordinance 10 does not
allow remnant lots that do not meet the requirements.

* All lots will require to meet Ordinance 10, Section 9.06 a(3)
which relates to lot size requirements and buildable area. The
property is not located within the MUSA area. Therefore, the
lot shall be buildable which meets the 39,000 square foot
requirement.
* The Water Resource Management Plan which was recently updated
and approved by the Andover city Council, Coon Creek Watershed
District and the Lower Rum River WMO is to be implemented with
the development.
* The 100 year pond elevation based on ultimate development will
be required to be identified on the preliminary plat. In
addition, drainage and utility easements are required for the
100 year flood elevation.

* The developer and/or owner is responsible to obtain all
necessary permits (DNR, U.S. Army Corps of Engineers, Lower Rum
River WMO, LGU, MPCA and any other agency which may be
interested in the site). Initial contact should be made with
the City regarding this item.
* There may be wetlands within the plan that must be delineated
by agencies and indicated on the preliminary plat. The Local
Government unit is the Lower Rum River WMO. The developer
shall contact the Watershed to discuss the 1991 Wetland
Conservation Act that is in effect.
* The developer is responsible to meet City Ordinance 8 and 10
and all applicable ordinance.
Remember: This has not been studied by staff in detail as most
of the detail will be reviewed with the preliminary
plat.
Park and Recreation Commission Recommendation
The Commission is recommending cash in lieu of land as determined
from the February 17, 1994 regular meeting.
Planning and zoning Commission Recommendation
The Commission has reviewed the sketch plan submitted by Willis
Langfeld and is recommending Sketch Plan B be utilized.

REQUEST
The City Council at their February 15, 1994 meeting directed
Staff to prepare a list of the "Findings of Fact" on the rezoning
of Crown pointe and Crown pointe East. The motion to approve the
rezoning failed by a lack of a 4/5 majority vote. Attached for
Council review is the "Findings of Fact" as requested.

RESOLUTION NO.
Resolution Denying Application of Ashford Development Corporation
for Rezoning of Property for Crown Pointe and Crown Pointe East
BE IT RESOLVED BY THE CITY COUNCIL OF ANDOVER, MINNESOTA:
FINDINGS OF FACTS
1. That the City has received an application for the re~oning of property
known as Crown Pointe and Crown Pointe East from Single Family
Rural (R.11 to Single Family Urban (R.41.
2.
The property is currently zoned Single Family Rural (R-1). That the
Andover Comprehensive Plan in Chapter I, Comprehensive Planning,
discusses the variety of growth related challenges the City must
consider, Included in these challenges are the effects on increased
population on the educational system to serve Andover's residents.
3.
That the City Council has been advised by the school district that
there is currently severe crowding and lack of classroom space and
that it may be necessary to implement a number of changes in the
school year or classroom schedules to accommodate students. That
in the alternative it may be necessary, if approved by school district
voters, to construct new schools. That such schools would not be
available for at least several years if such bond issues were approved.
That there would be an adverse impact on the educational oppor-
tunities available to Andover residents by the increased urban density
that would exist by the approval of the rezoning of Crown Pointe and
Crown Pointe East. That due to the impact the rezoning of additional
land to urban density would have on public facilities (school) with the
current supply of land zoned for urban growth (R-41, rezoning the
property cannot be justified at this time.
4. That the property owners are not denied reasonable use of their
property by having it remain in the R-1 zoning classification,
CONCLUSIONS
1.
The City Council of the City of Andover concludes that the current
zoning of the property as R-1 Is appropriate to protect the health,
safety and welfare of the community, and that there Is no reason to

change the current zoning.
2.
The City Council concludes that the application for rezoning should be
denied.

3. It is the understanding of the City Council through a letter to the Council
and through school district publications, that there is currently severe
crowding in certain areas of the district, the Andover area being one such
area. The Council also understands it may be necessary to implement a
number of changes in t~e school year or classroom schedules to accommodate
the increasing numbers of students which have moved into the Andover
area due to rapid urban development. The school district has indicated that if
approved by district voters, they will construct new schools to meet the
increased need, but that such schools would not be available for at least two
years following approval of such a bond issue for construction of these
facilities.
Because of this overcrowding there will be an adverse impact on the
educational opportunities available to Andover students by the increased
urban density which would exist by the premature approval of the rezoning
of Crown Pointe and Crown Pointe East at this time. The impact of rezoning
additional land to urban density at this time, .would have a negative impact
on public facilities (schools). The current supply of land zoned for urban
growth (R-4) in other sections of Andover is adequate for anticipated growth
in 1994.
4. That the property owners are not denied reasonable use of their property by
having it remain in the R-1 zoning classification through 1994. The property
is designated in the Comprehensive Plan for rezoning in the 199J-1995 time
period, and delaying the rezoning until 1995 for the reasons stateclabove ,
would still be within the Comprehensive Plan guidelines.
CONCLUSIONS
1. The City Council of the City of Andover concludes that the current zoning
of the property is appropriate at this time to protect the health. safety and
welfare of the community, and that within the guidelines of the
Comprehensive Plan, approved by the Metropolitan Council, the Plan does
allow for consideration of rezoning up to and including 1995, without
violating the intent and spirit of the plan. Because of these reasons so stated,
the Council finds no compelling reason to ch!lnge the current zoning this
year and therefore concludes the application for rezoning should be denied.

A RESOLUTION APPROVING THE 1994 COMMUNITY DEVELOPMENT BLOCK
GRANT BUDGET TO BE USED TO CONDUCT PROJECTS WITHIN THE CITY OF
ANDOVER FOR THE BETTERMENT OF ANDOVER RESIDENTS
WHEREAS, the City Council recognizes the need to use
Community Development Block Grant funds for the betterment of
Andover residents; and
WHEREAS, the County of Anoka makes said funds available to
the City through the Department of Housing and Urban Development
following guidelines e$tablished for the use of Community
Development Block Grant funds; and

WHEREAS, the City will receive funds distributed by Anoka
County to conduct projects for the residents of the City for the
1993 fiscal year; and
WHEREAS, a public hearing notice was published in the
Anoka Union indicating a translation service would be provided as
deemed necessary; and
WHEREAS, a public hearing was held and there was no
opposition to the proposed 1994 projects and Budget.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby approves the 1994 Community
Development Block Grant Projects and Budget.

PRELIMINARY PROJECT REQUEST
Anoka County Community Development Block Grant - 1994
I. PROJECT NAME
Andover Comprehensive Planning
II. PROJECT ACTIVITY
The proposed project is the continuation of the 1989
CDBG Program and will update and improve long range
planning efforts within the City. The current Andover
Comprehensive Plan was completed in 1980 and approved
in 1982. It addresses few if any housing, (low and
moderate income) issues. Because of the rapid growth
experienced by Andover, the Comprehensive Plan should
address public services and facilities. Administrative
costs will be included in this project.

All residents of the City of Andover will benefit from
the update and improvement of the City's Comprehensive
Plan. As the City continues to grow, residents will be
better served if the City has long range goals and
plans with which to guide development.

IV. PROJECT DURATION

The Comprehensive plan was projected to take three
years to update, including plan preparation, public
input, City approval, Metropolitan Council approval and
publication. However, with recent difficulties
encountered receiving Met Council approval the project
will need to be continued. The City Comprehensive Plan
will guide development and City improvement for the
next five to seven years and if implemented properly,
into the next century.
V. This project would address the problems of housing,
sewer and water capacity planning, parks end
recreation, public facility development, commercial
development and other development and growth issues.
VI. The Andover City Council proposes to use $20,000 in
1994 for the continuation of the task of ~pdating the
Comprehensive plan. Total dollars spent will depend
upon the resources needed to resolve the issues imposed
upon the City by Met Council.

impossible to determine at this time the number of
households that will be served by this project.

improve long range planning efforts within the City,
all residents will benefit from a better living
environment.

Anoka County Community Development Slock Grant - 1994
I. PROJECT NAME
Andover Public Service Assistance Program
II. PROJECT ACTIVITY
The proposed project will continue as it did in 1993 to
assist several local public service programs that serve
low and moderate income families or individuals. The
City will designate a portion of the CDSG funds for
programs that meet CDBG criteria. An application
procedure, approved by Anoka County, will be used to
determine which programs receive funding. The
application will be similar to the one used in 1993.
All public service programs must serve low and moderate
income individuals. Administrative costs will be
included in this project.

IV. PROJECT DURATION
This will be an on-going project. The Andover City
Council believes that programs that serve low to
moderate income families/individuals should receive
some level of funding from the CDSG funds annually.
V. This project would address the problems of services for
senior citizens, handicapped individuals and services
for the homeless.
VI. The Andover City Council proposes to use at least
$30,050 in 1994 for public service programming. Total
dollars spent will depend upon the number and amount of
the requests received by the city.

VIII. Because this project will be a City-wide effort, it is
difficult to determine at this time the exact number of
households that will be incorporated into this project.
The actual figures will be determined once awards have
been made and reports from subrecipients have been
received. It is expected, as in past years, that a
number of Andover and area households being affected.
IX. Andover believes that its financial involvement in
public service program funding is vital to the growth
of services required for a growing community. Andover
recognizes the need for programs that serve both local
and regional clientele and this effort is part of the
overall effort to fund public service programs
throughout the Twin Cities metropolitan area.

Andover Neighborhood Revitalization
II. PROJECT ACTIVITY

The proposed project is an on-going continuation of the
City'S effort to clean up blighted properties. The
project will include the identification of blighted
properties, the acquisition of the properties, possibly
the demolition/removal of blighted and/or substandard
structures and the resale of the property for new, more
energy efficient single family homes or commercial
properties. Administrative costs will be included in
this project.
The total number of persons receiving benefit from
this project is unknown at this time. These figures
will be determined by the number of blighted properties
identified and cleaned. Neighbors living in close
proximity to the proposed acquisition sites will
benefit from the removal of substandard and blighted
structures and from the clean up of the surrounding
neighborhood.

IV. PROJECT DURATION
This is an on-going project in the City of Andover.
The identification, acquisition and demolition/removal
will continue through the duration of the project. The
City will evaluate the project in the near future to
determine the program's effectiveness and if the
program will continue.
V. This project would address the problems of neighborhood
blight, substandard housing and energy efficient
housing.
VI. The funding for the Andover revitalization project
will come from the project income from the sale of lots
acquired in the past. The City is also requesting
$5,000 be allocated toward the project for the 1994
fiscal year.

VII. The cost of acquisition of the property and/or
demolition of the blighted structures will be
determined with the appraised value of the properties
and agreed purchase prices.

The money for this infield groomer for ball diamonds is in the Capital Equipment Bond for 1994, We looked at
other units, but they did not have the usage value of this unit. Eighty percent of the time, this unit would be
working at the City Park complexes grooming and filling holes and uneven surfaces, A utility box on the Cushman
Truckster will allow material to be dumped and leveled in the same operation, It also has an underbody blade,
30-tooth scarifier blade and a broom to leave a fine finished surface, All stripping materials, racks, shovels, and
I etc, can be carried in the utility box, thereby eliminating the need for any City truck to be stationed at the City Park
Complex, This will enable us to have all mowers, etc, working in the outer park areas,

project. We are currently reviewing the hydrologic calculations
and will have a drainage/erosion control plan to you this week.
Also, you requested an estimate for preparing a bid schedule and

Design and provide Construction Documents and Construction Administration for the installation
of Lighting Systems for three softball and one soccer fields located at the City Hall Park
Complex.
II. SERVICES TO BE PROVIDED BY TKDA
A. Design lighting systems for four athletic fields to meet IES recommendations for softball
and soccer.
B. Prepare complete Construction Documents and a Cost Estimate for the Project. The
documents to allow for a deduct alternate bids to omit two fields.
C. Assist the City during the Bidding Process.
D. Provide Construction Administration during the construction period. On-site observation
will be limited to one visit during construction and one at the completion of
construction.

III.
OWNER'S RESPONSffiILITIES
A. Provide TKDA with a copy of all available documentation of the existing buildings and
site.
B. Designate City Staff to meet with TKDA to review the system design.
C. Review final designs and approve.
IV. COMPENSATION
Compensation for the services described herein shall be computed in accordance with the
provisions of Article 3 of the January 5, 1988 Agreement, subject to the following additional
conditions:
A. For the services defined in Section II of this Authorization for Professional Services,
the total amount to be paid by the OWNER to TKDA shall be based on an Hourly Rate basis
with a fee not to exceed $6,000. In delivering these services, we will not provide
services or incur costs which will result in charges in excess of $6,000 without further
authorization.

A HISTORY, PURPOSE AND SUMMARY OF H.F. #1757
Because tourism, specifically trail use is essential to the economic well-being of the State
of Minnesota; several community, business, governmental, tourism and trail user
organizations are working together to insure the continued use of state-wide, multi-use
trails and trail systems through the introduction of new legislation.
This proposed legislation H.F. #1757 brings Minnesota law in line with the vast majority
of states in the snowbelt, particularly those who depend on outdoor recreation for
significant economic development.
In essence, H.F. #1757 would limit liability of private landowners who without charge allow
recreational use of their property. Currently, Minnesota law discourages these same
landowners from opening-up or continuing recreational use of their land for uses such
as snowmobiling, hiking, skiing, horseback riding, bicycling, etc...
State and local governments and for-profit enterprises alone can not provide adequate
outdoor recreational opportunities for the public. Free use of private land has helped to
fill the gap.
H.F. #1757 addresses and corrects this issue. It limits liability to conduct intended to
cause injury, and it requires that the landowner grant in writing an easement or other
property right before any such property right may be inferred from letting others use the
land for recreational purposes. H.F. #1757 also provides for costs and attorney's fees to
be awarded to the landowner if any frivolous lawsuit is brought against the landowner.
H.F. #1757 is authored by Representative Mary Jo McGuire in the House of
Representatives. Similar legislation will soon be introduced in the Senate. The following

12 Sec. 1. Minnesota Statutes 1992, Section 87.021, is amended to add a new subdivision
13 to read:

16 cause the result specified or believes that the 'lct performed bv the actor. if successful. will
17 cause that result.

21 87.0221 OWNER'S DUTY OF CARE OR DUTY TO GIVE WARNINGS
22 Except as specificaliy recognized by or provided in section 87.025, an owner (a) owes
23 no duty of care to render or maintain the land safe for entry or use by other persons for
24 ' recreational purposes, (b) owes no duty to warn those persons of any dangerous condition on
25 the land, whether patent or latent, (c) owes no duty of care toward those persons except to
26 refrain from intentionally causing willfully taking aetian ta cause injury, and (d) owes no
27 duty to curtail use of the land during its use for recreational purposes.

30 Sec. 3. Minnesota Statutes 1992, Section 87.024, is amended to read:

33 Unless otherwise agreed in writing, the provisions of sections 87.0221 and 87.023~'~g
34 shall be deemed applicable to the duties and liability of an owner of the following .,."
35 described land: (1) land leased to the state or any subdivision thereof for recreational
36 purposes; or (2) idled or abandoned, water filled, mine pits whose pit walls may slump or
37 cave, and to which water the public has access from a water access site operated by a public

recreational purpose shall take effect in consequences of the exercise of such use for any
length of time hereafter except as expressly permitted or provided in writing by the owner
nor shall the grant of oermission for such use bv such owner grant to any oerson an
easement or other orooertv right in the land exceot as exoresslv orovided in writing bv the
owner.
Sec. 6. [87.041J
PROTECTION FROM NUISANCE LAWSUITS.
If any oerson brings a claim against an owner in state or federal court for iniuries
arising from the recreational use of land and the court determines that the owner is immune
from Iiabilitv under this chaoter. the court in its discretion may award such owner its costs.

such claim.

liability of private landowners who, without charge, allow
recreational use of their property and will be introduced in the
1994 legislative session as H.F. 1757; and
WHEREAS, H.F. 1757 would bring Minnesota more in line with
at least 30 other states which have recreational use status.
NOW, THEREFORE BE IT RESOLVED by the City Council of the
City of Andover that recreational use of private lands and waters
is important to the economic well being of the Andover area and
that we do hereby support H.F. 1757 which increases protection of
landowners who without charge allow public recreational use of
their lands.

Establishment of an Economic Development Authority
We have been working with City staff regarding the potential
acquisition of the WasteCo Site which is currently a subject of a
Request For Proposals. Over the last seven years the City has
been involved in several development projects, but no project has
approached the size or complexity that is being contemplated with
the WastCo Site development.
It is particularly appropriate at this time that the City
consider establishing an Economic Development Authority ("EDA").
The EDA is a legal entity that is separate from the City itself.
It has a Board of Commissioners, which can be the City Council
Members, and a President, which can be the Mayor. Because the
EDA is a separate entity, it has a separate legal structure and
would help insulate the City in event of litigation.
Furthermore, because of the many environmental concerns in any
land development, it would be prudent for the City to avoid
taking title to land and thus avoiding the problems of becoming a
responsible party under Minnesota Statutes.
Economic Development Authorities are the most recent of the
various Authorities developed by the Minnesota Legislature to
deal with development, redevelopment and housing problems. As a
result, the statutory authority for an EDA contains the broadest
powers and incorporates by reference, housing and redevelopment
authority and development district powers. As a result, it
allows very creative development financing as well as equity and
other participation arrangements in the development. The EDA
does not have to use any of these powers, but if an occasion did
arise which necessitated their use, the EDA would be in place.

An EDA tends to bring budgetary discipline to the development
process since its funds need to be accounted for separately. In
addition, the EDA would adopt an annual budget and its finances
would be audited, along with the City finances, on an annual
basis.
To date, the City has operated its project area and its tax
increment districts under development district powers. Attached
is a six page comparison of the three most commonly used local
economic development structures. The column labelled "City" is
the development district. We would be happy to review these
powers with the Council.
It generally takes about thirty days to establish an EDA.
Several issues need to be discussed before an EDA is authorized
or established. Some issues, such as the number of
Commissioners, are easily resolved. Other issues involving the
transfer of your existing tax increment districts to the EDA
merit additional discussion.
In short, many cities who are proactive in development have found
it very useful to establish an EDA. In the past year we have
established EDAs in New Brighton, Alexandria and Zimmerman,
Minnesota. In Alexandria and Zimmerman, it was for much the same
reasons that we are suggesting Andover establish an EDA. Both of
those cities are in the process of or have purchased substantial
tracts of land for additional development. We would be happy to
meet with the Council and discuss these options with you. We

Dear Mr. Suelander:
This letter reports on my visit and subsequent workers' compensa-
tion safety survey of selected portions of your city's facilities
on January 25, 1994. The body of this report outlines specific
and potentially hazardous conditions I noted during the survey
and my recommendations for their abatement.
General City Recommendations
During a close inspection of your current right-to-know material
safety data sheet binders, it was apparent to me that gasoline,
diesel fuel and kerosene were not included in the material safety
data sheets. I recommend that your staff locate and include the
above mentioned items in your material safety data sheet binders.
City Garage
Sawina Area
I noted that the table saw located in the sawing area was not
equipped with a magnetic power interrupter. On woodworking
equipment where injury to the operator might result if motors
were to restart after power failures, OSHA requires positive
means to prevent the machine from restarting. A magnetic power
interrupter switch would provide this protection.

I noted at the time of my survey that the tool rest and tongue
guard were out of adjustment. I recommend that your staff adjust
the tool rest to within liB-inch of the grinding wheel surface
and the tongue guard to within l/4-inch.
Fire Station #3
I noted that gasoline was stored in non-approved flammable liq-
uids containers. You should provide an approved gasoline safety
can with a flash arrester. A flash arrester will not allow
ignited vapors to reach the inside of the gasoline can. I rec-
ommend that you store and dispense gasoline and other flammable
liquids from approved flammable liquids containers.
Well House #1
The well pump located within this building had its drive shaft
exposed. I recommend that your staff install a guard so that
individuals cannot come in contact with the rotating shaft.
I noted that hazardous substances were used in the pump house.
You must mark these hazardous substance containers with the name
of the substance, the appropriate hazard warnings and the name
and address of the chemical manufacturer or responsible party.
Also, your must post the material safety data sheets inside the
well houses for the chemicals used within.

with the maintenance of lighting systems, attention is called to
the desirability of having available in the factory an
instrument with which the footcandles of illumination received
at any point can be measured. One instrument, the footcandle
meter, while not designed for precise measurement, has a wide
field of usefulness because, with a little practice,
determinations are easily made and are accurate enough for most
practical purposes. The footcandle meter is small, light in
weight, and entirely self-contained. Illumination is read
directly from the scale without computation or manipulation.
By measuring light actually delivered to the work, the
footcandle meter automatically reveals the combined effect of
all possible causes of deterioration. Ignorance of the
magnitude of deterioration has often been the cause of
inadequate maintenance.

VENTILATION FOR GARAGES
5205.0200 GARAGE VENTILATION.
Subpart 1. Scope. Ventilation shall be provided for all
repair garages, service stations, body shops, and all live
storage garages, housing six or more vehicles driven by internal
combustion engines. A live storage area is any area within a
building used for the storage of fire trucks, tractors,
automobiles, trucks, and other self-propelled vehicles driven in
and out under their own power.
Subp. 2. Size of general ventilation system. The
ventilation system shall be capable of removing a volume of air
not less than three-fourths cubic foot per minute per square
foot of floor area in garages and not less than one-half cubic
foot per minute per square foot of floor area in service
stations. Exhaust ducts shall not be more than 18 inches from
the floor, so placed as to remove carbon monoxide gas from the
entire garage. An equal amount of tempered fresh supply air
shall be provided.
Subp. 3. Size of vehicle exhaust pipe ventilation system.
In addition to general ventilation requirements, exhaust gases
from the internal combustion engines being tested shall be
discharged to the outdoors through a duct or flexible hose of
noncombustible material of suitable size attached as an
extension to the exhaust pipe. Repair stalls may be located
adjacent to an outside wall so that ten feet or less of
extension duct will reach the outdoors through openings not more

than one foot above floor level. If repair stalls are not so
located, each stall shall be provided with a suitable exhaust
extension duct or flexible hose that is or can be connected to a
mechanical exhaust system and to the exhaust pipe of the

As a resident having property adjoining Coon Creek, you probably
enjoy the natural beauty along the Creek. I'm sure you realize
that it takes upkeep to retain beauty. However, you may not be
aware of the Coon Creek Watershed District and the responsibility
of the Watershed District to keep the Creek in the condition
needed to convey the flow of water through the area.
The water flow in the Creek is being slowed because of
approximately 3 feet of sediment within the creek's channel. The
Watershed District needs to correct this problem to prevent
flooding up stream and on the tributaries to the Creek. The
desired timing of this work would during March and April.
The area of concern is along Coon Creek from South Coon Creek
Drive to Crosstown Bld.
The Watershed District needs your cooperation in this important
project. The Coon Creek cleaning will involve a crew working for
the District. In order to reach the Creek easement and get the
job done, these workers may need to access your property. The
work will involve the use of a tractor backhoe andchainsaws.
You can help this project to be a success by assisting in the
following ways:
1. Read the fact sheet on the other side of this letter.
2. Attend the Open House on March 15 at 7:30PM at Andover
Elementary School cafeteria.
3. Advise me of any particular situation about the Creek
near your property.
4. Move any lawn furniture or other personal
property away from the Creek.
5. Keep children away from equipment and crews working in
the area.
NOTE: The cost of this project will be paid from District wide

CLEANING OF COON CREEK
Q. When is their Public Contact?
A. The Open House on March 15 at 7:30PM at Andover
Elementary School cafeteria will provide an opportunity to
hear a full explanation of the need for the project, the
alternatives looked at and ask questions and give input into
coordinating the work.
Q. Why is this project necessary?
A. Ditch 57 - the technical name for Coon Creek in Andover
was constructed in 1917 to provide for agricultural
drainage. Since then, Andover has experienced considerable
growth, and the ditch now conveys stormwater, in addition to
agricultural drainage, from as far away as the Columbus
Township and Carlos Avery Wildlife Management Area. This
drainage area is relatively flat and hence small
obstructions can create big problems upstream by blocking or
slowing the flow of water. The District has received
several complaints from farmers upstream from the area
concerning wetness in their fields.
In 1987 the District surveyed the streambed, and compared
the survey results to the plans for ditch 57. The survey
results showed that there has been an accumulation of
approximately 3 feet of sediment in this area. The need and
the goal of the proposed project is to remove the sediment
in order to reduce the flooding that is occurring upstream.
When this cleaning project is completed the chance of
flooding will be decreased, as well as increasing the
efficiency of the ditch to convey storm water run-off.
Q. What exactly will be done on this project?
A. A contractor working for the Coon Creek Watershed
District will excavate the channel using a backhoe to remove
woody debris, sandbars and sediment from the creek.
Q. What types of situation merit informing the Watershed
District about my property? '
A. Please call the Coon Creek Watershed District at
755-0975 and come to the Open House if you have prize bushes
and trees near the Creek or pumps or drains (for lawn
sprinkler system, for example) near the Creek. This
information will be noted for crews working in the area.

A briefreview of the Feasibility Report dated May 7,1991, "Hartfiel's Estates, City

Property owners in attendance are as shown on the sheet attached. Those interested in the
project for purposes of an updated feasibility report and future public hearing were asked
to sign a petition made available at the end of the meeting.

Mr. Davidson gave a brief overview of the area being considered between
Hanson Boulevard on the east, Jay Street on the west, Commercial Boulevard
on the south, and Bunker Lake Boulevard on the north, The area is part of the
Tax Increment Financing District (TIP).
~. Tom Syfko presented a sketch plan and concept,of service to the area. He
had met with several of the owners of property within the area and found
general approval of the concepts.
Council Action
After detailed discussion, the Council authorized the staff to prepare a feasibility
report using the concepts as presented.
B. Grading of Residential Developments
City staff presented a revision to development policy intended to control general
site grading.
Council Action
The Council directed that the item be placed on the agenda for the March 15,
1994 meeting.

Citizens from Andover attending a parent meeting at Andover Elementary School
addressed proposed changes In the land use plan nOW being considered by the City
of Andover. Specifically they expressed concern with the decrease in building lot
sIzeS and the increase in \he number of housing unils proposed lor the Crown point
Addition. Crown Point East Addition, and the Hills of Bunker Fifth Addition. They are
concemed with the ability of the schools to house additional students resulting from
the proposed change to these sub dMsions and the attendant boundary changeS
associated with this unanticipated growth.

The Anoka-Hennepin Schools recently proposed a bond issue for the construction of
new schoOls to accommodate expanding student populations. The defeat of the bond
issue has led to the establishment of a public Task Force to consider alternative
schedules and calendars as a means of eccommodating the addmonal students. The
Task Force may consider another bond issue; however, their full charge centers on
cons;dering the imptications of calendar changes such as the year round schools. spl"
shifts, and alternative uses of existing building spaces. Their work is considered long-
term and to be in place no earlier than the fall of 1995.
We are asking the city council to consider the following when reviewing the decisicr. ~v
decrease the lot sizes and Increase the number of dwellings for the sub divisions~
1. The schools ,ser/lng the existing student population of Andover are basically all at
oapaclty. Space thai we could oreate for 1994--95 was committed to the increased
number of students we expected from sub divisions in Andover prior to the
proposed increase in the number of homes expected from these sub divisions.
2. There are a host of issues that the citY and the schOol district need to consider at
this time of expanded growth and we are anxious to wor1<. together with the city to
find solutions.

been determined and may indeed be well outside the city of Andover.
