Woodland Meadows street Lights
I.
The City Council is requested to continue the public hearing for
project 93-8, Woodland Meadows street lighting.
The City Council tabled the the public hearing from the January
18, 1994 meeting to allow the Assistant City Engineer to
recalculate the street lighting costs for what is
administratively called the southern half.
Recommendation of Staff
It is recommended to close the public hearing and approve the
resolution which abandons the project for the entire area and
reschedule a public hearing for February 15, 1994 for the south
half only.
We are recommending to reschedule the public hearing for the
south half due to the recalculation of the street lighting costs.
The cost per quarter went from $25.79 to $29.52 which is a 14%
increase. The City Council allowed a 10% increase.

A RESOLUTION ABANDONING THE IMPROVEMENT OF STREET LIGHTING
PROJECT NO. 93-8, IN THE WOODLAND MEADOWS AREA.
WHEREAS, pursuant to the required published and mailed notice,
such hearing was held on the 18th day of January, 1994; and
WHEREAS, all persons desiring to be heard were given such
opportunity for same; and
WHEREAS, the majority of the people opposed the improvement on the
north end and the street costs increased by 10% on the south end.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover that the Council hereby determines not to undertake the
improvement proposed in the Council Resolution No. 269-93 adopted
November 11 , 19 93 for the north half and reschedule a public
hearing for February-rS , 19~ for the south half.

agreement for compensation analyses and personnel services with
Labor Relations Associates, Inc.
BACKGROUND
Labor Relations Associates, Inc. has provided the City of Andover
with professional personnel consultation services for several
years. This agreement will provide continuing pay equity analyses
and personnel support services.
Mr. Cy Smythe, from Labor Relations Associates, Inc. will be
present to answer any questions.

AGREEMENT BETWEEN
METROPOLITAN AREA MANAGEMENT ASSOCIATION (MAMA)
ON BEHALF OF METROPOLITAN AREA AND
GREATER MINNESOTA CITIES SUBSCRIBERS AND
LABOR RELATIONS ASSOCIATES, INC. (LRA)
A. PURPOSE OF AGREEMENT
The purpose of this AGREEMENT is to provide for labor relations services,
employee compensation analyses and personnel services to subscriber Twin Cities
Metropolitan Area and Greater Minnesota Cities and remuneration for such services
as outlined below.
B. SERVICES TO BE PROVIDED
1. For Cities in the Twin Cities MetroDolitan Area
Labor Relations Associates, Inc. - Principals and Associates - will not charge
\ individual subscriber cities for the services outlined as follows:

a. A Principal of LRA will participate with subscriber cities in any joint
negotiations and/or mediation involving two or more subscribers and a
common union representing similar bargaining units when the cities
choose to bargain jointly.
b. A Principal of LRA will consult with subscriber cities' elected and/or
appointed officials by telephone, letter, FAX, or in person with regard to
their individual labor relations, employee compensation, and personnel
matters.
c.
LRA Principals will provide subscribers with data maintained by LRA and
as provided for by this AGREEMENT, make recommendations as to
commonly used language to be placed in Labor Agreements, make
recommendations for initial City response to grievances filed by employee
organizations, make recommendations regarding individual arbitrators in
interest and/or grievance arbitration cases, provide recommendations
with regard to the general content of a subscriber's personnel policies
and practices, provide initial recommendations regarding responses to
State administrative agencies involving such issues as Workers'
Compensation, Unemployment Compensation, Veterans' Preference,
Equal Employment Opportunity/Human Rights, and Affirmative Action,

and make initial recommendations as to appropriate disciplinary action on
a case-by-case basis consistent with the requirements of "just cause" or
the criteria specified by State Veterans' Preference legislation.
d.
LRA Principals will assist subscribers with their preparation of wage and
fringe benefit data, provide analyses of interest and grievance arbitration
awards involving subscribers individually or collectively, and provide
representation in individual subscriber collective bargaining and/or
mediation provided the issue(s) involved have potential pattern-setting
impact on the bargaining efforts of other subscriber cities.

A Principal of LRA will provide advice to assist subscribers in their efforts
to comply with the requirements established by the State of Minnesota
Local Government Pay Equity Act (LGPEA), Minn. Stat. Chapter 471 as
administered by the Minnesota Department of Employee Relations
(DOER).
f.
A Principal of LRA will provide general advice to assist individual
subscribers with their preparation of reports or analyses required by
DOER or the Minnesota Department of Human Rights (DHR) under the
provisions of the LGPEA.
g.
A Principal of LRA will provide general advice to assist individual
subscribers with their preparation of any appeals of findings by DOER or
DHR under the provisions of the LGPEA.
h. LRA will serve as liaison to various municipal officials' groups as directed
by MAMA.
i. LRA will maintain a data base to include current information for the job
classifications of police officer, firefighter, police sergeant (or equivalent),
and public works maintenance person (or equivalent). The data base will
include Stanton Group V and VI Cities with the following information:
. Compensation (wage rates, longevity pay, performance pay, lump
sum payments and salary steps);
. Level of City insurance contributions for Health and Life with
reference to Dental and Long Term Disability if applicable;
. Uniform allowance;
. Educational incentive;

. Vacation accrual;
. Overtime pay;
. Court time compensation;
. Call back pay;
. Standby time;
. Wage differentials (shift or assignment);
. Severance pay;
. Holidays;
. Injury on duty;
. Compensatory time;
. Sick leave;
. Work/Shift Schedules; and
. Subscriber City Labor Agreements

j. LRA will provide subscribers with information regarding significant labor
relations and/or personnel items on a quarterly basis.
In the performance of these duties LRA personnel will:

Respond to telephone, letter or FAX inquiries from subscribers;
.
Agree not to represent any labor organization during the contract
period;
.
Maintain normal working hours;
.
Maintain telephone and FAX facilities in the LRA offices; and
.
Submit written monthly reports of services provided to
subscribers.

2. For Greater Minnesota Cities
LRA personnel- Principals and Associates - will not charge individual subscriber
cities for services outlined as follows:
a. A Principal of LRA will consult with the individual subscriber cities'
elected and/or appointed officials by telephone, letter, FAX or in person
in LRA offices with regard to their individual labor relations, comparable
worth (Pay Equity) or personnel matters.
b. LRA will provide current compensation (wage, longevity, performance
pay) data for Greater Minnesota Cities with a population of 2,000 or
more for the police officer and firefighter job classifications.
c. A Principal of LRA will provide general advice to assist individual
subscribers with their preparation of reports or analyses required by the
Minnesota Department of Employee Relations (DOER) or the Minnesota
Department of Human Rights (DHR) under the provisions of the State of
Minnesota Local Government Pay Equity Act (LGPEA).
d. A Principal of LRA will provide general advice to assist individual
subscribers with their preparation of any appeals of findings by DOER or
DHR under the provisions of the LGPEA.

LRA will provide individual subscribers with one comparable worth (for
LGPEA compliance) scattergram analysis each calendar year based on
data provided to LRA by the subscriber.
C. EDUCATION: METROPOLITAN AND GREATER MINNESOTA CITIES
1. LRA personnel - Principals and Associates - will provide for all interested cities,
regional training opportunities dealing with supervisory issues, labor relations
issues and issues pertaining to State and Federal legislation.
We suggest that MAMA and the Greater Minnesota Cities establish an
Education Committee which will provide input and approval relating to content
and location of a yearly training program developed in concert with LRA.
Commencing in 1992, it would be the intent of LRA to provide reasonably
priced training opportunities at convenient locations throughout the State to
enhance the skills of City personnel in such areas as contract administration,
grievance handling, discipline, reinforcement and performance appraisal, and
other subjects as directed by the committee. We see this expanded effort as

integral in developing a consistent professional approach by City personnel to
the burdens we continue to face from labor unions and the dictates of State
and Federal legislation.
2.
LRA will provide recommendations for educational programs for persons
assigned, by the subscribers, the responsibility of handling labor relations and
personnel matters.
D.
GENERAL PROVISIONS
1.
Consultant Facilities and Services
In providing the above-stated services, LRA will maintain telephone and FAX
services in LRA offices and respond to inquiries from subscribers within three (3)
working days. LRA will also maintain the capacity to provide additional labor relations,
comparable worth (Pay Equity) and personnel services to individual subscribers either
directly or through subcontractors acceptable to LRA.
2. Consultant Remuneration
LRA will be remunerated for the services outlined above through the payment
of:

a. A fixed monthly retainer fee: and
b. A fee based on hours worked by LRA Principals and/or Associates.
c. Work performed by LRA personnel for subscribers in addition to the
services provided for above will be billed at an hourly rate agreed to by
MAMA, Greater Minnesota Cities Labor Relations Committee, and Labor
Relations Associates, Inc. in addition to reimbursement for any direct
expenses incurred by LRA.
Items (a) and (b) above are subject to an upper dollar remuneration limit each
contract year period. Any monies not expended in a contract year will be carried over
and be available for payment in following years. Item (c) above pertains to LRA
billings to individual subscribers.
The dollar amounts to be shown in (a), (b) and (c) will be set each year of the
AGREEMENT based on discussions between MAMA, Greater Minnesota Cities Labor
Relations Committee and LRA.

3. Duration and Cancellation

This AGREEMENT shall be effective March 15, 1994 and continue in full force
and effect until March 14, 1997. This AGREEMENT is subject to termination by either
party with the provision of ninety (90) days' notice.
4. Exclusivity of Reoresentation
LRA Principals and Associates agree that they will not, during the term of this
AGREEMENT, represent any employee organization. Nor will LRA Principals and
Associates represent any employee organization for a period of two (2) years after the
termination of this AGREEMENT if the AGREEMENT is terminated by Labor Relations
Associates, Inc.

REQUEST
The Andover City Council is asked to review and approve the
request of the City of Andover to rezone from R-4, Single Family
Urban and LB, Limited Business to GB, General Business the
property legally described on the attached amendment to the Zoning
Ordinance.
RECOMMENDATION
The Planning and zoning Commission tabled the item at their
December 14, 1993 meeting, pending further information from the
DNR, Coon Creek Watershed District and Staff.
The Planning and zoning Commission, at their January 11, 1994
meeting, made the motion to recommend to the City Council
approval of the rezoning. Attached are the minutes and staff
report for Council review.
Attached is an amendment to Section 6.03, District zoning Map for
Council review and approval.

8:22 p.m. Mr. Carlberg briefly reviewed the request to rezone property
from R-4, Single Family Urban, and LB, Limited Business, to GB, General
Business. That property is generally located south of the Waste
Disposal Engineering site, west of Hanson Boulevard NW, north of Bunker
Lake Boulevard NW and east of Red Oaks Manor 4th and 6th Additions. At
the December 14, 1993, meeting, Staff was directed to contact the DNR
and Coon Creek Watershed District to determine why they objected to the
rezoning. Letters have been received from both agencies explaining they
have no objection to the rezonings. Also, Mr. Haas has prepared a memo
addressing the storm water issue in the area. Mr. Carlberg continued,
the Staff is recommending that entire area be zoned as one district to
allow the greatest flexibility of uses for a commercial park and to have
large commercial lots to develop.
The Commission discussion was that there is only a small area zoned LB,
that it would not be good planning to sandwich an R-4 residential
housing zone between the commercial parcels, that it is in the City's
best interest to provide a uniform zone for that entire area, and that
the proposed Comprehensive Plan calls for this area to be zoned
commercial. Mr. Carlberg reviewed the ordinances which requires
( . screening between the GB and residential areas and the protection of the
,wetlands. He also noted that the ordinances do not allow any new auto
I recycling businesses in the City.
MOTION by Apel, Seconded by Jovanovich, to close the public hearing.
Motion carried on a 6-Yes, 1-Absent (Pease) vote.
MOTION by Peek, Seconded by Jovanovich, that the Andover Planning and
Zoning Commission forward to the City Council the attached draft
Resolution with the recommendation for approval and change the date of
adoption at the bottom of the Resolution to the applicable date. Motion
carried on a 6-Yes, 1-Absent (Pease) vote. The item will be placed on
the February 1, 1994, City Council agenda. 8:37 p.m.
DISCUSSION - AMEND ORDINANCE NO.8, SECTION 8.23, RESIDENTIAL BUILDING
STANDARDS, REGARDING 4/12 ROOF PITCH
Mr. Carlberg reviewed the background of an application for a building
permit from Patio Enclosures, Inc., to build a three-season porch for a
homeowner. The permit was not issued because the roof pitch did not
meet the minimum requirement of a 4/12 roof pitch. He asked that the
Commission determine whether to amend the ordinance by excluding three-
season porches, greenhouses, etc., from the 4/12 roof pitch; leave the
ordinance as written and issue variances; or uphold the ordinance as
written.
. / Commissioner Ape1 recalled the 4/12 roof pitch provision was adopted
when there were concerns with mobile or manufactured homes in the City.
That ordinance was amended with regard to the size of the eaves when the

December 14, 1993 meeting. The Commission requested further
information from Staff on the request.
BACKGROUND
"
The Commission, at the December 14, 1993 meeting, reviewed the
request of the City of Andover to rezone property from R-4, Single
Family Urban and LB, Limited Business to GB, General Business.
The property is generally located south of Waste Disposal
Engineering (WDE) site, west of Hanson Boulevard NW, North of
Bunker Lake Boulevard NW and east of Red Oaks Manor 4th and 6th
Additions. Consult the location map included in your the December
14, 1993 packet materials.
The rezoning request includes an area of 86+/- acres.
The Commission should be aware that the forty (40 a.) acres
requested to be rezoned located immediately south of the WDE site
is required to be rezoned commercial as a part of the
institutional controls included in the "Access Agreement". The
remaining forty-six (46 a.) acres is being requested to be rezoned
to be consistent with the Comprehensive Plan and the future land
use map.

INFORMATION REQUESTED
The Commission directed Staff to contact the Minnesota Department
of Natural Resources (DNR) and the Coon Creek Watershed District
(CCWD) to determine why they objected to the rezoning as was
disclosed by a resident at the Decemb~r 14, 1993 meeting.
Attached are letters from both the DNR and CCWD explaining their
position. The Commission should note that both the DNR and CCWD
do not object to the rezoning.
The Commission also asked the Engineering Department to address
the storm water issue in the area. This information is
attached for Commission review.

This letter is in response to your recent request regarding our
position on the city rezoning where public waters wetlands are
involved. It is not the Department's position to oppose
justified rezoning. We do typically object to projects that have
adverse impacts on wetlands. The presence of wetlands on the
parcel to be rezoned does not cause us to oppose rezoning.
Filling wetlands, however, is contrary to Departmental goals and
would be opposed.

This is to confirm our conversation last week. I understand that
it has been suggested that the Coon Creek Watershed
District is opposed to a rezoning of the above
property. This is not the case. The District is not,
and, unless requested, does not get involved in local
zoning issues. Zoning is clearly an authority of the
City, not the Watershed District.

Given the following, the District has no objection to a rezoning:
1. The District has no authority over local zoning
issues.
2. A rezoning does not constitute a development
proposal, and
3. That under the Wetland Conservation Act, any
development proposal involving fill, drainage or
alteration of wetland, must provide a compelling
reason why wetland fill can not be avoided on
grounds other than economic considerations alone.

REFERENCE: DNR Protected Wetland i2-616W
Attached is a permit issued by the DNR, Water Level control, Unnamed
wetland 2-6l6W (Red Oaks Pond East). The control structure is at an
elevation of 882.5 feet which is considered the OHW (Ordinary High
Water) mark. The outlet storm sewer for the wetland is a 21 inch
Reinforced Concrete Pipe. (RCP) which will remove any additional
runoff above the 882.5 feet to the Red Oaks Pond West (DNR 2-6l6W).

Obviously, if the use changes, additional runoff may be created. If
and when development occurs, the City will need to review the overall
drainage area and the site plans as they are submitted to the City.
Obviously, we would need to review them to ensure the 100 year storm
event due to the additional runoff will not effect existing
structures within the watershed area.

ANDOVER
REZONING - R-4 AND LB TO GB,
SECTION 34, CITY OF
7:31 p.m. Mr. Carlberg reviewed the request of the City of Andover to
rezone property from R-4, Single Family Urban and LB, Limited Business
to GB, General Business. The property is approximately 86 acres located
south of the Waste Disposal Engineering site, west of Hanson Boulevard
NW, north of Bunker Lake Boulevard NW and east of Red Oaks Manor 5th and
6th Additions. The 40 acres immediately adjacent to the landfill is
required to be rezoned as part of the institutional controls included in
the agreement for the clean up of the landfill site. The remaining
property is being requested to be rezoned to be consistent with the
Comprehensive Plan and to be consistent with the zoning of that area.
The intent would be to have the property develop into an industrial park
in the future.
The hearing was opened for public testimony.
Barb Duerr, 13753 partridoe Street expressed opposition to the
rezoning of the LB area adjacent to Bunker Lake Boulevard. It is a
wetland now. She understood and had no problem with the rezoning next
to the landfill, but she asked why it is necessary to rezone that area
which is now LB. Mr. Carlberg explained the Comprehensive Plan calls
for that entire area to be s. No development will take
place in the wetland -- it 11 not be filled in and it will not be
redeveloped because the law does not allow it. The rezoning will
provide a consistent zoning for that entire area.

Ms. Duerr - lives by that area and recognizes there are no guarantees.
She repeated her preference to leave the low area zoned LB. She asked
if the junkyards will be allowed to expand in the GB zone. Mr. Carlberg
explained the junkyards are a non-conforming use and are not allowed to
expand. Right now the City is working with the junkyard owners to reduce
the size of their yards. There was some discussion on the different
uses allowed in LB and in GB, with Mr. Carlberg noting only a small
strip of property is usable between the existing junkyard and the
wetland area immediately north of Bunker Lake Boulevard.
Ms. Duerr - stated she talked with Tom Hovey of the DNR and Tom Kelly of
the Coon Creek Watershed. Mr. Kelly was not in favor of the rezoning.
Mr. Carlberg was not sure what the objection would be since the zoning
is currently LB and there will be no construction in the wetland. He
agreed to call Mr. Kelly and Mr. Hovey to explain the proposal.
Ms. Duerr - felt the effect on the wetland will be quite a bit and asked
the Commission to look at other options. Mr. Carlberg explained the
parking lot and structures really shouldn't affect the wetland, plus
there can be no direct storm water discharge into the wetland. Again,
the rezoning is similar to the current zoning, and it will be consistent
( with the Comprehensive Plan.

Chairperson Dehn liked the idea of having all the contiguous property
under one zoning, but a GB zone may be too intrusive on the residential
area. She wanted to know the reasons the DNR and watershed opposed the
rezoning because she is very concerned with the wetlands.
Pat Skoabera, 13808 Niahtinaale Street NW - asked if the wetland area is
where the storm water drains from the Red Oaks Additions. What will the
affect of commercial be on it? Mr. Carlberg stated that is possible,
but the rules have changed since the streets were done in those
subdivisions. Before any storm water can be discharged to the wetland
it must go through sediment or holding ponds. That would be looked at
when development is proposed.
Mr. Skoabera - stated the last time the City looked at the whole
situation the back of his property flooded out.
Randall Haaen, 13763 partridae Street NW - was under the assumption the
zoning of the wetland would not ch~nge. It is a very scenic area with
a lot of wildlife and gorgeous sunr~ses. He felt it could become an eye
sore if something is done with that property. He felt the wetland should
retain its current zoning.

Commissioner Jovanovich felt that more industrial property is needed in
Andover, and to leave the R-1 zone is not feasible. Chairperson Dehn
was now concerned about the storm water question and asked if the City
engineers could do a rough calculation as to how much additional storm
water would be generated by General Business development and whether or
not the wetland area is capable of holding additional storm water.

Tim Werle, 13770 partridae Street NW - agreed with the rezoning adjacent
to the landfill, but suggested residential development adjacent to the
wetland may be better than business. Mr. Carlberg stated there appears
to be only enough room for a road between the wetland and the existing
junkyard. He has also seen business development which is very
environmentally conscious and attractive, incorporating wetland into its
landscaping. There are also setback requirements, berming and
landscaping by businesses that abut residential areas as a buffer, etc.
Mr. Werle - suggested the current R-4 zone remain as is, which is more
conducive to the wildlife in that area.
Commissioner Putnam was concerned that the business areas be contiguous.
But it makes more sense to have the businesses access Hanson Boulevard,
so the existing R-4 area can remain residential and access onto Bunker
Lake Boulevard. That option would preserve the wildlife and would allow
General Business as well, though he is not yet ready to commit to
anything.
Ms. Duerr - would like to see at least the bottom piece remain as is, as
she sees no reason to change it unless it is changed to residential.
Otherwise she has no problem with the rezoning.

The Commission felt it would be appropriate to table the item pending
further information from the DNR and watershed on their position and on
the question of storm water runoff to the wetland.

receive further information from the watershed and DNR and the question
of storm water runoff. Motion carried on a 4-Yes, 3-Absent (Apel, Peek,
Squires) vote. This will be placed on the January 11, 1994, Planning

PUBLIC HEARING: VARIANCE - SETBACK ORDINARY HIGH WATER MARK, 13306

8:05 p.m. Mr. Carlberg reviewed the request of Arnold Dziuban to allow
for the construction of a 12' x 28' three-season porch and add a new 12'
x 12' deck encroaching into the required 75-foot setback from the
ordinary high water mark. The porch and deck would encroach 8 feet into
the required setback. An existing 12' x 24' nonconforming deck, of
which the City has no record, encroaches 8 feet into the setback. The
applicant wishes to remove the existing deck and construct the three-
season porch in its place. The bottom of the porch is proposed to be
enclosed for storage purposes, plus construct a deck south of the porch.
The DNR does not recommend increasing the nonconformity of the
structure. The adjacent property to the north was granted a variance

The Andover Planning and Zoning Commission is asked to review the
request of the City of Andover to rezone .property from R-4, Single
Family Urban and LB, Limited Business to GB, General Business.
The property is generally located south of Waste Disposal
Engineering (WDE) site, west of Hanson Boulevard NW, North of
Bunker Lake Boulevard NW and east of Red Oaks Manor 5th and 6th
Additions. Consult the attached location map included in your
packet materials.
The rezoning request includes an area of 86+/- acres.
APPLICABLE ORDINANCES
, Ordinance No.8, Section 5.02, establishes the procedure for
/ changing zoning district boundaries (rezoning).
Ordinance No.8, Section 5.03(B), establishes the criteria for
granting a Special Use Permit. These same criteria shall also be
considered in the determination of granting a rezoning request.
The criteria include:
the effect of the proposed use upon the health, safety,
morals and general welfare of occupants of surrounding lands,
existing and anticipated traffic conditions including parking
facilities on adjacent streets and land,
the effect on values of property and scenic views in the
surrounding area, and
the effect of the proposed use on the Comprehensive Plan.
If the Commission chooses to deny the rezoning request, it is
imperative that the Commission indicate findings of fact in this
and all rezoning cases.

BACKGROUND INFORMATION
The forty (40 a.) acres requested to be rezoned located
immediately south of the WOE site is required to be rezoned as a
part of the institutional controls included in the "Access
Agreement". The remaining forty-six (46 a.) acres is being
requested to be rezoned to be consistent with the Comprehensive
Plan and the future land use map.
COMMISSION OPTIONS
A. The Andover Planning and zoning Commission may recommend
approval of the rezoning requested by the City of Andover to
rezone property from R-4, Single Family Urban and LB, Limited
Business to GB, General Business, legally described on the
attached amendment to Ordinance No.8.
The Planning Commission finds that the proposal meets the
criteria established in Ordinance No.8 Section 5.03(B).
B. The Andover Planning and zoning Commission may recommend
denial of the rezoning requested by the City of Andover to
rezone property from R-4, Single Family Urban and LB, Limited
Business to GB, General Business, legally described on the
attached amendment to Ordinance No.8.
The Planning Commission finds that the proposal does not meet
the criteria established in Ordinance No.8 Section 5.03(B).

The City Council is requested to approve the preliminary plat of
Hills of Bunker Lake 5th Addition per Ordinance 8 and 10 and all
other applicable ordinances as requested by Tony Emmerich
Construction, Inc. Attached is the resolution.
The Andover Review Committee (ARC) has reviewed the preliminary
plat. Their comments are as follows:
General Comments
* The proposed preliminary plat is currently zoned R-4, Single
Family Urban. The proposed plat is not within the Metropolitan
Urban Service Area (MUSA), but is proposed to be included in
the request that is currently being reviewed by Metro Council.
* The proposed subdivision consists of 134 single family urban
residential lots. Since the Planning and zoning Commission
held the public hearing, three (3) lots have been removed
due to some wetland issues located in the southeast portion of
the plat. Removal of these lots have been agreed to by the
developer and the Coon Creek watershed District.
* The developer and/or owner will be required to obtain all
necessary permits (DNR, U.S. Army Corps of Engineers, Coon
Creek Watershed District, LGU, MPCA and any other agency which
may be interested in the site).
Andover Review Committee Recommendation
Approve the preliminary plat as presented.
Note: The preliminary plat should not be approved unless a
negative declaration on the EAW has been approved.

The Commission is recommending approval subject to review to
ensure 139th Lane NW is located properly along Richard Fuller's
property. Staff has reviewed this request and finds the location
acceptable as shown on the preliminary plat.
Park and Recreation Commission Recommendation
The Commission is recommending dedication of land as determined
in Ordinance 10, Section 9.07 from their December 2, 1993
meeting.
8.01 IDENTIFICATION AND DESCRIPTION
a. Proposed name is Hills of Bunker Lake 5th Addition.

g. The preliminary plat and the grading, drainage and erosion
control plan was prepared by John Oliver and Associates of
Elk River.
8.02 EXISTING CONDITIONS
b. Total acreage is 80.5.
c. The existing zoning within 300 feet of the proposed plat has
been shown.
f. Location of all existing telephone, gas, electric and other
underground/overhead facilities are shown on preliminary plat
per ordinance requirements.
g. The boundary lines within 100 feet of the plat have been
shown along the names of the property owners.

The city Council is requested to review the proposed sketch plan
of Fox Woods as presented by Gary Gorham.
The Andover Review Committee (ARC) has reviewed the sketch plan
and their comments are as follows:
General Comments
* The proposed sketch. plan is located in an R-1, Single Family
Rural zoning District with a minimum lot size of 2.5 acres.
The property will need to be rezoned to a R-4, Single Family
Urban zoning District with a minimum lot size of 11,400 square
feet. Minimum width is 80 feet except corner lots are either
90 or 100 feet minimum and minimum depth for all lots is 130
feet.
* All lots will require to meet Ordinance 10, Section 9.06 a(l)
which relates to lot size requirements. The property is not
located within the MUSA area. It is proposed to be included in
the MUSA with the most recent request. In addition, the front
100 feet of the lot shall be buildable which is a standard the
City has been using for sewer and water lots.
* The Water Resource Management Plan which was recently updated
and approved by the Andover City Council, Coon Creek watershed
District and the Lower Rum River WMO is to be implemented with
the development.
* The 100 year pond elevation will be required to be identified
on the preliminary plat. In addition, drainage and utility
easements are required for the 100 year flood elevations.

* The proposed subdivision consists of 73 single family urban
residential lots.
* The developer and/or owner is responsible to obtain all
necessary permits (DNR, u.s. Army Corps of Engineers, Coon

with the City regarding this item.
* There may be wetlands within the the plan that must be
delineated by agencies and indicated on the preliminary plat.
The Local Government Unit is the Coon Creek watershed District.
The developer shall contact the watershed to discuss the 1991
Wetland Conservation Act that is in effect.
* The developer is required to meet City Ordinance 8 and 10 and
all applicable ordinances.
Remember: This has not been studied by staff in detail as most
of the detail will be reviewed with the preliminary
plat.
Park and Recreation Commission Comments
The Commission will be recommending that cash be dedicated in
lieu of land as determined at the January 20, 1994 regular
meeting.

The Commission would like to see a combination of the sketch
plans that have been presented by the developer and the Andover
Review Committee. The Commission is recommending to stay away
from the grid system that has been recommended by the Andover
Review Committee to allow for a more aesthetically pleasing
development.
Andover Review Committee Comments
Sketch Plan A solves 2 issues the ARC was concerned with.
1. Eliminates the horizontal curves that have been proposed
which allows for easier snowplowing/maintenance of the streets
and less damage to boulevards and mailboxes.
2. Sight distance at intersections was a concern. At this
point, the developer's engineer has not done any detail to
ensure sight distance requirements are met, but will be able
to depending on which alignment is acceptable to the City.

A sketch plan dated 1-4-94 prepared by Hakanson-Anderson Associates, Inc., was reviewed with the
following conunents:

Sanitary Sewer

The 18" trunk sanitary sewer on Bluebird Street has the required depth to serve the plat and east to
Xeon Street. 8" outside drops were constructed for future connection at 146th Avenue NW and
146th Lane NW.
There are no 4" sanitary services along the east side of Bluebird Street. The 18" main is 25' to 29'
deep. Based on the sketch, nine (9) lots are shown to be served off Bluebird Street. These nine
services would be extremely costly.
2. Watermain
Watermains would be extended easterly from the existing 12" watermain on Bluebird Street.
3. Storm Sewer
There is a trunk storm sewer (27" and 30") on Bluebird Street that was designed for runoff on the
westerly portion of the proposed plat. A 30" storm sewer to be constructed this year would handle
nmoff to the East.
11le landlocked low area on the northerly line between Fox Woods and Oak Bluff should be
addressed.
The proposed grading and stormwater runoff plan would have to be prepared in accordance with
the Andover Water Resource Management Plan.

1.
The City Council is requested to discuss Hartfiel's Estates, the
Heil's property and Fox Woods area regarding the possibilities of
making improvements of sanitary sewer, watermain, streets and
storm drainage for the area.
With Fox Woods proposed to be included within the Metropolitan
Urban Service Area and immediate development of the property by
Gary Gorham, the Andover Review Committee is recommending
improvements be made into Hartfiel's Estates, Fox Woods and
Hei1's area. By including the area the project will become that
much more cost effective and will allow fairness for the
assessments.
Note: If Gary Gorham (developer of Fox Woods), Ron Smith
(developer of Heil property) and Chuck Hartfiel (owns a
number of vacant lots in Hartfiel's Estates) were to get
together to petition for those improvements, obviously
there would be an adequate petition.

REQUEST
The Andover City Council is requested to approve the 1994
Metro Mayors Association (NMMA) dues payment for $5,000 as
attached. An additional $1,000 needs to be approved from the
contingency account for this payment.
BACKGROUND
The 1994 General Fund Budget as adopted included $4,000 for the
; NMMA dues. The organization's dues structure is based on a
combination of flat fee and population for determining each member
city's dues. The membership fee for Andover is discounted from the
full fee structure.
The 1994 revenue forecast and suggested budget for the NMMA are
attached for your review.

discuss how the City wishes to finance the acquisition of the

OPTION AGREEMENT

(hereinafter called "Optionee").
WHEREAS, Optionor is the legal owner of certain real property situated in the
County of Anoka, State of Minnesota, and more particularly and specifically described
as:
The North Half of the Northeast Quarter of Section 34, Township 32,
Range 24, Anoka County, Minnesota
and
The Southwest Quarter of the Northeast Quarter of Section 34,
Township 32, Range 24, Anoka County, Minnesota
/
(hereinafter called "Option Premises"); and
WHEREAS, Optionee is desirous of obtaining the exclusive right, without
becoming so obligated, to purchase the Option Premises at an agreed consideration,
and Optionor is willing to grant such right on certain terms and conditions as hereinafter
set forth.
NOW, THEREFORE, in consideration of the covenants and agreements herein
contained, and the sum of Five Hundred and nO/100 ($500.00) Dollars paid by Optionee
to Optionor, which amount shall be applied to the purchase price described hereunder
in the event this Option is exercised, Optionor hereby grants to Optionee an irrevocable
Option to purchase the Option Premises on the following terms:

SECTION 1

PURCHASE PRICE AND OPTION PREMISES
1.1
In the event the Option hereby granted is exercised, the purchase price to
be paid by Optionee to Optionor shall be Seven Thousand and nO/100 ($7,000.00)
Dollars per acre. The exact acreage shall be determined by survey at Optionee's
expense prior to the closing. Such acreage calculations shall not include that area within
the easement previously purchased by Optionee which lies within said Southwest Quarter
of the Northeast Quarter. Such price shall be paid in the manner and at the times and
under the terms and conditions as follows:
Payment of the purchase price shall be cash upon the exercise of the
Option and shall entitle Optionee to a Warranty Deed for all right, title and
interest of the Optionor in and to the Option Premises, free and clear of all

mortgages, liens and encumbrances, real estate taxes and special
assessments, except as created hereunder, and except zoning regulations,
use restrictions of applicable governmental authorities, and utility
easements, and street easements of record and deferred assessments.
SECTION 2
OPTION TERM AND EXERCISE OF OPTION
2.1 Unless extended, the terms of the Option granted herein is for a period
commencing on execution hereof and continuing until 5:00 p.m., March 31, 1994, at the
expiration of which time the Option shall terminate, and unless it is exercised prior
thereto, Optionee shall have no further rights in and to the Option Premises.

2.2 The Option may be exercised by Optionee at any time during its term by

providing notice of the exercise thereof in writing in the manner provided for notices

in Section 10 hereof.
2.3 In the event this Option terminates. Optionee shall forfeit any right to the
return of any sums paid to Optionor and Optionee agrees at its expense to execute,
acknowledge, and deliver to Optionor, within twenty (20) days after written request,
release of this Option or such other document as may be required by any title
company, or title examiner, to remove the cloud of this Option from the Option
Premises.
SECTION 3
TITLE EXAMINATION
3.1 Optionor, as soon as possible after exercise of this Option by Optionee,
shall deliver to Optionee an abstract of title, certified to a current date, including all

appropriate searches, including without limitation, state and federal tax lien searches,
judgment searches in the district and county court in the county in which the Option
Premises is located, current and delinquent taxes, special assessments, and delinquent
utility bills, as such searches are made by the abstracter, showing marketable title to
the Option Premises in Optionor. Optionee shall have ten (10) days from and after
receipt of the abstract of title in which to examine the same and notify Optionor in
writing of any objections thereto. In the event no objections are made within said ten
(10) day period, such objections shall be deemed waived. If any objections are made,
Optionor, in good faith, shall use all diligence and make all reasonable efforts to
promptly cure such objections and make title marketable and shall be allowed one
hundred twenty (120) days after receipt of notice thereof to do so.

SECTION 4
TITLE DEFECTS

4.1 In the event, following the exercise of this Option, Optionor is unable to
close on the date designated for closing in Section 7 hereof, because of the existence
of title defects or objections which have not been removed to the satisfaction of
counsel for Optionee or a title insurance company licensed to do business in the State
of Minnesota, Optionee may elect anyone of the following procedures:
(a) Accepting the Option Premises subject to any title defects or objections
and closing shall be held within ten (10) days after Optionee gives
written notice of such election.
(b) Extending closing for such time as may be mutually agreeable to the
parties to afford Optionor time for curing said defects or objections up to
sixty (60) days; or
(c) Terminating this Agreement.
If Optionee makes the election set forth in Section 4.1 (b) above, at the expiration of
said sixty (60) day extension, if the objections to title or title defects have not been
removed or cured to the satisfaction of counsel for the Optionee or such title insurance
company described above, Optionee may then elect to terminate this Agreement.
SECTION 5
REPRESENTATIONS AND WARRANTIES
5.1 Optionor represents and warrants to Optionee as follows:
(a) Optionor is, or will be, lawfully seized in fee simple of the Option
Premises at the time of closing;

(b) Optionor will defend title and quiet enjoyment of the Option Premises
against the lawful claims and demands of all persons;
(c) Optionor knows of no unrecorded agreements not described herein
affecting any of the Option Premises;
(d) Optionor will not commit waste or materially damage the Option
Premises.
SECTION 6
CONDITIONS PRECEDENT
6.1 Notwithstanding anything stated herein to the contrary, Optionee's
obligation to perform at the closing shall, at Optionee's election, be conditioned upon
the satisfaction of each of the following conditions precedent:
(a) Optionor shall have performed and complied with all agreements and
conditions required by this Option to be performed and complied with
prior to or at the closing, and shall certify in such detail as Optionee may
specify to the foregoing effect;
(b) At the closing, there shall have been no material damage to, or
destruction of, the Option Premises;
(c) All legal matters in connection with the performance of Optionor of its
obligations in this Option shall be reasonably satisfactory to counsel for
Optionee, or such title insurance company described in Section 4.1 .
6.2 Notwithstanding anything stated herein to the contrary, Optionor's
obligation to perform at the closing shall, at Optionor's election, be conditioned upon
the satisfaction of each of the following conditions precedent:

SECTION 7
CLOSING
7.1 Closing hereunder shall take place on one of the following applicable
closing dates: .
(a)
Twenty (20) days after Optionor has delivered the abstract of title to

Optionee for examination pursuant to Section 3 hereof, provided no
objections have been made to title and there are no title defects; or
(b) Ten (10) days after the expiration of the one hundred twenty (120) day
period permitted for the removal of title objections and title defects as
provided in Section 3 hereof, provided, however, that all title objections
and title defects have been removed to the satisfaction of counsel for the
Optionee, or such title insurance company described in Section 4.1.
SECTION 8
REAL ESTATE TAXES AND SPECIAL ASSESSMENTS
8.1 In the event this Option is exercised, real estate taxes due in the year of
closing shall be prorated as of the date of closing. All taxes due for prior years shall

be paid by the Optionor. All levied and certified special assessments shall be paid by
Optionor as of the date of closing.
SECTION 9
POSSESSION
9.1 Possession of the Option Premises to be conveyed hereunder shall be
given and the risk of loss and damage thereto shall pass at the closing, and pending
closing shall be borne by Optionor.
9.2 Notwithstanding Section 9.1, Optionee shall have the right of access to
the Option Premises for the purpose of conducting surveys to determine the exact
acreage and boundaries of the property to be conveyed. Furthermore, Optionee shall
have the right of access for the purpose of performing environmental testing to
determine whether or not any environmental hazards exist on the Option Premises.
Such access rights shall include the right to collect soil samples, install testwells and
any other invasive procedures that are normally associated with environmental testing
analyses. As additional consideration for the granting of such option, Optionee shall
provide to Optionor copies of all investigative reports, surveys, topographical maps,
and any other items prepared on behalf of the City in preparation for the potential
development of the property. Optionor shall be entitled to possession and use of all
such reports, notwithstanding the failure of the Optionee to exercise this option.
9.3 Optionee agrees to promptly pay all bills for any such work performed as
described in Paragraph 9.2 hereof, and agrees to keep the premises free and clear
from any mechanic's liens that may be filed on such property, and will defend and
indemnify Optionor against any and all enforcement of any and all mechanic's liens
that may be filed against said property as a result of such work.

10.1 All notices, requests, demands, elections, and other communications
required or permitted by this Option Agreement shall be in writing and shall be deemed
to have been given at the time when mailed in any United States Post Office or Branch
United States Post Office, registered or certified mail, with return receipt requested,
postage prepaid, to the addresses set forth below, which addresses may be amended
in writing from time to time, in the manner herein provided for notices:

SECTION 11
ENTIRE AGREEMENT, MODIFICATION AND WAIVER
11.1 This Agreement constitutes the entire Agreement between the parties
hereto pertaining to the subject matter hereof and supersedes all prior agreements,
understanding, negotiations and discussions, whether oral or written, of the parties;
there are no warranties, representations or agreements among the parties in
connection with the subject matter hereof, except as set forth or referred to herein.
No supplement, modification or waiver to this Agreement or any provisions shall be
binding unless executed in writing by the parties to be bound. No waiver of any of the
provisions of this Agreement shall constitute a waiver of any other provisions, nor
shall such waiver constitute a continuing waiver unless otherwise expressly provided.

SECTION 12
ASSIGNMENT; RECORDING
12.1 This Option may not be assigned by Optionee; nor shall this Option be filed
for record in the office of the County Recorder in and for Anoka County, Minnesota.
SECTION 13
BROKER'S OR FINDER'S FEES
13.1 Optionee and Optionor represent to each other that, if they have engaged
a broker or finder in connection with this transaction, all fees incurred in connection
therewith shall be borne by the party engaging such broker or finder. Each shall pay the
same and shall indemnify and hold the other harmless from and against any and all
claims made in connection therewith.
SECTION 14
SURVIVAL OF REPRESENTATIONS, WARRNTIES,
COVENANTS AND CONDITIONS
14.1 All representations, warranties, covenants and conditions made pursuant
to this Agreement, and all agreements made by the parties pursuant to this Agreement
shall survive the consummation of the transaction or transactions contemplated by this
Agreement, and all the representations and warranties made in any document delivered
in connection herewith shall surVive the delivery of the deed and shall not be merged
therein, any rule of law to the contrary notwithstanding.

The City Council is asked to approve the attached amendment to
Ordinance No. 33, parking Regulations. Said amendment will
prohibit the parking of vehicles upon any City street during and
after a measurable snowfall until such time the snow has been
plowed from the street. Said amendment will also delete the snow
emergency declaration from the Ordinance.
REVIEW
The rationale for amending said Ordinance is due to the following:
1. Resident complaints have increased regarding the plowing and
snow removal of the full width of the streets. Parking on one or
both sides of the street during snow removal operations prohibits
the efficient removal of snow.
2. Snow removal operations will be safer and the possibility of
damage to private and public vehicles will be decreased.
Attached is the amendment for Council review and adoption.

AN ORDINANCE AMENDING ORDINANCE NO. 33, REGULATING THE PARKING OF
VEHICLES ON STREETS WITHIN THE CITY OF ANDOVER.
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY ORDAINS:
Ordinance No. 33 is hereby amended as follows:
Section 1.
It shall be unlawful for any person to leave, park, permit,
or allow any vehicle to stand or remain upon any City street or
right-of-way or on the traveled portion of the road or to obstruct
the flow of traffic, unless for an emergency between the hours of
one (1:00) o'clock A.M. and six (6:00) o'clock A.M. of any day,
except as provided by this Ordinance.
It shall be unlawful for any person to leave, park, permit,
or allow any vehicle in excess of twenty-four (24') feet in length
or having a weight in excess of one (1) ton to stand or remain
upon any City street right-of-way or on the traveled portion of
the road or to obstruct the flow of traffic at any time of any day
unless such vehicle is being used for the purpose of moving goods
from or to a commercial or residential location within one (1)
block from where such vehicle is located. In no instance shall
any vehicle described as being in excess of twenty-four (24') feet
or having a weight in excess of one (1) ton be left, parked or
permitted to be parked on any City street right-of-way for a
period of more that two (2) continuous hours of any day.
Notwithstanding the foregoing restrictions, the City Council
may impose additional parking restrictions on streets within the
City if in its opinion such restrictions are necessary to protect
the health, safety and welfare of persons or property. Streets
subject to such additional restrictions shall be designated by
Council Resolution and such restrictions shall not be enforced
until after posted notice thereof on such streets has taken place.
Violations of such restrictions shall be deemed a misdemeanor.
Section 4.

No person shall deposit or permit to be deposited and leave
on any public street in this City leaves, grass, sand or similar
materials, nor shall any person plow, shovel, or blow or permit
the blowing, shoveling or plowing of snow onto a public street in
the City and leaving it. Violation of this provision shall
constitute a misdemeanor. This provision shall not apply to any
person who is in the process of constructing or maintaining a yard
or drive provided that the materials are immediately removed from
the street.
All other sections of this Ordinance shall remain as written and
adopted by the City Council of the City of Andover.

The Andover City Council is requested to approve the attached
resolution cancelling the 1993 budgeted transfer of $30,500 from
the Sewer Trunk Fund to the Sewer Fund.
BACKGROUND

I
Each year the Sewer Trunk Fund transfers $30,500 to the Sewer Fund
to subsidize 'Sewer Area A'. The subsidy is for the reduced
quarterly sewer service charges, which repay the higher connection
charges paid by these customers. This subsidy will end in 1997.
The Sewer Fund operating surplus generated during 1993 of $70,000
warrants the cancellation of the 1993 subsidy. Without the
subsidy, the surplus would be reduced to approximately $40,000.

WHEREAS, the City of Andover Sewer Fund is primarily supported by
user fees; and
WHEREAS, the City of Andover Sewer Trunk Fund is primarily
supported by connection fees and area charges; and
WHEREAS, the Sewer Trunk Fund reimburses the Sewer Fund in the
amount of $30,500 each year for the reduced quarterly user
charges within 'Sewer Area A'j and
WHEREAS, the 1993 operating surplus generated by more new
accounts and user charges than estimated, along with lower
than budgeted expenditures negates the need for the annual transfer.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Andover hereby cancels the budgeted 1993 transfer of $30,500
from the Sewer Trunk Fund to the Sewer Fund.

REQUEST
The Andover City Council is requested to receive the preliminary
December 1993 financial statements for the General, Water, Sewer
and Central Equipment Funds. The final 1993 statements will be
presented to the Council when the audit is completed later this
year.
Please note:
1) These statements include the amended budgets adopted by
resolutions R016-93 on 1/19/93, R186-93 on 8/17/93 and
R275-93 on 11/16/93.
2) The 4th quarter utility billing released in January will
add the following revenue to the preliminary balances as
shown within the respective funds:
General Fund, street lighting: $ 23,428
Water Fund, water sales: 59,196
Sewer Fund, sewer charges: 130,177
3) The fourth quarter interest earnings and accrued interest
have not yet been recorded. Other revenue yet to be recorded
include CDBG and recycling reimbursements due from Anoka
County.

5) My projection for the year end surplus of General Fund
revenue over expenditures for 1993 is approximately $60,000.
This surplus will flow to fund balance, which is used to
finance the General Fund operations during the first half of
the year. An advance payment on tax receipts is due June 20th
with final settlement from the county due July 6th.
The current fund balance is $731,760. The projected 12/31/93
fund balance of 791,760 is 28% of the 1994 General Fund
budget. This leaves us $151,010 short of the target fund
balance of 33.3% or $942,770.
6) The Water Fund and the Sewer Fund will exceed estimated
revenue for 1993. Expenditures for both funds will be under
budget. I am estimating the 1993 operating surplus for the
Water Fund to be approximately $55,000. This will be reduced
to $30,000 after the transfer to the Water Trunk Fund for
capital maintenance is recorded. My estimate for the 1993
Sewer Fund operating surplus is $70,000. I recommend the
Council cancel the 1993 Sewer Trunk Fund transfer of $30,500.
A resolution to cancel the transfer has been prepared as a
separate agenda item.
The Council should consider a $10,000 to $15,000 transfer
from both Funds to the new Building Construction Fund to help
finance improvements to the Public Works building.
7) The Central Equipment Fund will be analyzed during the audit
to evaluate the centralization of the vehicle maintenance
function. Revenue and expenditures are within budget
projections at this time. The unexpended maintenance balance
remaining at year end should be placed in a reserve for
equipment replacement.

please contact me prior to the meeting so I may have adequate time
to research the question.

SPECIFICATIONS FOR THE IMPROVEMENT OF PROJECT NO. 93-12 FOR
SANITARY SEWER, WATERMAIN, STREET AND STORM DRAIN IN THE
FOLLOWING AREA OF HILLS OF BUNKER LAKE 5TH ADDITION
WHEREAS, the City Council did on the 6th day of July
19 93 , order the preparation of a feasibility study for the
improvements; and
WHEREAS, such feasibility study was prepared by TKDA and
presented to the Council on the 1st day of February, 19~; and
WHEREAS, the property owners have waived the right to a Public
Hearing; and
WHEREAS, the City Council has reviewed the feasibility study and
declares the improvement feasible, for an estimated cost of
$ 1,573,000.00 .
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby receive the feasibility report with an estimated
total cost of improvements of $ 1,573,000.00 , waive the Public
Hearing and order improvements.
BE IT FURTHER RESOLVED by the City Council to hereby direct the
firm of TKDA to prepare the plans and specifications for such
improvement project.
BE IT STILL FURTHER RESOLVED by the City Council to hereby
require the developer to escrow the sum of $ 70,000.00 with such
payments to be made prior to commencement of work on the plans and
specifications.

Lake 5th Addition.

Surface water within this plat will be controlled with storm sewers and on-site
ponding. All storm sewer sizing and catch basin spacing is based on a 10-year
design storm frequency. Ponding is based on a 1 DO-year design storm
frequency. Emergency overflow outlets must be provided at all low areas to
provide overflow protection of homes for storms more intense than that used for
design of the storm sewer collection system.
It is proposed to construct catch basins at all low points within the streets
throughout the plat and direct the runoff to the various ponds located within the
plat (See Drawing No.3).

Corps of Engineers, the Department of Natural Resources and/or the Coon
Creek Watershed District. All permits related to total site grading are the
