to adopt the following:
A RESOLUTION ORDERING THE IMPROVEMENT OF STREET LIGHTING, PROJECT NO.
93-8, IN THE WOODLAND MEADOWS AREA.
WHEREAS, pursuant to the required published and mailed notice, a
public hearing was held on the 18th day of January 1994; and
WHEREAS, all persons desiring to be heard were given such
opportunity for same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby order improvement No. 93-8, street lighting in the
woodland Meadows area with the costs of same to be billed on the
normal quarterly utility billing.

Formula used to determine street lighting costs:
$19,650.00 installing costs ~ 22 lights - $893.18 cost/light
The cost of each street light per month for 5 years at 8.75%
interest is $18.43.
$18.43 + $10.16 (flat monthly rate) = $28.59/month/light
$28.59 cost of light/mo. X 3 mos./qtr. = $24.51/lot/qtr.
3.50 * of lots/light
$24.51/lot/qtr. AEC
$ 1.28 overhead; computer; postage (city)
$25.79/qtr./lot or $103.16/yr./lot
The city of Andover is paying AEC monthly and lots will be billed
quarterly by the city.
Bill all lots.

Enclosed please find a notice of hearing on improvement of street
lighting in the above described area.
The estimated cost for installing the lights is $19,650.00. The
billing per lot will be approximately $25.79 quarterly or $103.16
yearly. This may increase or decrease depending on the Anoka
Electric Cooperative energy and maintenance charges.
It is recommended that if any property owners want to change
their vote on the petition, those property owners should attend
the scheduled meeting or send a letter to my office prior to the
scheduled meeting. If you have not signed the petition and you
are interested in signing the petition please contact me.

PROJECT NO. 93-8
NOTICE IS HEREBY GIVEN that the City Council of the City of
Andover, Anoka County, Minnesota will meet at the Andover City
Hall, 1685 Crosstown Boulevard NW, in the City of Andover on
Tuesday, January 18, 1994 at 7:00 PM to consider the making of
the following improvement:
Street Lighting
The property to be assessed, pursuant to Minnesota Statutes
Section 429, for such improvement is within the following
described area:

Woodland Meadows located in Sections 3 & 10, Township 32,
Range 24.
The estimated cost of such improvement is $19,650.00.
Such persons as desired to be heard with reference to the
proposed improvement will be heard at this meeting.

2.3.01 Legal Responsibilities of MnlDOT
Minnesota Statutes Annotated (MSA) 161.20
places MnlDOT under the supervision and control
of a Commissioner .who shall have and exercise
the rights and powers and perform the duties
prescribed by law.. These duties are generally
described in MSA 161.20 and are more
specifically defined in many other sections of the
Statutes, primarily in Chapters 160-173. In
general, the Commissioner must carry out the
provisions of the State Constitution as it relates
to the State highway system (Le., Trunk
Highways). To do so, he has the power to
acquire property, construct and maintain
highways, let contracts, make agreements with
local communities, expend funds, and promulgate
regulations.

The Law - MSA 169.04

MSA 169.04, Local Authorities, has two
important implications for MnlDOT engineers.
First, local authorities have virtually complete
authority (with notable exceptions such as Speed
Zoning and Experimental Devices) over all streets
and highways under their juriSdiction (county
state-aid highways, county highways municipal
state-aid streets and town roads). Since the
statutes permit it, these local authorities may
enact any ordinance or regulation authorized by
the statutes affecting traffic operation on these
facilities (for a legal definition of the various local
ro e M 0.02 - Iso see SA .,
ubd. 2 and 3 on re U1rement to conform to the
MN MUTCD). Second, oca governments may
un erta e ac Ions affecting Trunk Highways only
with the consent of MnIDOT. The District
Engineer is responsible for the review of all
ordinances, regulations, or proposed actions
affecting Trunk Highways.

2-3.03 MnlDOT Approvals

Proposed ordinances, regulations, or restrictions
affecting State Trunk Highways shall be
investigated and approved by MnlDOT before
implementation. A formal resolution requesting an
investigation shall be submitted to the District by
the local authority along with a draft of the
proposed ordinance, regulation, or restriction.
Proposals which would inhibit capacity or
movement of Trunk Highway traffic, such as
improper parking procedures, turn restrictions,
truck routing, or similar items, must be
investigated by MnIDOT. If the proposed change
is covered by the Minnesota Manual on Uniform
Traffic Control Devices (MN MUTCDI, the Traffic
Engineering Manual or Technical Memorandums,
the District may approve the action without a

review by the Director, OTE. Form 29187,
District Traffic Work Order, may be used for this
purpose.
Approval by the Director, Office of Traffic
Engineering
The need for statewide uniformity and the legally
sensitive nature of some work orders requires a
centralized review. In these cases, the District
conducts an investigation of the proposed action
and transmits the proposal to the Director, OTE
with recommendations for action. At all times the
District should make an effort, through close
contact with local officials, to ensure that the
applicable legal requirements are fulfilled. The
Director, OTE shall review and sign any order
affecting:
1. Speed restrictions (see Section VI.
2. DeSignations of through highways (see
Section VII).
3. Experimental traffic control devices.
4. Changes andlor additions to guide signing
on Interstate highways.
5. Business, bypass, alternate, and
temporary route guide signing (except
official detours).
2-4.00 SIGNS, SIGNALS, AND MARKINGS
2-4.01 Legal Background
This section will discuss the legal rights and
responsibilities of MnlDOT regarding the
placement and maintenance of signs, signals, and
markings on streets and highways in Minnesota.
Chapters 6, 7, 8 and 9 of this Manual describe
standards and procedures for their design and
implementation. Areas that will be covered in this
section include: (1) the Minnesota Manual on
Uniform Traffic Control Devices, (2) the
placement and maintenance of signs, signals, and
markings, (3) unauthorized devices, (4) railroad
stop crossings, and (5) vandalism.
~ 2-4.02 Minnesota Manual on Uniform Traffic
Control Devices
Under MSA 169.06, Subd. 1, a Minnesota
Manual on Uniform Traffic Control Devices (MN
MUTCD) has been prepared and adopted by
Mn/DOT. Unless a variation is approved by
MnlDOT all traffic control devices shall conform
to the specifications in the MN MUTCD.
2-4.03 Placement and Maintenance on Trunk
Highways - MSA 169.06, Subd. 2
Mn/DOT Responsibility
Under MSA 169.06, Subd. 2, it is the sole
responsibility of MnlDOT to place and maintain
all necessary traffic control devices on Trunk
Highways although permission to do so may be
granted to other authorities by Mn/DOT. All such

devices shall conform to the MN MUTCD and to
Mn/DOT specifications unless a variance for
experimental devices has been granted by
Commissioners order.
Variations from the MN MUTCD
Mn/DOT may authorize variations from the MN
MUTCD only for purposes of investigation and
research. It is important to note that any
authorized variation (experimental traffic control
devices) in traffic regulations must be published
in a "qualified newspaper of general circulation"
in the area affected by the variance. A qualified
newspaper is one which is recognized as a legal
or official publication of the municipality (see
MSA 331.02). Experimental devices are only
authorized on Trunk Highways.
~ ~ 2-4.04 Placement and Maintenance on local
Streets and Roads
- MSA 169.06. Subd. 3
"
Local Responsmnfty
Under MSA 169.06, Subd. 3 local authorities
have both the right and the responsibility to place
and maintain traffic control devices on streets
and highways under their jurisdiction. All new
traffic control devices shall conform to the MN
MUTCD and to State specifications. Legal liability
for the existence and condition of these facilities
rests with the local authority, and not with
Mn/DOT.
2-4.05 Unauthorized Traffic Control Devices
Unauthorized Devices (MSA 169,07J
MSA 169.07 gives Mn/DOT and local road
authorities the authority and responsibility to
identify and remove any sign, signal, marking or
other device on Trunk Highways or other roads
which is a traffic hazard or deters the
effectiveness of official traffic control devices.
Such devices may be removed by Mn/DOT
without notice to the owner. This authority does
not extend to informational signs on private
property which cannot be mistaken as official
traffic control devices.

Red Lights, Signs, and Signals
While most unauthorized devices may simply be
removed by Mn/DOT, the removal of red lights,
signs, and signals must be preceded by official
notice. MSA 163.073 prohibits private individuals
and companies from placing red lights, signals, or
signs within view of highways or active railroads
in such a way that affects the effectiveness or
efficiency of official traffic control devices.
Mn/DOT may order the removal or replacement
of such lights by giving official written notice to
the owner that the light is a traffic hazard.
Notices shall be issued officially as required in
MSA 216.17. In addition, the aggrieved party

has the rights of appeal as required in MSA
216,25.
2-4.06 Railroad Stop Crossings - MSA 219.20
Responsibility for Ranroad Crossing Signs
With respect to the provisions of MSA 219.20
Mn/DOT does not have the authority to install,
replace, or remove signs on railroad property,
including at railroad crossings. These signs and
signals are the responsibility of the railroad
company. Mn/DOT may declare a crossing
"dangerous" and order the installation of stop
signs at the crossing. Procedures for determining
the need for traffic control devices at railroad
crossings are discussed in Chapter 13 of this
Manual.
2-4.07 Vandalism - MSA 169.08
Prosecution
MSA 169.08 clearly provides a recourse against
vandalism related to highways and traffic control
devices. Vandalism is usually a misdemeanor.
Prosecution is normally handled by the county or
municipality in which the vandalism occurred
2-5.00 SPEED RESTRICTIONS
2-5.01 Basic Speed Rule (MSA 169.14, Subd. 1
The basic rule states in part that .No person shall
drive a vehicle on a highway at a speed greater
than is reasonable and prudent under the
conditions and having regard to the actual and
potential hazards then existing." This law
governing motor vehicle speed provides that
motorists are responsible for restricting their
speed to that which is reasonable under the
existing conditions. Regardless of the posted
speed limit, this basic concept governs the
enforcement of speed laws
2-5.02 Authority to Establish Speed Limits
Mn/DOT has the authority and responsibility to
establish speed limits on Trunk Highways and to
authorize speed limits on any street or highway
in the State. The purpose of this section is to
discuss the laws and regulations permitting the
restriction of speed on Minnesota streets and
highways.
2-5.03 Speed Limits
2-5.03.01 MSA 169.14, Subd. 2
states in part that:
"Where no special hazard exists, the following
speeds shall be lawful, but any speeds in excess
of such limits shall be prima facie evidence that
the speed is not reasonable or prudent and that
it is unlawful; except that the speed limit within

1988 edition, (herein referred to as the "FHWA MUTCD"), and Errata
Notification of Correction dated November 2, 1989. and
WH EREAS, this FHWA MUTCD has been approved by the Federal
Highway Administrator as the National Standard for all highways open to
pUblic travel in accordance with Title 23. U.S.C. Sections 109(d), 315 and
402(a), and 49 C,F.R. Section 1.48, and
WHEREAS, the Minnesota Department of Transportation has
ammended the FHWA MUTCD by adding Appendices and revising or

It is further ordered that the provisions of the 1991 MN MUTCD shall be
implemented and applied to all traffic control devices installed on or after
July 1, 1992 upon highways within this State except for pavement
markings which shall be in compliance as of the first application after
January 1, 1992 and except for those traffic control devices which
conform to the 1986 edition of the MN MUTCD and are on order or
under contract prior to July 1, 1992. All existing traffic control devices or
Installations not in conformance with standards in the 1991 MN MUTCD
shall be changed to conform to the new standards herein when replace-

The 1991 Minnesota Manual on Uniform Traffic Control Devices for
Streets and Hiahwavs (1991 MN MUTCD) has been established to provide
a uniform policy for all traffic control devices on all public streets, roads
and highways within the State of Minnesota. This Manual was prepared
pursuant to the authority vested in the State of Minnesota, Department of
Transportation as provided in Minnesota Statutes, Section 169,06, subd.
1 (1990). Standards described within this Manual may also be used by
private agencies on facilities which they control. It is recommended that
such be done so that the meaning of traffic control devices be uniform
throughout the State.
This Manual is in substantial conformance with the 1988 edition of the
Manual on Uniform Traffic Control Devices for Streets and Hiahwavs
(MUTCD) as published by the U,S. Department of Transportation, Federal
Highway Administration (FHWA). Many pages of this Manual are identical
to those found in the FHWA MUTCD, while others have been modified to
meet State laws or to more closely reflect the conditions and policies of
Minnesota.

AMENDMENT NO.1
TO
RESIDENTIAL RECYCLING AGREEMENTS
THIS AMENDMENT NO.1 is made this 8th day of June, 1993 (the date of the signatures of the
parties notwithstanding), between the COUNTY OF ANOKA, State of Minnesota. hereinafter referred to as the
"COUNTY", and the CITY OF ANDOVER, hereinafter referred to as the "MUNICIPALITY".
WITNESSETH:
WHEREAS, the parties entered into an Agreement for Residential Recycling Program on December
8, 1992, for the purpose of providing SCORE funds received for the calendar year 1993 to cities and to'MlShips
in the County for solid waste abatement programs (hereinafter referred to as the "Agreement"); and
WHEREAS, the COImty has received $369,178.00 in said SCORE funds from the State of Minnesota
for the second half of 1993, for a total of $738,357.00 for the calendar year of 1993; and
WHEREAS, the County wishes to assist the Municipality in meeting recycling goals established by
the Anoka County Board on February 26, 1991. by providing said SCORE funds to cities and to'MlShips for solid
waste recycling programs; and
WHEREAS, the County wishes to provide additional flexibility for the use of said SCORE funds;
NOW, THEREFORE, in consideration of the mutual covenants and promises of the parties, the
parties mutually agree to amend the Agreement as follows:
) 1. Section 6 of the Agreement shall be amended to read as follows:
6. ELIGIBILITY FOR FUNDS. The Municipality is entitled to receive reimbursement for
expenditures for eligible activities up to the project maximum as computed below. which shall
not exceed $39,317.75. Revenues or other reimbursement received from the sale of recyclable
materials may be used only to fund the Municipality's residential recycling activities or the
Municipality's programs for managing the following residential waste: used oil, waste tires,
antifreeze and yard waste. Expenses incurred by the Municipality for managing a residential
drop-off recycling center, including the costs for disposing of waste improperly left at such
recycling center, shall be eligible for reimbursement as a recycling activity. The project
maximum for eligible expenses shall be computed as follows:
A. A base amount of $10,024.00 for residential recycling activities or the Municipality's
programs for managing the following residential waste: used oil. waste tires, antifreeze
and yard waste; and
B. $6.25 per household for residential recycling activities or the Municipality's programs
for managing the following residential waste: used oil, waste tires, antifreeze and yard
waste.
C.
A supplemental grant of $8,422.92 (hereinafter referred to as a "Supplemental Grant")
for problem material management, solid waste recycling and yard waste abatement
programs to be disbursed to the Municipality within thirty days of execution of this
Agreement. Notwithstanding anything in this Agreement to the contrary. the
Municipality shall be entitled to use said Supplemental Grant monies only for eligible

expenses paid by the Municipality during the period January I. 1992. through June
30, 1993. for problem material management, solid waste recycling and yard waste
abatement programs. On or before July 20, 1993. the Municipality shall submit a
report itemizing the expenditures of the Supplemental Grant monies on a report form
provided by the County, together with receipts verifying said expenditures. Any
Supplemental Grant monies not expended by the Municipality on or before June 30.
1993, shall be returned to the County.

BACKGROUND
Letter of Credit 187-1093 was established by First Banks for the
Hills of Bunker Lake Addition, per terms of the Development

The special assessments for this project have been paid down to a
balance remaining of $23,802.65 which combined with the
grading and ponding escrow required is less than the certificate
of deposit pledged to the City of Andover. Therefore, this Letter
of Credit may be released.
Letter of Credit #88-1121 was established by First Banks for the
Hills of Bunker Lake Third Addition, per terms of the Development
Agreement for City project #88-5.
The special assessments for this project have been paid down to a
balance remaining of $57,131.89 which combined with the grading
and ponding escrow required allows the reduction of this
Letter of Credit from $53,000 to $38,200.

Re: Public hearing - street lights for Woodland Meadows
Dear Mr. Hass,
We are writing to express our strong opposition to the proposed
street lighting project for Woodland Meadows. We would also like
to express our disapproval of the methods used to obtain signatures
on the petition.
Although my wife did sign the petition, she, and we believe
many others, relied more on the verbal explanation by the petition
bearer than on the words written on the petition. My wife was
told that the petition was to be used to obtain cost figures
and would not be the official petition. She did not place an
"X" in either column but copies of the petition shown to us indi-
_cate ".her approval.
Although we don't believe the petitioners to be dishonest,
we believe their zealous efforts may have resulted in others sign-
ing that may be opposed to the project.
We would like the project to be tabled and a new petition
be circulated that will more clearly indicate the attitude of
the residents of Woodland Meadows.
We are opposed to street lighting for Woodland Meadows but
would support the petition limiting the lighting to the southern
part of Woodland Meadows.

Attended NSFMA poster winners award night in Anoka.
Attended several ARC meetings. A SPUR gas station at the SW corner of
Hanson & Bunker was one of them.
Attended NSFMA meeting in Maple Grove. The DNR was there. They still
have not gotten to all the cities on permits. We must use their permit
and attach our permit.
In January and February will need help with Scout programs at night. If
anyone would like to help, let Joyce know. They will usually be on Tues.

BACKGROUND
This plan amendment proposcs to add approximately 38 acres to its urban service area, The area to
be included is the City I-Iall Park Complex No, 2. The 38-acre MUSA expansion request is to provide
the main park complex huildings with city sanitary sewer, The park complex will be equipped with
softbalUbasebaH fields, soccer fields, two volleyball courts and a central building, which would be
hooked up to the sewer ~y.~tem, The proposed facility will add approximately 822 gallons/day to
Andover's projected sewer flow. The Metropolitan Disposal System has adequate capacity to provide
for the wastewater needs proposed in the plan amendment. The plan will not impact the
metropolitan transportation system.
The amendment is ill conformity with meLropolitan system plans.
RECOMMENDA nON
That the Metropolitan Council inform the city of Andover that it may place the plan amendment into
cffcct and no plan modification is necessary.

EXECUTIVE SUMMARY
L"lTRODUCTION
The city of Andover is proposing to add approximately 235 buildable acres (275 tutal acres) to the
Metropolitan Urban Service Area (MUSA). The area to be included is generally located in the
southeastern pan of the city (see Attachment 1). The 23S-acre MUSA expansion will add
approximately 517 housing units to thc urban service area of Andover.
The 235 acres included in this plan arnenument wcre originally included in the MUSA expansion
proposed as part of the city's overall plan revision submitted to the Council in December. 1991.
ISSUE
The key question the Council must address in this plan amendnlem is whether to allow the city to
place this plan amendment, which wi\! add 235 acres to the MUSA, into effect. The major issues
3~~ocillted with this plan amendment are the putential transportation impact~ created by additional
development from an expanded MUSA. Specific311y, the city of Andover prujected that increased
development will result in congestion on TH 10 and TH 65 after the year 2000. The city of
Andover identified potencial impacts from analysis done in conjunctiun with the revision of its
overall plan amendment in 1991 (Referral File No. 14206-5). In that plan review, Council
required a plan modification in which the city had to withdraw all MUSA expansion requests
(excepr 100 acres) until a comprehensive traffic analysis of the potential impact of the planned
land uses will have on TH 10 was completed.
At its April 15, 1993 meeting, the Committee of the Whole heard the mayor and statT from
Andover propose a three-year interim plan for MUSA expansions. The COlIuniuee directed the

staff to work wiLh lilt: city of Anduver to devdop an updated transportation plan and to arrive at
an int~rim proposal which coulll be broughl back to the Cuuncil. This plan review is part of that
interim agreement.
Recently, [he cities of Andover and Ramsey and Anoka County have cuntracted with a consulting
linn tn evaluale the potential congestiun problems and to recommend solutions. Council staff has
worked with the city and Anolca County on this lranspon:uion study effort.
ANALYSIS
The city of Andover projects to have 7.585 households in 2000, substantially above tht.' Council's
forecast of 7,150. Household forecasts are the basis for detennining land demand in a particular
community. Applying land demand factors to the Council's forecasted households results in a
LOtal demand plus overage for land within the MUSA of 1.711 acres for the year 2000.
Based 011 information provided by the city, there are currently 3,5:0 acres of land in the MUSA
designated for residential u.~e. This land is near full development. As of December 1.993, there
were 502 acres of develnpable land within the MUSA. Subtracting the available acres (502) from
the: demand (1,711 acres) indicates that the city can justify adding 1,209 acres to the MUSA.
With this plan amendment, the city is requesting to add 235 acres (275 gross acres) to the MUSA.
From the standpoint of supply and demand, the city can justify adding the 235 acres requested to
the MUSA.
The earlier plan amendment (Referral File No. 14206-5) idcntified potemia) traffic congestion
problems associated with additional development in Andover. As part of the review of that
amendment, the Council din:cted the city to address the potential congestion problems. The
Council also directed staff to work with tbe city and the county in addressing those problems and
in dcwloping an interim agreement for fUlure MUSA expansions. The cities of Andover and
lbmsey and Anoka County hay\: contracted with a eunsulting firm to cOlllpl~lt: this work. Staff
has reviewed the scope nf work and helicves it will define ule future problems on TH 10 and TH
65 in Andover and Ram\ey. A variety of solutions will be identified. Staff believes Andover is
making progress on the study, and on the basis of the progress made and the cOlIunitment of Lhe
city of Andover and the County. it reCOl1Ullcnds that the city be allowed to place the amendmem
imo effect.
There is sufficient capacity in the Metropolitan Waste Disposal System to aL:commodate the
sanitary sewer flow anticipated from the proposed MUSA area. The city has modified its on-site
septic system ordinance to meet Council policy requirements. The city ha.s adopted the Cuuncil's
Interim Strategyfor the Reduction of Nonpoint Source Pollution, and the amendment states that
stormwater runoff resulting from development of the area will be divertt:d to sediment basins
prior to it ultimate discharge into any wctland or Coon Creek. The amendment is con.~istent with
Council housing policies.

expansion request until a comprehensive traffic analysis that evaluates the potential impact the

of Andover presented a proposal for a three-year interim plan. The plan callc:d for 200 acr~s to
be added to the MUSA for each of three years. They asked that the Council staff be Jirected to
work with Andover Maff to develop an interim development proposal based on the 600-acre
allocation.
The Metropolitan Council directed the Council staff to work with the ciTies and county on this
tranSportal ion study effon. The Committee also directed the staff to work with the city of
Andover to arrive at an interim proposal, which woulJ then be brought back to the Council.
On May 13, 1993. the Melropolitan Council respondeJ to the chy of Andover's response to a
plan modification. In that response, the city responded to all the non-transportation modification
requiremctlls. In addition, it agreed to work with the surrounding conununities and Anoka
County TO prepare a compr~hensive traffic analysis that evaluates the potcllIial impact the
planned land lilies will have on TH 10. On that basis. the Council allowed the city tu place the
plan amendment (Referral File No, 15i96-2) imo effect in which the city added 100 acres [0 the
MUSA.
Since that time, the cities of Andover and Ramsey and Anoka COUlllY have contributed $27,000
and contracled with the consulting firm of BRW to prepare an update to lhe Anoka County
TranspOrtation Plan. The consulting tinn has begun the planning process. and is in the early
stnges of data gathering and analysis. The study is expected to be completed by August, 1994.

The Metropolitan Land Use Planning Act of 1976 rcquires local units of govcrrunent to submit
comprehensive plan amendments to the Mctropolitan Council for review (Minn. Stat. 473,864,

~ubd. 2. 1978). The Act al~o gives lh~ Council th~ authority to establish guiddines governing the
amendment r~view pro\;css (Minn. Stat. 4i3.854).
The city of Andov~r submitted its proposed comprehensive: plan amendment on August 26. 1993.
On October 19. 1993. the Chair determined that th~ amendment prescmed a potential impaCt on
the mCtropolitan rran~portation system. Ba~ed on an extension of the review period, the 90-day
review period will conclude on January 31. 1994.
ANALYSIS
Metropolitan Development and Investment Framework
Forecasts (Micha~1 Munson)
Anduver's plan furecasts population (17,000) chat is above the forecast of the Metropolitan
Council (22,300) for the year 2000. The plan contains a proj~cted average houschold size of 2.8
persons per household for th~ year 2000. ThLs n:sults in a furecast of 7 ,585 hous~holds ill 2000,
above the Council's forecast of 7,150. 'nIe city averaged abuut tOO residential permits from 1980
to 1984, and about 315 per year from 1985 to 1989. Since 1989 the city has averaged 375 building
permits, the majority (80 percent) within the MDSA,
The dty's forecasts indicate some increase in growth in households in the 1990's (2,282) over the
1980's (1.961). The growth in the next decade is then forecast to decline to 1,800. Gi....en th~
sharp slowdown in regional growth anticipated for the 1990's and beyond, few if any cities are
likely to surpass th~ growth Lhey experienced in the 1980's. The only ones that have allY chance
of doing so are conununities on Lhe edge of development (emerging suburbs). They will continue
to experience rapid growth as closer-in suburbs fill up. Whether they can actually increase the
allluunt of growth they receive will depend on how fast the region grows.
I..1nd Supply and Demand
When local governments request an expansion or their M lJSA lines. the Metropolitan Council
reviews those requests based on several criteria, The local unit of govenunent must demonstrate
a regional need and there must be adequate capacity available in the metropolitan seWer and
highway systems. The Council initially reassesses land supply and demand based on a comparison
of figures pro....ided by the city and current Council forecasts. If the city's land supply is below or
approat'hing the tive-year overage and regional facilities are adequate, the Council will agree to
service the expansion area.
l3ased 011 information provided by lhe city, there are 3,520 acres of Jand in the MUSA designared
for residential use. TIus land is near full development. Based on the analysis of Council staff. the
city of Andover had 258.6 acres of developable land within the MUSA in 1991. Of this land,
138.6acres was desig.n,.lted as residential and 110 at;n:s was designated as (;onunercial. Since 1991,
the city has add~d 244 acres of land to the MUSA, As of December 1993, there wt:re 502 acres
of developable land within the MUSA.
Land demand is bas~d on household forecasts for the eity of Andover. The Council forecasts
7,150 houst:hulds in Andover in the year 20{)(). This represents an increase of 2,270 households

u.:twecn 1990-2000. Applying laml demand factors, the. demand for Lhe city for the different land
L1ses will be 906 residential acres, 10 commercial acres, 50 industrial acres 5 public acres, 135 acres
for streels and 35 acres for parks. This yields a total demand of 1.141 acres which with overage
yields a 10lal demand of 1,711 acres in 2000. Taking the availahle acres from th~ demand plus

Wilh Lhis plan amendment, the city is requesting to add 235 nCI acres (275 gross acres) to the
MUSA. From the standpoint of supply and demand, the cilY can justify adding the 235 acres to
Ihc MUSA,
Sanitary Sewers and Surface Water (Jim Larseu)
Sanitary Sewers
Sufficient capacity exists in the Metropolilau Waste Comrol Commission's disposal system to
accommodate the sanitary sewer flow anticipated from the proposed MUSA art:a. The city has
modified its on-site septic system ordin.'lllCe to meet Council policy requirements and is in the
process of implementing those changes.
Surtace Water Quality
The city has adoptcd the Council's Interim Strategyfor tile RedllcriOll of Nonpoint Source Pollution.
In addition, the proposed amendment specifically slates that SlOrmwater lunoff resulting from
dcvelopment of the area will be diverted to ~ediment basins prior to its ultimate dischargc inco
:lIlY wetland or Coon Creek.
Transportation (Carl Ohm)
The city of Andover has submitted a MUSA alIlt:mlmem for 235 acres (275 gross acres). That
submittal does not resolve the issues raised in the Council actions of April 15, 1993 (Referral File
No. 14206-5). At the Council meeting of April 22, 1993, the Council instructed the staff to work
with the conununities to address Ihe transportmion problems created hy additional development
from an expanded MUSA. The Council also instructed the staff to work with the city of Andover
to develop an interim agreement on future MUSA t:xpansions. This plan amendment is part of
that interim agr\:ement.
The key prohlem was the projected congestion on TH 10 and TH 65. The updating of the Anoka
County Transportation Plan WaS recommended by the Council as a means of analyzing the
problem and developing a strategy Ulat would address the impacts of an expanded MUSA.
The city along with Ramsey and Anoka County have entered into a contract with a consulting
firm (BRW) to complete this work. Staff has reviewed the scope of work and believes it will
define the future problems on TH 10 and TH 65 with and without added MUSA in Andover and
Ramsey. In turn, if a congeslion prohlem is projected, a variety of solutions will be identified.
While t11e projected problems on TH 10 and TH 65 still appear valid, staff believes Andover is
ma1cing progress in better deflning the problems and solutions. On the basis of the progress made
and the commitmelll of the cicy of Andover and the county, staff recolluuends that the city be

allowed to place the: plan amendmcm into effect, but that the Council not allow any further
expansion of the MUS A until the update to the Anoka Coumy Trall-sportacion Plan is complete.

Housing (Audrey Dougherty)
The propo!;ed addition of 235 acres to the MUSA will add 571 housing units to the city at a
density of 2.2 units per acre. The amendment proposes to add a wide range of housing values
designed to serve low, moderate and upper income levels. and identifies that a number of units in
the $77,900 to .$90.00 range are planned. The 1990 Census indicated thac the city had a median
housing value of $95,500. Figures also indicated a single-family housing vacancy rate of 1.9
percent, Thal rate is nearly twice the one percent rate considered healthy for movement in the
market. The city should monitor carefully the addition of future single-family units to avoid
increasing vacancy concerns.
The amendment is consistent with Council housing policies. Policy 22 states: "Communities at
least partially within the Metropolitan Urban Service Area have the responsibility to provide
adequat~ land for projected housing growth and an appropriated share of housing opportunities
for people with low, moderate and modest incomes."
FIr'mINGS AND CO~CLUSlONS
1. Based on land supply' and demand in the city, it can justify adding 1.209 acres to the
MUSA. ,Therefore. the city can justify adding the 235 acres included in this plan
amendment to the MUSA.
2. Sufficiem capacity exists in the Metropolitan Waste Control Commission's disposal system
to accommodate the sanitary sewer nuw anticipated from the proposed MUSA area.
3. The city has adopted the Council's I/lterim Stra1egy for the Reduction of Nonpojm Source
Pollution and the plan amendment states thar stormwater runoff from the development
will be diverted to sediment basins prior to its ultimate discharge into any wetland or
Coon Creek.
4, The cities of Andover and Ramsey and Anoka Cuunty have entered into a conrract to
update the Anoh County Transpol1ation Plan. Staff believes that this update will detine

Dear Mr. Sulander:
Enclosed is a press release which describes the changes which the County is considering related
to the costs for funding the solid waste management programs. These changes are a result of
a federal court ruling earlier this year in Martin and Fairbault Counties which eliminated the
County's ability to designate that all garbage collected in Anoka County has to be brought to the
Elk River facility.
As you can see, one of the changes we have adopted is a reduction in the "tipping fee" at the Elk
River facility in order to make that facility cost competitive with out-of-state landfills. This
reduction in the cost to the haulers will need to be made up in some other manner In order to
fund the comprehensive solid waste management program we have established in Anoka County.
We are considering a Solid Waste Management Charge which would be collected with the
property tax bills as the mechanism jor funding the shortfall.
However. the Solid Waste Manaaement Charae should. in larae part. be offset bv a reduction in
the haulers' charae to their customers because of the haulers reduced costs for disposal. It is
possible that some haulers will trv to use this chanae as an opportunitv to raise their rates and
not pass on the full savinas to their customers. We believe that such action on the haulers part
would be inappropriate unless the haulers clearlv indicate thev are raisina their rates. We
estimate that the average disposal cost for a single-family residential unit should be
reduced by about $31 per year. Anything you can do to help us assure that these savings are
passed on to the consumers would be greatly appreciated. .

Because the current method for solid waste disposal in Anoka County greatly minimizes the
potential for SuperFund litigation in the future, we believe that its continuation is of major

County Board Approves Solid Waste Management Charge
A shift in the way Anoka County residents and businesses pay for environmental
protection and waste management programs was recommended by the Board of Commissioners
after a public hearing on December 21. Beginning in 1994, an annual solid waste management
charge to fund environmentally safe programs for processing garbage, recyclable materials and
household hazard?us waste will appear on property tax notices. The new charge will be offset
by reduced garbage bills which citizens pay through municipal utility bills or direct invoices from
garbage haulers.
'rrhe end result of the new payment procedure for solid waste disposal should have little
impact on the overall cost to Anoka County residents - but will provide for the long-term stability
of the County's comprehensive solid waste management system," said Anoka County
Commissioner Dennis Berg. "And it is our clear expectation that this method of funding these
vital services will result in a cutback on individual and commercial garbage bills."

Solid Waste Management Charge - Add 1 f
The Board's action took place in conjunction with a December 14 County Board vote to
approve a decrease in the per-ton fee that waste haulers are charged for dumping Anoka County
garbage at the Elk River refuse derived fuel processing plant. The fee dropped from $77 to $68
per ton. However, haurers who agree to sign a contract for the delivery of waste to the facility
will pay $49 per ton. Minnesota counties are mandated by State legislation to provide an
integrated waste management program to process waste, oversee county-wide recycling
programs and manage landfill abatement.
Formerly, the costs for this mandated responsibility were covered in the fee charged to
waste haulers for dumping their garbage at the Elk River facility. Because haulers were required
by a County "designation ordinance" to ship refuse to the Elk River plant. a guaranteed flow of
garbage kept the facility financially operative and the County's integrated waste management
programs funded.
The Board took action in response to a Federal court ruling in 1993 which found that
controlling the flow of waste across state lines pursuant to the designation ordinance violated
the commerce clause of the U.S. constitution. Consequently, the County is presently unable to
prevent haulers from disposing of waste in out-of-state landfills.
"Starting in 1985, the State of Minnesota required counties to handle their own solid waste
and to reduce the amount of garbage going into landfills. The designation ordinance was key
in fulfilling this cbligation," said Anoka County Commissioner Paul McCarron. "Anoka County has
an environmentally and financially sound method of dealing with waste. Within our system.
electricity is generated from processed garbage; food and yard waste is composted; tree waste
is processed; hazardous chemicals are voluntarily collected from households; and our cities and
haulers cooperate with us in collecting thousands of tons of recyclable material each year. The
result of this work is that. since 1989, the County has kept nearly 600 thousand tons of garbage
out of landfills."

"Lowering the haulers' costs was necessary in order to keep the County's integrated
waste management structure economically competitive and to prevent haulers from shipping
County waste to ecologically hazardous landfills in other states where tipping fees are cheaper,"
said McCarron. "Interstate shipments of waste would have placed County citizens and
businesses in a situation where they could be liable in future law suits similar to the legal
problems seen recently at local landfills."
Anoka County residents and businesses will see the annual solid waste management
charge included on their property tax statements in late February. Individual households will be
charged an approximate annual fee of $36.00, and the fee for business will be based on four
categories of estimated market value, minus the land value.
''The County Board believes that this method of paying for waste management is equitable
because now everyone is participating in the process." said McCarron.
In summarizing the issue. Commissioner Berg said, "Of the numerous choices available
to the County, the system we have chosen is, I believe, the most fair, financially sound and
environmentally safe decision that we could make. The County will conduct careful evaluations
of the process throughout the upcoming months to determine if alterations are needed."
