At the February 7, 1995 and February 21, 1995 City Council
meetings, the Council tabled this item at the request of the
developer. This item is requested to be removed from the table
for dis'cussion.
At the February 21, 1995 Council meeting, Council directed the
City Attorney to work with the developer's attorney, Mr. Steve
Nash, to construct the proper wording for the development
contract pertaining to the creek crossing or a second access for
the future Crown pointe site.
The City Attorney will be providing the language for Council
consideration of this item.

At the February 7, 1995 City Council meeting the Council tabled
this item pending the City Attorney's redrafting of specific
items in the development contract.
If the development contract is approved by the City Council,
Council is recommended to award the bid for Crown pointe East,
City Project 94-22, to C.W. Houle, Inc. in the amount of
$636,842.90 contingent on the final pla~ development agreement
and all other permits and documentation being signed, approved
and executed.

WHEREAS, pursuant to advertisement for bids as set out in
Council Resolution No. 011-95, dated January 17, 1995, bids were
received, opened and tabulated according to law with results as
follows:

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby accept the bids as shown to indicate

BE IT FURTHER RESOLVED TO HEREBY direct the Mayor and City Clerk
to enter into a contract with C.W. Houle, Inc. in the amount
'/ of $636,842.90 for construction of the improvements; and direct
the City Clerk to return to all bidders the deposits made with their
bids, except that the deposit of the successful bidder and the next
lowest bidder shall be retained until the contract has been executed
and bond requirements met.

The original bids identified Ryan Contracting as the low bidder
with C.W. Houle, Inc. as the second low bidder. A bid tabulation
was perfor.med by TKDA which identified an incorrect number in the
Ryan Contracting bid resulting in C.W. Houle, Inc. as the low
bidder.
Upon reviewing the bid tabulation, C.W. Houle, Inc is the low
bidder for the project with a bid amount of $636,842.90. C.W.
Houle, Inc. has successfully perfor.med other projects for the
City.

At this time, the developer does not have an approved final plat
or development agreement with the city.
Prior to award of this contract by the city council, it will be
necessary to insure that all required documentation is complete.
Council can consider the following options regarding this
project.
1. Receive bids but not award a contract at this time.
2. Award a contract to the low bidder, C.w. Houle, Inc. in the
amount of $636,842.90 for the construction of City Project 94-
22 contingent on the final plat, development agreement and all

ROLL FOR THE IMPROVEMENT OF WATERMAIN, SANITARY SEWER, STREETS AND
STORM SEWER , FOR PROJECT NO. 93-11 EMERALD GLEN
THE CITY COUNCIL OF THE CITY OF ANDOVER HEREBY RESOLVES:
WHEREAS, a contract has been entered into for the construction of
the improvements and the contract price for such improvement is
$194,045.74, and the expenses incurred or to be incurred in the making
of such improvement amount to $ 68,770.91 and work previously done
amount to $ 86,568.50 so that the total cost of the improvement will
be $ 349,385.15
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover, MN:
1. The portion of the cost of

2. Assessment shall be payable in semi-annual installments extending
over a period of 10 years. The installments shall bear interest

forthwith calculate the proper amount to be specially assessed for
such improvement against every assessable lot, piece or parcel of
land within the district affected, without regard to cash
valuation, as provided by law, and she shall file a copy of such
proposed assessment in her office for public inspection.
4. The Clerk shall, upon the completion of such proposed assessment,
notify the Council thereof.

The City Council is requested to approve the plans and
specifications and order the advertisement for bids for
Project 94-32, Well *5 construction.

At the February 7, 1995 City Council meeting, the Council ordered
the plans and specifications be prepared by TKDA for this
project.
This project will be bid in two phases. The first phase will be
for the drilling and development of the well. The second phase
will be a separate bid for the well pump and electrical system.
This will be let as a separate contract at a later date to insure
the well pump and controls are sized appropriately based on the
results that are obtained from the drilling and test pumping of
the well under this contract.
The plans and specifications are available in the Engineering
Department for review.

The City Council is requested to approve the assignment of
easement rights that are being conveyed from Jeffrey R. Luedtke
and Hope Luedtke to the City of Andover.
Attached is a letter from the City Attorney explaining the
situation.
The City Staff is concerned that the easement does not meet the
requirement of 60 feet as required in Ordinance 10. Attached is
a map that shows Jivaro street NW which the City currently
maintains and will continue maintaining from 165th Avenue NW to
the red reflectors. That portion between where the red
reflectors are and the existing home, the City has been using
this.section to drive their vehicles, with some blading, up to
the home to be able to turn around.
The first question is should the City require a 60 feet dedicated
easement/right-of-way and meet the required Standard
Specifications for Rural Residential Street Construction
(bituminous with necessary storm sewer)? The second question is
should an easement/right-of-way provide for a turnaround near the
home since that is currently where the Public works vehicles turn
around now?
Note: A portion of this road is currently designated as a
minimum maintenance road.

Dear Dave:
Enclosed please find an Assignment of Easement Rights that is being conveyed
from Jeffrey R. Luedtke and Hope Luedtke to the City of Andover. This concerns
a parcel of property that the Luedtkes own. They currently have a home on this
land and want to demolish it to construct another home. It is my understanding
the City has been maintaining a roadway to this property; however, there has been
no formal conveyance of an easement to the City, In order to avoid the question of
whether or not the property fronts on a public roadway, we have required the
formalization of this easement. Mr. Luedtke has obtained an easement from Anoka
Independent Grain and Feed Dealers, Inc. which covers the location of the roadway
at the present time. Originally, I had asked that the easement run from the Anoka
. Independent Grain and Feed to the city; however, he has had difficulty getting the
attorney for Anoka Grain to complete the documents and we agreed that they
would merely assign his easement rights to the City. The easement has already
been recorded, however, it is necessary for the City to accept the assignment.
Accordingly, I would ask that you present this matter to the city council for
acr.eptance of the easement rights assigned under this document. The acceptance
portion that I have completed on the Assignment of Easement Rights must be
completed by the City and it should be returned to me for recording. If you have
any questions, please contact me.

transfer unto the City of Andover, a municipal corporatio~,
Assignee, all the Assignors' interest in that certain Easement
Agreement dated the 20th day of October, 1994, made by and between
Anoka Independent Grain and Feed Dealers, Inc. , a Minnesota
corporation, and Jeffrey R. Luedtke and Hope Luedtke, husband and
wife, filed for record in the Office of the Anoka'~ ~ty Recorder
on December 2, 1994, as Document No. 1145919, which Co .J~nt grants
an easement over the following described property located in Anoka
County, Minnesota, to-wit:
An 18 foot easement for roadway purposes over, under and
across the following described property:
The Southeast Quarter of Section 7, Township 32,

Many communities throughout the area have a City Flag which tries
to consolidate or capture a theme that can be positively
identified with the people.
Flags serve as a symbol of strength, unity and identity. In an
effort to foster pride and interest in Andover, I would ask the
Council consider requesting input from residents for the
creation of an Andover flag.
A contest was held a few years ago for the development of a
"logo." A prize was offered to the winner. I have requested
that the LIONS Club consider sponsoring a prize for the
development of a City flag, so a similar contest could be held
this spring. Once complete, the flag could be kept on display at
City Hall for everyone to enjoy. The flag could also be used for
special occasions such as parades, community events etc.. (See
the Display of flags notice from last years league of cities
registration. )

The League of Minnesota Human Rights Commissions is urging
communities not having developed a Commission, that they consider
doing so at this time.
The essence of this type of commission is to provide support to
victims of acts of bias and/or prejudice, and education to
citizens.
The first step in organizing a Human Rights Commission would be
to accept a volunteer to act as an area representative as part of
the League's statewide Hate Crimes Response Network. The
Minnesota League, which has requested this action, has included
a form used to identify an individual contact.
The League will help get a commission started in Andover if there
is interest from the City Council to do so.

As you may have read, following nine regional meetings held around
Minnesota this past year, we have begun a statewide response network to
come to the aid of victims of hate-bias crimes, and to work to prevent such
ugly incidents from occurring. To date we have 127 persons who have signed
up to represent their communities by befriending any local victim of a hate
crime, and in helping us mobilize local support for such victims.
We especially need representation from cities and towns that do not now have
a Human Rights Commission. So please take up this request at a forthcoming
City Council meeting, and then let us know whom your representative will be
by completing and returning the enclosed form to us. The enclosed material
provides the necessary background infonnation, which of course can be
tailored to your local needs. We would be pleased to answer any further
questions you may have on this important matter, and/or starting a local
Human Rights Commission.

To Human Rights Commissioners:
What would you do if there were cross bumings in your
community? What action would you take if swastikas were
painted on waIls in your town? Suppose hate crimes were
reported in your area as they are, in increasing numbers, all
around the state. Is your Commission prepared to respond?
The League of Minnesota Human Rights Commissions has set
a goal to express concern and regret to victims of overt acts of
bias and prejudice. Members of the League are creating a
human rights network of local Human Rights Commissions
and community groups to promptly contact the victims in a
supportive manner.
. The Midwest has a long-standing tradition of neighbors coming
to the support of those who have suffered losses. Fanners do
the field WOIX of a neighbor who is ill; church committees bring
casseroles to families who are experiencing sickness and death.
There are cards, collections, visits. Sympathy is appropriately
expressed to create a supportive presence.
The League wishes to build a netwoIX of people who will
support victims when a hate crime has OCCUlTed. The flow chart
on the next page diagrams a plan for responding to acts of bias
and prejudice. Steps to create the Response Netwolk are listed
on this page. Ideas from this letter (with appropriate variations)
may be used by your local commission to contact groups in
your community.
No centrally designed plan will fit every community. We hope
these ideas will stimulate your Commission to think about how
your community should respond if hate crimes occur. We urge
you to design your own Response Network.

Dear Friends,
It has come to the attention of this Commission that you and your family have
suffered harassment in your home and that damage has been done to your
property. We understand from authorities and news reports that the
motivation for these acts is racial bias and prejudice. The Commissioners
express regret that this has happened. It saddens us to know that someone in
our community is going through such an ordeal.
We are alerting our bias Response Network to this outrage and someone will
be calling you soon to arrange for an appointment to discuss how we can be of
continuing support to make certain that such an ugly act does not recur. If you
prefer, we can discuss this by phone ( ).
Enclosed is a brochure outlining what your rights are in this case and what
organizations you may contact for help and support.
We see once again that much work needs to be done to stop hate crimes in our
communities. This quotation from Charles Kuralt captures our thinking on
this: "When will there be justice in America? When one who is not injured is
as incensed by injustice as those who are injured.- We are incensed by this
incident and are motivated to increase our efforts in the Human Rights arena
so that this type of incident will not happen here again.

on a Sunday Liquor question after the same issue has been previously defeated by the
voters. If the question is brought by petition it cannot be held for six months from the date
of the first election on this subject,( Minnesota Statutes 205.10). If the special election is

at least 45 days prior to the day of the election, (Minnesota Statutes 205.16).

I am writing to request that you place en the March 7, 1995
Council agenda the que.tion of whether the Council would hold
another election on Sunday liquor in Andover.
In addition, I would greatly appreciate it if you would permit me
to speak ~o the council on the question of holding another
election. There are several reasons for my request:

1)
Only 600+ people out of an estimated population of
24,000 voted in the eleotion held a few weeks ago. By
my calculation, that is about two and one-half percent
decided the issue ot Sunday liquor.
2) Such a small turnout indicates that the decision may
not reflect the will of the electorate.
3) I now understand that it iB very important to PUbliCize
the election so that a larger percentage of the
electorate turns out, and I will pledge to do so, if
given the opportunity.
4) I made a large investment in the softball fields and
other fixture. at Pov'a Sports Bar so that weekend
softball tournaments would be available. without
Sunday liquor, I will lOBe the softball tourn~ment
business, estimated at $500,OOO/year.

REQUEST
The City. Council is requested to review and approve modifications to
Resolution R036-92 which set service charge fees for nonsufficient checks.
, At the present time a fee of five dollars ($5.00) is being charged to residents
when they present a bad check. This fee is added to the residents utility bill
J and the check is redeposited. If the check is returned a second time, a twenty
dollar ($20.00) fee is charged to the residents utility bill.
City staff is requesting that the fee be raised to twenty dollars ($20.00) when the
check is proven to be bad. At this time the fee would be added to the residents
utility bill and a letter sent to the resident requesting the resident to
send or certified check or drop off cash to cover the bad check. The bad check
would not be redeposited.
By implementing this procedure, efficiency will be improved and time can be
utilized more effectively.

WHEREAS, the City Council of the City of Andover has
previously adopted Resolution No. R036-92 which established
the bad check fee for services for the 1992 year; and
WHEREAS, the City Council of the City of Andover, due to
increasing costs has deemed it necessary to amend the fee for bad
checks.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Andover that the bad check fee for checks received for
payment of a City utility bill shall be twenty dollars when the
check is not honored by the bank.
BE IT FURTHER RESOLVED that the above bad check fees shall be
automatically added to the individuals next utility bill.
BE IT STILL FURTHER RESOLVED that the bad check fee for
checks not related to a utility account remains at twenty
dollars.

exercised his rights under the Occupational Safety and Health Act of 1970, Minnesota
Statutes 182.65 (et. seq. 1992).
As a result of our findings, it has been determined that there is insufficient evidence
to support this discrimination complaint. Therefore, the Department of Labor and
Industry has closed this file as a "non-merit" case. The complainant does have the
right to appeal this dismissal to Gary Bastian, the Commissioner of the Department
of Labor and Industry, within fifteen days of receipt.
