Union as the official newspaper for the city of Andover, Minnesota for the
year of 1995. The Anoka County Union is a legal newspaper, printed and
published in Anoka County and meets all legal qualifications.
Our legal rates for 1995 will be $5.10 per column inch for the first
pUblication and $4.50 for each successive week.
We also wish to express our appreciation for the opportunity of serving
your community throughout the past years. If we can be of any service

A RESOLUTION REVISING THE AUTHORITY OF THE TREASURER TO PAY CLAIMS.
WHEREAS, the 1993 Legislature passed into law the State Auditor's
bill, Chapter 315 (S.F.580) which provides for the delegation of
authority to pay claims to certain administrative officials; and
WHEREAS, the City Council recognizes the need to pay claims of the
city in a prompt and prudent manner while exercising frequent review
and approval of said claims; and
WHEREAS, the City Council adopted resolution R181-93 on August 3,
1993 delegating the authority to pay claims up to $5,000 per vendor to
the Treasurer; and
WHEREAS, the need to raise the per vendor limit to $10,000 to
promptly pay various claims of the City to meet discount dates or avoid
late payment fees is prudent.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of
Andover hereby authorizes the Treasurer to pay claims and bills not to
exceed $10,000 per vendor prior to City Council review. Said claims and
bills must be presented for City Council review at the next regularly
scheduled council meeting.

REQUEST
The City Council is requested to approve the attached resolution
authorizing the Treasurer or Deputy Treasurer to wire transfer
funds from the official City depository for investments or bond
payments.
BACKGROUND
The City Council adopted resolution R018-91 on February 5, 1991
authorizing this procedure specifically from First National Bank
of Anoka. Since this institution was merged into Norwest Bank N.A.
the authorizing resolution needs updating.
I have re-worded the resolution to state the 'official City
depository' to eliminate the housekeeping function of future
updating of this authority should the City's official depository
change again.

A RESOLUTION AUTHORIZING THE CITY OF ANDOVER TREASURER TO WIRE
TRANSFER FUNDS FROM ALL BANK ACCOUNTS AT THE CITY'S OFFICIAL
DEPOSITORY WITHOUT REQUIRING A SECOND APPROVAL.
WHEREAS, the City of Andover annually adopts by resolution the
official depository for City monies; and
WHEREAS, resolution R018-91 adopted February 5, 1991 authorized
the Treasurer to wire transfer fund from First National Bank of Anoka,
know known as Norwest Bank, without a second authorization; and
WHEREAS, the City of Andover periodically desires to transfer
funds to other financial institutions or bond paying agents through the
use of electronic wire transfers in an efficient and uncomplicated
manner; and
WHEREAS, the dollar amounts for wire transfers are larger than the
City of Andover authorizes the Treasurer to act on the City's behalf to
pay claims up to and including a $10,000 per vendor limit prior to
Council review.
NOW, THEREFORE, BE IT RESOLVED that the City Council authorizes
the Treasurer to wire transfer funds from the official City depository
for the purpose of investment placement and/or payment of bonded debt
without a second approval.
BE IT FURTHER RESOLVED that wire transfers must be approved for
internal control procedure by the Finance Director with documentation
kept for permanent record of the transactions.
Adopted by the Andover City Council on the 3rd day of January, 1995.

The City Council is requested to adopt the attached resolution
designating the City's official depositories, supplemental
depositories for investments, and designating the Treasurer as
the approval authority for the collateral transactions.
BACKGROUND
Minnesota State Statutes Section 118 requires the City Council to
designate official depositories annually. Financial institutions
designated as official depositories are the only institutions in
which city funds may be deposited.
Section 118 also requires the City Council to receive collateral
for all deposits in excess of federal insurance or to authorize
the Treasurer or Chief Financial Officer to receive the
collateral. The last paragraph of the resolution delegates this
responsibility to the Treasurer.

WHEREAS, Minnesota Statutes, Section 118 sets forth the
procedures for the deposit of public funds which include requ~r~ng the
Andover City Council to annually designate the official depositories
for City funds and manage the collateral pledged to such funds; and
WHEREAS, other financial institutions are, from time to time,
able to pay the City of Andover interest rates on deposits which are
greater than can be obtained from the official depositories.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover that the City's official depositories for 1995 are the Anoka
office of Norwest Bank Minnesota, N.A. and the Andover office of
Firstar Bank of Minnesota, N.A.
BE IT FURTHER RESOLVED that Norwest Investment Services Inc., the
Minnesota Municipal Money Market Fund, Firstar Trust Co. of Minnesota,
First Bank Minneapolis, FBS Investment Services Inc., Twin City Federal
Savings and Loan, Merrill Lynch, Pierce, Fenner and Smith Inc., Dain
Bosworth Inc., Dean witter Reynolds Inc., Piper Jaffray Inc., Fidelity
Investments, Smith Barney Shearson Inc., paineWebber Inc., and
Investment Emporium in conjunction with Royal Alliance Associates, Inc.
be designated as additional depositories for 1995 for investment and
cash management purposes only.
BE IT STILL FURTHER RESOLVED that the Treasurer of the City of
Andover is hereby designated as the approval for the release and
acceptance of all collateral to be held by the City in conjunction with
City funds on deposit with authorized institutions.

The City Council is requested to appoint Park and Recreation
members for terms that expired on December 31, 1994.
The 3 terms that have expired are Tom Anderson, Jeff Kieffer and
Al Grabowski. Al was recently appointed to the Commission. Tom
and Jeff have requested to remain on the Commission.
In addition, if Tom is appointed to the Commission he has
indicated interest in being chair for 1995. Tom has filled in as
chair for approximately 3 months during 1994 due to Darrell
Delarco resigning. Jim Lindahl was acting chair also during
those 3 months and could remain as acting chair if the City
Council so chooses.

Anoka County Commissioner Paul McCarron has requested that the
City Council appoint one elected official to serve on an advisory
committee for the Anoka County Housing and Redevelopment
Authori ty.
He has also requested that one staff person be appointed to serve
on a technical sub-committee. Dave Carlberg, Planning Director,
has agreed to serve on the sub-committee.
Attached is a letter that was sent to the mayors in Anoka County
requesting these appointments.

REQUEST
The City Council is asked to review the Special Use Permit request
of Robert paddock to operate a home occupation (build fireplace
surrounds and cabinetry) in an accessory structure on the property
located at 2439 "South Coon Creek Drive NW (PIN 28-32-24-14-0004).
BACKGROUND
Consult the attached staff report presented to the Planning and
Zoning Commission on December 13, 1994 for further background
information.
In granting a Special Use Permit, the City Council shall examine
the effect of the proposed use upon the health, safety, morals and
general welfare of occupants of surrounding lands.
PLANNING & ZONING REVIEW & RECOMMENDATION
The Planning and zoning Commission, at their December 13, 1994
meeting, recommended approval of the Special Use Permit with
conditions. Attached for your review are the minutes from the
meeting which reflect those conditions. Also attached is a
resolution for Council review and approval.

A RESOLUTION GRANTING THE SPECIAL USE PERMIT REQUEST OF ROBERT
PADDOCK TO OPERATE A HOME OCCUPATION (BUILD FIREPLACE SURROUNDS
AND CABINETRY) IN AN ACCESSORY STRUCTURE ON THE PROPERTY LOCATED
AT 2439 SOUTH COON CREEK DRIVE, LEGALLY DESCRIBED BELOW.
WHEREAS, Robert Paddock has requested a Special Use Permit
to operate a home occupation (build fireplace surrounds and
cabinetry) in an accessory structure as specified in Ordinance No.
8, Section 4.30, on the property located at 2439 South Coon Creek
Drive, legally described as follows:
The East 496.5 feet as measured along the South line thereof, of
the Southeast Quarter of the Northeast Quarter of Section 28,
Township 32, Range 24, lying South of the centerline of County
Ditch No. 57, also known as Coon Creek, Anoka County, Minnesota.
WHEREAS, the Planning & zoning Commission has reviewed the
request and has determined that said request meets the intent of
the criteria of Ordinance 8, Sections 4.30 and 5.03; and
WHEREAS, the Planning and Zoning Commission finds the
proposed use will not be detrimental to the health, safety and
general welfare of the occupants of the surrounding lands; and
; WHEREAS, the use is consistent with the Comprehensive
plan and is determined to be an allowed use.
WHEREAS, there is no impact on governmental facilities and
services.
WHEREAS, the use should have no negative effects on the
sensitive environmental features.
WHEREAS, a public hearing was held and there was no
opposition regarding said request; and
WHEREAS, the Planning and Zoning Commission recommends to
the City Council approval of the Special Use Permit requested.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Andover hereby agrees with the recommendation of the
Planning & zoning Commission to allow Robert Paddock to operate a
home occupation (build fireplace surrounds and cabinetry) in an
accessory structure on said property with the following
conditions:
1. The size of the lot shall be three (3 a.l acres or
larger.
2. The specific location and size of the structure and/or
outside storage area shall be as allowed by the City.
3. The combined square footage of the accessory structure
and outside storage area shall not exceed 800 square
feet.

4. Setbacks of the accessory structure and/or outside
storage area shall be of a magnitude found necessary
by the City, but in no case shall it be less than a
100 foot front yard setback, thirty (30') foot
sideyard setback and a 50 foot rear yard setback or as
required in section 6.02.
5. The outside storage area and all vehicles, materials
and equipment being stored there shall be fenced,
landscaped and screened in such a manner as to prevent
it from being visible at any time of the year from
road rights-of-way, public properties and surrounding
properties.
6. The number of employees shall be limited to one person
on site in addition to family members.
7. On-site sales shall be prohibited, except those
clearly incidental to services provided in the
accessory structure.
8. Vehicles associated with the home occupation shall be
limited to one (1) vehicle on the premises and as set
out in Section 8.08 of Ordinance No.8.

9. Unusual parking and traffic patterns shall not be
created, which are not normally found in the
neighborhood, and in no case, shall the need for more
than three (3) additional vehicles be created on the
property.
10. Signs shall be regulated as set out in Section 8.07 of
Ordinance No.8.
11. The Special Use permit be subject to a one (1) year
sunset clause as defined in Ordinance No.8, Section
5.03(0).
12. The City may at any time inspect the home occupation
and revoke the Special Use Permit if the applicant is
not adhering to the permit and the conditions of the
permit.
13. The Special Use Permit is contingent upon the purchase
of property by Mr. Paddock.
Adopted by the City Council of the City of Andover on this
3rd day of January, 1995.

7:02 p.m. Mr. Carlberg reviewed the request of Robert Paddock to operate
a home occupation in an accessory structure at 2439 South Coon Creek
Drive. The property is zoned R-4 and is approximately 5.4 acres. Mr.
Paddock, whose occupation is to build fireplace surrounds and some
cabinetry, wants a horne-based business due to his family's health needs.
The question is whether the request meets the intent of the City's
ordinance. He provided a copy of the Council's concerns with allowing
some home occupations in accessory buildings as discussed at the May 17,
1994, regular meeting. The City has approved two or three other Permits
that have been similar in nature having to do with woodworking and
cabinetry. Mr. Carlberg reviewed the applicable ordinances and criteria
to be examined. If the Commission chooses to recommend approval, he
suggested 12 conditions be added to the Permit.
Commissioner Peek questioned the limitations on the size of accessory
structures in an R-4 zone. Mr. Carlberg stated even though this is an
R-4 zone, it is outside the MUSA where total coverage of all structures
is considered. That is not exceeded in this case. He then reviewed
several Special Use Permits that have been granted in the last two to
) three years that have been similar in nature. No complaints have been
received on any of those activities. They are all on large lots and the
applicants had talked to the neighbors prior to the activity. The
reason for the concern is whether the woodworking and cabinetry activity
is outside of the intent of the ordinance.

Robert Paddock - stated he lives in Anoka right now and has been doing
this for five years. In August he became aware of the need for a Permit
in Anoka, but their ordinance specifically excludes carpentry work as a
home occupation. He lives along the Mississippi River in an urban
setting and has been doing this full-time for 1 1/2 years. Many of his
neighbors didn't even know he was operating the business except the very
close ones which he talks to. Noise has not been a problem. He feels it
is necessary that he work out of his home. He has not had an employee
yet; but because of his wife's health, he felt he may need one other
person at some point. There is very little traffic. He expected a
Speedy Delivery or UPS truck once a week and a lumber truck about once
every three months. He does not do retail work, even discouraging it,
other than by word of mouth. All orders are taken by fax and billed by
mail.

In response to questions by the Commissioners, Mr. Paddock stated he had
hoped to use the entire accessory structure for the business; but he now
realizes he can only use 800 square feet of it. The building is already
partitioned off. It is a stick frame garage which he will need to
insulate, heat and make some modifications. He is planning to purchase
the property contingent upon approval of this Permit. There would be no
outside storage. The only vehicle is a half-ton pickup which is his
personal vehicle used for deliveries. The buildings on the lot are 300
feet off the street and are quite secluded with a lot of vegetation all
around. He did not see a problem with scrap material. What is not
burned for heat is disposed in the regular dumpster. He has not had a
problem of exceeding the disposal limit. He does not generally have
specific hours of operation. It depends on the family activities. He
likes to get the children off to school in the morning, so he may start
at 10 a.m. It is unusual to work in the evenings; and if he does, it is
not beyond 10 p.m. He asked if the hours of operation must be
stipulated.
Commissioner Apel felt in a situation such as this, it is not necessary
to stipulate hours of operation. The reason for the home-based operation
is to have that flexibility. As long as there is no noise problem, he
didn't feel the City should be dictating hours of operation in this
case. Mr. Carlberg noted there are other ordinances that would cover
problems that may arise from the hours of operation such as the Noise
Ordinance regulating noise from 10 p.m. to 7 a.m. The City is not
required to stipulate hours of operation. In looking at other similar
requests, the only difference is the zoning designation. This is R-4,
though it is large acreage.

Commissioners Peek, Apel and Dehn pointed out the request is consistent
with the interpretation of the ordinance in the past when similar uses
were granted. They also felt that the conditions proposed would cover
any of the problems that may arise. Commissioner Jovanovich had a
concern with these types of businesses located in a residential area.
She noted Brooklyn Center has an industrial area where small businesses
can rent space. Andover does not have such an area where small
businesses can go. Commissioner Apel argued in this case the applicant
wants to be close to his family because of health problems. Forcing
them to rent space in an industrial area overlooks the major reason why
people want home occupations. He also noted that concept has been tried
in other places and were unsuccessful. People want home occupations for
convenience and economic considerations. Once they have to take on the
overhead of rent, the occupation fails. He felt the Special Use Permits
can take care of any concerns that may arise. Commissioner Jovanovich
has seen small industrial areas with rental space be successful, and
such an industrial area also adds to the tax base. Commissioner Peek
stated the City has a relatively liberal home occupation ordinance in
that it is willing to allow the residential area as an incubator for
small businesses. Mr. Carlberg noted once the business exceeds the
requirements of a home occupation, then it would be appropriate to move
into a commercial area.

Chairperson Squires was concerned with the language in the ordinance. It
appears the woodworking and carpentry uses are conducive to the larger
lot areas, and they have been allowed. He thought the Commission should
suggest to the Council that a provision be included in the ordinance
allowing things like this in large-lot areas, perhaps irrespective of
zoning. He isn't necessarily opposed to the application; but it is
another situation where the "repair" category doesn't fit. The
Commission generally agreed but noted that direction should come from
the elected officials. In discussing the issue further, Mr. Carlberg
stated he receives few complaints on home occupations that have received
Special Use Permits. He agreed an amendment is needed to the ordinance
to allow the carpentry and cabinetry work to a degree.
Commissioner Dehn asked if it would be appropriate to add a provision to
allow crafts and other cottage industries as home occupations as well as
carpentry. The Commission felt that would be too broad. Care must be
taken not to open it up to uses that the City does not want.
MOTION by Peek, Seconded by Apel, that the Planning and zoning
Commission forward to the Andover City Council the recommendation for
approval of the Special Use Permit requested by Robert Paddock to
operate a home occupation, which is to build fireplace surrounds and
miscellaneous cabinetry, to be conducted in an existing accessory
structure located at 2439 South Coon Creek Drive, legally described as

among high power lines in Tacoma, hington. People have been
experiencing problems with garage doors 0 ning and closing, lights
going on and off, etc., as a result of the p wer lines being 40 feet

APPLICABLE ORDINANCES

Ordinance No.8, Section 4.30 defines home occupation uses,
including, "office uses, repair services, photo or art studio,
dressmaking, or teaching limited to three (3) students at anyone
time and similar uses".
Ordinance No.8, Section 3.02 defines repair services as, "Repair
and/or servicing of such items as musical, scientific and medical
instruments, photographic equipment, jewelry, watches, clocks,
small household appliances, office machines, shoes and clothes,
and similar uses".
Ordinance No.8, Section 4.30, Home occupations, requires a
Special Use Permit for any home occupation that is located in an
accessory structure and/or that requires exterior storage. These
home occupations shall be subject to the following conditions:
1. The size of the lot shall be 3 acres or larger.
2. The specific location and size of the structure and/or outside
storage area shall be as allowed by the City.
3. The combined square footage of the accessory structure and
outside storage area shall not exceed 800 square feet.

Ordinance No.8, Section 5.03 regulates the Special Use Permit
process.

Ordinance No.8, Section 7.03 lists those uses allowed by.Special
Use Permit. In a Residential District, Home Occupations, on a
parcel of three acres or larger, utilizing an accessory structure
and/or exterior storage, is allowed under a Special Use Permit.
In granting a Special Use Permit, the following criteria shall be
examined as defined in Ordinance No.8, Section 4.30.

1. The effect of the proposed use upon the health, safety, morals
and general welfare of the City including but not limited to
the factors of noise, glare, odor, electrical interference,
vibrations, dust and other nuisances; fire and safety hazards;
existing and anticipated traffic conditions; parking
facilities on adjacent streets and land.
2. The effect on surrounding properties, including valuation,
aesthetics and scenic views, land uses, character and
integrity of the neighborhood.
3. Consistency with the Andover Comprehensive Plan and
Development Framework.
4. The impact on governmental facilities and services, including
roads, sanitary sewer, water and police and fire.
5. The effect on sensitive environmental features including
lakes, surface and underground water supply and quality,
wetlands, slopes, flood plains and soils; and other factors as
found relevant to the City.
Ordinance No.8, Section 4.30 also states that, "a Special Use
Permit is valid for one year from the date of issuance unless
otherwise specified in the Resolution for approval and thereafter
shall be automatically renewed each year unless objections or
complaints are received from neighboring property owners, the City
/ Councilor City Staff and a request for review is made.

GENERAL REVIEW
The applicant has provided to the Commission the attached letter
explaining the intent of the applicant's request.
The Commission needs to determine whether the requested use meets
the intent of Section 4.30, Home Occupations.
COMMISSION OPTIONS
1. The Planning and zoning Commission may approve the Special Use
Permit requested by Robert Paddock to operate a home occupation
(build fireplace surrounds and cabinetry) to be conducted in an
accessory structure located at 2439 South Coon Creek drive,
legally described above.
The Commission finds the request meets the criteria established in
Ordinance No.8, Section 4.30 and 5.03. The Commission also
finds that the use is permitted by special use under Ordinance No.
8, Section 7.03, Residential Districts.
2. The Planning and zoning Commission may deny the Special Use
Permit requested by Robert Paddock to operate a home occupation
(build fireplace surrounds and cabinetry) to be conducted in an

4. Setbacks of the accessory structure and or outside storage "
area shall be of a magnitude found necessary by the City, but
in no case shall it be less than a one hundred (100') foot
front yard setback, thirty (30') foot sideyard setback and a
fifty (50') foot rear yard setback or as required in Section
6.02.
5. The outside storage area and all vehicles, materials and
equipment being stored there shall be fenced, landscaped and
screened in such a manner as to prevent it from being visible
at any time of the year from road right-of-ways, public
properties and surrounding properties.
6. The number of employees shall be limited to one (1) person on
site in addition to family members.
7. On-site sales shall be prohibited, except those clearly
incidental to services provided in the dwelling.
8. Vehicles associated with the home occupation shall be limited
to one (1) vehicle on the premises and as set out in Section
8.08.

9. unusual parking and traffic patterns shall not be created,
which are not normally found in the neighborhood, and in no
case, shall the need for more than three (3) additional
vehicles be created on the property.
10. Signs shall be regulated as set out in Section 8.07.
11. The Special Use Permit will be subject to a one (1) year
sunset clause.
12. The City may at any time inspect the home occupation and
revoke the Special Use Permit if the applicant is not adhering
to the permit and the conditions of the permit.

The Economic Development Authority Board is requested to adopt the
attached resolution designating the Authority's official banks and
depositories, supplemental depositories for investments, and
empowering the City Finance Director with the approval authority
for the investment and collateral transactions. The Board is also
requested to empower the City Treasurer with the authority to
deposit, transfer or disburse funds as approved by the Board.
BACKGROUND
The attached resolution is similar to the resolution approved by
the Andover City Council each year for the safeguarding and
management of City funds. The separation of the T.I.F. Funds
transactions and any other E.D.A. financial transactions from
regular City business will be accomplished through the enactment
of this resolution.

WHEREAS, Minnesota Statutes, Section 118 sets forth the
procedures for the deposit of public funds which include requiring the
Andover Economic Development Authority Board annually designate the
official depositories for funds and manage the collateral pledged to
such funds; and
WHEREAS, other financial institutions are, from time to time,
able to pay the Authority interest rates on deposits which are greater
than can be obtained from the official depositories.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of
the Andover Economic Development Authority that the official
depositories for 1995 are the Anoka office of Norwest Bank Minnesota,
N.A. and the Andover office of Firstar Bank of Minnesota, N.A.
BE IT FURTHER RESOLVED that Norwest Investment Services Inc., the
Minnesota Municipal Money Market Fund, Firstar Trust Co. of Minnesota,
First Bank Minneapolis, FBS Investment Services Inc., Twin City Federal
Savings and Loan, Merrill Lynch, pierce, Fenner and Smith Inc., Dain

of Andover is hereby authorized to place investments, transfer funds
between said investment institutions, release disbursements prepared by
the City Treasurer and approved by the Board, and is designated as the
approval for the release and acceptance of all collateral to be held in
conjunction with funds on deposit with authorized institutions.

The Andover Economic Development Authority (EDA) is asked to
review a request from Chuck Greenwood (Greenwood Graphic Arts).
As you are aware, the EDA approved a request at the November IS,
1994 EDA meeting for Mr. Greenwood to construct a commercial
building on Lot 2, Block 3, Andover Commercial Park. Mr.
Greenwood would finance the land acquisition costs over a two
year period with payments beginning January 15, 1995 and the
construction of the building to be completed no later than
January 15, 1997 (See attached EDA minutes - Nov. IS, 1994).
Mr. Greenwood misunderstood these terms and would like to request
an extension of the construction completion date to January 15,
1998. The financing terms would remain the same.
Staff requests EDA direction at this time to resolve this item.

\ ) Greenwood Graphics Discussion
Jeff Johnson reviewed the request of Greenwood Graphics to
purchase Lot 2, Block 3, Andover Commercial Park for the
construction of a 10,000 square foot commercial building. The
price of the lot is 55 cents per square foot,or $28,820.00,
which does not include connection charges estimated at
approximately $6.000. Mr. Greenwood would like to finance the
land acquisition costs over a 2 year period and pay the
connection charges upon issuance of a building permit. The
payments would begin January 15, 1995 and construction of the
building would be completed no later than January 15, 1997.
It was noted that the soils corrections have been completed on
this lot.
Council discussed the 55 cents. per square foot price rioting that
this is the figure we have been using for ,a long time. Mr.
Carlberg stated that ,the first few_lots sold for 65 centsper,~
square foot.
.Councilmember Knight asked what would happen if Mr.
decides to sell the lot after the first two years. Mayor
MCKelvey suggested adding a provision that if that happens, Mr~
Greenwood would sell the lot back to the city. Mr. Greenwood '
agreed to do so.

Mr. Fursman suggested that Council move to deed the property to
the control of the Economic Development Authority.
MOTION by Perry, seconded by Knight that the City Council deed to '
the EDA Lot 2, Block 3, Andover Commercial Park. Motion carried
unanimously.
Councilmember Jacobson requested that the, Economic Development
Commission look at the 55 cent per square foot selling price to
see if it is adequate.
Mr. Greenwood noted that with the pollution in the area he would
not want to be responsible for cleanup if a problem, is
discovered. Mayor McKelvey noted that the EPA has said the
property is now clean.

Purchase of 4-Wheel Drive Tractor and Mowers

Councilmember Jacobson noted that the tractor and mower are more
than what was budgeted, the I-ton du~p truck and front plow (Item
#6) is less and the I-ton cab and chassis are less (Item #7).
Combined they equal the amount that was budgeted with about
$11,000 left over.
Mr. Stone stated that he wanted to use the $15,000 that would be
left over from the purchase of the cab and chassis to purchase a
box for that vehicle and only purchase the tractor without the
mowers. He was looking at buying the mowers in 1995. He didn't
know if $11,000 would be sufficient to purchase the box.

Hiring Update
The deadline for applications for finance director was
December 30, 1994. I am recommending that Daryl and I screen
applicants and present the Council with the top choices for an
interview. I will request the Council set an interview date for
the second week in January.
The deadline for applications for Fire Chief is January 9, 1995.
Two members of the fire department have been appointed to assist
with the screening of the applicants. It is anticipated that
) Daryl, two fire department personnel and I will interview 8-10
candidates. A member of the council, or a fire chief from
another department could also assist with the preliminary
screening and interviewing. The final four candidates will be
interviewed by the Council, at a date to be selected at the next
meeting.

The City Council is requested to approve the revised
grading/drainage and erosion control plan of Foxberry Farms as
being requested by Contractor Property Developers Company
in Section 26, Township 32, Range 24, Anoka County, Minnesota.
The revisions to the grading plan reflect raising 141st Lane NW
12 inches at Eagle Street NW and 18 inches at Drake Street NW.
This is the third revision made by the developer. Attached is a
letter from the developer's engineer as to why the revision has
been made.
TKDA will need to revise the existing street and utility plans to
reflect the revisions. The revised grading plan has been
reviewed by City Staff and TKDA and has been found to be
acceptable.

BY CONTRACTOR PROPERTY DEVELOPERS COMPANY IN SECTION 26,
TOWNSHIP 32, RANGE 24, ANOKA COUNTY, MINNESOTA.
WHEREAS, the Andover Review Committee has reviewed the revised
grading/drainage/erosion control plan; and
WHEREAS, Resolution No. 188-94 continue to be in force
regarding the preliminary plat; and
WHEREAS, the City Council approves the revised
grading/drainage/erosion control plan with a revision date of
November 29, 1994
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Andover to hereby approve the revised grading/drainage/erosion
control plan.

Dear Mr. Carlberg:
The Metropolitan Council slaff has reviewed the city of Andover's plan amendment received by
the Council on September 22, 1994 and the additional information received on December 23,
1994. We have determined that the amendment is complete. The amendment proposes to add
109 acres tu the MUSA for constructIon of a new middle school and an addition to the ArxJover
Elementary School. The MUSA cxpamion will ~~ tak.e in the ,,;urrent city hall propeny. We
have determined that the propo&ed amendment h:1Jl no potential impact upon My of the
metropolitan system plans. Therefore, the city may place the amendment into effect immediately.
Because the proposed amendment appears unlikely to affect policies and plans in other chapters
of the Metropolitan Development Guide, the Council will waive further review and romment on
1hi3 amendment. The city ~hould be advist:ti, however, that it must fully Implement its on-site
inspcc1ion~ ordinance before it makes any future MUSA cxpllDlSion requC3ls.
The amendment, explanatory materials supplied and the infonnation submission form 1Ni1l be
appended to the city's plan in the Council's files.

30 acres to the MUSA for construction of a Anoka County Sheritrs substation. We have
dctt;rmined that the pruposed amendment bas no potentlallmpact upon any of the metropolitan
system plans. Therefore, the city may place the 4Incndment into clTCct immediately.
Because the proposed amendment appears unlikely to affect policies and plans in other ChapteR
of the Metropolitan Development Guide, the Council will waive further review and comment on
this amendment. The city should be advised, however, that it must fully implement its on-site
inlSpettions ordinance before It makes any future MUSA expansion requests.
