The City Council is asked to review and approve the attached ordinance amendment to Ordinance No.8, Section 4.30 - Home Occupations. A public hearing was held at the September 10, 1996 Planning and Zoning Commission meeting (see attached minutes). As you are aware, staff was directed by Council to have the Planning and Zoning Commission review this ordinance and establish some criteria for those businesses that do not comply with the current provisions of this ordinance. This proposed amendment provides little change to the language in the ordinance that has been previously adopted. Staff however, has added provisions in this ordinance to accommodate those home occupations that have been conducting business at their residence prior to May 15, 1990 (last ordinance amendment date) and do not comply with the home occupation ordinance. As proposed, these home occupations will be allowed to continue to operate or conduct business at their residence (in the same manner) with an approved Special Use Permit. The entire process involves the property owner to obtain a Special Use Permit. An on- site inspection is conducted by staff with the cooperation of the property owner. Staff will document the conditions on-site that are associated with the home occupation and will present a report the advisory boards that describes the conditions in which the home occupation must adhere to. The home occupation will not be required to increase in extent, volume or scope otherwise the Special Use Permit will be subject to revocation. The Special Use Permit for these home occupations will be temporary in nature. If the Special Use Permit holder dies or moves to a new location, the permit shall automatically terminate, except in the case of death, a surviving spouse, residing at the same address desires to continue the home occupation, written notice shall be given to the Planning and Zoning Department. " MOTION BY: SECOND BY: \ / Page 2 City Council Meeting - 10/1/96 Approve Ordinance Amendment Ordinance No.8, Section 4.30 Home Occupations All Special Use Permits for home occupations, once granted, may be revoked by the City Council. Complaints seeking revocation of such permit shall be initiated by the Planning and Zoning Department (ifthere is reason for revocation) or any three (3) residents within 350 feet of the parcel where the home occupation is being conducted. Should the City Council deny the application, all such persons shall immediately cease their business activities from their residence or comply with the current provisions of the ordinance. / \ / CITY OF ANDOVER COUNTYOFANOKA STATE OF MINNESOTA ORDINANCE NO.8 AN ORDINANCE AMENDING ORDINANCE NO.8, THE ZONING ORDINANCE OF THE CITY OF ANDOVER The City Council of the City of Andover hereby ordains: Ordinance No.8 is hereby amended as follows: 4.30 Home Occupations (A) Intent: Planning principles protect the public interest in part by avoiding land use conflicts. One such conflict involves differences between commercial and residential activities. This confrontation has commonly been resolved by relegating commercial activities to commercial zoning districts. However, some limited commercial activities have been allowed in residential areas, and have had no negative impact. The purposes ofthis Section are to: I) allow such limited passive commercial uses as would not detract from the character and integrity of residential neighborhoods; 2) identify conditions under which such uses may be permitted, and 3) continue to require all other commercial uses to be located only in commercial zoning districts. (B) General Provisions Home occupation uses may include office l:lses, repair services, photo or art studio, dressmakiRg, Elr teaching limited to three (3) stl:ldeRts at an-y ORe time and similar uses. Such home oeel:lpatioRs are s1:1bjeet to the following coaditions: All home occupations which conform to the following standards may be conducted in a residential zoned district without a Special Use Permit: , I) The number of employees shall be limited to one (1) person on site in addition to family members. / I J 2) The area within the principle structure used by the home occupation shall not exceed twenty (20%) percent of the dwelling's livable floor area. Basements may be included ifthey meet all Uniform Building Code requirements for ingress and egress. 3) On-site sales shall be prohibited, except those clearly incidental to services provided in the dwelling. 4) Any interior or exterior alterations of a dwelling for a home occupation shall be prohibited, except those customarily found in a dwelling. 5) Vehicles associated with a home occupation shall be limited to one (1) vehicle on the premises and as stated in Section 8.08. 6) Unusual parking and traffic patterns shall not be created, which are not normally found in the neighborhood, and in no case, shall the need for more than three (3) additional vehicles be created on the property. 7) Signs shall be regulated as set out in Section 8.07. 8) Home occupation uses may include office uses repair services photo or art studio. dressmaking. cabinet making/wood working or teaching services limited to three (3) students at anyone time or similar uses. 8) }. (C) Home Occupations Located in an Accessory Structure or Requiring Exterior Storage A Special Use Permit shall be required for any home occupation that is located in an accessory structure and/or requires exterior storage. These home occupations shall be subject to the following conditions: 1) The size of the lot or ~ ofland shall be three (3 a,) acres or larger. 2) The specific location afld size of an accessory structure and/or o\:ltside storage area shall be as allowed by the City. 2) The combined square footage of the accessory structure and/or outside storage area utilized by the home occupation shall not exceed eight hundred (800 s.f.) square feet. 3) Setbacks of the accessory building and outside storage area shall be of a magnitude found necessary by the City, but in no case shall it be less than one hundred (100) feet front yard setback, thirty (30) feet side yard setback and fifty (50) feet rear yard setback or as required in Section 6.02. \ 4) The outside storage area and all vehicles, materials and equipment being stored thei=e on-site shall be fenced, landscaped and screened in such a manner as to prevent it from being visible at any time of the year from road right-of-ways, public properties and surrounding properties. .I 3 \ I 5) All provisions in Section 4,30(B). (D) Non-Conforming Home Occupations All residents that are conducting a home occupation or business that do not conform to the standards contained in Section 4,30(B) and (C) and have conducted such business at their residence in the City prior to May 15. 1990 must make application for a Special Use Permit. but may continue to conduct such business pending final determination of their application. Should the City Council deny the Special Use Permit request. all such persons shall immediately cease their business activities from such residential premises or comply with the provisions in Section 4.30(B) and (C). These home occupations are subject to the following conditions: 1) The applicant shall demonstrate written proof that they have conducted business at their current address or residence prior to May 15 1990, 2) An on-site inspection will be conducted by City staff with the cooperation of the property owner conducting the home occupation The inspection shall be conducted ten (10) days prior to the public hearing. The inspection by staff will document the following conditions on-site that are associated with the home occupation. a) Number of employees. b) Number and types of vehicles along with their respective gross vehicle weights. c) An inventory of all equipment and machinery. d) Location and area within the principle structure and accessory buildings utilized by the home occupation. e) Location and size of exterior storage. t) Hours of operation. g) Life safety issues. h) Any other relevant activity or issues. / 4 I Upon completion of the inspection. staff will prepare and present to the Planning and Zoning Commission and City Council a detailed report of the home occupation that describes the conditions as stated above pursuant to the procedures established in Section 5,03. Special Uses and General Statement. These conditions will be outlined in the Special Use Permit If the Special Use Permit is approved by the City Council. the conditions as stated must be adhered to. The home occupation shall not increase in extent. number volume or scope from any of these conditions or the Special Use Permit will be subiect to revocation, All home occupations which were conducted by residents after May 15 1990 are required to comply with the provision in Section 4 30(B) and (C). (E) Special Use Permits and Provisions 1) Special Use Permits granted by Section 4 30(C) shall follow the criteria established in Section 5 03 Special Uses General Statement. These permits shall be valid one (1) year from the date of issuance unless otherwise specified in the Resolution for approval and thereafter shall be automatically renewed each year unless obiections or complaints are received from any three (3) residents within 350 feet of that parcel where the home occupation is being conducted. the City Councilor the Planning and Zoning Department. If a Special Use Permit holder who was granted a permit under Section 4,30(C) dies or moves to a new location. the existing permit shall be automatically terminated, Special Use Permits granted by Section 4 30(D) shall follow the criteria established in Section 5.03. Special Uses General Statement shall be temporary in nature. and shall be granted to a designated person who resides at the address the home occupation is being conducted. If a Special Use Permit holder who was granted a permit under Section 4.30(D) dies or moves to a new location. the existing permit shall automatically terminate except in the case of death. a surviving spouse residing at the same address. desires to continue the home occupation. written notice to that effect shall be given to the Planning and Zoning Department. and the City Council may authorize continuation of that permit without further hearing. / 2) There may be one (1) annual inspection each year by the City Administrator or Administrator's designee of the property covered by the Special Use Permit. In addition the City Administrator or the Administrator's designee. shall have the right at any time. upon reasonable request. to enter and inspect the premises covered by said permit for compliance pUl:poses. If it is found that the permit and/or conditions of the permit are not being adhered to. the applicant shall be notified in writing by the City and given ten (10) days to come into strict 5 J compliance. If compliance is not achieved after the ten (10) day period. the City Council shall hold a public hearin~ to consider the matter and may revoke the Special Use Permit. 3) Vested Ri~hts: No home occupation allowed by a Special Use Permit shall confer upon any person or to the benefit of any property owner any vested ri~ht to that use. rather the use shall remain subiect to all conditions of the permit as established by the City. The City may find it necessary from time to review the conditions of the permit as they relate to the protection of the ~eneral welfare of the community, 4) Special Use Permits once granted may be revoked by the City Council for cause after hearing before City Council. Complaints seeking revocation of such permit shall be filed with the City Clerk and may be initiated by the Planning and Zoning Department if it has reason to believe revocation may be warranted. and/or any three (3) residents within 350 feet of that parcel where the home occupation is bein~ conducted. All such hearings shall be conducted in accordance with Section 4.30(F). 5) All home occupations bein~ conducted at a property zoned for residential use on the effective date ofthis ordinance shall have ninety (90) days thereafter to apply for the necessary Special Use Permit. 6) Persons who are conducting a business from property zoned for residential use on the effective date of this ordinance must make application under this Section but may continue to conduct such business pending final determination of their application. Should the City Council deny the petition for a Special Use Permit all such persons shall immediately cease their business activities from such residential premises or comply with the provisions in Section 4.30(B). (F) Request for Hearin~, All written requests by residents or staff seeking revocation of a Special Use Permit for a home occupation shall be made in writin~ to the City Clerk. The City Clerk shall refer the request to the Plannin~ and Zoning Department A staff report will be prepared and discussed at a City Council Meetin~ within thirty (30) days from the date the written req..uest was received All property owners and occupants within three hundred and fifty (350) feet of the property in question will be notified by mail at least ten (to) days prior to the City Council meeting. Failure of any property owner(s) or occupant(s) to receive such notice shall not invalidate the proceedings. At such hearin~. the City Council shall determine whether revocation of the Special Use Permit for the home occupation is warranted and shall issue written Findings of Fact. Conclusions of Law and an Order pertinent to revocation. The Findings of Fact. j 6 I Conclusions of Law and an Order shall be filed with the City Clerk and shall be mailed to all interested parties aJ)pearing or represented at said hearing. The City Attorney shall furnish such assistance and advice to the City Council as said Council shall request. (0) Revocation of Special Use Permit for Home Occupation When the City Council determines that the public interest so requires. it may revoke or suspend the Special Use Permit of a home occupation when it finds. after due investigation and a public hearing. that: 1) The applicant for the permit or any of his or her employees have concealed the receipt of stolen property or have knowingly received stolen property. 2) The applicant for the permit has not complied with the provisions of law applicable to the premises. equipment or operation of the home occupation, 3) The applicant has obtained a permit through fraud or misstatement. 4) The home occupation or activity is being conducted in a manner found to be detrimental to the health. safety. or general welfare ofthe public or is a nuisance. or is being operated or carried on in any unlawful manner. 5) The home occupation has not been operating or in business for a period of six (6) consecutive months. (H) Illegal Home Occupations All home occupations that are being conducted in violation of this Section are illegal and are subiect to punishment defined by State law. McKelvey, Mayor / Victoria V olk, City Clerk 7 Regular Andover City Council Meeting Minutes - June 18, 1996 Page 8 I (Business in Residential District - Junker, Continued) Winslow Holasek - felt that the ordinance must be enforced uniformly, but he didn't think the ordinance applied in this situation. He felt the type and nature of the business has to be considered. No manufacturing is being done, just temporary storage, with no noise and few employees. He felt an ordinance change is needed which considers the nature of the business. Attorney Hawkins also advised it is a question of enforcing the ordinance uniformly. This is not allowed under the existing ordinance. If it is to be allowed, the ordinanc~ must be changed or the City will not be able to uphold the ordinance in court against other similar violations. There was some discussion with residents who again noted the City knew about the business ten years after the ordinance was passed when it issued the building permit for the accessory building. The Ccuncil noted that has not been shown at this point. The requirements at the time did not allow pole barns, which had nothing to do with the business. ~ MOTION by Knight, Seconded by Dehn, to put this issue on hold and refer the ordinance back to the Planning and Zoning Commission for consideration. Criteria to consider could be 1) time in business or year of starting, and 2) look at changing what types of businesses would be allowed. Give the Planning Commission two months to make a recommendation. DISCUSSION: The residents wanted to know when this will be discussed by the Planning Commission. Mr. Carlberg stated Staff will notify the Junkers of the meetings. Mayor McKelvey also indicated he would keep the residents informed. Motion carried unanimously. ESTABLISH SPECIAL REVENUE FUNDS Ms. McGann asked for Council approval to establish separate funds for the Andover Fund Fest and Capital Equipment Reserve. The Andover Fund Fest fund will track the contributions and expenditures related to the Andover Fund Fest so those funds are not commingled with the General Fund budget. The Capital Equipment Reserve fund will be used to fund future equipment and major maintenance purchases so it will no longer be necessary to issue Equipment Certificates. Staff is also recommending equity transfers be made to the Capital Equipment Reserve fund, $166,853 from the General fund, $35,074 from the Sewer fund and $25,000 from the Water fund, totalling $226.927. These are the fund balances made at the end of 1995 for purchases to take place in 1996. II As Chairman of the Andover Fund Fest, Mr. Fursman explained no City funds will be used for that activity. They are starting out with contributions of $5,000, plus it is expected the event will generate funds through the sale of pop and merchandise. This is a City-sponsored function, but no City funds are used; and all Staff time has been donated. City grounds will be used, and they do have some liability coverage from the City's insurance policy. Any excess revenues this year will be carried over to the following year. (612) 755-5100 PLANNING AND ZONING COMMISSION MEETING - SEPTEMBER 10, 1996 MINUTES The Regular Bi-Monthly Meeting of the Andover Planning and Zoning Commission was called to order by Chairperson Jay Squires on September 10, 1996, 8:01 p.m. at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover, Minnesota. Commissioners present: Lynnette Barry, Jeffrey Luedtke, Randy Peek, Lorna Wells Maynard Apel, Jerry Putnam Planning Intern, John Hinzman City Planning, Jeff Johnson Community Development Director, Dave Carlber~ Others Commissioner absent: Also present: APPROVAL OF MINUTES J August 27, 1996: Page 5, third paragraph, add after first sentence, "Lawrence Carlson, representing Woodland Development, has lived in the community for 25 years and developed and worked wi th the City for about 30 years. He now resides' in Ham Lake." Page 8, last paragraph, correct, "Commissioner Wells provided maps of the Anoka-Hennepin School District elementary, middle school and high school attendance areas." PUBLIC HEARING: SPECIAL USE PERMIT - ANTENNA TOWER IN EXCESS OF 35 FEET - 3017 161ST AVENUE NW - SBA, INC. The Commission agreed to move this Hearing to Item 3 on the agenda an] to table it per the request of Staff. Mr. Carlberg stated Staff is asking for more time to obtain further information. When the hearing is to be held, it will be republished in the paper and abutting property owners will receive another written notification of it. MOTION by Wells, Seconded by Barry, to move Agenda No. 5 to No. 3 and table it for further notification of information for Staff. Motion carried on a 5-Yes, 2-Absent (Apel, Putnam) vote. \ PUBLIC HEARING: AMEND ORDINANCE NO.8, SECTION 4.30, HOME OCCUPATIONS -REGARDING NON-CONFORMING HOME OCCUPATIONS BEING ALLOWED BY SPECIAL USE PERMIT ~~ Mr. Johnson reviewed the proposed amendment to Ordinance No.8, Section 4.30 - Home Occupations. provisions have been added to accommodate Regular Planning and Zoning Commission Meeting Minutes - September 10, 1996 Page 2 (Public Hearing: Amend Ordinance 8, 4.30, Home Occupations, Continued) those home occupations that have been conducting business at their residences prior to May 15, 1990, which is the last ordinance amendment date, and who do not comply with the home occupation ordinance. Those businesses would be allowed to continue at their residences in the same manner with an approved Special Use Permit. Based on the Commission's discussion at the August 27 meeting, the following two changes have been proposed: Page 4, D, 1, was added to require written proof that an operation has conducted business at the current address prior to May 15, 1990. Page 5, E, 1, second paragraph, was added for the process when the Permit holder dies or moves to a new location. Mr. Johnson also explained the process to receive the Permit. Revocation of the permit may be initiated by the Planning and Zoning Department or by any three residents within 350 feet of the parcel where the home occupation is being conducted. Commissioner Wells asked if the compliance provision is business or calendar days. She felt that should be specified in the ordinance. Mr. Johnson stated it is calendar days, though Staff will research the policy of all other compliance provisions. This one would follow the same procedure. Chairperson Squires stated typically that is not written in the ordinance. The Commission agreed the procedure should be the same as the City's policy in other instances. MOTION by Wells, Seconded by Barry, to open the public hearing. Motion carried on a 5-Yes, 2-Absent (Apel, Putnam) vote. 8:20 p.m. John Backum, 134th Lane and Crooked Lake Boulevard - asked what types of businesses the City would allow to continue. He felt there are those that are not consistent with the residential community. Councilmember Kunza owns a tire business about one-half block from him. He complained of the noise of the equipment and the number of cars going in and out, plus he felt there is potentially a serious safety issue. He stated the business is definitely not in compliance with OSHA safety conditions. There are commercial tires in the garage and in another storage area that could be a big problem if there was a fire. He felt the homogeneous area of the neighborhood is being disturbed which creates a commercial climate in a residential neighborhood. The City h3.S an obligation to correct those kinds of home businesses. He would not like to see a Special Use Permit which allowed the addition of buildings in residential areas for additional storage. The City should look toward businesses that are more compatible with the residential areas. , James Junker, 13503 Crooked Lake Boulevard - stated this started as a result of his business. His concern was to keep Staff from making false statements. He alleged the Staff stated he had a manufacturing business with employees building doors, but he does not build doors at his residence. He installs them on site. Mr. Carlberg indicated Staff said there was a possibility of manufacturing on site and storage. J Regular Planning and Zoning Commission Meeting Minutes - September 10, 1996 Page 3 / (Public Hearing: Amend Ordinance 8, 4.30, Home Occupations, Continued) Mr. Carlberg continued that once a Permit is granted, the Planning Department could initiate a revocation, but it would be based on the violation of the conditions of the Permit. Staff cannot revoke or deny a Special Use Permit. Staff makes recommendations and the City Council ultimately makes the decision. The Commission explained that the proposed amendment is intended to help people like himself to continue to operate their businesses. Mr. Junker - stated the City gave him a building permit to build a garage and office in 1982. He had to put a fire door between the garage and the house. The City allowed him to build it and is not holding to the contract now. He asked how many businesses are legal since 1990. Mr. Carlberg explained this amendment affects all those businesses operating between 1971 and 1990 that are outside the ordinance requirements. He estimated two to three home occupation permits are granted every year. That does not include those home occupations that are permitted by ordinance and are not required to have a Special Use Permit. Again, this amendment has been created to allow businesses such as the Junker's to continue operation. Mr. Backum - again asked the Commission to be concerned with the types of permits that are not homogeneous with the residential neighborhoods. MOTION by Luedtke, Seconded by Wells, to close the public hearing. Motion carried unanimously. Commissioner Wells wondered if the businesses should be required to show proof of insurance. Mr. Carlberg stated that can be looked at on an individual basis and added as a condition of the Permit. Worker's Com~ liability is not a local issue. Chairperson Squires also stated insurance isn't a common provision in land use regulations. He too preferred to handle insurance on an applicant-by-applicant basis. Commissioner Wells did not feel an automobile repair service is compatible with residential areas, though repair shops of electrcnics, clocks, etc., would be acceptable. Mr. Carlberg stated the ordinance considers repair services of small items, not auto repair. That would have to be reviewed on a case-by-case basis as well. If the use is not compatible with the neighborhood, it is a cause for denial. Commissioner Wells asked what happens if the City knowingly issued a building permit for a garage in which an automotive repair service was to be conducted. Mr. Carlberg stated that is a difficult situation which would have to be addressed. Generally the City does not consider use when issuing building permits, as the intended use is not disclosed in that process. Under those conditions, Chairperson Squires agreed with the statement as written, though he hoped the Council will discuss it further. No change was suggested. Page 4, D, 2: There was a concern with the time period in which the Staff shall conduct an inspection of the business site, noting the 60- day time limitation from the date of application to approval of Special Use Permits. It was agreed that the intent is Staff will make th~ inspections prior to the public hearing so all information is available for the Commission. It was agreed that the process should be the owner make application for the Special Use permit. Staff should then respond promptly to do the inspection and get the item on a Commission agenda for a public hearing. Mr. Carlberg stated the inspection then must be done at least 10 days before the public hearing, which is consistent wi th the practice of the City. The inspections will be uniformly applied according to City policy. Page 6, E, 5: There was considerable discussion on the 30-day time frame in which businesses have to apply for the necessary Special Use Permit. Concerns noted were getting the word out so people are made aware of the fact that they should apply for the Permit; the process of notifying the City, the inspection, and then application for the Permit; and the time period in which all of this could be done. Suggestions were to require the person make application before the inspection takes place, extending the 30-day window to 60 days, 90 days or even up to one year. , I Mavor Jack McKelvey - asked that the Commission consider requiring the applicant apply for the Permit before the Staff makes its inspection. In that way if the Staff would deny the request, the applicant would be able to appeal to the Council. Otherwise the applicant would have no recourse. Mr. Carlberg stated the Staff does not have the right to deny a request. In subsection 5 on Page 6, the Commission agreed to change the 30 days to 90 days, the time frame after the effective date of the ordinance in which applications must be made for the necessary Special Use Permit. This will be placed on the October 1 City Council agenda. 9:10 p.m. PUBLIC HEARING: VARIANCE - SETBACK FROM THE ORDINARY HIGH WATER MARK PER ORDINANCE NO. 52, SCENIC RIVER ORDINANCE - 15628 POTAWATOMI STREET NW - MIKE FOTH 9:10 p.m. Mr. Hinzman reviewed the variance request of Michael Foth to encroach 47 feet into the 150-foot setback from the Ordinary High Water Mark at 15628 Potawatomi Street NW. The property is 2.5 acres, zoned for R-2, Single Family Estates and is located in the Rum River Scenic River District. He noted the applicable ordinances and conditions to consider when granting a variance to the Scenic River Ordinance. The DNR has inspected the property and indicated the construction of a home at the proposed setback would not be detrimental to the protected waterway, slope or view from the bluff line. The lot has extreme slopes of 10 percent and greater plus the bluff. The house will not be constructed on eroding slopes and would be screened from the river with natural vegetation. The location of the house is proposed to be on the most level portion of the lot. A similar setback variance of 105 feet was granted to the adjacent property at 15684 Potawatomi in 1983. Staff is recommending approval with conditions. Commissioner Wells noted the lot is all wooded. By moving the house sc far back to the bluff line, many trees will be lost. Plus many of the homes in the area have in and out driveways. Mr. Hinzman stated the trees along the river would not be disturbed. The variance is from the ordinary high water mark in the back yard. The house will be in compliance with all other building setbacks except for the variance being requested. A public hearing is needed on the variance as a part of the Scenic River Ordinance. (33A, 1-16-79; 33B, 2-15- 83) J It shall be unlawful for any person to leave, park, permit, or allow any vehicle in excess of twenty-four (24') feet in length or having a weight in excess of one (1) ton to stand or remain upon any City street or right-of-way or on the traveled portion of the road or to obstruct the flow of traffic at any time of any day unless such vehicle is being used for the purpose of moving goods from or to a commercial or residential location within one (1) block from where such vehicle is located. In no instance shall any vehicle described as being in excess of twenty-four (24') feet or having a weight in excess of one (1) ton be left, parked or permitted to be parked on any City street or right-of-way for a period of more than two (2) continuous hours of any day. Following the declaration of a snow emergency by the City, it shall be unlawful to park or permit to be parked, or to continue to park or permit to stand, any vehicle upon any City street until such time as the snow has been plowed from said street or the snow emergency declaration lifted. (33A, 1-16-79) No person shall deposit or permit to be deposited and leave on any public street in this City leaves, grass, sand or similar materials, nor shall any person plow, shovel, or blow or permit the blowing, shoveling or plowing of snow onto a public street in the City and leaving it. Violation of this provision shall constitute a misdemeanor. This provision shall not apply to any person who is in the process of constructing or maintaining a yard or drive provided that the materials are immediately removed from the street. (33D, 1-03-89) SECTION 5. / The designated Law Enforcement Official is hereby authorized and empowered to remove or cause to be removed any vehicle parked, stored, stalled, or standing on City streets in violation of any of the provisions of this Ordinance. Said vehicles may be removed by towing or otherwise and be stored in garages or outdoor storage areas by persons, individuals, or firms engaged in the general garage or towing business within the City. Said vehicles shall not be removed from place stored until the owner or his authorized agent shall have fully paid the costs incurred for towing and storage to the person or firm who has furnished such service. SECTION 6. In the event that any vehicle held or stored is not claimed or recovered by the owner thereof, there is deemed to be imposed upon such vehicle a possessory lien for the amount of the costs incurred for towing and storage. Staff has discussed with the Anoka County Highway Department the necessity to sign and provide traffic control for the students walking to and from the schools along Hanson Blvd. and Crosstown Blvd. (See attached correspondence to the Anoka County Highway Department). The County has indicated they will be installing the informational signs indicating a school zone ahead. With the City's concurrence, they are also pursuing a speed study for the area in an attempt to reduce the speeds at these locations. As the Council is aware even though technically all of the students are to be bused to these schools, there are students which are walking from the adjacent neighborhoods. PUBLIC HEARING: VARIANCE - SETBACK FROM THE ORDINARY HIGH WATER MARK ~ PER ORDINANCE NO. 52, SCENIC RIVER ORDINANCE - 15628 POTAWATOMI STREET NW - MIKE FOTH 9:10 p.m. Mr. Hinzman reviewed the variance request of Michael Foth to encroach 47 feet into the 150-foot setback from the Ordinary High Water \ Mark at 15628 Potawatomi Street NW. The property is 2.5 acres, zoned J for R-2, Single Family Estates and is located in the Rum River Scenic River District. He noted the applicable ordinances and conditions to consider when granting a variance to the Scenic River Ordinance. The DNR has inspected the property and indicated the construction of a home at the proposed setback would not be detrimental to the protected waterway, slope or view from the bluff line. The lot has extreme slopes of 10 percent and greater plus the bluff. The house will not be constructed on eroding slopes and would be screened from the river with natural vegetation. The location of the house is proposed to be on the most level portion of the lot. A similar setback variance of 105 feet was granted to the adjacent property at 15684 Potawatomi in 1983. Staff is recommending approval with conditions. Commissioner Wells noted the lot is all wooded. By moving the house sc far back to the bluff line, many trees will be lost. Plus many of the homes in the area have in and out driveways. Mr. Hinzman stated the trees along the river would not be disturbed. The variance is from the ordinary high water mark in the back yard. The house will be in compliance with all other building setbacks except for the variance being requested. A public hearing is needed on the variance as a part of the Scenic River Ordinance. MOTION by Barry, Seconded by Wells, to open the public hearing. Mr. Hinzman addressed the swale toward the rear of the lot which is two to three feet deep and 10 feet wide. The soils would not be disturbed and the natural vegetation would remain. Commissioner Peek asked the applicant if he anticipated the construction of an accessory building. Michael Foth - stated no. There would be some landscaping toward the river side of the property. Specific DNR concerns are addressed in the conditions of approval, the letter follows as attachment A-2. Background \ J The 2,5 acre lot has 305.67 feet offrontage on Potawatomi Street NW and contains approximately 282 feet of Rum River shoreline, The lot depth ranges from 253,61 feet on the northern boundary to 306,34 feet on the southern boundary. The variance is being requested to allow the property owner to construct a home 103 feet from the OHWM. A similar OHWM setback variance of 105 feet was granted to the adjacent property at 15684 Potawatomi in 1983 (V AR 83-13). Determination Slopes in excess often percent exist over most of the lot and present an exceptional circumstance, unique to the property, as stipulated under Ordinance No. 52, Section 10.03. Gold Nugget Development Co, has requested the preliminary plat be revised. The revisions that have been made were to Lots 7 & 8 of Block 3, The lot sizes have been decreased in acreage but still meet the 2.5 acre minimum acreage requirement. By decreasing these lots, Lot 6 of Block 3 has increased in acreage. The purpose of this general policy is to establish a consistent standard for the apportionment of special assessments. II. TypES OF IMPROVEMENTS v This policy shall relate to those public improvements allowable under Minnesota Statute 429. Generally, the improvements include: street and street lighting improvemtIlts; sanitary and water utility improvements; sanitary and water utility improvements; stOmt sewer and drainage improvementS; and bikcwaylpcdlway improvements. This policy outlines how new construction reconstruction, and major maintenance shall be financed uooer each type of project. Project costs shall include: the construction costs; engineering; testing; permining; legal; administrative; land or easement acquisition; fiscal; capitalized interest; data processing and publications fees. III. SPECIAL ASSESSMENT METHODS Becefiling properties generally are assessed by one or a combination offour (4) methods; front footage; area; unit and benefit appraisal. Generally, the nature of an improvement lends itself'to ~ particular method. The four (4) methods are desctibed as follows: A. Frontage Method: Frontage is measured a.t the building setback line. The purpose of the petition is simply to provida a means for residents to initiate proceedings for an improvement project. Following the receipt at a petition or determination by the city council to initiate an improvement., the cit.y Council will schedule a public hearing for all affected res idents. If your driveway is not within this four feet, no portion of your driveway will be paved during the construction. The shoulders adjacent to other driveways will be stabilized with class five gravel. The ditches will be seeded. School starts at 0910 hours. Children arrive at school by bus, car and on foot. Community Service Officers reporting for duty at their first shift at 0800 should report to and remain in the area, unless called away, from 0815 until traffic and congestion is relieved. Deputy Sheriff Officers should make frequent patrols both stationary and roving, unless called away, beginning at about 0800 hours. Officers should take appropriate action to relieve congested traffic, enforce crosswalk and no driving on shoulder laws as well as other violations to help ensure everyones safety and well- being.
