DISCUSSION
The purpose ofthis agreement is to provide cooperation between the County and the
Municipality to implement the solid waste recycling program in the Municipality by funding it.

of Commissioners by providing SCORE funds to the City Of Andover for solid waste recycling
programs,

AGREEMENT FOR RESIDENTIAL RECYCLING PROGRAM
TIDS AGREEMENT made and entered into on the 13th day of December, 2005,
notwithstanding the date of the signatures of the parties, between the COUNTY OF ANOKA,
State of Minnesota, hereinafter referred to as the "COUNTY", and the CITY OF ANDOVER,
hereinafter referred to as the "MUNICIPALITY".
WITNESSETH:
WHEREAS, Anoka County has received $355,100 in funding from the Solid Waste
Management Coordinating Board and the State of Minnesota pursuant to Minn, Stat. ~ 115A.55?
(hereinafter "SCORE funds"); and
WHEREAS, Anoka County anticipates receiving an additional $355,100 in SCORE
funds in the spring of 2006; and
WHEREAS, the County wishes to assist the Municipality in meeting recycling goals
established by the Anoka County Board of Commissioners by providing said SCORE funds to
cities and townships in the County for solid waste recycling programs.
NOW, THEREFORE, in consideration of the mutual covenants and promises contained
in this Agreement, the parties mutually agree to the following terms and conditions:
1. PURPOSE. The purpose of this Agreement is to provide for cooperation between the
County and the Municipality to implement solid waste recycling programs in the
Municipality.
2, TERM. The term of this Agreement is from January 1, 2006 through December 31,
2006, unless earlier terminated as provided herein.
3. DEFINITIONS.
a, "Problem material" shall have the meaning set forth in Minn. Stat. ~ 115A.03,
subdivision 24a,
b. "Multi-unit households" means households within apartment complexes,
condominiums, townhomes, mobile homes and senior housing complexes,
c. "Opportunity to recycle" means providing recycling and curbside pickup or
collection centers for recyclable materials as required by Minn, Stat, ~ 115A.552.
d, "Recycling" means the process of collecting and preparing recyclable materials
and reusing the materials in their original form or using them in manufacturing
processes that do not cause the destruction of recyclable materials in a manner
that precludes further use,
e, "Recyclable materials" means materials that are separated from mixed municipal
solid waste for the purpose of recycling, including paper, glass, plastics, metals,
fluorescent lamps, major appliances and vehicle batteries,

recyclable material.
g, "Yard waste" shall have the meaning set forth in Minn. Stat. ~ 115A.03,
subdivision 38.
4. PROGRAM. The Municipality shall develop and implement a residential solid waste
recycling program adequate to meet the Municipality's annual recycling goal of 2,560
tons of recyclable materials as established by the County, The Municipality shall ensure
that the recyclable materials collected are delivered to processors or end markets for
recycling.
a, The Municipal recycling program shall include the following components:
i. Each household (including multi-unit households) in the Municipality
shall have the opportunity to recycle at least four broad types of materials,
such as paper, glass, plastic, metal and textiles,
11. The recycling program shall be operated in compliance with all applicable
federal, state, and local laws, ordinances, rules and regulations,
lll. The Municipality shall implement a public information program that
contains at least the following components:
(1) One promotion is to be mailed to each household focused
exclusively on the Municipality's recycling program;
(2) One promotion advertising recycling opportunities available for
residents is to be included in the Municipality's newsletter or local
newspaper; and
(3) Two community presentations are to be given on recycling.
The public information components listed above must promote the
focused recyclable material of the year as specified by the County. The
County will provide the Municipality with background material on the
focused recyclable material of the year.
IV, The Municipality, on an ongoing basis, shall identify new residents and
provide detailed information on the recycling opportunities available to
these new residents.
b. If the Municipality's recycling program did not achieve the Municipality's
recycling goals as established by the County for the prior calendar year, the
Municipality shall prepare and submit to the County by March 31, 2006, a plan
acceptable to County that is designed to achieve the recycling goals set forth in
this Agreement.
5, REPORTING. The Municipality shall submit the following reports semiannually to the
County no later than July 20, 2006 and January 19,2007:
a. An accounting of the amount of waste which has been recycled as a result of the
Municipality's activities and the efforts of other community programs, redemption
centers and drop-off centers. For recycling programs, the Municipality shall
certify the number of tons of each recyclable material which has been collected
and the number of tons of each recyclable material which has been marketed. For
recycling programs run by other persons or entities, the Municipality shall also

provide documentation on forms provided by the County showing the tons of
materials that were recycled by the Municipality's residents through these other
programs. The Municipality shall keep detailed records documenting the
disposition of all recyclable materials collected pursuant to this agreement. The
Municipality shall also report the number of cubic yards or tons of yard waste
collected for composting or landspreading, together with a description of the
methodology used for calculations. Any other material removed from the waste
stream by the Municipality, i.e, tires and used oil, shall also be reported
separately.
b. Information regarding any revenue received from sources other than the County
for the Municipality's recycling programs,
c. Copies of all promotional materials that have been prepared by the Municipality
during the term of this Agreement to promote its recycling programs,
The Municipality agrees to furnish the County with additional reports in form and at
frequencies requested by the County for financial evaluation, program management
purposes, and reporting to the State of Minnesota.
6, BILLING AND PAYMENT PROCEDURE, The Municipality shall submit itemized
invoices semiannually to the County for abatement activities no later than July 20, 2006
and January 19, 2007. Costs not billed by January 19, 2007 will not be eligible for
funding. The invoices shall be paid in accordance with standard County procedures,
subject to the approval of the Anoka County Board of Commissioners.
7, ELIGmILITY FOR FUNDS. The Municipality is entitled to receive reimbursement
for eligible expenses, less revenues or other reimbursement received, for eligible
activities up to the project maximum as computed below, which shall not exceed
$48,102.90, The project maximum for eligible expenses shall be computed as follows:
a, A base amount of $10,000.00 for recycling activities only; and
b, $4.70 per household for recycling activities only.
Notwithstanding any provision to the contrary, the County reserves the right to reduce the
funding provided hereunder in the event insufficient SCORE funds are available. If the
spring SCORE payment of $355,100 is not received or is reduced, the County may
reduce the project maximum amount payable to the Municipality. The County will
promptly notify the Municipality in the event that the project maximum will be reduced,
8. RECORDS, The Municipality shall maintain financial and other records and accounts in
accordance with requirements of the County and the State of Minnesota, The
Municipality shall maintain strict accountability of all funds and maintain records of all
receipts and disbursements. Such records and accounts shall be maintained in a form
which will permit the tracing of funds and program income to final expenditure, The
Municipality shall maintain records sufficient to reflect that all funds received under this

Agreement were expended in accordance with Minn, Stat. ~ 11SA.5S7, subd. 2, for
residential solid waste recycling purposes, The Municipality shall also maintain records
of the quantities of materials recycled. All records and accounts shall be retained as
provided by law, but in no event for a period ofless than five years from the last receipt
of payment from the County pursuant to this Agreement.
9, AUDIT. Pursuant to Minn, Stat. ~ l6C.05, the Municipality shall allow the County or
other persons or agencies authorized by the County, and the State of Minnesota,
including the Legislative Auditor or the State Auditor, access to the records of the
Municipality at reasonable hours, including all books, records, documents, and
accounting procedures and practices of the Municipality relevant to the subject matter of
the Agreement, for purposes of audit. In addition, the County shall have access to the
project site(s), if any, at reasonable hours,
10. GENERAL PROVISIONS.
a. In performing the provisions of this Agreement, both parties agree to comply with
all applicable federal, state or local laws, ordinances, rules, regulations or
standards established by any agency or special governmental unit which are now
or hereafter promulgated insofar as they relate to performance of the provisions of
this Agreement. In addition, the Municipality shall comply with all applicable
requirements of the State of Minnesota for the use of SCORE funds provided to
the Municipality by the County under this Agreement.
b, No person shall illegally, on the grounds of race, creed, color, religion, sex,
marital status, public assistance status, sexual preference, handicap, age or
national origin, be excluded from full employment rights in, participation in, be
denied the benefits of, or be otherwise subjected to unlawful discrimination under
any program, service or activity hereunder. The Municipality agrees to take
affirmative action so that applicants and employees are treated equally with
respect to the following: employment, upgrading, demotion, transfer, recruitment,
layoff, termination, selection for training, rates of pay, and other forms of
compensation,
c. The Municipality shall be responsible for the performance of all subcontracts and
shall ensure that the subcontractors perform fully the terms of the subcontract.
The Agreement between the Municipality and a subcontractor shall obligate the
subcontractor to comply fully with the terms of this Agreement.
d, The Municipality agrees that the Municipality's employees and subcontractor's
employees who provide services under this agreement and who fall within any job
classification established and published by the Minnesota Department of Labor &
Industry shall be paid, at a minimum, the prevailing wages rates as certified by
said Department.

e. It is understood and agreed that the entire Agreement is contained herein and that
this Agreement supersedes all oral and written agreements and negotiations
between the parties relating to the subject matter hereof.
f. Any amendments, alterations, variations, modifications, or waivers of this
Agreement shall be valid only when they have been reduced to writing, duly
signed by the parties.
g, Contracts let and purchases made under this Agreement shall be made by the
Municipality in conformance with all laws, rules, and regulations applicable to the
Municipality.
h. The provisions of this Agreement are severable, If any paragraph, section,
subdivision, sentence, clause or phrase of this Agreement is for any reason held to
be contrary to law, such decision shall not affect the remaining portion of this
Agreement.
1. Nothing in this Agreement shall be construed as creating the relationship of co-
partners, joint venturers, or an association between the County and Municipality,
nor shall the Municipality, its employees, agents or representatives be considered
employees, agents, or representatives of the County for any purpose.
11. PUBLICATION. The Municipality shall acknowledge the financial assistance of the
County on all promotional materials, reports and publications relating to the activities
funded under this Agreement, by including the following acknowledgement: "Funded by
the Anoka County Board of Commissioners and State SCORE funds (Select Committee
on Recycling and the Environment),
12, INDEMNIFICATION. The County agrees to indemnify, defend, and hold the
Municipality harmless from all claims, demands, and causes of action of any kind or
character, including the cost of defense thereof, resulting from the acts or omissions of its
public officials, officers, agents, employees, and contractors relating to activities
performed by the County under this Agreement.

The provisions of this subdivision shall survive the termination or expiration of the term
of this Agreement.
13, TERMINATION. This Agreement may be terminated by mutual written agreement of
the parties or by either party, with or without cause, by giving not less than seven (7)
days written notice, delivered by mail or in person to the other party, specifying the date

of termination. If this Agreement is terminated, assets acquired in whole or in part with
funds provided under this Agreement shall be the property of the Municipality so long as
said assets are used by the Municipality for the purpose of a landfill abatement program
approved by the County.
IN WITNESS WHEREOF, the parties hereunto set their hands as of the dates first

INTRODUCTION
The Human Resources Department has completed the interview and selection process for the
full-time AccountinglEngineering Clerk position.
DISCUSSION
The Human Resources Department advertised and received 12 applications for the
AccountinglEngineering Clerk. The interview team consisted of the City Administrator, the City
Engineer, the Assistant Finance Director, the Engineering Secretary and the Human Resources
Manager.
The interview team recommends hiring Sandra K Broughton for the AccountinglEngineering
Clerk. Mrs. Broughton has extensive office experience, which includes 10 years with Thrivent
Financial, and previous accounting experience, Mrs. Broughton would be an asset to the City of
Andover.
BUDGET IMPACT
The proposed starting date for this position is Monday, January 9, 2006, Mrs, Broughton would
be offered $15,21 per hour, which is the Step Level 3 rate, based on her previous office
experience, and then would be eligible for any general increases and annual Step Increases after
successful completion of her 6-month probationary period.
ACTION REOUESTED
Please approve hiring Mrs. Broughton as the AccountinglEngineering clerk, effective Monday,
January 9, 2006.

This item is in regard to approving a resolution accepting the restricted donation made by the Andover
Baseball Association for the Andover Station North Park,
DISCUSSION
The Andover Baseball Association is making a $30,000 donation to be used strictly for the construction
of baseball fields at Andover Station North Park. These funds are for Andover Station North Park only
and if not used for this purpose, the $30,000 will be returned to the Andover Baseball Association.
ACTION REOUIRED
The City Council is requested to approve the resolution accepting the restricted donation.

Approve Donations for Senior Class All Night Parties

INTRODUCTION
The City is starting to receive requests from the Senior All Night Party Donation Committees for a City
donation to help fund activities in support ofa High School Senior All Night Party.
DISCUSSION
Last year the City Council approved donations of $2.00 per student who are graduating that are Andover
residents to all requesting senior class parties (03-01-05 minutes attached), The question is whether or
not the City Council wants to proceed with that direction again in 2006, The donation amount would be
used to assist each association to hold the All Night Party, with funds being used for foods, events and
other miscellaneous items that celebrate the accomplishments of the graduating senior class,
The City Council, pursuant to the Public Purpose Expenditure Policy adopted by the Council provides for
such a donation. The All Night Party's primary goal is to provide a safe atmosphere for graduating
seniors by keeping them off the road and in a supervised environment. Parents coordinate and supervise
the "party" and volunteer their time to the event.
BUDGET IMP ACT
Funding for a donation is available through the City's Charitable Gambling Fund, Estimate of the total
donation to all requesting schools would be $1,200,

CONSIDER DONATIONIANOKA SENIOR PARTY
City Administrator Dickinson explained the City has received a request from the Senior All Night
Party Donation Committee for a City donation to help fund activities in support of an Anoka High
School Senior All Night Party.

Councilmember Grttel stated there was not an amount indicated. Mr. Dickinson stated he did not
put in an amount because he wanted to find out how many students from Andover would be
graduating from the area schools.
Mr, Dickinson explained he did some research and Andover High School was projecting 342
graduates, Anoka was projecting 563 graduates of which 105 are from Andover, St. Francis was
projecting 331 graduates of which 23 are from Andover, Coon Rapids was projecting 645 graduates
of which 26 are from Andover, Blaine was projecting 664 graduates of which 9 are from Andover.
Councilmember Grttel thought $1,50 per student from Andover was a good amount. He stated they
need to have some sort of proportional basis otherwise they will be giving $500,00 to every high
school in the area. The other Councilmembers agreed.
Councilmember Grttel stated if they gave $2.00 per student, it will result in $1 ,000 total. This would
give five hundred for each school, Andover and Anoka.
Motion by Grttel, Seconded by Trude, to approve a donation of $2.00 per student who are
graduating that are Andover residents to all requesting senior class parties. Motion carried
unanimously.

Reimbursement Resolution /2006 Equipment Purchases

INTRODUCTION
The Andover City Council is requested to approve the reimbursement resolution to provide reimbursement for
the equipment purchases approved through the 2006 City of Andover Capital Improvement Plan and the annual
budget process,
DISCUSSION
The Andover City Council, as part of the December 6, 2005 Council meeting, officially adopting the 2006
Capital Improvement Plan and on December 20, officially adopted the 2006 Annual Operating Budget that
included $510,000 for General Obligation Equipment Notes planned for purchasing Public Safety and Public
Works equipment (see Exhibit A).
BUDGET IMPACT
The equipment purchases were part of the 2006-2010 Capital Improvement Plan and budgeted in the 2006

A RESOLUTION RELATING TO FINANCING OF CERTAIN PROPOSED PROJECTS TO BE
UNDERTAKEN BY THE CITY OF ANDOVER ESTABLISHING COMPLIANCE WITH
REIMBURSEMENT BOND REGULATIONS UNDER THE INTERNAL REVENUE CODE.
WHEREAS, the Intemal Revenue Service has issued Section 1.103-18 of the Income Tax
Regulations (the "Regulations") dealing with the issuance of bonds, all or a portion of the proceeds of
which are to be used to reimburse the City for project expenditures made by the City prior to the time of
the issuance of the bonds; and
WHEREAS, the Regulations generally require that the City make a prior declaration of its official
intent to reimburse itself for such prior expenditures out of the proceeds of a subsequently issued
borrowing, that the borrowing occur and the reimbursement allocation be made from the proceeds of
such borrowing within one year of the payment of the expenditure or, if longer, within one year of the
date the project is placed in service, and that the expenditure be a capital expenditure; and
WHEREAS, the City desires to comply with requirements of the Regulations with respect to
certain projects hereinafter identified;
NOW THEREFORE BE IT RESOLVED that the City of Andover, Minnesota adopts a "declaration
of official intent" pursuant to Section 1,103-18 of the Regulations.
1. Official Intent Declaration
(a) The City proposes to undertake the following projects described on Exhibit A attached
hereto.
(b) Other than (i) expenditures to be paid or reimbursed from sources other than a
borrowing or (ii) expenditures permitted to be reimbursed pursuant to the transition
provision of Section 1,103-18(1)(2) of the Regulations or (iii) expenditures constituting
preliminary expenditures as defined in Section 1.103(1 )(2) of the Regulations, no
expenditures for the foregoing projects as identified on Exhibit A have heretofore been
made by the City and no expenditures will be made by the City until after the date of this
Resolution.
(c) The City reasonably expects to reimburse the City expenditures made for costs of
designated projects out of the proceeds of debt (the "Bonds") to be incurred by the City
after the date of payment of all or a portion of the costs. All reimbursed expenditures
shall be capital expenditures as defined in Section 1.150-1 (h) of the Regulations.
(d) This declaration is a declaration of official intent adopted pursuant to Section 1,103-18
of the Regulations.
2. Budoetarv Matters, As of the date hereof, there are no City funds reserved, allocated on a
long-term basis or otherwise, set aside (or reasonably expected to be reserved, allocated on a
long-term bases or otherwise set aside) to provide permanent financing for the expenditures
related to the projects, other than pursuant to the issuance of the Bonds. This resolution,
therefore, is determined to be consistent with the City's budgetary and financial
circumstances as they exist or are reasonably foreseeable on the date hereof, all within the
meaning and content of the Regulations,

official books and records of the City, This resolution shall be available for inspection at the
office of the City Clerk at the City Hall (which is the main administrative office of the City)
during normal business hours of the City on every business day until the date of issuance of

"reimbursement allocations. described in the Regulations, being generally the transfer of the

used by the City to make payment of the prior costs of the projects, Each allocation shall be
evidenced by an entry on the official books and records of the City maintained for the Bonds,
shall specifically identify the actual prior expenditure being reimbursed or, in the case
reimbursement of a fund or account in accordance with Section 1.103-18, the fund or account
from which the expenditure was paid, and shall be effective to relieve the proceeds of the
Bonds from any restriction under the bond resolution or other relevant legal documents for the
Bonds, and under any applicable state statute, which would apply to the unspent proceeds of
the Bonds,

INTRODUCTION
The Andover City Council is requested to approve the reimbursement resolution to provide reimbursement for
the projects approved through the 2006 City of Andover annual budget process.
DISCUSSION
The Andover City Council, as part of the December 9, 2005 Council meeting, officially adopted the 2006 -
2010 Capital Improvement Plan and on December 20, 2005, officially adopted the 2006 Annual Operating
Budget. Included in the adopted budget are $1,950,000 PIR Bonds for new development projects and the first
phase of the Andover Station North ballfields. See Exhibit A for a listing of the projects to be included in this
resolution and the estimated cost.
BUDGET IMP ACT
Approval of a resolution at this point does not indicate approval of the project, but allows the City the ability to
provide adequate cash flow if the projects would move forward,

WHEREAS, Minnesota Statutes sets forth the procedures for the deposit of public
funds which include requiring the Andover City Council to annually designate the official

Andover interest rates on deposits that are greater than can be obtained from the official

INTRODUCTION
This item is in regard to a request from Meadows Creek Christian School to consider the City to
allow locating tennis courts in concept at Pine Hills Park.
DISCUSSION
Attached is a letter from the Meadow Creek Christian School with the request. The school is
interested in investing and constructing 4-6 new tennis courts in Pine Hills Park, The details are
in the school's letter, In reviewing the request, it is City staffs understanding that the tennis
courts would be considered public during most of the year, except for certain designated times
during the school's tennis season, which is generally in the fall. An agreement between the
school and the City would be necessary similar to the agreement the City has with the Anoka
Hennepin School District #11 for Eveland Fields which is located west of Andover High School.
Attached is an aerial view of the park for your review, If some of the Council members have not
been to the site, there is a storm drainage pond located near the west end of the park which in
the past has been used as a skating rink, but it was difficult getting the water tanker truck in and
out of the pond area,
If this improvement were to move forward, the church and the City will need to work out the
details as to who be responsible for the design of the park (including redesigning the storm
drainage pond) and the construction, etc,
The Park and Recreation Commission has reviewed the request and agrees with the concept of
having tennis courts at the park, Note: The Park Commission did discuss the possibility that the
parking lot may need to be paved, which will need to be discussed at a later date if the church
decides to move forward with the concept.

Meadow Creek Christian School is in the process of planning for a new school to
be located at 16lst and Tulip in northwest Andover, In the planning for the school and its
accompanying athletic facilities, the school will be investing in four to six tennis courts,
While initially laid out on the school property for the exclusive use ofM.eadow Creek, the
idea emerged that perhaps the courts could provide additional opportunities for the Park
Board,
Our proposal is that Meadow Creek School locate four to six tennis courts across
the street from the school in the current city park, The number of courts to be built would
depend on the amount of property available, The school would pay for the construction
and then turn the courts over to the city for public use, The only caveat to this proposition
is that Meadow Creek School would require full use of the courts during the school tennis
season (say from 2 -5 p,m. during the school day and when the school has tournaments
and intra-school competition), At other times the facility would be open for public play,
The scheduling of the exclusive use times would be arranged each year through the Park
Board. This would provide a public tennis facility in the northwestern part of the city.
Since tennis facilities are minimal in Andover, this private/public partnership would
benefit both parties.
It is requested that the Park Board consider this proposal, send its
recommendation to the City Council and, if approved, authorize the city attorney to draw
up the necessary agreement, It is anticipated that the construction would be done
approximately one year after the school is operational (2007 or 2008), The reason we
bring this proposal at this time is to not only allow the City to plan for the courts to be
built, but to allow the school to complete its planning of the layout of the site so we can
begin construction ofthe school building beginning in the spring of2006.

INTRODUCTION
The Council authorized letters of support for Youth First and Meals on Wheels at the last
meeting and suggested the City pursue a planning application for the Rural Reserve and
Comprehensive Plan Update,
DISCUSSION
Attached is a resolution authorizing a CDBG application for a combined Rural Reserve and
Comprehensive Plan Update project. It is anticipated that the City will need to work with
consultants when updating the Transportation Plan and Sewer Study as was done when these
documents were created. These expenses could easily reach $35,000. Staff suggests that the
City pursue an application in the amount of$35,000. Other costs associated with the project
including staff time, mailings, public hearings and publication expenses. In this manner, the
City's application will show cost participation and be within a range that may be funded with the
limited funding not assigned to low/moderadte income projects.
ACTION REOUESTED
The Council is asked to approve the attached resolution authorizing the 2006 CDBG application
with adjustments as necessary.

As per the City Personnel policy, all employees are required to have an annual review. The City
Administrator, James Dickinson, is due for his annual review no later than February 17, 2006.
The City Council is requested to schedule a date for the review.
DISCUSSION
Mr. Dickinson has been the City Administrator since August 18, 2004. He was given his 6-
month review effective February 17, 2005, and based on past practice he is due for his next
review on or before February 17,2006,
One suggestion to complete the review would be prior to or after a City Council meeting,
January 17 or February 3, 2006. However, the City Council may choose another date if they
would prefer.
The Hwnan Resources department will send out the review forms for the City Council to
complete prior to the review.

INTRODUCTION
Attached are disbursement edit lists for claims related to the on going business of the City of Andover,
DISCUSSION
Claims totaling $142,360.77 on disbursement edit lists #1 - #2 from 12/21/05 - 12130/05 have been issued
and released.
Claims totaling $306,288.23 on disbursement edit list #3 dated 01103/06 will be issued and released upon
approval.
BUDGET IMPACT
The edit lists consist of routine payments with expenses being charged to various department budgets and
projects.
ACTION REOUIRED
The Andover City Council is requested to approve total claims in the amount of $448,649.00. Please note
that Council Meeting minutes will be used as documented approval.
