The City Council is asked to hold a public hearing on the attached ordinance which would establish a 90
day moratorium on the area known as the "new" Metropolitan Urban Service Area. The "new" MUSA
is that area recently approved by the Metropolitan Council (1,215 acres) for inclusion in the
Metropolitan Urban Service Area.
The moratorium is being discussed to allow staff to prepare the necessary policies and ordinances to
regulate growth, establish time lines for development proposals and provide for orderly development of
'\ land within the MUSA. The moratorium will also allow staff the needed time to switch the platting
/
responsibilities from the Engineering Department to the Planning Department.
Staff met with developers on Friday, July 12, 1996. Staff will be preparing an add-on item for the
Council meeting to discuss the results of that meeting and to explain in greater detail the main issues of
the need for the moratorium and the effect it will have on development.

ORDINANCE NO.
AN INTERIM ORDINANCE REGULATING THE USE AND DEVELOPMENT
OF LAND WITHIN THE CITY OF ANDOVER FOR THE PURPOSE OF
PROTECTING THE PLANNING PROCESS AND THE HEALTH, SAFETY
AND WELFARE OF THE CITY.
The City Council of the City of Andover does hereby ordain:
Section 1. Legislative Findings of Fact.

The City of Andover, Minnesota, a predominantly residential and agricultural
community has sustained considerable urban residential development. With the
recent approval of the Andover Comprehensive Plan by the Metropolitan Council
and the approval for a 1,215 acre Metropolitan Urban Service Area (MUSA)
expansion hereinafter referred to as the "new" MUSA, the City deems it necessary
to prepare and recommend for hearing and adoption new and amended ordinances,
policies and regulations which are necessary measures for effectuating the
Comprehensive Plan. The City finds that unless reasonable measures are taken
for a reasonable interim period to protect the public interest by preserving the
integrity of said plan until the appropriate amendments to ordinances, policies and
regulations are adopted it will destroy the integrity of the Comprehensive Plan and
its basic purpose, need and effect.
Section 2. Legislative Intent.
It is the intention of the City Council to protect the Comprehensive Plan, proposed
amendments thereto, and their implementation by hereby adopting, pursuant to the
authority vested in the Council by Minnesota Statutes, Section 462.355 an interim
ordinance for a reasonable time during consideration of the aforementioned
Comprehensive Plan, proposed amendments, ordinances, policies and regulations
for the City, to protect the public health, safety and welfare of the community.

Section 3. Affected Area: supersedes,
This Ordinance shall apply to and govern all lands that recently were approved to
be included in the Metropolitan Urban Service Area (MUSA) for the years 1995-
2005 as shown on Exhibit A and known as the "new" MUSA for the purpose of
protecting the planning process and the health, safety and welfare of the City for a
period of 90 days from the date of adoption. Those properties in which sketch
plans have been reviewed by the Planning and Zoning Commission and City
Council, and those properties in which preliminary plats have been received by the
City shall be allowed to develop and shall be exempt from the moratorium. This
ordinance, during its effective period, shall replace and supersede provisions in all
other ordinances and regulations applicable to the City of Andover which are in
conflict or inconsistent with the provisions herein. All ordinances and provisions
therein which are not in conflict with the terms and conditions of this ordinance
shall continue in full force and effect.

Section 4. Scope of Control,
Except as hereinafter provided in this ordinance, during the period of July 16. 1996
through October 13. 1996:
Neither the Planning and Zoning Commission of the City of Andover or the
City Council shall review sketch plans or grant any preliminary approval to a
subdivision plat in the "new" MUSA unless such subdivision plat has been
filed with the City prior to July 16. 1996.
Section 5. Appeal Provisions.

The City Council shall have the power to vary or modify the application of any
provisions in this ordinance upon its determination in its absolute legislative
discretion that such variance or modification is consistent with the letter and intent
of the Comprehensive Plan or proposed amendment, upon which this local
ordinance is based, and with the health, safety and welfare of the City of Andover.
Upon receiving any application for such variance or modification, the City Clerk
shall refer such application to the City Council.

Section 6, Penalties.
Any person, firm, entity, or corporation who violates any provisions of this
ordinance shall be subject to the penalties and enforcement provisions set forth in
Ordinance No. 10, Section 18 of the City of Andover.
Section 7. Validity.
The validity of any word, sentence, section, clause, paragraph, part or provision of
this ordinance shall not affect the validity of any other part of this ordinance which
can be given effect without such invalid part or parts.
Section 8. Effective Date.
This ordinance shall take effect upon adoption and publication as required by law.

The City Council is asked to discuss the establishment of a 90 day moratorium on
development within the Metropolitan Urban Service Area. The Council is aware
that the City recently received approval from the Metropolitan Council on a
Comprehensive Plan Amendment which will incorporate 1,215 acres into the
MUSA over the next ten years. The moratorium would be done by ordinance and
would indicate that the City will not accept any residential development proposal
(sketch plan or preliminary plat application) from the effective date of the
ordinance in those areas recently approved to be included in the MUSA. The City
has done three other moratoriums in 1976, 1977 and 1979.
Why a 90 day moratorium?
The moratorium is being discussed to allow staff to prepare a policy on how the
1,215 acres will be staged for development on a yearly basis within the five year
phases as shown on the attached map. The policy would set specific guidelines
and procedures for the allocation of acreage within the MUSA.
What will be the effect of the moratorium on development?
The moratorium, if effective in July or August would expire in October or
November. As stated earlier, no sketch plan, or preliminary plat application will
be accepted for review within the area recently approved for MUSA expansion.
Based on a January I, 1997 deadline for plat approval to conduct street and utility
improvements for 1997, the moratorium would for all practicable purposes,
prevent any additional development in the "new" MUSA.

Where do we go from here?
Staff needs direction from the Council at this time. The Council has the following
options available:
1. Direct the Planning and Zoning Commission to hold a public hearing on and
Ordinance establishing a 90 day moratorium. The Council would then be
reviewing the ordinance, at the earliest, on August 6, 1996.
2. The Council may schedule a public hearing for July 16, 1996 and hold a public
\ hearing on the ordinance. This would expedite the approval ofthe ordinance.

3. The Council may not want to establish a 90 day moratorium.

plan and amendments to it by resolutio.n submitted to the planning agency. Befor
adopting the comprehensive municipal plan or any seetion or amendment of the plar
the planning agency shall hold at least one public hearing thereon. A notice of the tim,
place and purpose of the hearing shall be published once in the official newspaper l
the municipality at least ten days before the day of the hearing.
Subd. 3. Adoption by governing body. A proposed comprehensive plan Or ar
amendment to it may not be acted upon by the governing body until it has receive,
the recommendation of the planning agency or until 60 days have elapsed from the dah
an amendment proposed by the governing body has been submitted to the plannin,
agency for its recommendation. Unless otherwise provided by eharter, the governin~
body may by resolution by a two-thirds vote of all of its members adopt and amenc
the comprehensive plan or portion thereof as the official munieipal plan upon such
notice and hearing as may be preseribed by ordinance.
;> Subd. 4. Interim ordinance. If a munieipality is condueting studies or has autho-
nzed a study to be condueted or has held or has scheduled a hearing for the purpose
of eonsidering adoption or amendment of a comprehensive plan or offieial controls as
defined in section 462.352, subdivision 15, or if new territory for which plans or eon-
troIs have not been adopted is annexed to a munieipality, the governing body of the
municipality may adopt an interim ordinance applicable to all or part of its jurisdiction
for the purpose of proteeting the planning proeess and the health, safety and welfare
of its eitizens. The interim ordinance may regulate, restriet or prohibit any use, devel.
opment, or subdivision within the jurisdietion or a portion thereof for a period not to
exceed one year from the date it is effective, and may be extended for such additional
periods as the munieipality may deem appropriate, not exceeding a total additional
period of 18 months. No interim ordinance may halt, delay, or impede a subdivision
which has been given preliminary approval prior to the effective date of the interim
ordinance.

Subdivision I. Recommendations for plan execution. Upon the recommendation by
the planning agency of the comprehensive municipal plan or sections thereof, the plan-

means for putting the plan or section of the plan into effect. Subject to the limitations
of the following sections, such means include, but are not limited to, zoning regulations,
regulations for the subdivision of land, an offieial map, a program for coordination of
the normal public improvements and services of the municipality, urban renewal and
a eapital improvements program.
Subd. 2. Compliance with plan. After a comprehensive munieipal plan or section
thereof has been recommended by the planning agency and a copy filed with the govern-
ing body, no publicly owned interest in real property within the municipality shall?e
acquired or disposed of, nor shall any capital improvement be authorized by the mU~IC-
ipality or special district or agency thereof or any other politieal subdivision haVIng
jurisdietion within the municipality until after the planning agency has reviewed the
proposed aequisition, disposal, or capital improvement and reported in writing to the
governing body or other special district or agency or political subdivision concernc:d.
its findings as to compliance of the proposed acquisition, disposal or improvement WIth
the comprehensive municipal plan. Failure of the planning agency to report on t.he P:i
posal within 45 days after such a reference, or such other period as may be deslgnat .

During the traffic discussions with the Woodland Terrace residents one of the items the
neighborhood requested to be reviewed is the possibility of installing a sidewalk along the
service road from Narcissus Street NW east to Heather Street NW. Staff has reviewed this
possibility and has generated the following comments:
1. If a permanent 5 foot wide concrete sidewalk is constructed it would need to be located on
the south side of the service road adjacent to the existing residential lots. If it were located
along the north side of service road it would be removed during the future reconstruction of
Bunker Lake Boulevard.

2. If a sidewalk at this location is desired by the City Council a neighborhood meeting with the
property owners adjacent to the service road will need to take place.
3. If the sidewalk is located within the right-of-way adjacent to the existing residential lots
there may need to be some retaining of the lot to facilitate the sidewalk installation.
4. The funding for this could possible be from one of the following sources:
- assessments
- PIR fund
- state aid?
- other
- combination of the above noted funds

The City's consulting engineer, MSA, is currently preparing the drainage information relating to
the stormwater discharge located at the southeast corner of Crooked Lake Blvd and Bunker
Lake Blvd. The results of this information and the responses from the adjacent residents will
be discussed at the Council meeting. Based upon the results of the drainage information and
discussions with the adjacent property owners, the following options would be recommended:
1. If the necessary agreements can be worked out with the property owners the project could
be awarded as presented.
/ 2. If there are drainage and easement issues remaining the reconstruction of the intersection
could be performed at a later date either under a separate contract or with the
reconstruction of Bunker Lake Blvd. in the future.

The City Council is requested to approve the preliminary plat of Indian Meadows 4th Addition
per Ordinance 8 and 10 and all other applicable ordinances and policies as requested by
North Suburban Development.
The Andover Review Committee (ARC) has reviewed the preliminary plat. Their comments
are as follows:

General Comments
. The proposed preliminary plat is currently zone R-1, Single Family Rural. In addition, the
proposed plat is not within the Metropolitan Service Area (MUSA).
. The proposed subdivision consists of 29 single family rural residential lots.
The developer and/or owner is responsible to obtain all necessary permits (DNR, U.S.
Army Corps of Engineers, Lower Rum River WMO, LGU, MPCA and any other agency
which may be interested in the site.).
Comments of the Andover Review Committee
The Andover Review Committee has found the following variances that are being requested
as part of the preliminary plat.
1. A variance to Ordinance 10, Section 9.06 A3 for Lots , Blocks , (to be
determined at a later date) that do not meet the minimum 39,000 square foot requirement
subject to a report from the developer regarding on-site sewage treatment as required by
the Building Department for any or all lots prior to any grading of the site.
The Andover Review Committee has reviewed the variances. Because the variances will not
have an effect on the health, safety and general welfare of the community, it is recommended
to approve the preliminary plat.
Planning and Zoning Commission Comments
The Commission is recommending approval citing the following items that are proposed in the
attached resolution. The City Council should review the meeting minutes of the Commission
as to the public testimony that was presented.

h. The proposed method of disposing of surface water has been shown on the grading,
drainage and erosion control plan. The developer is required to comply with the Water
Resource Management Plan that was approved in January 1993.
8.04 ADDITIONAL INFORMATION
b. Source of water supply is private well.

c. Sewer disposal facilities will be private septic system.
d. Rezoning of properties will not be required.
f. Flood Plain Management is the Lower Rum River WMO (see Section 9.04(b) for additional
information regarding the 100 year flood elevation).
g. Street lighting is required and the installation costs will be paid by the developer.
j. The total linear road mileage for the proposed plat is 1.1 miles.
9.02 STREET PLAN
a. The typical section, right-of-way and grade are indicated on the preliminary plat.
9.03 STREETS
a. The proposed right-of-way is shown as 60 feet which conforms to standards by
classification.
m. Driveway access shall be 60 feet or more from any intersection.
n. Boulevard is required to be topsoil, seeded and mulched (disc anchored) to provide erosion
control.
9.04 EASEMENTS
b. A drainage and utility easement will be required to follow the 100 year flood elevation.
9.06 LOTS
e. The developer is responsible to obtain all necessary permits from the Lower Rum River
WMO, DNR, Corps of Engineers, LGU, MPCA, and any other agency that may be
interested in the site.
9.07 PARKS, PLAYGROUND, OPEN SPACE
Park dedication as recommended by the Park and Recreation Commission.

Note: The Commission and the public also wanted to know if CSAH #7 and CSAH #20 met
warrants for signals. They did meet warrants in 1994 but a signal at this intersection is
a low priority on Anoka County Highway Department's list of signals because the
accident rate was low.

Park and Recreation Commission Recommendation
The Commission at their June 21, 1996 meeting reviewed the preliminary plat. The park
dedication requirements have been previously met.

be approved by the Tree Inspector prior to any construction.

Dear Mr. Carlberg:
We are writing to you concerning the Indian Meadows Fourth Addition preliminary
plat. We will be on vacation the week of June 24-28, 1996, during which time the
meeting is scheduled on Tuesday, June 25, 1996. The following are our thoughts
and concerns regarding this project.
1. Traffic. Our main concern with this construction will be the traffic associated
with this project. We feel under no circumstances should any construction
vehicle (heavy dirt trucks, lumber trucks, septic trucks, block trucks, etc.)
should enter our development of Indian Meadows Third Addition on to 155th
Avenue, N.W. from County Road 20 to Fox Street, N.W. to 155th Avenue,
N.W., County Road 20 to Dakota Street, N.W. to 155th Avenue, N.W. and 7th
Avenue to 155th Avenue, N.W.
Vehicles for this construction should use the new Indian Meadows Fourth
Addition roads exclusivelv to avoid damage to our street which is 155th
Avenue, N.W. All the roads in the Indian Meadows Third Addition are in
marginal condition now and they will not withstand the weight of all the heavy
trucks and equipment.
We would like the City of Andover or the developer of this project to post signs
at the appropriate intersections to instruct the construction vehicles to use the
new Xenia Street as the main entrance.

Sians. During or after this development, we request that the City of Andover
immediately post three way stops signs, speed limit signs of 25 m.p.h. and

slow down signs children at play on 155th Avenue, N.W. The 155th Avenue,
N.W. is a main thoroughfare for the current Indians Meadows Third Addition
and if there is going to be additional traffic from the new development, it is
very important that our children are safe as well as the residents of this area.
Under no circumstances do we want cars speeding on 155th Avenue, N.W.
3. Road Improvements. If for any reason the use of heavy dirt trucks, lumber
trucks, septic trucks, block trucks, etc. are going to use 155th Avenue, N.W.
as an entrance to this new development, we reauest that the City of Andover
pav for all repairs to this road at no cost to the current residents in this area.
As stated above, the roads are in marginal condition now and they will not

154th Avenue. N.W. Road. We really find it hard to believe that with all the
construction available that a through street cannot be made from 7th Avenue
to 154th Avenue, N.W. If you are able to loop 154th Avenue, N.W. to Hopi
Street, N.W. and Eidorado Avenue, N.W., there is no reason why there cannot
be one through street of 154th Avenue. N.W. to 7th Avenue and then Eldorado
Avenue. N.W. and Hopi Street. N.W. do not have to have throuah streets. We
disagree that there is no alternative way to traffic the 29 homes in this new
development directly to 7th Avenue without the use of the streets in the Indian
Meadows Third Addition.

Based upon the above, our main concerns are traffic on 155th Avenue, N. W., the use
of the roads during this project on 155th Avenue, N.W. by heavy equipment and
improving 155th Avenue, N.W. at no cost to the current residents.

. The proposed preliminary plat is currently zone R-1, Single Family Rural. In addition, the
proposed plat is not within the Metropolitan Service Area (MUSA).
. The proposed subdivision consists of 22 single family rural residential lots.
The developer and/or owner is responsible to obtain all necessary permits (DNR, U.S.
Army Corps of Engineers, Lower Rum River WMO, LGU, MPCA and any other agency
which may be interested in the site).

Comments of the Andover Review Committee
The Andover Review Committee has found the following variances that are being requested
as part of the preliminary plat.
1. A variance to Ordinance 10, Section 9.06 A3 for lots that do not meet the minimum 39,000
square foot requirement.

engineer was not able to provide the 50 foot minimum requirements.

The Andover Review Committee has reviewed the variances. Because the variances will not
have an effect on the health, safety and general welfare of the community, it is recommended
to approve the preliminary plat.
/ Planning and Zoning Commission Comments
The Commission has reviewed the preliminary plat and is recommending approval subject to
historical data relative to the removal of the temporary cul-de-sacs at the end of 164th Lane
NWand 164th Avenue NW and with the location of Heather Street NW.
Staff did review the public hearing meeting minutes a few years ago when the streets were
constructed but was unsuccessful in finding documentation or any discussion that the streets
would be extended. The streets are well beyond the 500 foot maximum the ordinance allows.
The cul-de-sac radius is 25 feet for 164th Lane NW and 30 feet for 164th Avenue NW. In
discussing this with Public Works, the cul-de-sacs are difficult to plow. The Fire Department
obviously is very concerned with the length of each. We do recommend that each City
Council member visit the site which will give you an idea of what the surrounding area is like.
Note: One of the City Council Mission Statements is to require streets and roads to assure
access to and between all developable properties for public safety.
The public and the Planing and Zoning Commission have requested to look at moving Heather
Street NW further east to minimize the existing properties from having double frontage (side
and front). Problems could possibly exist if the street was to move east and they include the
poor organic soils (peat) and the general floodplain may be affected. Also, the developer
could potentially lose a lot depending on the location of Heather Street NW.

Park and Recreation Commission Recommendation
The Commission at their June 20, 1996 meeting reviewed the preliminary plat and is
recommending cash in lieu of land.

be removed within all right-of-ways and buildable areas for each lot as required by

8.03 DESIGN FEATURES
a. The proposed right-of-way as indicated is 60 feet.
c. The storm sewer/street plan and profile will be designed by the developer's engineering
consultant and will need to be reviewed and approved by the City Engineer prior to any
construction.
g. The setbacks for each lot are shown.
h. The proposed method of disposing of surface water has been shown on the grading,
drainage and erosion control plan. The developer is required to comply with the Water
Resource Management Plan that was approved in January 1993.
8.04 ADDITIONAL INFORMATION

b. Source of water supply is private well.
c. Sewer disposal facilities will be private septic system.
d. Rezoning of properties will not be required.
f. Flood Plain Management is the Lower Rum River WMO (see Section 9.04(b) for additional

WHEREAS, the Planning and Zoning Commission finds the request would not have a
detrimental effect on the property values and scenic views of the surrounding area; and
WHEREAS, the Planning and Zoning Commission finds the request meets the criteria of

private property. The landscaping on the island will be maintained by
the City. Acting Chairperson Peek also felt one sign on a major
arterial is appropriate.

adjustment for the request that only one sign be issued and not two as
requested. Also, it is located on 166th Lane NW and not 166th Avenue as
indicated by Staff. Motion carried on a 2-Yes, S-Absent (Squires, Apel,

Ordinance No.8, Section 5.03, regulates the Special Use Permit process.
Ordinance No.8, Section 8.07 (D) (2), lists those signs allowed by Special Use
Permit. Area identification signs may be allowed provided:
1. The area for development is larger than five (5 a.) acres.
2. One sign per development. Additional signs shall be reviewed by the Andover
Review Committee (ARC) and the Planning and Zoning Commission and
approved by the City Council.
3. The maximum square footage of the sign is thirty-two (32 s.f.) square feet in

In reviewing a Special Use Permit request for any sign, certain criteria shall be
used. The criteria of most concern are:
1. No sign shall be permitted that constitutes a hazard to vehicular safety.
2. No sign shall be permitted that may tend to depreciate nearby property values,
be a detriment to scenic or pleasant views, or otherwise mar the landscape.
Ordinance No.8, Section 5.03, Special Uses, also establishes criteria in reviewing
Special Use Permit applications. These criteria include:

the effect of the proposed use upon the health, safety, morals and general
welfare of the occupants of surrounding land,
the existing and anticipated traffic conditions including parking facilities on
adjacent streets and land,
the effect on values of property and scenic views in the surrounding area, and
the effect of the proposed use on the Comprehensive Plan.
General Review
The applicant is requesting the Special Use Permit to erect two (2) permanent
monument area identification signs for Hunter's Hollow.
As indicated above, one sign per development is allowed per Section 8.07(D)(2).
Additional signs must be reviewed by the Andover Review Committee (ARC) and
Planning and Zoning Commission and approved by the City Council. The ARC
has reviewed the additional sign being requested and does not see a need for the
additional signage at that location. The ARC is concerned with the number

Per Council recommendation, we worked with two different construction firms on designing and glvmg
us an estimated cost per/foot on the construction of the Public Works Building addition. However, both
firms refused to draw
a design of a building at no charge and we use this design for our bidding process. Because there
would be a
large possibility that they would not get the bid and their design would be a total lose for them. They
will draw
this type of design for private industry, but seldom for Government entities. Therefore, I am asking for
permission to hire an engineering firm to design this building, so we can start moving forward.
For over three months, we explored other options so that we could proceed with the building addition in
an economically feasible manner. However, we have been derailed at every turn. There have been
many suggestions,
but I think now is the time to look at a secure source for funding this addition and try to lock in where
the funding
is going to come from.
We will also have to look for equipment storage for this coming winter. We should devise a plan to get
these units housed inside somewhere. Service has become very important to the public in the last ten
years and we need equipment housing for the winter months to provide the best possible service we can.

ORDINANCE NO.
AN ORDINANCE ESTABLISHING BUFFER STRIPS AND STANDARDS FOR THE
PROTECTION OF WETLANDS
THE CITY COUNCIL OF THE CITY OF ANDOVER DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Findings and Intent.
This ordinance hereby incorporates by reference the Wetlands Conservation Act of 1991
[Minn. Stat. 103G.221 et seq. (herein after referred to as the WCA)] and any future
amendments adopted by the legislature. All wetlands and activities shall comply with
those regulations as adopted under the WCA.

The City finds it necessary to regulate the use of lands surrounding wetlands. Buffer
strips, are necessary and beneficial to maintaining the health of wetlands. These strips of
land surrounding wetlands protect their shorelines from erosion, while serving to filter
sediment, chemicals and other nutrients before storm water discharges into the wetland.
Buffer strips are also beneficial in providing habitat for wildlife.

It is the intent of this ordinance to establish and maintain a buffer strip that abuts all
wetlands that may be left undisturbed, or is of natural condition.
Section 2. Purpose and Implementation.
Through the adoption and enforcement ofthis ordinance, the City shall promote the
general health, safety, and welfare of its residents by both conserving and protecting
wetland resources of the City. The City seeks to accomplish the following purposes:
(a) To satisfy all of the requirements of the Wetlands Conservation Act of 1991
as amended;
(b) To balance the needs to preserve and protect natural resources and systems
with both the rights of private property owners and the need to support the
efficient use of developable land within the City;

(c) To promote water quality by maintaining the ability of wetlands to recharge
ground water and receive the discharge of ground water, to retain sediment

and toxicants and filter and strip nutrients from surface water runoff before
it discharges into community lakes and streams, thus avoiding the
contamination and eutrophication of these water features; and

(d) To provide wildlife habitat and thereby support the maintenance of diversity
of both plant and animal species within the City.
Section 3. Definitions.
Buffer Strip
A one rod (16.5 feet or 5 meters) wide area abutting a wetland that shall be left
undisturbed or in its natural condition during the development and building phases.
Wetland (s)
Lands transitional between terrestrial and aquatic systems where the water table is usually
at or near the surface or the land is covered by shallow water. For the purposes ofthis
definition, wetlands must:

(1) have a predominance of hydric soils;
(2) be inundated or saturated by surface water or groundwater at a frequency and
duration sufficient to support a prevalence ofhydrophytic vegetation typically
adapted for life in saturated soil conditions; and
(3) under normal circumstances support a prevalence of such hydrophytic vegetation.
Section 4. Wetland Buffer Strips and Setbacks.
For lots of record created after the adoption of this ordinance, a buffer strip shall be
established abutting all wetlands. The buffer provisions of this ordinance shall not apply
for developments that have paid the preliminary plat fee (As Established in Ordinance
No. 10, Section 7.02 - Procedures for Platting and Subdividing Tracts of Land) to the
City within 30 days after the adoption of this ordinance.
Buffer strips shall be established and maintained in accordance with the following
requirements:

(a) Buffer strips shall be identified within each lot by active protective fencing
approved by the City. The developer shall be responsible for the placement of
the fencing. A one rod (16.5 feet or 5 meters, measured linear) wide
undisturbed buffer strip shall be maintained abutting all wetlands during the
development and building phases.

(b) Wetland buffer strips shall apply to all wetlands.

Recognizing that there are instances where because ofthe unique physical characteristics
of a specific parcel of land, narrower buffer strips may be necessary to allow for the
reasonable use of the land and to allow for the natural functioning of the wetland. The
Andover Review Committee may approve alternative standards, based on an assessment
of the following:
(a) Size of the parcel,
(b) Existing roads and utilities,
(c) Percentage of parcel containing wetlands, and
(d) Configuration of wetlands on parcel.
The Andover Review Committee will evaluate the appropriateness of using the
alternative standards as part of its review. An applicant must receive Andover Review
Committee approval through either of these review processes prior to submitting a
preliminary plan or plat application that applies the alternative buffer strip standards.
Active protective fencing shall be installed by the developerfbuilder along the most
upland edge of all wetland buffer strips prior to any development and/or building
construction. These fences will be a minimum ofthree (3) feet high. Geotextile fabric
fencing (silt fence) is acceptable as long as it meets MNDOT 3733 Type 3.

All fencing barriers must be installed prior to and maintained throughout development
and/or building construction. All fencing barriers shall not be removed until construction
and/or development has been completed and all landscaping has been installed.
It shall be the responsibility of the builder or property owner to remove all fencing
barriers once the lot has been landscaped (sod and/or seed established). The fencing
barriers are intended to inform the developer, builder and property owner of the wetland
buffer strip protection process.
Section 5. Exemptions.
1) City initiated projects (Le. trails, roads, etc.) may be exempt from the wetland
buffer strip requirements.
2) Grass and weed height requirements are exempt from Ordinance No.34 - An
Ordinance Regulating and Controlling the Growth of Noxious Weeds, Grass and
Other Harmful Vegetation in the City of Andover.

Section 6, Wetland Buffer Strip Protection Plan.
A Wetland Buffer Strip Protection Plan shall be submitted either as part of the Grading,
Drainage and Erosion Control Plan or as on a separate drawing, to include the following:
(1) Location of all wetlands.
(2) Location of wetland buffer monuments.
(3) Location of buffer stripes).
(4) All required setbacks from the buffer stripes).
The following notes shall be indicated on the wetland buffer strip plan in large letters:
(1) Contact the City prior to any land disturbance.
(2) All wetland buffer strip protection measures shall be installed prior to
development and/or building construction.
Section 7. Variances.
(a) Requests for variances shall be made in accordance with the procedures and
requirements set for in Ordinance No.8, Section 5.04.
(b) Variances shall only be granted when the standards and criteria set forth in
Ordinance No.8, Section 5.04 have been met. Variances shall not be granted
which would circumvent the intent and purposes of this ordinance.
Section 8. Inspection and Investigation.
The City Administrator or its duly authorized employees shall inspect all premises and
places within the City of Andover as often as practicable to determine whether any
condition described in this ordinance exists. The inspector shall investigate all reported
wetland incidents.
Section 9. Penalty.
A General Notice will be given to any developer, builder, or property owner who fails to
comply with the provisions ofthis ordinance. The Notice will state the following
information:
1) The violation.
2) Items or work to be completed in order to comply.
3) Date work to be completed.

I Failure to comply with this Notice will result in a order to stop work on the site.
Any person (firm, or corporation) who violates any section of this ordinance or shall
obstruct staff or their representatives from carrying out their duties, shall be guilty of a
misdemeanor and, upon conviction thereof, shall be punished as defined by State Law.

The first full year of the Anoka County Housing and Redevelopment Authority (ACHRA) operation
has been very successful. So far this year ACHRA funds have been used to obtain nearly $4.5
million in first-time home buyer funding; undertake construction of a $3 million senior citizen
facility in Ham Lake; complete a senior housing study in Centerville; examine underwriting the
sale of bonds for a four-sheet ice arena in Blaine; assist in funding a $1.3 million apartment
/ building rehab in Lexington; and develop a housing rehabilitation program in the cities/towns
within the levy area.
This last effort is one in which your participation is the most vital to the overall success in
improving the housing stock in our neighborhoods. As you may recall" we had hoped to be able
to take the money raised by the levy and double it by having other entities such as MHFA match
our local effort. Unfortunately, the relatively small amount of money available - due to the lack
of participation of our larger cities. caused our leveraging effort to be unsuccessful. We simply
need to bring more dollars to the table to make that type of deal.
Therefore, the Anoka County Housing and Redevelopment Authority is, as we did last year,
asking you to consider approving the ACHRA levy in your community, As you recall, we have
established a policy which requires council approval for this levy in those cities which already
have their own HRNEDA. We believe this cooperative approach maximizes the possibility for
making this a united effort to improve the housing stock in our communities.
Consequently, we would appreciate an opportunity to attend one of your council workshops in the
next several weeks and discuss the benefits we see in working together to meet the housing
needs of our citizens. We think the track record we have now established, the acceptance of the
levy by the taxpayers in the current levy area and the recognition that your community's
involvement is critical to the overall success of this effort warrant your reconsideration of your
decision to not participate in 1996.

The Andover Housing and Redevelopment Authority is requested to
discuss and decide whether the City of Andover will allow the
Anoka County HRA to levy a special benefit tax for senior housing
development and housing rehabilitation. The Anoka County HRA has
the option to exercise its statutory authority to levy a special
benefit tax. However, the Anoka County BRA will not exercise any
levy authority in a municipality which has an existing BRA, unless
the BRA approves.
The Anoka County BRA expects to collect approximately $89,005 from
the special benefit tax from Andover. The effect of the tax
on a house with a value of $72,000 is $6.42. The Anoka County BRA
intends to use the proposed levy for the development of senior
citizen housing and the rehabilitation of single family and rental
housing in the county.
Attached for BRA review is a letter from Paul McCaron, Chairman,
Anoka County HRA and a resolution for HRA consideration.

Dear Mayor McKelvey:
The Anoka County HRA has been working with elected officials and technical staff from your
communities to develop a program which will address housing needs identified in the enclosed
draft Anoka County Housing Study. Over the last nine months, our joint efforts have shown us
that there is a need to do more to improve the quality of housing in Anoka County.
The Anoka County HRA believes that increased County investment in housing will enable our
communities to maintain the value of their property, will slow the progress of urban blight and will
I make the county a better and safer place to live. Anoka County recognizes that many
municipalities and local HRAs and EDAs have undertaken efforts to address local housing needs.
The Anoka County HRA believes, however, that it is now time for us to work together to leverage
our resources in order to enhance our abilities to make the necessary investment in our future.
The Anoka County HRA draft Housing Study identified two priority housing needs in the county.
These priority areas are senior housing development and housing rehabilitation, which includes
both single-family and rental housing. Approximately 14% of the housing units in the county
(13,307 out of 97,006 units) are substandard. Although the county and the municipalities have
used CDSG and other funding over the years to rehabilitate our housing stock, the enormity of
this problem greatly outweighs our current ability to address the issue. Further, over the next 10
years, the number of persons 65 years and older living in Anoka County will increase by 55%.
and already there are waiting lists for senior housing in the County. It is clear that the rapid rate
of growth will outstrip the ability of current projects to provide adequate housing for our elderly
population.
The benefit that the Anoka County HRA can offer is the ability to levy a special benefit tax that
can then be leveraged to bring up to four times the amount of the revenue received through the
levy. Thus, the Anoka County HRA is considering exercising its statutory authority for a special
benefit levy. It is the policy of the Anoka County HRA, however, that it will not exercise any levy
authority in any municipality Which has an existing HRA or EDA with HRA authority, unless both
the municipality and the HRNEDA approve.

At its meeting of July 18, 1995, the Anoka County HRA approved a motion requesting that
municipalities with an HRA/EDA consider consenting to the special benefit levy for 1996, If the
Anoka County HRA determines that it will exercise its levy authority, it must certify the levy to the
County Auditor by September 15. Thus, we request you seriously consider and respond to this
request no later than Friday, August 18, 1995. At the August 22, 1995, meeting of the Anoka
County HRA, the Board will determine whether or not it will exercise its levy authority and will
adopt a proposed budget based on the level of participation. We anticipate that the amount of
County HRA tax collected in your community would be approximately $89,005. It is our intention
to use the proposed levy for the development of senior citizen housing and the rehabilitation of
single-family and rental housing in the county. It is further our intention to establish committees
of the participating communities to work with the County HRA on the implementation of these
programs. We recognize the importance of ensuring that contributing municipalities benefit from
the levy. In 1996, it is our intention to ensure that all of the revenue collected in a municipality
be spent to benefit that municipality.
In order for the Anoka County HRA to exercise its levy authority in your community, we must have
a resolution stating your consent. A draft resolution is attached for your convenience. If you have
any questions, or would like any additional information, please contact Tim Yantos at 323-5692.
Approved resolutions should be sent to Mr. Yantos' attention no later than Friday, August 18,
1995.

Brad Povlitzki from Pov's Sports Bar & Grill had asked about extending his
liquor license to cover the softball fields so that he could sell liquor outside
during the Family Fun Fest. He is having a band play on the fields. At that time
I checked with Liquor Control to see if this could be done and I was told that it
could not.

Therefore, the Sno-Dragons Snowmobile Club requested a license to sell non-
intoxicating liquor on the softball fields, which is allowed by Liquor Control with
, Council approval.
On Thursday, July 11th, Brad met with Liquor Control and explained his request
and was told that he could request an extension of premise permit from the City
for a special event. He came in on Friday and I called Liquor Control to confirm
this and was told that he could ask for a permit.
Brad would like Council to consider his request to extend the license for July
19th and 20th.

$1 184517.00 for construction of the improvements; and direct the City
Clerk to return to all bidders the deposits made with their bids, except that the
deposit of the successful bidder and the next lowest bidder shall be retained until

A RESOLUTION ACCEPTING BIDS AND AWARDING CONTRACT FOR THE
IMPROVEMENT OF PROJECT NO. 93-17 FOR
SANITARY SEWER. WATERMAIN. STREET AND STORM SEWER
CONSTRUCTION IN THE AREA OF CROWN POINTE.
WHEREAS, pursuant to advertisement for bids as set out in Council
Resolution No. 122-96 , dated June 18 ,1996, bids were received,
opened and tabulated according to law with results as follows:

W.B. Miller, Inc.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby accept the bids as shown to indicate C.W. Houle. Inc.
as being the apparent low bidder.
BE IT FURTHER RESOLVED TO HEREBY direct the Mayor and City Clerk
to enter into a contract with C.W. Houle Inc. in the amount of $420.621.25 for
construction of the improvements; and direct the City Clerk to return to all bidders
the deposits made with their bids, except that the deposit of the successful bidder
and the next lowest bidder shall be retained until the contract has been executed
and bond requirements met.

WHEREAS, the City Council did on the ~ day of June, 19 96 , order
the preparation of a feasibility study for the improvement; and
WHEREAS, such feasibility study was prepared by the City Engineer
and presented to the Council on the 2nd day of July , 19~; and
WHEREAS, the property owners have waived the right to a Public Hearing;
and
WHEREAS, the City Council has reviewed the feasibility study and declares
the improvement feasible, for an estimated cost of $ 6.315.00
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Andover to hereby receive the feasibility report with an estimated total cost of
improvements of $ 6.315.00 , waive the Public Hearing and order
improvements.
BE IT FURTHER RESOLVED the property would be assessed over a-5.
year period.

Approve Slurry Seal Maintenance Project

As a segment of this year's street maintenance, we are planning to try an application of slurry
seal on a few streets within the City. The slurry seal is an asphalt emulsion with a slag stone
mixed with it. The result is similar to the sealcoat applications that we will be applying this
year. As there is only one vendor of the product, we are requesting the Council approve
contracting with Struck and Irwin Paving, Inc. to provide slurry seal improvements for the City
at an amount not to exceed $15,000.00.
The funding for this activity will be out of the sealcoaUcrackseal budget.

The City Council is requested to approve the resolution ordering the improvement of
miscellaneous bituminous park trails and directing the preparation of final plans and
specifications for Project 96-8.
The trails recommended being constructed are to provide handicapped accessibility to meet
American Disabilities Act (ADA) requirements. CDBG funds are recommended by the Park
and Recreation Commission to construct the following:

Note: Staff will also include the construction of the completion of a basketball court at

Staff has received a number of complaints in regards to compo sting (location of compost
materials on private property, odors, etc.) which prompted this proposed change to the
ordinance.
Staffhas researched similar ordinances from several metropolitan communities on this
issue.

AND TRANSPORTATION OF GARBAGE, RECYCLABLES AND REFUSE WITHIN THE CITY OF
ANDOVER.
The City Council of the City of Andover hereby ordains:
Ordinance No.1 02 is hereby amended as follows:
Section 3.
General Regulations
Subd. 2.
Scattering of Refuse; Composting. No person shall bury any refuse in the
City except in an approved sanitary landfill.
a. Compost upon private property. Yard waste and easily biodegradable,
non poisonous garbage may be composted on the premises, where such
yard waste/refuse has been accumulated or on private property with the
owner's consent.
a. Composting.
Composting is permitted on private property if all of the following
conditions are met:
I) Only organic materials. yard wastes and easily biodegradable.
non poisonous garbage may be composted.
2) Composting shall be placed in a container(s) or a pile (pile not
to exceed thirty-six (36) square feet in area and shall not exceed
three (3) feet in height).
3) The compost pile or container(s) shall be located in the rear
yard at least five (5) feet from any property line or twenty (20) feet
to a side yard lot line if adiacent to any public street right-of-way.
If a rear yard location is unavailable or impractical. the compost
materials may be placed in another location approved by the City
Administrator or authorized designee.

4) All compost piles and containers shall be fully screened so as
not to be visible from adiacent properties and public right-of-ways.
5) Compost materials shall be maintained so as not to create odors.

Amortization: A thirty (30) day amortization shall be estaablished for all
non-conforming composting uses from the date the ordinance amendment
is adopted
All other sections of this ordinance shall remain as written and adopted by the Andover City

The City Council is requested to approve the 1996-1997 animal control contract.
The only difference from our existing contract is that when an animal is
quarantined upon our order, if the owner is unknown or known but will not pay
the fee, the Humane Society will bill the city. If the fee remains unpaid, the
Humane Society will have the option of notifying the city that after 30 days it
will not longer accept quarantined animals. On average, we have three dogs that
are quarantined each year.
The Humane Society will be changing their name next year to the North Metro
Humane Society.
Attached is a copy of the proposed contract.

Randy Bromley, who is helping with the Burnett Senior Classic, has requested
that they be allowed to use the Hills of Bunker Lake 5th park for parking during
the tournament.
They will provide a certificate of insurance; cut the grass (weeds) and rope off
the area so that there is only one way into and out of the park.

They are also willing to donate 25 percent of their proceeds for whatever
purpose we want (City staff recommends that they donate the proceeds to next
year's Family Fun Fest).
Attached is a map of the property they would like to use.

Section 2.
2.4 Pets must be kept leashed or under control. Pets that are on or directly
adjacent to all athletic fields must be leashed. Owners are required to clean up

AN ORDINANCE AMENDING ORDINANCE NO. 28, AN ORDINANCE
LICENSING AND REGULATING THE SALE AND CONSUMPTION OF NON-
INTOXICATING MALT LIQUOR AND PROVIDING A PENALTY FOR THE
VIOLATION THEREOF.
The City Council of the City of Andover hereby ordains:
Ordinance No. 28 is amended as follows:
Section 6. Persons Ineligible for License
No license shall be granted to any person:
(1) Under twenty-one years of agc or born on or before September 1, 1967.
Section 8. Conditions of License

AN ORDINANCE AMENDING ORDINANCE NO. 53/ KNOWN AS THE DOG
ORDINANCE.
The City Council of the City of Andover hereby ordains:
Ordinance No. 53 is hereby amended as follows:
Section 6. Dogs on Leash
The restriction imposed by Section 5 shall not prohibit the appearance of any dog
upon streets or public property when such dog is on a leash and accompanied by
a responsible person or accompanied by and under the control and direction of a
responsible person so as to be as effectively restrained by command as by leash.
Pets that are on or directly adjacent to all athletic fields must be leashed. Owners
are required to clean up and dispose of their pet's excrement.

Removal (Part 1)
The City Council is requested to approve the resolution ordering the improvement of removal
of contaminated soil and debris and directing the preparation of final plans and specifications
for Project 94-33B, Commercial Boulevard NW.
A separate contract is necessary to excavate the contaminated soils on the Best Auto Parts
site. This contractor will also be available to excavate soils if any further contamination is
found during the normal grading and utility installations. This contact will excavate and
stockpile the contaminated soils. A separate contract (Part 2) will then be let for the disposal
of the contaminated soils.

hereby direct the City Clerk to seek public bids as required by law, with such bids
