SPECIAL CLOSED CITY COUNCIL MEETING - OCTOBER 2, 2001
MINUTES
A Special Closed Meeting of the Andover City Council was called to order by Mayor Mike Gamache
on October 2, 2001, 8:24 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover,
Minnesota, to discuss potential litigation on the Fire Department facilities issue.
Councilmembers present: Ken Orttel, Julie Trude
Councilmembers absent: Don Jacobson, Mike Knight

Fire Chief, Dan Winkel
City Engineer, Scott Erickson
City Administrator, John Erar
:) FIRE STATION FACILITY ISSUES -POTENTIAL LITIGATION
Mr. Erar explained they have been dealing with issues with the Fire Station facilities for the last
several months. Staff has been meeting with the original construction manager, Bonestroo, Rosene
and Anderlik and Associations. He noted the repairs to Fire Stations 1 and 2 need to occur this year
before winter, as the problems are getting progressively worse.
Chief Winkel described the leaks in the roof on Station 1, which is the worst, and the resulting
problems. Warranty work has been done on it ever since he's been here, and it still isn't right. Station
1 has a score of different kinds of leaks causing major interior wall damage. A big concern now is
mold. They are about to do air quality tests. Mr. Erickson stated Bonestroo has been out a number of
times. They have a proposal to repair the problems once and for all. The Building Official has looked
at the repairs being recommended.
Councilmember Orttel suggested Staff look at the insurance liability of the roof contractors. There is
consequential liability even if they are out of business. That is more. of a claim than a lawsuit.
Attorney Hawkins thought there may be some statute oflimitation problems with the insurance. Mr.
Erar pointed out the problem has been on-going and warranty work has been done over the last 10
years. He is asking that the Council approve the repairs to the roofs for both Fire Stations at a cost of
about $21,000 to $45,000. In addition, he asked that Staffbe allowed to explore preliminary legal
avenues of what can be done.

After further discussion, the Council agreed the roof work on both buildings must be done
immediately. Authorization for that is to be approved at the regular meeting immediately following
this meeting. They also agreed with the recommendation to have Staff and legal counsel pursue
preliminary legal action, what action the City could or should take with the firms involved.
The meeting was adjourned at 8:37 p.m.
