SPECIAL CLOSED ANDOVER CITY COUNCIL MEETING - JUNE 18,2001
MINUTES
A Special Closed Meeting of the Andover City Council was called to order by Mayor Mike Gamache
on June 18, 2001, 9:04 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW, Andover,
Minnesota, to discuss potential litigation with Woodland Development.
Councilmembers present: Don Jacobson, Mike Knight, Ken Orttel, Julie Trude
Councilmembers absent: None
Also present: City Attorney William G. Hawkins
City Engineer, Scott Erickson
City Finance Director, Jim Dickinson
Community Development Director, Dave Carlberg
City Administrator, John Erar

\ J Attorney Hawkins reported Woodland Development developers have submitted a number of issues
about the practices the City had engaged in regarding the charges to developers. The City is
attempting to answer those questions and will submit the responses by Friday. He hoped the matter
could be resolved by June 29 when they are scheduled to meet again. There are allegations he thinks
the City can justify. He does not think the Staffhas done anything incorrectly. Some of the items
are three to four years old and some are covered under the Development Contract. Some items are
about the escrows. He felt from a legal standpoint that the City has a solid position on it.
Mr, Erar stated a lot of the issues occurred prior to his tenure. In reviewing the financial data,
everything is consistent with the City's policy. Rates being charged have been approved by the City
Council. Staff is also surveying 10 to 20 cities on their development fees for comparison. He also
informed the Council of meetings held with the developer and letters received from their attorney.
If the Staffhas made mistakes, they will make the proper adjustments. From what he can see, Staff
has followed policy and has done a good job documenting it as well.
Mr. Dickinson also reported the developers have been given full access to the financial Staff and
financial data relating to their developments. As a result of some of their comments, Staff is in the
process of redesigning their sheets for greater clarification of expenses, fees, charges, etc. Right now
the developer is not paying the escrows. He is waiting for the results of the June 29 meeting before
pursuing that issue.

Council discussed some of the issues and concerns raised by the developer. Mr. Erar stated they
would continue to work with Woodland Development, understanding they have been good
developers in the past. He is willing to accommodate them until the June 29 meeting.
No action was required at this time.
Mayor Gamache closed the meeting at 9:40 p.m.
