DISCUSSION The street crack seal program is an effective street maintenance technique utilized to protect and prolong the life of the City's street infrastructure. The crack sealing program divides the City into seven separate maintenance zones. Each year the streets in one of the seven zones is targeted for sealing the cracks which is then followed up the following year with a seal coat. DISCUSSION The street seal coating program is an effective and cost efficient means to prolong the life of the City's street infrastructure. The seal coat program has been administered for approximately seven years and is one tool currently utilized to protect and prolong this investment. The grant is through the FireWise Community Program administered by the Minnesota Department of Natural Resources (DNR) Division of Forestry. The grant is in the amount of $6,600. DISCUSSION The thinning will begin in early-April and last until mid-May. Among the many benefits that will arise, the thinning will create healthier pine stands, make them less fire prone, and control the effects of a detrimental insect called the pine bark beetle. The grant will be needed to cover the costs ofthe services provided by the DNR and their associates, which includes chipping the slash generated from the felled trees and transplanting young trees. BUDGET IMP ACT The City's grant match will be covered through in-kind services (see attachment). ACTION REOUESTED It is requested that the City Council accept the grant agreement. City Engineer SUBJECT: Information on Speed Limits in Rural Areas - Engineering DATE: April2,2002 INTRODUCTION This item is in regards to information that was recently requested by the City Council as to Minnesota State Statute 169, which sets speed limits. DISCUSSION As we all know, Andover is a City and not a township. The new law that was effective August 1, 1999 does not allow Andover to establish 30 mph speed zones in 2.5 acre estate type developed areas. In urban districts of the City the speed limit is 30 mph (areas for most part that have City sewer and water). Attached is information from the Minnesota Department of Transportation (MnDOT) and the League of Minnesota Cities which may be helpful in understanding what Cities can do in regulating speeds of motor vehicles. Note: It is possible to request speed studies in the rural areas. In the past few years, MnDOT has not allowed speed limits to be reduced in rural areas because of the general prohibition in the law against driving at a greater speed than is responsible under the conditions then existing which means that when hazardous conditions exist (such as curve in the road), it may be unlawful to go as fast as permitted in a particular place under optimum conditions. It appears the City Council and/or residents should contact their State Representatives and Senators to revise the State Statute to include Cities to allow a 30 mph speed limit in rural residential areas. Respectfully submitted, ~~ 1 I , J '. / URBAN DISTRICT MS 169.01 subd. 59 Urban district means the territory contiguous to and including any stteet which is built up with structures devoted to business, industry, or dwelling houses situated at intervals of less than 100 feet for a distance of a quarter of a mile or more. Origin was the National Vehicle Code, 'With the intent of establishing a uniform speed of 30 MPH on easily identifiable urban streets. Whether spacing is on one side, both sides or alternating sides is left up to interpretation of city attorney. MS 169.14 subd. 5b allows the governing body to override a commissioner speed authorization and by resolution declare 30 MPH as the appropriate speed in an urban district, on any city street - municipal state aid street or town road. RURAL RESIDENTIAL DISTRICT MS 169.14 subd. 2 clause 1 and 7 (c) ( 1) 30 miles per hour in an urban district or on a town road in a rural residential district; - clause 7 ( c) - For the purposes of this subdivision, " rural residential district" means the territory contiguous to and including any town road within a subdivision or plat of land that is built up with dwelling houses at intervals of less than 300 feet for a distance of one- quarter mile or more. ~ Effective August 1,1999 meant to allow only townships, to establish 30 MPH zones in 2.5 acre estate type develooed areas. Due to length of set backs of homes on estate lots, it is extremely difficult for drivers to recognize. Alternate spacing with long setbacks is impossible to recognize. This position vacancy is the result of a department restructuring previously approved by the City Council. DISCUSSION An interview panel consisting of the Finance Director, Finance Department staff and Human Resources Manager interviewed several candidates for the position of Assistant Finance Director and has conditionally offered the position to Mr. Lee Brezinka, subject to ratification by the City Council. Mr. Brezinka is currently serving as Senior FinanciallBudget Analyst for Anoka County since 1997. His responsibilities are diverse and have included serving on the County Budget Team with specific involvement in the preparation of the Annual County Operating Budget, Capital Improvement Plan, Year-end Reporting, Debt Service and other senior level financial reporting responsibilities. Prior to his current position, Lee served as a Senior Accountant for Pine Medical Center from 1993 -1997 with senior level responsibilities for general and cost accounting, financial reporting, budget development, audit and regulatory reporting and managed the Medical Center's financial reporting system. Mr. Brezinka also has in-depth work experience with financial information systems, websites and network administration. With respect to educational qualifications, Mr. Brezinka has a Bachelor of Science Degree in Accounting from Minnesota State University at Mankato. Consequently, Mr. Brezinka is fully qualified to perform the duties and responsibilities of the position. , I \ I , / _ .' The existing house was constructed in 1984 and is located between 31 and 32 feet from the front property line. At the time the structure was constructed, Ordinance 8 required a front yard setback of 30 feet. Since that time, the ordinance has been amended to increase the required front yard setback for this zoning district to 35 feet. As a result of this action, the structure became lawful, nonconforming (see attached Zoning Ordinance Section 4.03). A variance to remove the nonconformity is needed before a building permit may be issued. DISCUSSION \ The proposed addition is indicated on the attached survey. The addition would be located on the east side of the existing structure. The addition is designed to angle toward the southeast to increase the front yard setback for the addition and to add architectural interest. The addition would have a front yard setback of 31.39 feet at the west end and approximately 46 feet at the east end. , \ \.-----) "- ) Applicable Ordinances Ordinance 8 Section 5.04 prescribes the process for reviewing variance requests. This section requires applicants to demonstrate findings to substantiate variance requests. State Statute provides review criteria that are used to determine the merit of variance cases. In all cases the applicant must demonstrate undue hardship. The considerations for undue hardship include: 1. There are circumstances unique to the property that were not created by the landowner. Unique conditions may include the physical characteristics, including topography or water conditions that may exist on the property. 2. The property, if the variance is granted, will not be out of character with other properties in the same neighborhood. 3. The applicant has exhausted all reasonable possibilities for using hislher property or combining a substandard lot due to size, shape or lot line dimensions, with an adjacent vacant lot. 4. Economic considerations may not constitute an undue hardship if reasonable use of the property exists with application of the minimum standards of this chapter. Findings for this Request The special circumstance for the subject property is the fact that the structure was built in compliance with established setbacks at the time of construction. An amendment to the Zoning Ordinance later increased the front yard setback and caused the nonconformity. Neither the existing structure nor the addition will be out of character with the existing neighborhood. As the attached aerial photograph indicates, all of the structures along 135th A venue in this neighborhood are located at approximately the same distance from the street. The applicant has explored all other feasible options to locate the addition on the property. There is not sufficient space for the addition to be located on the west side of the building. Locating the structure in front of the building would require a more substantial variance. The existing deck and a large Anoka County drainage and utility easement prevent the addition from being constructed behind the existing structure. It is important to note that the variance is needed primarily for the existing structure. Only a small portion of the addition will be within the 35 foot front yard setback. 2 .F \ ': \ ) \ , _.' - Planning and Zoning Commission Recommendation The Planning and Zoning Commission unanimously recommended approval of the proposed variance. The Commission wanted clarification on whether the Uniform Building Code or the Zoning Ordinance established criteria for non-conforming structures. Staff has reviewed them and found that only section 4.03 of the Zoning Ordinance regulates them. The Ordinance states that "(B) No structural alteration may be made". Therefore, to allow the expansion, a variance to remove the lawful, nonconformity is necessary. VARIANCE (02-01) TO ORDINANCE 8, THE ZONING ORDINANCE, TO REDUCE THE FRONT YARD SETBACK FOR PROPERTY LOCATED AT 2820 135TH A VENUE NW FOR KURT DALLMAN. City Planner Courtney Bednarz explained that Kurt Dallman, the applicant, is seeking approval of a variance to Ordinance 8 to reduce the front yard setback for property located at 2820 13Sth Avenue NW. The applicant is planning to construct an addition to the existing structure on the subject property. The existing house was constructed in 1984 and is located between 31 and 32 feet from the front property line. Mr. Bednarz explained that at the time the structure was constructed, Ordinance 8 required a front yard setback of30 feet. Since that time the ordinance has been amended to increase the required front yard setback for this zoning district to 35 feet. (,J \ ) Regular Andover Planning and Zoning Commission Meeting Minutes - March 26, 2002 Page 2 As a result of this action, the structure became legal-nonconforming. He stated the Uniform Building Code does not allow building permits to be issued to expand nonconforming structures. A variance to reduce the front yard setback requirement is needed to allow the structure to be considered conforming and to allow a building permit to be issued for the addition. Mr. Bednarz noted the addition would be located on the east side of the existing structure. The addition is designed to angle toward the southeast to increase the front yard setback for the addition and to add architectural interest. The addition would have a front yard setback of 31.39 feet at the west end and approximately 46 feet at the east end. Mr. Bednarz presented the applicable ordinances and criteria that are used to determine the merit of variance requests. He noted the special circumstance for the subject property is the fact that the structure was built in compliance with established setbacks at the time of construction. An amendment to the Zoning Ordinance later increased the front yard setback and caused the nonconformity. A variance to the front yard setback is necessary to allow the proposed addition. Neither the existing structure nor the addition will be out of character with the existing neighborhood. Mr. Bednarz stated the applicant has explored all other feasible options to locate the addition on the property. There is not sufficient space for the addition to be located on the west side of the building. Locating the structure in front of the building would require a more substantial variance. The existing deck and a large Anoka County drainage and utility easement prevent the addition from being constructed behind the existing structure. He indicated it is important to note that the variance is needed primarily for the existing structure. Only the portion of the addition that is attached to the existing structure will be within the 35-foot front yard setback. Mr. Bednarz indicated the request meets the criteria for granting a variance. It is recommended that the variance be granted to allow the Dallman's to move forward with the addition. Commissioner Daninger asked what kind of easement is in place on this property. Mr. Bednarz indicated that it is an existing 100-foot wide County easement. Mr. Bednarz stated that the County Board will vacate a portion of the easement for the proposed addition Commissioner Falk asked if the Planning Commission should wait for the County approval. Mr. Bednarz indicated to the Commission that the meeting has been scheduled for late April in regard to the easement. Chair Squires asked for clarification, noting the Commission did not have to wait or place conditions upon this issue in regard to the easement. Mr. Bednarz stated the Commission could condition the motion if deemed necessary. He also stated this item is being brought forward at this time to run concurrently with county meetings scheduled for April 2nd and 9th and to allow the addition to proceed within a reasonable time frame. , 1 , \ .--, \ Regular Andover Planning and Zoning Commission Meeting . Minutes - March 26, 2002 Page 3 Commissioner Greenwald indicated that due to undue hardship he is comfortable with the vanance. Commissioner Greenwald noted he was unfamiliar with the Uniform Building Code provision that does not allow building permits to be issued for certain structures. Chair Squires asked whether the Uniform Building Code or Zoning Ordinance regulates this proposal. Staff responded that the building code would not allow a building permit to be issued without a variance to the front yard setback. Chair Squires asked staff to bring information forward on this item at the next meeting. Motion by Daninger, seconded by Hedin, to recommend to the City Council approval of Resolution No. 02-01, approving the variance request for Kurt Dallman to reduce the front yard setback to 30 feet on property located at 2820 135th Avenue NW. Motion carried on a 7-ayes, O-nays, O-absent vote. Uses and Structures (A) Any structure or use lawfully existing upon the effective date of this Ordinance may be continued at the size and in manner of operation existing upon such date as hereinafter specified. ...:f(B) No structural alteration shall be made. (C) Nothing in this Ordinance shall prevent the placing of a structure unsafe condition when said structure is declared unsafe by the Building Inspector. (D) When any lawful non-conforming use of any structure or land in any district has been changed to a conforming use, it shall not thereafter be changed to any non-conforming use. (E) Whenever a non-conforming structure shall have been damaged by fire, flood, explosion, earthquake, war, riot, or act of God, it may be reconstructed and used as before if it be reconstructed within twelve (12) months after such calamity, unless the damage to the structure is fifty (50%) percent or more of its market value (as estimated by the Building Inspector), in which case the reconstruction shall be for a use in accordance with the provisions of this ordinance. (F) Whenever, a lawful, non-conforming use of a building or structure or land is discontinued for a period of one (1) year, any future use of said building or structure or land shall be in conformity with the provisions of this Ordinance. (G) Any non-conforming open use of land lawfully existing upon the effective date of this Ordinance may be continued for a period ofthree (3) years after the effective date of this Ordinance, whereupon such non- conforming use shall cease. (H) Normal maintenance of a building or other structure containing or related to a non-conforming use is permitted, including necessary non-structural repairs and incidental alterations which do not exceed or intensify the non- conforming use. WWW.CI.ANDOVER.MN.US TO: Mayor and Councilmembers FROM: John Erar, City Administrator SUBJECT: Anoka-Hennepin School District/Student Transportation Update DATE: April 2, 2002 INTRODUCTION In response to student transportation changes being made by the Anoka-Hennepin School District, my office has invited Mr. Chuck Holden, Director of Operations for the School District and Captain Dave King, from the Anoka County Sheriff s Office to present and share information with the City Council and public on how these changes will be implemented. DISCUSSION As Council is aware, the School District will be implementing a significant change in their student transportation policies by requiring all students living within a 2-mile radius of a school facility to either walk to school, obtain private transportation or pay a district service fee to underwrite the cost of bus transportation. The effective implementation date of this policy change will be April 8, 2002. In anticipation of these changes, Council has communicated its concerns and met with the School Board to discuss various issues, and has acknowledged the need to educate the public on these student transportation changes prior to April 8, 2002. Mr. Holden will be in attendance at the April 2, 2002 Council meeting to present information to the Council and public on the progress of these changes, including the hiring status of adult crossing guards and student walking routes, and to respond to any questions Council may have. Captain King will also be in attendance to describe public safety mechanisms that will be put in place by the Sheriffs Office for the first two weeks of this transition period to assist the School District in ensuring the safe conduct of students across busy County roadways. Mr. Holden has also prepared an article for publication in the May edition of the City Newsletter. It is my understanding that the Anoka County Board has approved speed zones on Hanson Boulevard spanning the entire length of the roadway beginning at Andover Elementary's southerly property line to the northerly property line of Oakview Middle School, including the 0 0 roadway span in front of City Hall. Mr. Holden and Captain King will address speed zones and Hanson BoulevardIV erdin Street crossing points at the meeting. Staff has reviewed the Special Use Permit (SUP) for the shopping center and found that the garden center use is covered by that SUP. DISCUSSION The City Council approved a Special Use Permit in 1988 that allowed the outdoor storage, sales and display of goods overnight at the shopping center as long as long as the area is well lit and ~, marked for safety reasons. Staff has made a determination that the original SUP allows the garden center use, however Frattallone will need to apply for a Commercial Site Plan Review. I'm Mike Frattallone and my company is Frattallone's Ace Hardware and Garden Stores. Many of you already know that we have signed a lease agreement with a local property owner and will be opening a hardware store in the old Thompson's Oak Furniture location. From our market studies, we feel that Andover needs a "real" hardware store. A store that can fix a broken window, repair a lawnmower, or even replace a lamp socket. We are that store! We do it all! Our slogan is simple, Frattallone's- the best "real" hardware stores in Minnesota! We run up-scale, full service, very successful hardware and garden stores. Our problem is this- we have the need for a special use permit for our outdoor garden center. Because we have just recently signed the leaSe we were unable to inform the city of our needs sooner (we weren't sure that we could get the lease signed). But, I fear that we will miss our main lawn and garden season if we wait any longer. Hardware stores like our's do 70% of our sales for the year in the summer months, May being the most important month. In the lawn and garden business we do almost 90% of that business in May and June. Ifwe miss those months we can write off the entire year as a loss, guaranteed. I'm enclosing our entire plan for our outdoor Lawn and Garden Center and hope that you will call me and give me advice on what you think I should do in order to get business rolling. Our garden centers are top of the line, up-scale, premium, and attractive. If at anytime they fall below that our customers just stop buying from us. So we only have one way to do it- PERFECTLY. We attain a clean, well stocked, fair priced, and aesthetically ph;:asing garden center at every store. We can do it no other way. DISCUSSION The subject property is presently restricted from development by the Neighborhood Business Moratorium (Ordinance 259) as well as the Multi Family Housing Moratorium (Ordinance 255). These ordinances are attached. ACTION REOUIRED Mr. Harris is requesting that the Council consider exempting the subject property from the multi- family housing moratorium to allow a sketch plan to be reviewed. If the project moved through the approval process successfully, the neighborhood business moratorium would need to be lifted before building permits could be issued. The City Council of the City of Andover does hereby ordain: Section 1. Lee:islative Findine:s of Fact. The City of Andover, Minnesota, a predominantly residential community has sustained considerable urban residential development. On March 6, 2000, the City Council adopted housing goals for the City of Andover as required by the Metropolitan Council as a part of the updating of the Andover Comprehensive Plan. The housing goals provide for a substantial increase in the number of multi-family housing units within the City over the next ten years. The City Council of the City of Andover has committed to the integration and implementation of the housing goals within the Andover Comprehensive Plan. Based on this commitment, the City Council deems it necessary to study, prepare and recommend for hearing and adoption new and amended ordinances, policies and regulations which are necessary measures for effectuating the Comprehensive Plan. The City finds that unless reasonable rneasures are taken for a reasonable interim period to protect the public interest by preserving the integrity of said plan until the appropriate amendments to ordinances, policies and regulations are adopted it will destroy the integrity of the Comprehensive Plan and its basic purpose, need and effect. Section 2. Lee:islative Intent. It is the intention of the City Council to protect the Comprehensive Plan, proposed amendments thereto, and their implementation by hereby adopting, pursuant to the authority vested in the Council by Minnesota Statutes, Section 462.355 an interim ordinance for a reasonable time during consideration of the aforementioned Comprehensive Plan, proposed amendments, ordinances, policies and regulations for the City, to protect the public health, safety and welfare of the community. This Ordinance shall apply to and govern all lands within the City for the purpose of protecting the planning process and the health, safety and welfare of the City for a period of one year from the date of adoption unless otherwise amended. Those infill properties located in the existing Metropolitan Urban Service Area (MUSA) ofless than two acres in size in which sketch plans have been reviewed by the City Council and those properties where preliminary plats have been approved by the City Council that provide for multi-family housing units shall be allowed to develop and shall be exempt frorn the moratorium provided the sketch plan was reviewed prior to April 18, 2000. Nor shall said Commission or Council review sketch plans or grant any preliminary plat approval to a subdivision of multi-family housing that exceeds a density of four units per acre. Section 5. DISCUSSION Precinct #3 has been split into two legislative districts, 49A and 49B. Kathy Tinglestad will now represent legislative district 49B, which also includes the City of Coon Rapids. The portion of Precinct #3 now in 49B has a population of 579. Staff does not know how many registered voters there are among the 579. Since Precinct #6, Bunker Hills Activity Center, has over 2300 registered voters my office plans to split the portion west of the railroad tracks and combine it with the portion of Precinct #3 in District 49A, creating Precinct #10. A polling location for this new precinct needs to be identified and that will be accomplished within the next two weeks. Attached is a map showing the split of Precinct #3. ACTION REOUIRED No action is required at this time. The new precinct boundaries will be brought to Council on April 16th for approval as our boundaries must be completed by April 30th. SUBJECT: Doug Falk, Planning and Zoning Commissioner DATE: March 27,2002 INTRODUCTION Mr. Falk has informed staff that he will be activated by the National Guard on April 23, 2002 as indicated in the attached letter. His period of service will be for a minimum of 90 days although no cap has been set on the term of service at this point. DISCUSSION Although the attached letter indicates Mr. Falk's resignation from the commission, I reminded him of the discussion we had during the Planning and Zoning Commission interview process. In this conversation, we had agreed that Mr. Falk could continue to serve on the coinmission as his schedule permits. The commission can operate with a vacancy without affecting their responsibilities. Mr. Falk would like to continue to serve on the commission. He is an experienced commissioner and has provided exemplary service to the city. Staff recommends that Mr. Falk be allowed to continue his term on the Planning and Zoning Commission. Ifhis period of service with the National Guard is extended beyond 90 days, this matter can be reviewed at that time. ACTION REOUIRED If Council concurs, no action is required. However, should Council members have concerns, this item can be placed on an agenda for further discussion.
