A Meeting of the Andover Economic Development Authority was called to order by Vice President
Trude, October 19, 2004, 6:00 p.m., at the Andover City Hall, 1685 Crosstown Boulevard NW,
Andover, Minnesota

ANDO VER STATION SOUTH PROPOSAL - RYAN COMPAMES
Community Development Director Neumeister stated the City staffhas worked with the
architectura1 staff at Ryan Companies to develop an architectura1 plan for the new 10,000 square
foot bulding for the space in front of the Target Store at the comer of Martin Street and Bunker
Lake B )ulevard.
Mr. Tom Palmquist with Ryan Companies made a presentation regarding the Andover Retail
Center.
Commi,sioner Trude wondered what types offood shops they could have for the small areas.
Ms. Melly Carson stated they could have sandwich shops and if they had seven thousand square
feet or !Oore they could have something like a Chinese Restaurant.
Mr. Nate Inger explained the layout of the building on the property and the elevation of the
buildin!:. Commissioner Trude stated she did not consider looking at the back of the building

while :!riving by. She wondered if they wanted to have people look at the garbage area Mr.
Palmquist explained the way they wanted traffic to move through the area
Mr. Inger noted trash was brought indoors and what they would see would be small doors.
Commissioner Jacobson wondered how they got by the problem of trucks delivering to the
building. Mr. Inger stated the coffee shops usually have normal hours and they could schedule
delive:ies around the drive thru hours,
Mr, Inger described the materials that will be used in the building,
Comnissioner Trude did not like the look of metal on the back of the building. Commissioner
Knight stated they usually face the front of the building out from the road. Ms. Molly Carson
stated they talked to some retailers and the retailers preferred to face Target because it would
help tl,eir sales,
Comnissioner Trude thought the way the building faced was dependent on the surrounding
activit}'. Mr. Neumeister stated there is a building like this in Blaine where the building faces
,~ inside with the back of the building facing Highway 65,
Mr. N?umeister stated Ryan Companies is mimicking the Target building with matching colors
and m lterials, Mr. Inger stated the logic of this building is trying to achieve what they did with
Target.
Presid?nt Gamache arrived at 6:15 p.m.
Ms. Carson stated they are looking at a variety of users for this site and are in serious
negoti'ltions with some national companies.
Co=issioner Jacobson understood the back service doors would be normal size, He wondered
if the rest of the panels would be fixed and why would they use panels throughout the back of the
building, Mr. Inger stated a lot of the tenants will have kitchens which they will put in the back
of the ")uilding and make it easier for a tenant to set up their store, He stated there is also a nice
clean bok with all of the different users throughout the years.
Co=issioner Trude wondered how the colors of this building would match up to Tanners. Mr.
Neumdster stated they would be similar and compliment each other.
Co=issioner Trude thought this building was more boxy than the surrounding buildings. Mr.
. '\ Inger explained the different articulations they are using on the building to make it a cleaner look.

Co=issioner Jacobson wondered what the ceiling height inside would be, Mr. Inger stated it
would be twelve feet high. Commissioner Jacobson wondered if they would be able to hide the
equipment on the roof from the road. Mr. Inger stated they have brought the parapet up three feet

from the roofto conceal the units.
Commissioner Knight asked if they considered putting the drive thru on the end. Ms. Carson
stated'vith a sixty foot depth building, they could not get stacking in and it would be too hard of
a turn 10 make,
Commissioner Trude stated she has a hard time seeing the back of the building facing the main
road. ~;he thought the marketing to the community was so important. Commissioner Orttel
stated if the building was placed another way, he did not know if it would work and fit on the
properly. He stated he would like to see some buildings that are set up like this.
Commlssioner Jacobson wondered if they could move the building ninety degrees,
Commlssioner Trude thought they could have two buildings instead of one, Mr. Palmquist stated
it woul:l not be economically feasible to do that.
Commcssioner Jacobson thought it would be helpful to move the building over and move the
curb Clt so the building can face the road because the back of the building facing the road does
not apleal to him.
Mr. Pa"mquist stated they could look at the south elevation again with different options.
Mr. Inf.er noted they could bring samples of the metal panels.
Comm'ssioner Knight wondered if there was any way of breaking the building elevation up. Mr.
Inger S1 ated they could bring back samples of different elevations.
Mr. Neumeister wondered if they brought this back to the Commission, would they consider
keeping the building this way because Ms. Carson may have a problem keeping the tenants she
has possibly locked in if they change the building to face the road, Ms. Carson stated many of
the terunts stated they wanted the building to face Target and they would not consider anything
else.
Commi ssioner Trude wondered if they could move the entrance over one way or another because
she thO'lght it was dangerous to have an entrance in the front of the buildings with people
backinf: up and people entering it. Ms. Carson explained the flow of traffic for the drive thru.
Ms, Ca'son stated they have had good interest with tenants.
The Co nmission asked Ryan Companies to look at staggering the entrance from the Target
entranc,: for safety concerns.

Co=:mity Development Director Neumeister explained the City staff have worked with the
engine,~ring consultant to establish a more realistic schedule for the development of Andover
Station North, Jay Street extension. Staff is of the opinion that this new schedule works well, as
the cor tractors typically don't start until frost is out of the ground, which is usually early April.
Mr. Neumeister noted another recent development is the design of a site plan from Bruggeman
for the proposed townhomes. This plan shows that they are not going to plat units over the lot
line, as their negotiations with Mr. Brad Povlitzki have not moved along to the point that they
can de"elop townhomes over onto the Povlitzki property. The design still leaves the opportunity
to develop some units on the Povlitzki property, however it will be slightly diminished.
Co=:ssioner Trude thought they need to hear back if things do not go through.
Co=:ssioner Jacobson stated with the new pond configuration, one of the buildings will be in
the pord, Mr, Neumeister stated they will need to change the configuration of the buildings to
allow for more parking space at the ball park. He stated the ponding has been accepted and
approv;:d by the watershed so they cannot change the configuration of the pon<k

J Co=:ssioner Orttel stated there should be access to the west for access to Povlitzki's property.
UPDA TE ON ANDOVER STATION SOUTH
Co=mity Development Director Neumeister stated City staff met with the people from Ryan
Constmction to go over the maintenance responsibilities for the area around the ponds and all the
sites at Andover Station South- Construction is coming along nicely and looks like it will be
possibl ~ that Walgreens could open sooner than Thanksgiving. Target is still on schedule to
open plior to Easter of2005,

INTRODUCTION
Brugg( man Properties have worked on preparing preliminary plat drawings for their proposed
townh(.me development at Andover Station North. The latest engineering drawings are attached.
The s11ff has been working on the purchase agreement with them, Based upon the latest
infonn Ition, Bruggeman Properties are no longer interested in completion of streets and utilities to
serve their first phase by August I, 2005, Instead they would prefer the summer of 2006 for
compktion of the first phase of Jay Street and begin constructing units in their first phase of their
housing development at Andover Station North by the fall of2006,
D1SCLSSION
The re, son for this is the market has been a little slow of late throughout the entire home building
industrj, For that reason, the developer has indicated that a slower approach is needed on when
the first phase should be completed at Andover Station North. The decision to move ahead on
preparilg a feasibility report for Jay Street is still the proper one, Deciding how much of Jay
Street t3 build in the first phase is the only question. Since we are planning to design a plan set
that albws for options, the City can defer the decision on how much Jay Street to build until
Janual) 2005, when the bid package is sent out for bid, By that time, we should know how many
other dl:velopers have committed to signing purchase agreements in Andover Station North,
The preparation of a preliminary plat by Bruggeman still shows that they are very much interested
in building in Andover Station North, It is likely that the purchase agreement will be amended to
reflect the new dates of completion for of sewer, water and streets to serve their proposed
townho nes,

INTRODUCTION
This past week staff have met with another local developer that is interested in looking at the
possibility of building an office showroom building in Andover Station North, The other
develoJers that we have been in contact with are still showing interest in being in the first
phase of the construction and that would enable the City to build at least the first phase of Jay
Street in the summer of2005.
DISClSSION
As Wlll explained in the previous report on the Bruggeman Property update, the ability to get
even tl:e first phase of Jay Street off the ground, we need developers that are willing to move
ahead ;md put together "letters of intent" followed by purchase agreements, Planning and
admini ;tration are still working with a select group of individuals to get their "letters of
intent" prepared, This will be an on-going process over the next three months, and as they
come ill, they will be forwarded to the EDA for consideration.

INTltODUCTION
The League of Minnesota Cities Insurance Trust (LMCIT) requests that participating cities and
spec' al authorities annually decide whether or not to waive the statuto!)' tort liability limits
estat lished by Minnesota Statutes 466,04.
DISCUSSION
Attached is the "LMCIT Liability Coverage - Waiver Form" provided by the LMCIT, which
prov"des a description of the options available to the City of Andover Economic Development
Authority (EDA), Currently the City of Andover EDA DOES NOT WAIVE the monetary
limit; on municipal tort liability established by Minnesota Statutes 466.04. As Executive
Director, I am recommending continuing with past practice,

The EDA is requested to not waive the monetary limits on tort liability established by Minnesota
Statutes 466.04.

LIABILITY COVERAGE - WAIVER FORM
Citie:; obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide
whet ler or not to waive the statutory tort liability limits to the extent of the coverage purchased, The
deci~ ion to waive or not to waive the statutory limits has the following effects:
If the city does not waive the statutory tolt limits, an individual claimant would be able to recover no
rT ore than $300,000,on any claim to which the statutory tort limits appiy, The total which all ciaimants
would be able to recover for a single occurrence to which the statutory tort limits apply would be
lirnited to $1,000,000, These statutory tort limits would apply regardless of whether or not the city
p Jrchases the optional excess liability coverage,
If the city waives the statutory tolt limits and does not purchase excess liability coverage, a single
c'aimant could potentially recover up to $1,000,000. on a single occurrence, The total which all
c'aimants would be able to recover for a single occurrence to which the statutory tort limits apply would
a so be limited to $1,000,000" regardless of the number of claimants.
If the city waives the statutory tolt limits and purchases excess liability coverage, a single claimant
c Juld potentially recover an amount up to the limit of the coverage purchased, The total which all
c aim ants would be able to recover for a single occurrence to which the statutory tort limits apply would
a so be limited to the amount of coverage purchased, regardless of the number of claimants,
Clairns to which the statutory municipal tort limits do not apply are not affected by this decision,
This decision must be made by the city council. Cities purchasing coverage must complete and
retu on this form to LMCIT before the effective date of the coverage. For further information, contact
