INTRODUCTION
Mr. Doug Fischer (Anoka County Engineer) requested a meeting with the Andover City Council,
Anoka County Commissioners, Anoka County Sheriff and City staff to discuss the need and options
for improvements to the intersection of Andover Boulevard NW and Hanson Boulevard NW (CSAH
78).
DISCUSSION
Staff has discussed possible improvements and funding options with Mr. Fischer and Anoka County
Commissioners to expedite needed improvements to the intersection of Andover Boulevard NW and
Hanson Boulevard NW. The basis for this meeting is to determine the most feasible solution to
alleviate traffic congestion and a time frame to get a project moving forward for construction in
2005.
ACTION REOUIRED
After the open discussion, the City Council is requested to direct staff on how to proceed with
intersection improvements to Andover Boulevard NW and Hanson Boulevard NW.

INTRODUCTION
The City Council is requested to discuss granting Ralph Schafer permission to fill part of a pond that has
been expanded into a road easement so that he can gain access to his property,
DISCUSSION
r ') Mr. Schafer and 4 property owners from the Caster Addition submitted a petition for road improvements on
'--./ 6/16/81. A feasibility report was completed by TKDA for the extension of Potawatomi St. north to 163"'
Ave. and the construction of 163'0 Ave. Ultimately, the project was not completed, as these 5 property
owners would be the only ones benefiting and the assessments would have been too high, Mr. Schafer
continued using the road easement to access his property.
At some point between 1989 and 1993 a wetland area near the road easement was dug out, expanding a pond
across the road easement. (See aerial photographs) This was done without the knowledge or approval of the
City,
Mr. Schafer is now requesting permission to re-fill the area that was dug out in the road easement so that he
can have access to his property, He would also need to remove some trees and brush along the 163'. Ave.
easement in order to get a vehicle to his property, Because this area may now be considered a mature
wetland area, any work that is done would have to be approved by the Lower Rum River Watershed District.
All guidelines for the filling of a wetland area would have to be met.
ACTION REOUIRED
The City Council is requested to decide whether or not to grant Mr. Schafer permission to re-fill the dug out
wetland area in the City's road easement to allow him access to his property. Staff recommends that Mr.
Schafer pay for any work that is done.

Date Unknown- Stenquist Addition is subdivided under a Registered Land Survey.
(7/21/81 CC minutes,) Mr. Stenquist started selling lots in 1960. (6/7/74 CC minutes.)
6/16/81- The City receives a petition signed by 5 property owners (Mr. Schafer and 4 in
the Castner Addition) requesting completion of road improvements on Potawatomi St.
and 163'd Ave, Petition met the requirements of containing at least 35% of the land area.
Also on this date, the City Council directs TKDA to generate a cost estimate for
preparing feasibility study for the project.
7/7/81- The City receives two petitions- one signed by 10 residents, the other signed by 8
residents (some duplicates)- opposing the street improvement project.
Also on this date, TKDA presents an estimate of $850 to prepare a feasibility study for
the project.
Also on this date, Robert Fodness told the Council that he was in discussions with Mr.
Schafer to purchase his property, (Mr. Fodness owned the property east of Mr. Schafer's)
The City Council tables the item until this question is cleared up,

7/21/04- Mr. Schafer states to.the City Council that he is not in the process of selling his
lot, and he, along with others, state that they are still in favor of the improvements,
Also on this date, the City Council authorized TKDA to do a cost feasibility study for the
extension ofPotawatomi St. and the construction of 163'd Ave., including alternatives
extending Potawatomi St. north through Castner Addition to County Road 7, and 163'd
east through Registered Land Survey No. 072 to Makah St. The City Council expresses
concern that the project could have very high assessments,
8/5/81- Feasibility reports on Street and Drainage Improvement project #81-4 are
submitted by TKDA. It states that the project is feasible, It also indicates that a large
amount of peat would need to be removed to construct Potawatomi St. north of 162nd,
The assessments range between $29,85-$41.90/FF with a total cost ofapprox. $108, 900.
8/18/04- A public hearing is held about the proposed improvement project. TKDA's
report is reviewed. Several property owners object to the cost of the project and raise
concerns about impacts onclrainage onto their property.
Also on this date, Mr. Fodness clarifies that he had been attempting to purchase Mr.
Schafer's lot, but that they could not agree on a price,

Also on this date, the City Attorney (Hawkins) states "just because the City has a road
easement, it doesn't mean it has an obligation to open up and improve the roadways
unless building is allowed back there,"

9/1/81- The City receives a petition from property owners fronting on 162nd Lane to
combine their front and back lots.
The public hearing is continued to the 9/15/81 meeting at the request of those petitioning
for the improvements,
9/15/81- The property owners petitioning for the improvements request a new feasibility
study be ordered for a scaled down version of the project, extending Potawatomi St. north
to 163 rd, and building 163 rd 250 fee~ to the west and 400 feet to the east, providing access
to the Castner Addition lots and Mr. Schafer's property, Mark Schumacher from TKDA
states that this would reduce the overall cost of the project, but that the peat removal
would keep the costs high. It is questioned whether the City can legally make
assessments this high, since they can only make assessments equal to the increased
benefit to the properties.
Also at this meeting, Attorney Hawkins states that "the creation of lots imposes no legal
obligation on the city to put the roads in and that the City has no legal obligation to
construct roads on all City right of ways unless building permits have been issued and
building is allowed. He also advised that another factor to consider is that it appears the
City might not be able to assess the entire costs of that project."

Also at this meeting, a motion is passed to terminate the discussion of extending
Potawatomi St. "for the reasons that Council is concerned about an extra exit in the area
and the proposed plans do not meet that; the Council is also concerned about the high
cost of the said project and the assessability of it; there is also the question of the
financial showing of benefits to the lots for any assessment; there is some question as to
whether that can be sustained; and also because the City has no legal obligation to build a
street on a public right of way."
Date Unknown- The City receives a petition from property owners in the Stenquist
Addition with lots fronting on both 162nd Lane and the proposed 163rd Ave to vacate the
easement on the south side of 163 rd.
9/22/81- A public hearing is held before the Planning Commission regarding the vacation
of easement. A petition is presented in opposition. The Planning Commission
unanimously recommends denial of the vacation of easement.
10/6/81- The City Council unanil!lously denies the request for the vacation of easement.

The feasibility report will include infrastructure improvements such as mass site grading, utility
construction, Jay Street NW construction, traffic signal and road improvements at Hanson
Boulevard NW & 139th Lane NW, trails and sidewalks. The report will identify benefiting
properties and establish an assessment value for each property identified.

The City Council got its first look at the proposed 2005-2009 Capital Improvement Plan at the August
31, 2004 workshop meeting, The proposed CIP was prepared by City Departments, after a number of
meetings discussing a number of projects and equipment purchases over the next five years,

DISCUSSION
The proposed 2005-2009 CIP has been prepared as a strategic planning tool to assist the City Council
in identifYing proposed capital improvement projects over the next five years, With the inclusion of
preliminary financing sources, appropriate background infonnation citing needs and projected cost
estimates, this document will provide Council with the needed infonnation to begin the process for
planning improvements that meet the City's infrastructure and equipment needs, The CIP serves as a
flexible guide plan to properly identify the critical components of the City's infrastructure &
equipment, yet maintain flexibility in detennining project timeframes, project scope and possible
funding sources. The 2005-2009 CIP continues the emphasis of judiciously managing the City's
limited resources by prudently planning for known and/or anticipated future capital expenditures.
. Each Councilmember is requested to bring their proposed 2005-2009 Capital Improvement Plan with
them to the workshop. Attached are documents provided by department heads to assist in answering
questions brought up by at the August 3151 workshop, Also at the direction of the Council a number of
residents have been invited to the workshop to discuss trail improvement priorities,

INTRODUCTION
This item is in regard to considering possible new trail construction for 2005 as part of the Capital
Improvement Plan.

DISCUSSION
As you recall, there are three neighborhood groups that have expressed interest in having trails constructed in
their general area to allow for safe routes for residents and youth to the schools and other facilities/businesses
that are available to the public. Attached are the petitions that have been received over the last few months
from individuals and neighborhoods and also a map showing the three trail locations that are requested
(indicated in red), The areas are as follows:
A. Hanson Boulevard NW from l55th Lane NW to 161" Avenue NW, Note: Out of all the trail request calls
that staff has received, this location has been the most requested. The residential area is designated as a
walker area for the middle and elementary students (not sure about high schools). If the Council recalls,
City staff spoke with a couple of the residents in the last month who were against having a trail
connecting the neighborhoods in Chesterton Commons development from Bluebird Street NW to Avocet
Street NW, So therefore, the only other option is to construct a trail along the east side of Hanson
Boulevard NW from l55th Lane NW to 159th Avenue NW (it is not necessary to construct a trail to 161"
Avenue NW), Keep in mind that there are DNR wetlands and other regulated wetlands under the
Wetland Conservation Act that need to be dealt with, The cost estimate for this section of trail is
$150,000.
R Crosstown Boulevard NW (East Side) from l39th Avenue NW to 141" Lane NW, Note: It appears based
on the location of the resident, the students from this area should be able to find their way through the
Red Oaks Manor and Kensington Estates developments to access the new trails that have been built or
near completion along the east side of Crosstown Boulevard NW. A trail between l40th Avenue NW and
141" Lane NW would be somewhat helpful to the area residents on the western side of Red Oaks Manor
development so the students don't have to backtrack through Kensington Estates developmenL The cost
estimate for this section of trail is $30,000,

C. l57th Avenue NW between Prairie Road NW and Kumquat Street NW, Note: Although constructing this
section may be somewhat safer for residents and students, the students still would need to walk along a
section of Crosstown Boulevard NW west of Prairie Road NW where a trail section has not been
constructed, This segment is located just east of Yellow Pine Street NW on the north side of Crosstown
Boulevard NW. The cost estimate for this section of trail is $230,000 (this estimate does not include a
separate railroad crossing for the trail),

Also, there are other areas the City Council may want to consider, which may be of higher
priority. These locations are indicated in green on the map.
D, Complete Station Parkway NW Between Thrush Street NW and Jay Street NW to allow the new residents
in The Village at Andover Station to access a controlled intersection to allow a safe crossing to the local
businesses, theater, Festival Foods, Target, etc, Estimate to complete is $60,000,
E. Complete the trail from the Silver Meadows development to 166th Avenue NW to allow students a safe
access to the Rwn River Elementary School. A portion of the trail was constructed a couple years ago
with the Silver Meadows development, but never completed through Lunds North Park to I 66th Avenue
NW. Estimate to complete is $20,000.
F, Crosstown Boulevard NW (North Side) from Nightingale Street NW to Hanson Boulevard NW, This
section would allow a safe route to the high school, middle school and elementary school without having
to cross Crosstown Boulevard NW at I 49th Avenue NW (which is currently designated a trail crossing).
Estimate to complete is $100,000,

G, Crosstown Boulevard NW (West Side) from South Coon Creek Drive NW to Andover Boulevard NW,
This allows residents on the west side of Crosstown Boulevard NW a safe route, without crossing
Crosstown Boulevard NW, Traffic volwnes have increased significantly since new development has
occurred in Woodland Estates and construction of the new school creating limited safe crossing locations
on Crosstown Boulevard NW. Estimate to complete is $75,000,
H. Bunker Lake Boulevard from Hanson Boulevard NW to Crane Street NW, This trail will allow residents
easier and safer access to the Bunker Lake Boulevard regional trail that exists west of Hanson Boulevard
NW, Bunker Lake Boulevard trail provides all kinds of accesses to businesses, schools and churches,
Estimate to complete is $30,000.
Note: It appears at this point that this section of trail will be constructed with the Hanson Boulevard
reconstruction project schedule in 2006,
BUDGET
The Trail Fund balance as of August 31st is $129,491.00, Staff is anticipating that at least another $25,000
will be added to the Trail Fund by the end of the year, due to new plats that will be filed with Anoka County
by the end of the year, This balance already takes into account projects that have been recently completed or
will be completed this year.
ACTION REOUIRED
The City Council is requested to consider trail priorities for 2005.

We are very concerned parents of Middle School Children, Since our children are
now walkers, and it looks like they will be for a long time to come, we want to be
confident that they will arrive to school safely, We have some concerns about the lack of
a sidewalk/walking path from l55th Ave to 161'1 Ave on Hanson Blvd. We understand
that that area is deemed a Wet Land; therefore you are not able to build on it Are both
sides' Wet Lands? It looks like the West side isn't totally Wet Land. Could you possibly
build on that side? Is there any way around the Wet Land Ordinance since it is a safety
concern for children to be walking on the street in that area? Please let us know what you
find out
Another question we have is about the trail that could be put in on Drake St to
connect our development with the trail system already in existence, We heard that there
is already part of a trail there for the sewer lines that are back there. All that would have
to happen is to pave a small section and we would be connected to the current trail. Why
can't it be done? Why should a few residents be able to say No? Aren't there easements
around each house? lfthere is no other way for our children to safely get to school, why
can't the city just inform those residents that the trail is a necessary safety measure and it
will be put in to keep the children safe? Also, we would like to safely take our children
up to the new businesses. Without a trail in place, it isn't safe for us to do so. Please let
us know what we can do to expedite the trail system being implemented,

Thank you in advance for your consideration of my request. In December 2003, my family and I chose to live in
Andover. We have finally settled in and are impressed by the open communication efforts the City of Andover
provides to residents regularly, We are also grateful for the increase in services and products soon to be available to
residents and to visitors of Andover.
The immense athletic activity we've observed and briefly participate in, within the community, shows just how

<J healthy a community Andover is. My family and are regular bike riders, runners and walkers, Since the traffic does
travel fast and heavy in some spots around Andover, we wondered if in the next planning opportunity to upgrade
the roadways, if there might be consideration to create safe pathways for those of us like to move around the city in
other ways than in a motorized vehicle.
Before Andover, we lived in New Hope and they did have many sidewalks and tree bark pathways, including stand-
alone trash tans and animal waste holders at various places located on the trail.. . signs indicating the bike path and
the walkers path.
We're slowly meeting our neighbors and other new residents (via yard sales and in passing on walks/rides, etc.), and
the consensus is the same. Some vehicles are not careful and it can be dangerous, so please consider our requesrior
different roadways that connect throughout Andover and maybe even an overpass for children who like to go the
Andover Cinema.
I realize there is protocol for this type of request, and what we're requesting asks residents to either increase
property tax or for the City of Andover to find grant money and more creative budgeting, but beautiful Andover is
growing and we hope to have more safe pathways so that we can continue growing a healthy community.

Dear Mr. Berkowitz,
I'm writing to you because of a matter that concerns me and my family.
Recently, I received the application for bus service for my 10th grader, $175, which I was
expecting, but something occurred to me, even last year although I didn't act on il-
It's a matter regarding sidewalks, I feel it somewhat unfair that I really don't have much
of an option but to bus my child due to safety concerns. We live in the Red Oaks West
development off 139th and County 18, I have no choice but to send my son on the less
than 2 miles to school bus ride without the option of him being able to safely walk there,
I spoke with Jane Rose at the Anoka County highway division, and she informed me that
you were the person to contact regarding this issue.
Are or will there be any plans for a complete sidewalk or walking trail on that end of the
school? I have another younger child who will be in school in a couple years as well,
Jane Rose informed me there is no money to reconstruct county 18 right now to install
sidewalks on their end.
I would really appreciate this issue be addressed as I'm sure I'm not the only concerned
parenl- Please get back to me on this as well and let me know of any potential plans.

Subject: Fire Department 2005 to 2009 C.LP.
During the August 21, C,LP. a couple of items were discussed regarding the fire department Capital
Improvement Plan and I would like to review the needs for both of them,
The first was the cost for the proposed auxiliary structure to house an existing power generator at fire station # I.
The proposed cost was to build a structure about the size of a one car garage and finish it with similar block as
currently used on the exterior of fire station # 1, The generator is a high priority item for us to be able to use in
the event of a power outage. It should be noted that the fire station is designated in our city emergency plan as
an emergency operations center in the event of a disaster and needs to have a reliable source of power at all
times. Staff is evaluating options to using the mobile generator currently parked in the apparatus bay at station
# I, We do have two firefighters who are electricians reviewing the total electrical needs for the station. The idea
,_ ,\of purchasing a permanent generator enclosed in its own weather resistant structure may be less expensive than
'-J"ve originally thought and will be a better solution, Two years ago we did re-wire the fire station so that the
entire facility can operate on emergency power in the event of normal power outages. Also note that the fire
department command post will also be established at station #1 for any type ofIong term incident or event. The
questions raised at the work session appeared to be related to the proposed structure and not to the need for the
emergency generator. Permanent generators with the appropriate power ratings, enclosed in its own structure
may be done at a lower cost and provide the best alternative to the auxiliary power supply concerns.
The second item was the need for a rescue boat to conduct water and ice rescues, In order for the fire
department to safely conduct a rescue on any body of water in Andover, including the Rum River, the fire
department should have the appropriate equipment to perform the activity. While the Sheriff's office does have
a boat, the responses to an event in Andover will take up to an hour to get to the scene. The Sheriff's boat has
been traditionally used for recovery work because the delayed time to respond does not allow for rescue work to
be accomplished. Having a boat in the station and ready for an immediate response will allow us to quickly get
to the scene of any ice or water rescue. Our firefighters train regularly on how to appropriately conduct this
specialized type of rescue but need the boat to perform the required tasks safely,
The fire department management staff and all firefighters greatly appreciate the Mayor and City Council
members support on these two very important items.

Sewer Rate Study

INTRODUCTION
Recently, an analysis was conducted by TKDA to develop alternative sanitary sewer trunk extensions to meet
the projected development demands east of Hanson Blvd. These upgrades include improvements to the
existing sanitary sewer system, The results were used to determine an equitable sewer rate structure that
would provide adequate funding for sewer expansion projects and operation & maintenance costs.
DISCUSSION
The City currently divides its sewer revenues into two separate funds: the Sanitary Sewer Fund (Sewer Fund)
and the Sanitary Sewer Trunk Fund (Trunk Fund).
The Sewer Fund is used to cover annual operations and maintenance costs of the sewer system, The revenues
for this fund are generated from quarterly sewer use charges,
The Trunk Fund is used to finance sewer system expansion projects and cover debt service payments for past
projects, The revenues are generated through the sewer area charges that are based on connecting properties'
acreage and connection fees, These are both one-time fees. Currently, the sewer system has no outstanding
debt.
The attached spreadsheet shows the 2003 Actual, 2004 Estimates and a forecast for years 2005 - 2014 using
the inflationary factors listed at the top portion of the page.
Again, this analysis only includes areas east of Hanson Blvd, it does not include the Rural Reserve area.
ACTION REOUIRED
The Council is requested to review the proposed Sewer System Financial Projections, receive a presentation
and provide direction to staff to appropriately set the sewer system rates for 2005.

INTRODUCTION
The City staff has met with over 90 property owners at three neighborhood meetings over the past two
months and have informed them of the new sewer plan and the potential changes to the sewer staging
plan, It was explained how the proposed changes might affect the timing of new growth and
development in their neighborhoods.
DISCUSSION
" Proposed changes to the Sewer Staging Plan are considered amendments to the Comprehensive Plan
j and will require a public hearing, and approval by the Metropolitan CounciL These changes are
needed as a result of the sewer plan that was recently adopted, Adoption of a new Sewer Staging Plan
is the next step to implementing the plans for future growth and development.
ACTION REOUESTED
The Council is requested to: L) Review the proposed Sewer Staging Plan modifications; and 2,)
Authorize the Public Hearing to be scheduled for the October 26, 2004 Planning Commission meeting,

INTRODUCTION
For a few months now, the City has been working with Metropolitan Council staff on the
Comprehensive Plan request from Larry Emmerich and his neighbors to get a favorable
recommendation, The attached report shows that the Metropolitan Council is working towards such a
recommendation, however it is going to be conditioned upon achieving a density of at least three (3)
units per acre over 28.33 acres of buildable area. The original request was to amend the
Comprehensive Plan to allow a portion of the Rural Reserve area, north of 161s' Avenue, to be
developed at urban density prior to the year 2030, About a year ago, the Pentagon Holdings group had
requested a similar amendment and it was approved by Metropolitan Council. That request did not
have a minimum density requirement placed on it.
DISCUSSION
The City staff have discussed this issue and have determined that to achieve the minimum density of
three units per acre, there will need to be a Planned Unit Development planned for the property similar
to "Miller's Woods", Staff feels that the requirement can be met using a Planned Unit Development
approach. The question for the Council is whether there will be any objection to achieving the 3 units
per acre net density, In determining the density wetland and floodplain areas are allowed to be
deducted. It may be difficult to achieve the 3 units net density with only conventional single family
development and may necessitate the planning of some of the area being detached townhomes or some
similar type oftownhome development.
ACTION REQUESTED
Council is requested to discuss the issue and advise staff regarding the three unit per acre minimum
density requirement for Comprehensive Plan Amendment involving the Emmerich property.

REQUEST SUMMARY
The City of Andover proposes a comprehensive plan amendment (CPA) to change the land use
designation of six parcels totaling 63 acres located east of Hanson Blvd and north of 1615' Avenue
NW, (see Figure 2), Of the 63 acres, 28,33 acres would change from Rural Reserve to Urban
Residential to accommodate 85 residential units at a density of 3 units per acre, '
These 85 units will use all remaining sewer connections allowed in this portion of the City's local
sewer system, and at the downstream lift station,
The remaining 34,67 acres would change from Rural Reserve to Rural Residential.
PROPOSED ACTION
Staff recommends that the Community Development Committee (COC) recommend that the
Metropolitan Council:
1. Allow the City of Andover to put the amendment into effect with no plan modification
required,
2, Request the City of Andover to participate in the Council's plat monitoring program,
3, Require that the CDC discuss the request to develop land within the Rural Reserve,
I ISSUES
The Council reviewed the City's 2020 Comprehensive Plan Update on December 12, 2001 (see
attached recommendations), The Council allowed the city to put the plan into effect, with a
number of conditions that included submitting a plan amendment within 18 months that
designated at least 1,000 acres as rural reserve, or land available for urban development after
2020, The Council also required the city to prohibit subdivision of more than one unit per 40
acres, and lot splits under 20 acres within the rural reserve,
In April 2003 the City submitted a plan amendment designating a "Rural Reserve" area of
approximately 1,100 gross acres and 964 buildable acres, The City included a resolution to
restrict lot splits of less than 20 acres, and to restrict subdivision of rural land to no less than one
per 40 acres within the Rural Reserve, The Council accepted this amendment In May 2003.
The City's "Rural Reserve" has two parts: the larger is located to the west and is 859 (buildable)
acres in size, the smaller is located east of Hanson Blvd and is approx, 88 acres in size (see
figure 1A),
The eastern 88 acres was the equivalent to the number of sewer connections remaining in that
part of the city's sewer system, A 2003 plan amendment committed 100 connections, and the
proposed amendment will use this remaining 85 connections,
The City has over 1,000 gross acres in the western Rural Reserve area, The City's information
summarizing residential development from 2000 to the present shows that the average
residential density community-wide is 3,39 units per acre, meeting the Council's recommended
density of 3 units per acre within the MUSA,
The City has provided the Council staff housing information describing housing type, density
and mix, and demonstrates how the City is meeting its Housing policies for the 2000 to 2010
period,
FINDINGS AND CONCLUSIONS
Conformance The amendment conforms to Regional System Policy Plans for Aviation,
with Regional Recreation Open Space, Transportation, and Wastewater Services, having no
Systems substantial impact on or departure from, these systems plans. In January 2004
the City prepared and submitted its Tier 1 and 2 Comprehensive Sewer Plan,
Consistency The amendment is consistent the Council's 2030 Regional Development
with Council Framework, Council forecasts and water resources management, and Housing
Policy policy,
Compatibility The amendment is compatible with the plans of adjacent communities,
