The regular monthly meeting of the Grow Township
Zoning and Planning Commission was held November 30, 1971
at Crooked Lake school. Chairman Norm Stout called the
meeting to order at $:07 PM with Commission members
Christenson, Holasek, Jones, Nash and Rither present.
E. M. Burkhardt, 921 Rae Drive, Richfield, Minn-
esota and attorney John Labenski appeared before the Com-
mission and presented a petition requesting a variance
committment in writing to the property owners for the con-
struction of a permanent type residence on [parcel #6760,
S t of Section 6J in Grow Township. That the committment
be allowed to pass to his successor in interest. That the
present cabin located thereon be continued to be used in the
manner it has been used as a summer cottage. That in the
eventuality of the construction of a new residence the owners
be allowed to use the cabin as a temporary cottage until such
time as the new building is completed. Thereafter, the cabin
be continued to be used as an accessory building to the main
building. Burkhardt presented a letter from Richard J.
Astrup, Anoka County Health Department which stated that
the Department had inspected the sewage system on September
24, 1971 and found that the [sewage systemJ "appears to be
located in accordance with the recommended standards of the
Minnesota Department of Health." Commission noted that
subject building and septic system is located on the Rum
River flood plain, is subject to flooding and therefore
questioned the accuracy of the Anoka County Comprehensive
Health Department inspection. Burkhardt stated that the
septic system of the abutting property owner is also located
within the flood plain. Nash asked if Burkhardt had read the
Township Ordinance #$, particularly section 5.04, Variances.
Burkhardt stated that they were not aware of the Ordinance.
Labenski stated that the building inspector ordered the septic
system removed. In response to questioning by Nash, Burkardt
stated that Appleby had asked him to cut off the system.

After extended discussion, it was brought out that the
petitioner desires to sell subject property and wanted a
written committment from the Township stating that the buyer
could live in the cottage until such time as a new dwelling
or septic system is constructed higher up on the lot. Holasek
stated that the Commission could not make the committment; the
Commission or conditions could change; it should be handled
when the application for a building permit is made; we cannot
give this assurance to someone we do not know. Christenson
stated that the Ordinance sets forth the requirements and will
provide the assurance needed. Burkhardt was given a copy of
Ordinance #$.
Filiatrault variance application was discussed.
Stout reported that the Township attorney said that the
variance is O.K., that there are only three lots involved.
Christenson disagreed stating that today it is only three lots
while tomorrow it may be three thousand; we cannot create three
substandard lots when there is another alternative, namely;
rezoning. Commission agreed that subdivision of lots should
not be affected by use of the variance section but should be
handled under the rezoning section. It was moved by Jones
and seconded by Nash to recommend to the Town Board the
disapproval of the Filiatrault variance application. Motion
carried unanimously.
Commission approved the proposal by Nash that the
Commission send out a postcard notification of agenda items
prior to each regular monthly meeting and that items not on
the agenda not be taken up by the Commission.
Commission corrected the October 26, 1971 minutes.
Stout presented Norton Byrd preliminary plat. Subject
plat was approved by the Commission on October 26, 1971 and
disapproved by the Township Board of Supervisors. Stout
stated that Appleby asked the Commission to make any changes
on the plat. Holasek stated that it is not the business of
the Commission to design plats. Discussion was held regarding
the revised road easement and cul-de-sac on County Road #60.

Nash stated that the proposed road with an additional
cul-de-sac means that the Township would be grading and
plowing what amounts to a private driveway as it serves
only one lot. Christenson stated that the size of the parcel
and the number of lots proposed result in a poor plat and
that the problem is that you cannot put ten pounds of anything
in a five pound bag. No action taken.
It was moved by Jones and seconded by Holasek to
adjourn. Motion carried. Meeting adjourned at 10:05 PM.

LOUIS J. FILIATRAULT - VARIANCE APPLICATION
Gentlemen:
In accordance with Ordinance No. $, paragraph
5.04, Variances and Appeals, the Commission herewith
submits a report regarding the aforementioned variance
application.
1. The applicant, Mr. Louis J. Filiatrault, appeared before
the Commission on October 26, 1971 stating that the
variance seeks to create three parcels as described within
the application.
2. Commission notes that only proposed Tract C qualifies
under paragraph 5.04 in that it is boxed in by Eidelweiss
Street,' Crooked Lake school property and County Road 116
whereas proposed Tracts A and B do not.
3. Commission notes that granting the variance would
create three substandard lots within the R-I Zoning
District.
4. It is the opinion of the Commission that subdivision
of lots should fall under the jurisdiction of the rezoning
section of Ordinance No.8.
5. Commission recommends that the Township Board of Super-
visors disapprove the variance application of Louis J.
Filiatrault.
6. Discussion regarding subject variance application was
held on October 26, 1971 and November 30, 1971.
