HomeMy WebLinkAboutNovember 16, 1971 A special meeting of the Grow Township Zoning and Planning Commission was held November 16, 1971 at Crooked Lake school. Chair- man Norm Stout called the meeting to order at $:11 PM with Commission members Christenson, Holasek, Langseth, Nash and Rither present. Grow Township engineering consultant David E. Hansing, P.E., of TRI-STATE Engineering, Inc., and Norm Hoium, representing EV Builders also present. Hansing presented a letter dated November 15, 1971 which reviewed the plat data for Beaudry's 3rd Addition. Hansing discussed the road easement for 173rd Avenue NW noting that the center line was not located on the section line. Hoium stated that according to county records the center line of the road easement is not located on the section line. Hansing discussed the marsh area stating that planning for long range sewer extension would require that an easement be granted along either the westerly or northerly perimeter of the marsh; that it would not be advisable to extend the sewer main across the marsh; that it would be advisable to require an easement along the north line of the park and along the east line of Block 2. Hoium stated that the easements presented no problems. Hansing discussed drainage on Block 1, Lot 5 and trapped water and drainage in basin in Block 3, Lots 1 and 2. Borings were discussed. In response to questioning by Nash, Hoium stated that only three borings as shown on the plat were taken. Hansing stated that percolation tests should be required on Block '1, Lot 7 and on Block 2, Lot 3; that developer has not indicated how pocket on Block 2, Lot 1 will be handled. Hoium stated that a representative of his office was at the site and had observed water draining north across 173rd Avenue in the area of Block 2 Lot 1. Hansing noted that he had observed the same. Hansing reviewed contents of letter. Hansingsuggested that the Commission have a planner look at the plat; that the butt lots in Block 2 are not consistent with the rest of the subdivision and suggested that Lots 1 and 2 in Block 2 be turned to face the other direction. Hoium stated that client does not feel he wants to make any changes; the county is satisfied; fill from service road to Lot 1 Block 2; Lots 1 and 2 Block 3 can be filled; 171st Avenue should be shaped up; easements for sewer can be granted and that should be it. Christenson noted that nothing was mentioned about the drainage problems. Nash noted that to fill -2- NOVEMBER 16, 1971 Lot 1 Block 2 creates a problem with drainage on 173rd Avenue. Hansing stated that there is going to be a problem if it is filled or not; that the water must go to the marsh; that the Township has a problem on 173rd now but not near as much as it will be. Hoium stated that the problem can be solved; that the drainage can be diverted to the marsh. Hansing noted serious silting and erosion at the corner of 171st Lane and Town Road. In response to questioning by Nash, Hoium stated that to his knowledge no stabilization of the roads was planned; that he knew how much had been put into the roads and that it wasn't very much. Christenson stated that at a previous meeting it was stated that the roads were expensive; how can we ask you to agree to these things if you are not the owner's agent? Hoium stated that he could not agree to these things because he did not own the property. Christenson stated that the owner should be present to represent his case. Hansing stated that we have reviewed his recommendations and that the Commission should now formulate the suggested revisions to be made on the plat; that the Commission should review the report and compile a list of changes which Hoium can take back to the developer. Chairman Stout stated that the Commission should at this' time take up the Soley variance application. Rither read the minutes of the July 27 and September 2$, 1971 Commission meetings at which time the Soley variance was discussed. Richard Wandersee appeared before the Commission. Wandersee stated that his property abuts the Soley property; that if the Township has an ordinance which requires a minimum size lot and if the variance would create a substandard lot, a lot smaller than is required, he would ask that the ordinance be followed and thereby request that the variance not be granted. Stout stated that according to the Township attorney, Tract B is not a lot of record, that it is recorded as parcel number 6750, which is made up of both Tract A and B. It was moved by Nash and seconded by Christenson that whereas the variance does not have any application under the Ordinance No. $, paragraph 5.04, the request for variance should be denied. Motion carried. It was noted that although the special meeting was called to consider the Soley variance, Soley did not appear. Chairman stated that we should again take up the Beaudry 3rd Addition plat discussion. Holasek stated that we should get -3- M0VEMBER 16, 1971 rid of the two butt lots and go to the park from there. Christenson suggested that Lots 1 and 2 in Block 2 be turned around; that the 75 feet left over should be added to the park - a rectangle 75 feet wide and 370.57 feet deep. Commission completed review of engineering recommendations. Hansing stated that the Commission could recommend approval subject to the following restrictions, improvements as contained in the suggested list of revisions, [1] That the developer satisfy all requirements set forth in Engineers letter dated November 15, 1971. [2J That the developer change the lotting arrangement of Block 2 to provide four lots, 165 feet wide, facing onto Town Road. [3] That the developer agrees to: (a) Submit a drainage plan for the subdivision. (b) Submit typical roadway sections for the proposed streets. (c) Construct all roadways and drainage facilities in accordance with (a) and (b) above with the understanding that no building permits shall be issued unless and until these facilities are approved and accepted by the Town Engineer. (d) Set aside utility easements, at least 20 feet wide, along the edge of the existing swamp with the understanding that no permanent buildings may be constructed on said easements. (e) Perform sufficient site grading to eliminate trapped water areas and to provide for a rectangular play area of at least 75 feet wide and 325 feet deep at the south end of Block 2. said area to be filled to elevation 876 and graded for positive drainage to the swamp. Said area also to be seeded. Hansing suggested-and'the Commission agreed that the roads should be constructed of three inches of class five stabilizer, road mixed with a lip curb on side and no ditch with the boulevard graded one quarter inch per foot minimum towards the street. After discussion, it was moved by Christenson and seconded by Rither to table action on the preliminary plat for Beaudry's 3rd Addition until November 18, 1971. Motion carried.
