A meeting of the Grow Township Zoning and Planning
Co~mission was held June 15, 1971 at Crooked Lake school.
Chairman Norm Stout called the meeting to order at 8:05 PM
with Commission members Holasek, Jones, and Rither present.
Glenn Barrett, representing Noon Realty, appeared
before the Commission regarding a variance application on
lot "T" Hughes addition. Subject lot is in the R-I Zoning
District and is one of six lots adjacent to the R-3 Zoning
District. Variances have been granted on lots "S" and "V"
in subject area. It was moved by Jones and seconded by
Holasek to recommend to the Town Board that the variance
application of Noon Realty for lot "T", the west 200 feet
of the east 400 feet of south 233 feet of the north 932 feet
of the Wnt of the ~\1t, Section 16, Town 32 Range 24, Anoka
County Minnesota, Subject to an easement for roadway purposes
over the northerly 33 feet thereof, for a single family
dwelling be approved. Motion carried.
Bob Tix appeared before the Commission seeking
approval to place a modular home in the Nordeen addition,
located off l57th Avenue m1. Tix stated that the lot is
some 3 and 3/4 acres; there is a trailer house located there
with an existing well and cesspool. Tix stated that they plan
to use the existing well and cesspool and are unable to say
what date it was installed. Rither stated that the question
here is that Tix wants to move a modular home into an R-3
Zoning District in which case the Ordinance is very clear
as to what is allowed and where.
Board of Supervisors Chairman Louis Appleby
announced that James Nash had been approved as a member of
the Zoning and Planning Com~ission to fill the vacancy of
Lyle Bradley who was appointed Supervisor to fill the term
of LeRoy Winner who had resigned from the Town Board.
Appleby stated that Nash should sit in on the Board starting
now.
Discussion was held regarding which model of modular
home was to be moved into the Township. Jones and Stout
reported that they had inspected a modular home at Kjellbergs
in Anoka which reportedly was the one Tix wanted to move in.
Tix, however, stated that Kjellbergs did not have the model
he was interested in, that all he had was the literature on
the home. Rither stated that this is a matter for the Building
Inspector, that the Inspector will have to inspect the home
to determine if the home meets the Township building code. Nash
stated that if the home is manufactured out of state there will
be problems with the State electrical inspector and cited an
example in Ham Lake tovmship. Langseth stated that we already
have an example located on Constance Blvd. Wn, the Barkaloo
house. Tix stated that the home is manufactured in Dallas,
Texas. Discussion centered on materials and construction features,
noting that Langseth will have to inspect the modular home.
Jones reviewed the construction features of the home as listed
in the brochure and compared them to the Township building code.
Jones noted six provisions of the Township building code which
\1ere not met in the modular home and said that the building
inspector should be so advised. Stout stated that this does not
meet the building code, consequently it may not be approved.

Holasek read from Zoning Regulations Ordinance, Section 7,
Permitted Uses, R-5 Manufactured Housing District: "Mobile
homes and modular homes provided they are developed under a
"planned unit development" and the complex is a minimum of
20 acres or 50 dwelling units in size." Holasek noted further
that it does not meet the building code and even if it does it
must come into the Township under planned unit development.
Stout informed Tix that under the terms of the building code
and the Ordinance, the proposal to move the modular home into
the TO~TIship would not be allowed.
\1illiam McPherson and Eldon Hall appeared before the
Corr~ission regarding a variance application on lot size. Subject
lot "F" as described in the application is located in the R-l
Zoning District. McPherson noted that there are two possible
courses of action, namely, grant the variance or allow a
rezoning in that the lots meet the requirements of the R-3
Zoning District. Holasek stated that it was not a good idea
to rezone individual lots. McPherson stated that they would not
have to put septic tanks in backfill. Stout stated that that
would not be allowed anyway. Corrmission and petitioner discussed
the location of wells and cesspools. It was noted that adjacent
wells are 135 feet to 140 feet deep. McPherson stated that it
was his understanding that our concern was the contamination of
wells. Holasek stated that we were also concerned about the
contamination of the lake. Hall stated that the well and
cesspool on lot "F" would be about seventy-five feet apart.
McPherson asked the Corrmission if you can reasonably assume that
you will have a well and cesspool that will not present problems.
McPherson stated that the character of the neighborhood has been
established and that the characteristics of the land indicate that
a variance is appropriate. McPherson noted that adjacent land
is small lots, "A" is built; "B" is built; "C" not built; "D"
is built; "E" not built; and "F" is the lot covered in the
variance application. Requirements of the Zoning Ordinance were
discussed, notably the provisions of the R-3 Zoning District
which requires 20,000 square feet and 40,000 square feet without
sewer and water. It was noted that lot "F" contains approximately
20,000 square feet. Petitioner noted that the well on lot "A"
was 145' deep; lot "B" 140' deep; and lot "D" 135 feet deep. Nash
stated that we are talking about three variances; if one on lot
"F" is granted they will be in for a variance on lots "C" and
"E" at a later date. Commission noted the Minnesota State
Regulations, Rules and Regulations of the Department of Conser-
vation, Relating to Statewide Standards and Criteria for Manage-
ment of Shoreland Areas of ~linnesota, 1970 Edition. Rither
suggested the Co~~ission conduct a walk through of the area noting
that it would be easier to judge from a first hand inspection of
the lot rather than looking at and relying on a plat drawing.
Jones disagreed, stating that it was irrelevant; that we all know
where the lot is and are familiar with the area. McPherson
stated that if there is a delay the buyer has stated that he would
be forced to look elsewhere. McPherson presented photographs of
a house in the immediate area. Subject photos depicted both
interior and exterior views of the home constructed by Hall on
lot "D". A photo taken from the interior of lot "F" with n portion
of Round Lake Blvd. visible was also presented. Finally, house
plans of the proposed building to be erected on lot "F" were
presented for Commission reviewal. It was noted that a home has
been built on a lot adjacent to lot "F". Jones asked if we

be possible in that the variance only involves one lot.
Commission noted that subject lot is a lot of record. Jones
stated that we should grant variance on lot "F" and ask that
the two remaining lots be held off. It was moved by Jones to
recommend to the Town Board that the Town Board approve the
variance application of Eldon Hall on lot "F" as described in
the variance application with the provision that the cesspool
be located in the front yard and the well be located in the
rearyard. No second. Motion died. McPherson indicated that
he would like a recommendation that he could take to the Board
in order to minimize delay. Rither stated that according to the
Ordinance the Commission is required to submit a report to the
Town Board, which shall be done at the next regular meeting of
the Town Board to be held July 13, 1971. McPherson stated that
it was his understanding that the Commission would recommend
approval. Holasek stated that he did not voice his approval
and that as far as he knew the Commission did not recomhend
approval, that the motion to approve the variance did not
receive a second. Stout informed McPherson and Hall that a
report of findings would be sent to the Town Board of
Supervisors.
Leroy Winner appeared before the Com~ission regarding
28 lots in the S~ of swt of Section 8. Subject lots were noted
in the research done on the proposed amendment to the Zoning
Regulations Ordinance. Stout informed \linner that if the Amend-
ment if approved by the Town Board the lots will be buildable.
Winner stated that he would rather see large lots; one lot sold
in that area was ten acres, one was five acres, and another was
one and one-half acres. Winner stated that the area was zoned
for 2! acres lots and that was adequate. Stout stated that the
Com~ission was opposed to the Amendment and that \linner should
talk to the Board of Supervisors regarding the matter.
Tom Timmisch appeared before the Co~mission. Ti~misch
inquired as to the lot sizes required in the Tovmship stating
that he owned land on the east side of Round Lake. Stout informed
Timmisch that in his area the minimum lot size is 2t acres.
Tiwmisch demonstrated hO\1 he could back-fill and reclaim land
to subvert the ordinance. Holasek read Zoning Regulations
Ordinance paragraph 4.23, Land Reclamation. Stout noted
State Conservation Regulations regarding lake shore development.
Timmisch stated that he had obtained a copy of the regulations
Stout referred to. Stout invited Tim~isch to attend the June 29
meeting of the Zoning and Planning Com~ission at which time the
County Sanitarian will be present.
It was moved by Rither and seconded by Holasek to
adjourn. Motion carried. Meeting was adjourned at 9:45 PM.
