Chair- man Norm Stout called the meeting to order at 7:45 PM with Commission members Bradley, Christenson, Holasek, Jones, Langseth, and Rither present. Robert Johnson appeared before the Co~~ission. Johnson stated that he had purchased a lot located on the south side of 165th Ave. NVl between 7th Ave. and Valley Drive. Johnson stated that Langseth told him in June of 1970 that the lot size was OK and had signed a purchase agreement at that time. Johnson presented a drawing of subject lot noting that the lot was 104 feet wide by 419 feet deep. Subject location is in the R-I Zoning District. Stout stated that it would require a variance in that a deed or contract for deed had not been recorded. Johnson stated that the seller is involved in probate and that the abstract is currently being brought up to date. Stout read letter to audience regarding cigarette burns on floor tiles caused by smokers snuffing out cigarettes. Stout announced that there would be no smoking. The letter was signed by Wally Johnson, Principal of Crooked Lake school. Attorney stated that the Ordinance only speaks of deed or contract for deed and that a purchase agreement is not recordable. Johnson stated that the problem is that the land is in probate and that recording another deed would present more problems. Discussion was held regarding 2t acres. A representative of Smith realty asked if they could get a description of a ?t acre plot, ask for a building permit, fulfill the requirements and then sell back to the origina~ owner that portion of the lot not required. Attorney stated that it would not be proper to do so. Stout noted that if the lot was 2t acres a building permit must be issued. Johnson stated that they would see about increasing the size of the lot. Lawrence Carlson appeared before the Commission regarding preliminary plat legally described as the mq! of Section 2 T32R24. Carlson explained to the Commission the protective covenants which would accompany each deed, i.e., minimum square footage, value of homes, and location of accessory buildings. Carlson noted that he had applied for a variance on lots in Block 1, Lots 1,6,7,10,11,16, and Block 2 lots 1,6,7,9,10,11,13, and 14. Holasek stated that we should get a copy of the variance to see what the variance is asking. Carlson noted that the plat as presented is the variance. Carlson noted that the road in Block 2 will bp- redrawn in order to save more of a high ridge which is located at the point of curve. Holasek stated that we should have the plat as it will be in final form. It was mnved by Jones and seconded by Langseth to recommend to Town Board to accept preliminary plat legally described as the mv! of Section 2 T32R24 Anoka County Minnesota including variances on frontage and lot sizes. Christenson stated that it is not the proper procedure. Rither stated that under the terms of the Ordinance he would have to say no. Four ayes, two nayes, motion carried. John Wallenbecker appeared before the Commission regarding a metes and bounds ~lat, Oak Ridge ~funor North Sectionl North of 161st Ave. wa at SE4 of mv! of Section 17, E 1/3 of SW4 of IfNi Section 17, T32R24 Anoka County Minnesota. Subject subdivision is located in the R-2 Zoning District. It was moved by Jones, seconded by Christenson to recom'1lend approval of preliminary -2- May 4, 1971 metes and bounds plat of Oak Ridge Manor North Section North of 161st Ave. mi. Motion carried unanimously. One copy of said metes and bounds plat left with Zoning and Planning Commission and endorsed with Commission resolution and signed by Norm Stout. Stout noted that buidlings must conform to the Ordinance requirements of the R-2 Zoning District. Eldon Hall and attorney Bill McPherson appeared before the Com~ission regarding a variance. McPherson stated that they do not presently have adequate information and would like to pass and return later. McPherson later returned and asked to be placed on the agenda for the next meeting. Mr and ~trs Douglas Bonde appeared before the Cowmission regarding a variance application. Discussion was held regarding lot size noting that the average dimensions were 118 feet wide by 151 feet deep. Subject lot is located in the R-I Zoning District. Langseth suggested buying an additional lot. Jones, Stout discussed swamp areas; Bonde stated that his lot is high land. Bonde stated that the lot was recorded in November of 1970. Stout discussed the 40,oon square foot lot provision without sewer and water, noting that in the area of the Bonde lot the water table was high and that the chances of polluting the ground water was good. Jones stated that we should insure that 40,000 square feet should be considered. Stout explained Menkveld and Bonde applications, that both variances cover the the same lot, and asked if one should be considered before the other. Attorney noted that the 40,000 square foot provision does not apply in the R-l District and that the Ordinance does not address priorities with respect to variance applications, only that it be a lot of record prior to January 1, 1971. Holasek noted that variances are granted on characteristics of land; subject lot is a lot of record prior to January 1, 1971; lot does not meet the sixty percent requirement of 5.04 and that it requires a variance. Holasek stated that it does not meet the requirements of paragraph 5.04 of the Ordinance. Commission to submit report of findings to the Town Board of Supervisors. Terry Luke appeared before the Commission regarding plans to build a house on lot 13, Block 2, Oak Ridge Manor. Luke stated that the house would measure 26x40 with an attached 6X12 foyer, split entry. Discussion was held regarding the square footage requirement for the floor area with Holasek stating that it is up to the building inspector to interpret code and Stout stating that the code is specific on the matter of basement and living area. Stout read definitions of cellar, basement, and floor area. Jones noted how the floor plan could be changed to comply with the code. Rither stated that the Building Inspector issues the permits, not the Com~ission, and that the Ordinance sets forth the requirements. Stout noted that the matter of floor area is before the court by E-V Builders and will be decided by the court one way or another. ,John Boros and Harland Nelson appeared regarding a lot on the east line of County Rd. #9, on the Hughes property. Boros noted that Nelson would like to build but must vacate his present home by July 1. Stout noted the predicament but the Com~ission must consider it on an individual basis. Location of lot is in the R-I or R-3 District, with some question as to the location of the south line of the R-3 District. Wallace Hughes asked for the procedures for rezoning the area if not in the R-3 District. Stout told Hughes to obtain zoning forms from the Town Clerk. Attorney to examine Zoning Map and determine south line of the R-3 Zoning District. It was moved by Rither, seconded by Christenson to adjourn. Motion carried. Meeting was adjourned at 9:57 PM.
