The regular monthly meeting of the Grow Township planning and zoning
commission was called to order at 7130 July 25th by Chairman Robert Hither.
First to be called was Larry B. Carlson, who was not as yet in attendance.
At 7135 a Public Hearing was called for !Any Baden and Hayes Quickstrom.
They were not as yet in attendance and were pt...ed over.
At 7140 a Public Hearing was held on a rezoning application for
Marvin and Terry Luke. (See attached legal description). Chainan Bither
added this Public Hearing was in accordance with Ordinance 8 and noted all
residents within )00 feet of proposed. rezoning had been notified and notice
of hearing had been published. in the union. Chairman Hither pointed out
differences from R-1 to B-2 were aainly lot size and square, footage
requirement of swelling. Marvin and Terry Luke and Leroy Winner were present
with preliminary plans and a colored. overlay. Winner explained the parcel
included 82 acres, of which 65 acres would be used for roads and building
lots, 17 acres of wetland park, having a total of 44 building lots if
property would be rezoned frOlll R-1 to R-2. Terry Luke noted that lands to
north and east are,already R-2 and R-). also noting that he resides in an
R-2 area Oak Hidge Manor to the east. Chairman Rither explains that Oak
Ridge and the other areas in question existed prior to enactment of Ordinance
No.8. COllUlission member Holasek brought forth the question of how much land
is required for park dedication. After discussion he atates 7% of grosl!5
area must be dedicated. Ch&1nan Bither proceeded to read Section 9 of
platting ordinance. Holasek interprets that town Board has authorty to
accept land or request cash to buy park area elsewhere. Marvin Christenson
asked Mr. Winner to describe land to be dedica.ted for pPork. Winner said it
was wet in spring and dry enough to walk in the week of the 20th of July.
Richard Schneider questioned Chairman Hither whether pu'cel. if rezoned R-2,
could be subdivided when sewer reaohed area. Cha.irlllan Hither explains hOlIes
must be 1200 square feet with 165 feet Ilinimwa frontage and could not be
subdivided at any tille in the future. He alao pointed out R-2 classification
would be largest parcels of land in Grow Township when we reached full
density. Mr. Schneider noted this is what he wanted pointed out. Marvin
Christenson points out this part of Grow Township resides in sewer area 3
and this Ileans there are no plana for sewer in this area. Winner. points
out that state and county allow private sewer on lake frontage with 40,000
square feet. Terry Luke stated perculation tests would be taken to determine
size of drain field.
Art Leu, 4075-165th Ave. N.W.. points out if airport site is in Grow.
165th or Co. Rd. 58 would be heavily traveled and was on his property as
well as others and would like to know where area. in question would lie in
reference to road. Mr. Winner notes that area in question goes to section
line 60 feet south of county road. Mr. Leu states he would like road moved.
Mr. Winner states township has no control over placement of county roads.
Phyllis Leu asked what type of sewer dispoasl system would be used. Terry
Luke explained again they would go to code plus. Ms. Leu asked if each lot
would have its own well. Mr. Luke says yes. Commission member Johnson asks
Chairman what are we required to do. Chairman Rither reads from Ordinance 8,
Section 4.34. part D. which explains procedure. Member Jaworski notes that

only one street in plat runs to proposed park. Mr. Winner states this is
preliminary and subject to change. Chairman Rither says point well taken
but real question now is whether rezoning request should be accepted or
denied. Chairman Rither points out soil resource map which was purchased
by town Board for planning commission to assist us. Area in question was
pointed out. Marvin Christenson asks Winner what is at left of plat and
if south boundary is true. Winner explains drainage ditch remains on
Stack property he still owns to the south. Hither states there is no
comprehensive plan for this part of township which puts planning commission
at a disadvantage. Commission member Dutton again points out possible
sewer problems with R-2 density for years. Terry Luke explains they plan
to build up the area in :3 to 5 years and not over night. Chairman Hither
asks Mr. Luke what the drawbacks to H-1 were. Terry says with more money
in 2t acres the cost of homes would have to be kept down in order to be
competitive in market. Chairman Hither states some of the most expensive
homes in Grow are on 2t acre plots and has not been detrimental to these
areas for they have sold out their whole area. Holasek points out if this
area is rezoned area to north should also be zoned R-2 to get away from
spot zoning. The BOlU'd is questioned by Jim Stack on zoning of Klenk,
Stenquist and Mayo property. R1ther notes R-2 area on river to encourage
larger width on river lots. Winner explains Mayo property was in accordance
with Grow zoning before Ordinance 8. Klenk property was registered before
Ordinance 8 and Stenquist property was so zoned to get away.from spot zoning.
Discussion was ended and Chairman Hither asked. if anyone would entertain a
motion. It was moved by Clendening and seconded by Dutton to recommend
that the town Board deny rezoning application, Holasek states we ,need more
information to make a deCision, and also states without a comprehensive
plan we need more time. Dutton maintains his stand on no sewer breakdown
for area. Terry Luke asks for a definition on the area. Clendening says
possible H-:3 area in future. Question--4 for denial, 1 for approval, denial
carried--Johnson, Clendening, Dutton, Jaworski for denial. Holasek against
denial.
At 8145 Larry Carlson was called and brought forth his subdivision road
layout for approval. Because parcel was registered before Ordinance 8 we
are asked to view road plat and note that although it is a dead end. the road
goes beyond the Cul-de-Sac in case it ever goes further in future. Johnson
makes a motion to recommend town Board approve road layout. Dutton seconds.
All for.
At 9100 a Public Hearing for Larry Baden and Hayes Quickstrom was
recalled. concerning their preliminary plat. Chairman Hither had list of
people notified of. public hearing and item was published in union. At this
time no one has come forth as requested by Mr. Hither if they are interested
parties. The planning commission and Mr. Qu1ckstroll and Baden jointly wnet
over Grow Township's engineering reviewal of Verdin Acres. After full
discussion a !lotion was made by Johnson to approve preliminary plat subject
to changes made before town Board meeting. It was seconded by Clendening.
All for. Section change improvements are 8.02F, 9.03C, 9.03E, 8.0:3H, 9.020
and last 906A-2 should be sown subdivision into R-J lots. At 9155 it was
moved by Clendening and seconded by Holasek to adjourn. All for.

(2) Commission accepts preliminary plat subject to changes
noted on attached engineering report.
(:3) COlllllission notes above changes aust be made before town
Board should review plat.
(4) Commission notes plat should include breakdown to R-J type

A Public Hearing was held July 2.5, 1972 to consider the application
by Marvin and Terry Luke to rezone the property described on attached sheet
from R-1 single family rural to R-2 single family estate.
(1) Commission notes property is northwestern part of township,
a part of the township that has no comprehensive plan.
(2) Commission notes property is in Sanitary Sewer district No.3.
At the present time there are no plans for sewer in this area.
(3) Commission notes that no rezoning has been done in this part
of township; therefore could be called spot zoning.
(4) It was moved by Clendening and seconded by Dutton to recolUl1lend
the town Board deny petition to rezone. Johnson, Dutton, Clendening,
Jaworski for denial. Holasek against denial.
