REZONING - RIVER SHORES ESTATES, INC.
GENTLEMEN:
In accordance with Ordinance No.8, the following
is submitted for your consideration.
A Public Hearing was held May 30, 1972 to consider
the application of River Shores Estates, Inc., to rezone the
Nt of the SEt of the swt Section 17, T32R24, from R-1 to R-2.
(1) J. Featherstone, representing River Shores
Estates. Inc., appeared before the Commission and stated that
the petitioner wished to have subject area rezoned from R-1 to
R-4 instead of to R-2 as originally stated in the application.
(2) Chairman stated that Township Attorney had advised
that the change could be made at the discretion of the Commission
and that republication of the Hearing was not necessary.
(3) Commission notes that subject parcel contains
twenty acres and abuts an existing R-2 Zoning District on the
northerly and westerly boundries with Tulip St. NVl on the easterly
boundry. An undeveloped tract of land is located on the southerly
property line of the subject parcel.
(4) Commission notes that granting a rezoning to the
R-4 Zoning District would result in "spot Zoning" and not the
most appropriate use of the land in terms of density and
compatibility with the adjoining R-2 Zoning District.
(5) It was moved by. Jones and seconded by Dutton to
recommend that the Town Board disapprove the request to rezone
the Nt of the SEt of the swt Section 17_ to'R~4_ and to approve
the original application to rezone the Nt of the SEt of the swt
Section 17, T32R24 from the R-1 to R-2 Zoning District. Motion

SUBJECT: PRELIMINARY PLAT - RAY KLENK
GENTLEMEN:
The following is submitted for your consideration.
Ray Klenk appeared before the Commission on ~Y30,
1972 and presented a preliminary plat described as Valley
View Estates, Second Addition.
Commission notes that subject plat represents a
revision of a plat submitted and subsequently approved by
the Commission on September 28,1972.
Commission notes Ordinance No. 10, Subdividing and
Platting, Section 15, Plats Previously Approved: All preliminary
or final plats, registered land surveys, or other subdivisions
of land approved by the Town Board but not filed with the
Register of Deeds under previous ordinances shall not be subject
to requirements of this ordinance, provided said subdivision is
filed within 6 months of the effective date of this ordinance,
[FEBRUARY 25, 1972J.
Commission notes that revised plat is superior to
original plat in that street layout results in more efficient
traffic patterns and that lotting_arrangement affords greater
accessability to proposed park area.
It was moved by Holasek and seconded by Dutton to
recommend that the Town Board of Supervisors approve the plat
as presented by Ray Klenk known as Valley View Estates Second
Addition. Motion carried unanimously.

SUBJECT: REZONING - LOUIS J. FILIATRAULT
GENTLEMEN:
In accordance with Ordinance No.8, the following is
submitted for your consideration.
A Public Hearing was held May 30, 1972 to consider the
application of Louis J. Filiatrault to rezone property as des-
cribed in the Certificate of Survey attached to this report and
herein referred to as Tracts A, B, and C, from the R-l Zoning
District to the R-4 District.
(1) Commission notes that within the R-4 Zoning
District, Ordinance No. 8 requires a minimum of 39,000 square
feet lot area where private sewer and water systems are to be
used.
(2) Commission notes that Tract A contains in excess
of 96,000 square feet; Tract B contains in excess of 80,000
square feet, and Tract C contains in excess of 71,000 square
feet.
(3) Commission notes that Tract C abuts School
District No. 11 property on the west, Eidelweiss St NW on the
East and Bunker Lake Blvd NW on the south.
(4) Commission notes that an R-4 Zoning District is
located immediately to the north and south of, subject tracts.
(5) Commission notes that subject area will be one
of the first areas of the Township to be served by sanitary
sewer and water.
(6) It was moved by Jones and seconded by Holasek
to recommend that the Town Board approve the Filiatrault petition
to rezone property as described in the Certificate of Survey as
attached to this report and herein referred to as Tracts A, B,
and C, from the R-l Zoning District to the R-4 Zoning District.
Motion carried unanimously.

The regular monthly meeting of the Grow Township Planning and Zoning
commission was held on Tuesday, June 27, 1972. Chairman Rither called it
to order at 8.00 P.M.

First on our agenda was the continued public hearing far Paul Jensen
concerning his application far an amended special use permit--alteration of
existing nonconforming use. Chairman Rither explained to all that this item
must first meet criteria, Ordinance No.8, Section 5.03 and proceeded to read.
Discussion commenced with Jones questioning if Item falls under Section 4.03
nonconforming uses and structures. Holasek noted definition QQQQ which would
get Item back to commission taking responsibility of deciding whether proposed
building would meet criteria. Hither, Holasek, Johnson questioned George Jensen
and he stated.
1. Structure would be agreeable to surrounding residential area.
2. No plans far increased traffic to and from property.
3. No increased p!.rking area planned.
George Jensen stated at public hearing they already have majarity of replir work
in Twin City area so no increased traffic could be expected. Holasek mentioned
site was well screened. Dean Johnson noted proposed building site well off road
and in wooded area. A motion was made by Dutton and seconded by Jones that the
amended special use permit be denied with Dutton stating that structure would be
in residential district and could have imp!.ct on future residents. George Jensen
noted that mare increases in size would also require approval by Board. Jones
states he feels structure falls under limited manufacturing definition BBB. After
reading over BBB rest of commission agrees it does not fall under BBB. At this
point Jones notes that in 1967 and 68 Grow Township issued him a special use
permit far a one-man business on his property and was subsequently taken to court
by his neighbor, Marvin Christensen. Jones stated the court ruled against h1m
and his $5,000.00 investment was after one year of no use to him. A vote was
taken and Dutton's motion was denied. Clendening made a motion to grant a.m.ended
special use permit. Seconded by Johnson. Motion carried to recOlllmend that
town board approve amended special use permit on property of Paul Jensen as shown
in his plans presented to planning and zoning commission.
Second and last on our agenda was a plat, Langseths Pine Acres 2nd addition,
previously approved, revised, and submitted for final approval. There was
general discussion with land surveyar Winner placing maps of previous plat and
present revised plat befare commission.
At this time proceedings were interupted by Mr. Dallas Flynn, who has
property in an exception area of Langseths Pine Acres 1st addition. He explained
his position of having roads on three sides of his property and wanted to know if
there was sOlIe way he oould prevent this because it would oreate problems of
traffic, dust, etc. Mr. Winner pointed out the road in question was placed there
on the county's request and was already dedicated as road by Grow Township and
also was part of first addition, therefare, was out of order at this time.
Flynn questions if there is any way he can resolve his prOblem, and states he would
buy 2 of Langseths lots if they would move road down to second addition. Dave
Langseth states that some time in the future he was thinking of a dairy store
on the lots in question to serve the growing area. Chairman Hither advised
Mr. Flynn that he would have had to cOllle before cOIIlmission when 1st addition

j Town Board of Supervisors. Discussion cOllllllenced with Chairman Rither noting
to Ia.ngseth that he would have to place the hOlies so
1. There would not be any contigious building. Holasek notes that is
possible because 1st and 2nd addition are not tied together COIIII. Rither states
the ordinance gives commission power to regulate this.
2. Jones questions which way water nows. Winner produced original water
plat for ground in question. Jones notes area allocated for park is on high
ground which is quite unusual. Commission members check all lots for minimUll
square footage. Rither noted that in first plat Block 1, Lots 2, 3, 4-, did
not meet minimum square footage. Together commiasion, Winner, and IAngseth
agreed on the following lots for building I
Block 1 - Lots 1, 3, 5
Block 2 - Lots 2, 4-, 6, 8
Block 3 - Lots 1, 3, 5
Block 4- - Lots 1, 3, 5, 7
Jones makes a motion the commission approve revised plat Ia.ngseth Pine Acres 2nd
addition. Clendening seconds. It was carried unanilllously to recolUlend that the
Town Board approve above with a stipulation that only lots noted be buildable.
A motion for adjournment was made by Dean Johnson and seconded by Clendening.

GENTLEMEN:
The following is submitted for your consideration.
Ray Klenk appeared before the Commission on l1aY:30,
1972 and presented a preliminary plat described as Valley
View Estates, Second Addition.
Commission notes that subject plat represents a
revision ofa plat submitted and subsequently approved by
the Commission on September 28,1972.
Commission notes Ordinance No. 10, Subdividing and
Platting, Section 15, Plats Previously Approved: All preliminary
() or final plats, registered land surveys, or other subdivisions
of land approved by the Town Board but not filed with the
Register of Deeds under previous ordinances shall not be subject
to requirements of this ordinance, provided said subdivision is
filed within 6 months of the effective date of this ordinance,
[FEBRUARY 25, 1972J.
Commission notes that revised plat is superior to
original plat in that street layout results in more efficient
traffic patterns and that lotting~arrangement affords greater
accessabi1ity to proposed park area.
It was moved by Holasek and seconded by Dutton to
recommend that the Town Board of Supervisors approve the plat
as presented by Ray Klenk known as Valley View Estates Second
Addition. Motion carried unanimously.
