Chairman Robert Rither oalled the meeting to order at 7135, introduoed members, and explained agenda. COJlIJIiss1on members Clendening, Dutton, Holasek, Jaworski, Johnson, and Jones were present. ) First on the agenda was a Public Hearing on the property of Dr. Louis J. nliatrault. at 13725 Eidelweiss Street and Bunker Lake Boulevard for a possible rezoning. The area in question was discussed and all proper steps for rezoning had been previously taken. Duane Jones makes a motion to rezone these three lots. Winslow Holasek seoonds. All members for. At 7145 a Publio Hearing was held for Paul Jensen, who now has a non- oonforming business on his property at 17225 Round Lake Boulevard. He proposed to oonstruct a 20 by 40 foot building sexarate from home for his business. The area was defined to all and it was noted he qualifies under an amended speoial use permit. George Jensen produoed plans and noted the building would be asthetio to tiurrounding area. George also noted he would like to start building around the 19th of June. Dean Johnson stated he would like to view property. There was disoussion by all. Jones made a motion to table so all could view property. Clendening seconded this motion. At 8115 a Publio Hearing was held for Addrian addition, with Jeff Fetherstone representing. This itell was published to ohange R-l to R-2 but, at this time, Fetherstone would like to ohange zoning to R-4. Item was disoussed and it was deoided the petitioner oould change his mind without republioation in xaper. Disoussion on subject with Jones noting adjaoent area zoned R-l and R-2. Jones stated against R-4 and made a motion to rezone to R-2 and deny R-4. Dutton seoonds. Zoning commissions main oonoern is that R-4 would allow smaller homes under Seotion 8. It will be reoolRlllended to change R-l to R-2 to Town Board per Robert Hither. At 8130 a Public Hearing, whioh was held May 30, 1972, to consider a preliminary plat of Nightengale Estates for Kenneth Olson was disoussed. (1) COIDlIIission notes that the preliminary plat presented on May 30, 1972 was in oonformanoe with Ordinance No. 10, Seotion 8, Required D:l.ta. However, the plat filed with the Clerk did not oontain all of the required data. (2) Chairman noted that a letter dated May 25, 1972 had been received from Caswell and Associates, Township Engineers, stating that they had not reoeived suffioient information to perform a complete engineering review of the proposed plat. (3) Olson stated that the required information had been given to the engineer on May 26, 1972. (4) No objections to the plat were heard. (5) It was moved by Clendening and seoonded by Jones to approve the preliminary plat of Nightengale Estates subjeot to engineers report. Motion carried unanimously. At 8155 a preliminary plat for Harm HoiW1l was brought forth by Mr. Quickstrom. They were told a subdivision sketch plan is required by Ordinance No. 10. Upon discussion with them, it was learned that their aim was over 5 Acre Hobby Farms. Final item not on agenda was a proposal by Dick Netz of Blaine for a private water system at Meadow Creek Estates. FILIATRAULT GENTLEMEN: In accordance with Ordinance No. $, the following is submitted for your consideration. ~ -- ~ Public Heari5g was held Y~y 30, 1972 to consider the application of Louis J. Filiatrault to rezone property as des- cribed in the Certificate of Survey attached to this report and herein referred to as Tracts A, B, and C, from the R-l Zoning District to the R-4 District. (1) Commission notes that within the R-4 Zoning District, Ordinance No. <$ requires a minimum of 39,000 square feet lot area where private sewer and water systems are to be used. o u (2)" Commission notes that Tract A contains in excess of 96,000 square feet; Tract B contains in excess of $0,000 square feet, and Tract C contains in excess of 71,000 square feet. (3) Commission notes that Tract C abuts School District No. 11 property on the west, Eidelweiss St NW on the East and Bunker Lake Blvd NW on the south. (4) Commission notes that an R-4 Zoning District is located immediately tb-the north and south of, subject tracts. (5) Commission notes that subject area will be one of the first areas of the Township to be served by sanitary sewer and water. (6) It was moved by Jones and seconded by Holasek to recommend that the Town Board approve the Filiatrault petition to rezone property as described in the Certificate of Survey as attached to this report and herein referred to as Tracts A, B, and C, from the R-1 Zoning District to the R-4 Zoning District. GENTLEMEN: o In accordance with Ordinance No. $, the following is submitted for your consideration. A Public Hearing was held May 30, 1972 to consider the application of River Shores Estates, Inc., to rezone the Nt of the SEt of the swt Section 17, T32R24, from R-1 to R-2. (1) J. Featherstone, representing River Shores Estates, Inc., appeared before the Commission and stated that the petitioner wished to have subject area rezoned from R-1 to R-4 instead of to R-2 as originally stated in the application. (2) Chairman stated that Township Attorney had advised that the change could be made at the discretion of the Commission and that republication of the Hearing was not necessary. (3) Commission notes that subject parcel contains twenty acres and abuts an existing R-2 Zoning District on the northerly and westerly boundries with Tulip St. NW on the easterly boundry. An undeveloped tract of land is located on the southerly property line of the subject parcel. (4) Commission notes that granting a rezoning to the R-4 Zoning District would result in "spot Zoning" and not the most appropriate use of the land in terms of density and compatibility with the adjoining R-2 Zoning District. (5) It was moved by. Jones and seconded by Dutton to recommend that the Town Board disapprove the request to rezone the N-} of the SEt of the swt Section 17. to'R-4. and to approve the original application to rezone the Nt of the SEt of the swt Section 17, T32R24 from the R-1 to R-2 Zoning District. (1) Co~~ission notes that the preliminary plat presented on May 30, 1972 was in conformance with Ordinance No. 10, Section $, Required Data. However, the plat filed with the Clerk did not contain all of the required data. (2) Chairman noted that a letter dated May 25. 1972 had been received from Caswell and Associates, Township Engineers, stating that th~y had not received sufficient information to perform a complete engineering review of the proposed plat. (3) Olson stated that the required information had been given to the engineer on V~y 26, 1972. (4) No objections to the plat were heard.
