The regularly scheduled monthly meeting of the
Grow Township Zoning and Planning Commission was held
March 28, 1972 at Crooked Lake school. Chairman Norm
Stout called the meeting to order at 7:45 PM with Commission
members Holasek, Jones, and Nash Present.
It was moved by Nash and seconded by Holasek to
recommend that the Town Board issue a Special Use Permit
to the Seventh Day Adventist Church for construction of
a church building in Section 20, T32 R24, subject to
conformance with all State and local codes with particular
reference to building, parking, set-backs and/or any
other restrictions relative to the building or site.
Ayes: Holasek, Jones, Nash
Nayes: None
It was moved by Holasek and seconded by Nash to
recommend to the Town Board that the Mann Realty rezoning
request from R-I to R-2 in Section 36, T32 R24, be denied
at the present time because; (1) proposal does not contain
a feasible street plan and (2) insufficient information
on development of surrounding parcels relative to land use
or projected sewering as complete comprehensive sewer plan
of Grow Township is not available at this time.
Holasek withdrew motion. Nash withdrew second.
It was moved by Holasek and seconded by Nash to
table action on the Mann Realty rezoning request.
Ayes: Holasek, Jones, Nash
Nayes: None
Ken Olson sketch plan was discussed with no action

It was moved by Nash and seconded by Jones to
recommend to the Town Board the disapproval of the Canner
Variance application on lot size in Section 6, T32 R24,in
that no hardship due to characteristics of the land was shown.
Ayes: Holasek, Jones, Nash
Nayes: None
It was moved by Jones and seconded by Nash to
recommend to the Town Board the disapproval of the Smith
Variance application on lot sizes in Section 24, T32 R24,
in that no hardship due to characteristics of the land
was shown and that too many lots were affected.

VARIANCE APPLICATION - RON SMITH

GENTLEMEN:
The following is submitted for consideration.
(1) Subject parcel is located in the R-1 Zoning
District, :contains twenty (20) lots, twelve (12) do not
conform to requirements of Ordinance No. $, paragraph 6.02
with respect to lot width at front set-back line; ten (10)
do not conform to the required lot area in square feet.
Combined, a total of fourteen (14) lots, or seventy (70)
percent of the total are covered in the variance request.
(2) It is to be noted specifically that on
September 2$, 1971, Smith presented the Commission with
a preliminary metes and bounds drawing of the same parcel
of land as described in the aforementioned variance
application.
(3) Commission notes that the plat presented
on the 2$ September 1971 conformed entirely to the require-
ments of Ordinance No. $, and subsequently recommended
approval to the Town Board of Supervisors ina report
dated September 2$, 1971.
(4) At the February 29, 1972 Commission meeting,
Smith stated that, "The lot dimensions were changed because
[rJ was having trouble getting the gas company to install
gas mains on the larger lots."
~5}; Ordinance NO. $ para. 5.04 and Ordinance
NO. 10 Section 17.01, state that variance may be granted
where hardships are created due to characteristics of the
land and not the property owner.

(6) Commission recommends that the variance
application be denied in that Smith did not show any
hardship created by the topography or physical character-
istics of the parcel in question.

GENTLEMEN:
The following is submitted for consideration.
(1) Subject parcel is located in the R-I
Zoning District.
(2) Canner parcel is 2t acres in area.
(3) Subject parcel is proposed to be
conveyed by metes and bounds description.
(4) Ordinance No. 10, Subdivision and Platting,
Section 7.01 states; "...there shall be no conveyance of
land described by metes and bounds if the conveyance is
less than 5 [five] acres in area and 300 feet in width."
(5) Ordinance No. 10, states; "...where it is
shown that by reason of topography or other physical
conditions strict compliance with these requirements could
cause...hardship..." a variance may be granted. Sec. 17.01.
(6) Commission l.notes that no hardship due to
characteristics of the land was shown.
(7) Commission recommends that the Canner
Variance application be disapproved.

GENTLEMEN:
The following is submitted for your consideration
regarding the aforementioned Special Use Application.
(1) In accordance with Ordinance No. $, Mr.
H. I. Jarnes appeared before the Commission at a Public
Hearing held March 2$, 1972. Jarnes presented plans for
the proposed church building, its location, capacity, and
proposed parking facilities.
(2) Examination of exhibits revealed them to
be in conformance with Ordinance No. $, Zoning Regulations.
(3) No objections to the proposal were heard.
(4) The Commission recommends that the Town
Board issue a Special Use Permit to the Seventh Day
Adventist Church for construction of a church building
in Section 20, T32R24, subject to conformance with all
State and local codes with particular reference to building,
parking, set-backs and/or any other restrictions relative
to the building or site.
(5) Ayes: Holasek, Jones, Nash
