The regular monthly meeting of the Grow Township
Zoning and Planning Commission was held February 29, 1972 at
Crooked Lake school. Chairman Norm Stout called the meeting
to order at $:05 PM with Co~~ission members Christenson,
Holasek, Jones, Langseth and Rither present.
Myron Roseland, 16109 Valley Drive rrN, appeared
before the Commission regarding his petition for a Special
Use Permit to erect a pole type storage building on property
legally described as That part of the North 113.63 feet of
the South 225.33 feet as measured at right angles from the
South line of the SEt of the NEt of Section 1$, Township 32,
Range 24, Anoka County Minnesota, that lies West of Block 2,
Alladin Acres, and that lies Easterly of the Center line of
Valley Drive (County Road No. 5$), formerly known as Lake
George Road, as now shown on said plat of Alladin Acres. In
response to Commission questioning, Roseland stated that the
building would be used for the storage of trucks, road patrol,
catepillar and similar equipment; that the building would be
a pole type structure, forty (40) feet by sixty (60) feet
with a dirt floor, located on approximately one plus acre.
Roseland stated that a concrete floor would be installed in
June of 1~72. Roseland stated that the proposed building
would be erected on a lot fronting on Genie Drive mv and that
ingress and egress would be on Genie Drive. Roseland stated
that property owners located within 300 feet of subject property
had been notified, namely; Stack, McNeal, Cogan, and Paragon
Builders. Rither referred to Ordinance No. $, Zoning Regulations,
Paragraph 7.03, Special Uses and noted that according to the
Ordinance, subject property is located within the R-3 Zoning
District and that the proposed use is not a permitted use with
or without a Special Use Permit. Holasek noted that the pro-
posed use could not be classified as similar to the uses as
listed in Paragraph 7.03, Special Uses, adding that no one
was located close to Roseland, there is a street on two sides
of the property, Holasek discussed the R-1 Zoning District,
asking if large storage buildings were prohibited. Christenson
said yes, but it does not apply if there are five acres or more.

Langseth stated that there is a section in the Ordinance which
puts a time limit on the Special Use and asked if Roseland could
state how long he would want the building to remain on the
property. Roseland replied that he could not give a definite
time. Holasek stated that if the proposed use is not similar
to a use listed in 7.03 then it is not permitted. Christenson
read Paragraph 5.03 C(5) pertaining to what action the Commission
must take, namely; report finding to the Town Board. Holasek
stated that after reading Paragraph 5.03 (B) Criteria for Grant-
ing Special Use Permits, in his opinion a use is permitted if
it isn't out of place and that a riding stable is permitted and
that a riding stable would be more objectionable than a storage
building; that a riding stable is a barn and that he would
rather have a storage building. Rither stated that the question
does not concern a riding stable, that it concerns the storage
of commercial vehicles such as snow plows, catepillars and the
like in a residential area, which use the Ordinance specifically
does not allow; the Ordinance generally provides a definite place
for all uses and activities citing the example of Ace Solid
Waste located in the Grow Town Industrial Park, which is zoned
Limited Industrial. Holasek stated that the use meets Paragraph
5.03 Special (Conditional) Uses General Statement.
It was moved by Holasek and seconded by Jones that if
set back requirements are met and there are no objections at the
hearing that we recommend that the Town Board of Supervisors
issue a Special Use Permit for a storage building located on

that lies West of Block 2, Alladin Acres, and that lies Easterly

Acres. Holasek, Jones, Langseth announced for, Christenson,
Rither announced against. Motion carried. Rither stated that
the action of the Commission was clearly a violation of Ordinance
NO. $, specifically Paragraph 7.03.
Ken Olson appeared before the Commission regarding a
sketch plan for a subdivision of three lots within Section 22.

Proposed lot wi~_n at front setback line i5 J60 (three-hundred
fifty) feet and lot depth is 305 (three-hundred five) feet
with a lot area of 109,$00 square feet which meets the require-
ments of Ordinance No. $. Christenson referred Olson to the
requiremehm of Ordinance No. 10, Platting Ordinance stating
that the Ordinance for subdividing of land must be followed.
Commission discussed possibilities of resubdivision, future
road easements, proposed use of property located north of
subject parcel and adjacent lands. Stout stated that there
appeared to be no reason that it could not be approved.
Commission advised Olson to follow procedures as outlined
in Ordinance No. 10, Platting Ordinance. No action taken.
Bob Munns, attorney, and Byrd Norton appeared
regarding subdivision located within the SEt of the mvt of
Section 13. Norton stated that owner of Exception would not
grant an easement as requested by the Commission and Board of
Supervisors on January 25, 1972. Christenson reviewed actions
and recommendations of the Commission and the Town Board
noting that the parcel does not allow subdivision as proposed
due to the location of abutting lands not owned by Norton.
Stout suggested that easements be obtained along the southerly
line of lots 1 and 6 in anticipation of a future easement
across the Exception. Rither stated that easements would
possibly create more problems in the future if a service road
was never established across the Exception. Munns suggested
that lot 6 be eliminated and make it conform to the Platting
Ordinance minimum of five acres. Stout suggested that a road
easement be established along the westerly line of lot 6 and
lot 5, extending to proposed cul-de-sac of road easement as
proposed. It was noted that one area of the road would have
to be constructed across a swampy area. Corr~ission noted that
the street would be classified as a minor street with a right
of way of 50 (fifty) feet. No action taken.
Jack Lundgren appeared regarding a sketch plan for
subdivision of lots in Section 33 at 135th Ave NN and Gladiolus
St mv. Subject plat is located in the R-4 Zoning District.
Commission noted designated Outlot and informed Lundgren that
Ordinance No. 10, Platting Ordinance does not permit outlots.
Lundgren stated that he would then delete the outlots and
dedicate the area as a park, that he was going to let it go
back for taxes anyway. Commission discussed lot dimensions

and square footage requirements of the R-4 District without
sanitary sewer and water, noting that there shall be no
more than one residence per 39,000 square feet of lot area.
Jones suggested that Lundgren redraw the plat in order to get
the maximum lot square footage and the maximum number of
houses permitted. Proposed plat contained eight lots, with
the square footage allowing two single family homes. Lundgren
stated that he would revise the plan, adding one lot for a
total of nine so that every third lot could be built. No
action taken.
Chairman Stout noted that although not on the
agenda, there were four additional people waiting to transact
business with the Commission.
H. I. Jarnes, 275 Yoho Drive, Anoka, appeared
regarding a proposal of the Anoka Seventh Day Adventist Church
to erect a new church building in Section 20, on the former
Girl Scout Property on the shores of Round Lake. Jarnes
presented proposed plans for the building, its location, and
proposed parking facilities. Preliminary examination revealed
that the proposal is in general conformance with Ordinance
No.8, Zoning Regulations. Jarnes was advised that the proposal
would require a Special Use Permit and was given instructions
regarding forms, fees, and information required. Rither gave
Jarnes the name, telephone number and address of the Township
Clerk. In addition, Rither stated that he would be in contact
with the clerk and notify Jarnes of the hearing date.
Ronald Canner appeared before the Commission. Canner
stated that he wanted to buy 2t acres of land in the mvt of the
mvt Section 6. Commission noted that subject area is located
in the R-l Zoning District. It was also noted that Canner must
have five acres or more for a metes and bounds description to
be permitted under the terms of Ordinance No. 10. Corrmission
discussed the problem of the boundarY separating the R-l
District and the R-2 District in Section 6 noting that it
could possibly be in error. However, Commission noted that
the Official Zoning Map would have to be consulted in order
to determine the proper location of the R-2 Zoning District
boundary.

Ron Smith, representing Smith and Anderson Inc.
presented sketch plan for subdivision lying within the swt of
the SEt Except the North 650 feet of the West 130 feet thereof.
Also except that part of the East 34.6 feet lying North of the
South 885 feet thereof, All in Section 24, T32 R24. Also the
East 726.0 feet (as measured at right angles to the East line)
of that part of the West ~ of the NEt of Section 25, T32 R24
lying North of the following described line: Commencing at the
Southeast corner of said Northeast t; thence North 0000' East
along the East line of said Northeast % a distance of l035.35
feet to the point of beginning of the line to be herein
described: thence North 82035' West to the West line of said
Northeast t and there terminate. Subjects to easements of
record, if any. Subject parcel is located within the R-1
Zoning District, contains twenty lots, twelve of which do
not conform to requirements of Ordinance No. 8 with respect
to lot width at front setback line; ten do not conform to
the required lot area in square feet. Combined, a total of
fourteen lots, or seventy percent of the total, do not meet
Ordinance No.8 requirements. Rither stated that subject
metes and bounds plat was recow~ended for approval on September
28, 1971 but that the drawing presented in September is
substantially different from the one presented tonight.
Commission and Smith noted that the plan presented in September
conformed in every respect to the requirements of Ordinance
No.8. Smith stated that the lot dimensions were changed
because he was having trouble getting the gas company to
install gas mains on the larger lots. Rither stated that he
was a little confused over the number and variety of plat
drawings and asked Smith which drawing he wished to use so that
the Commission might know which drawing to examine. Smith
stated that the plan submitted tonight was the one he wanted
to use. Rither stated that a variance cannot be granted because
of gas company policy. Christenson stated that the characteristics
must have to do with the land. Smith stated that the Township
had granted a considerable number of variances to Carlson in
the northeast corner of the Township. Holasek stated that the
Town Board granted the variances against the recommendation of

the Commission and the Township attorney. Jones stated that
Smith needs a variance and asked if the Commission could say
how it would view the granting of a variance. Rither stated
that there was not sufficient grounds, that the plat had been
submitted once in conformance with Ordinance NO. S. Smith
stated that he would apply for a variance. No action taken.
It was moved by Christenson and seconded by Rither
to adjourn. Stout stated that there was still one more guy
waiting in the back to see the Commission.
Donald Fawley appeared and presented a sketch plan
for a subdivision lying within Section 29, east of County
Road 9 and fronting on 142nd Lane Wd. Subject plat is in the
R-4 Zoning District, and contains eighteen lots, two of which
were marked exception. Fawley stated that one was already
built and that the other had already been sold but not built.
Fawley stated that the road had been put in a long time ago,
that he had tried to get Appleby, Winner, and Schneider out
to inspect the road, approve it, but that no one knew what
the road standards were and that no one would come out to look
at it. Holasek noted that the lots as drawn conform to
Ordinance NO. S. However, Holasek stated that the length of
the cul-de-sac exceed_the maximum 500 foot length as required
by Ordinance No. 10, Platting Ordinance. Discussion was held
regarding future road easements to adjoining developments.
No action taken.
There being no further business to come before the
Commission, it was moved by Jones and seconded by Holasek to
adjourn. Carried. Meeting was adjourned at 11:15 PM.

GENTLEMEN:
THE POPULATION OF THE TOWNSHIP OF GROW HAS TRIPLED
FROM 1400 TO 4500 PERSONS IN THE PERIOD 1960 TO 1971 WITH A
TOTAL OF 298 BUILDING PERMITS ISSUED IN 1971 ALONE, INDICATING
AN ACCELERATING RATE OF DEVELOPMENT AND URBANIZATION. GROW
TOWNSHIP IS ON THE THRESHOLD OF A FULL SCALE SANITARY S~NER
PROGRAM AND ONCE THE PROGRAM BECOMES A REALITY DEVELOPMENT
WILL CONTINUE AT A MORE RAPID PACE THAN BEFORE CREATING
ADDITIONAL DEMANDS FOR SANITARY S~~ER, STREET IMPROVEMENTS,
PARKS, PLAYGROUNDS, FIRE AND POLICE PROTECTION AND OTHER
MUNICIPAL SERVICES.
AT THE PRESENT TIME, THE TOWNSHIP DOES NOT HAVE AN
ADMINISTRATIVE TOOL, SUCH AS A SUBDIVISION ORDINANCE, TO GUIDE
THE DEVELOPMENT OF THE COMMUNITY. THE TOWNSHIP HAS HAD TO RELY
ON A LIMITED PLATTING SECTION CONTAINED IN ORDINANCE NUf1:BER 8,
ZONING REGULATIONS, A SECTION WHICH WAS NOT DESIGNED TO ADMINISTER
THE SUBDIVISION AND PLATTING OF LAND.
THEREFORE, THE ZONING AND PLANNING CO~1ISSION HEREBY
RECOMMENDS TO THE BOARD OF SUPERVISORS THAT THE PROPOSED
SUBDIVISION AND PLATTING ORDINANCE BE ADOPTED AS PRESENTED AT
-THE PUBLIC HEARING HELD ON,FEBRUARY 1, 1972.

GENTLEMEN:
In accordance with Ordinance No.8, Zoning Reg-
ulations, paragraph 5.03(C)5, the following report is sub-
mitted for your consideration.
[lJ A Public Hearing was scheduled for January
25, 1972 to consider the aforementioned Special Use Permit
application. Petitioner did not appear as required by
paragraph 5.03(C)4. Commission tabled action on subject
permit until its next regular meeting to be held February
29, 1972.
[2J At an unannounced Commission meeting held
February 1, 1972 at Crooked Lake school, four of the seven
member Cow~ission voted to recommend to the Town Board of
Supervisors the approval of the Special Use Permit.
Petitioner was present.
[3J On February 7, 1972, the Grow Township
Building Inspector issued to Myron Roseland building
permit #559 for a pole type storage building, 2,240 square
feet, with dimensions of forty (40) feet by sixty (60) feet.
[4J Chairman Norm Stout called a special meeting
of the Commission on February 15, 1972 with all Commission
members were present. At this meeting, discussion was held
regarding the propriety of the action taken on February 1,
1972. In view of the tabling action on January 25, 1972,
and assuming that a permit was issued as a result of the
action taken at the unannounced meeting held February 1, 1972,
Commission agreed that to take action at any time other than
the announced February 29, 1972 meeting could possibly lead
to repercussions later on should someone object to the
issuance of the Permit.
[5J On February 29, 1972, Myron Roseland, 16109

Use Permit, nor is the proposed use "similar in character"
to those uses listed in Ordinance No.8 (see page 10).
[llJ It was moved by Holasek and seconded by Jones
that if setback requirements are met and there are no
objections at the hearing that we recommend that the Town
Board of Supervisors issue a Special Use Permit for a storage
building located on that part of the North 1l3.63 feet of the
South 225.33 feet as measured at right angles from the South
line of the SEt of the NEt of Section 18, T32 R24, Anoka County
Minnesota, that lies west of Block 2, Alladin Acres, and that
lies Easterly of the Center line of Valley Drive (County Road
No. 58), formerly known as Lake George Road, as now shown on
said plat of Alladin Acres.
