A special meeting of the Grow Township Planning and
Zoning Commission was held November 6, 1973 at the Crooked Lake
school. Chairman Art Jaworski called the meeting to order at
10:20 PM with Commission members Bush, Johnson, Miles, Newell,
VanderLaan, and Rither present.
Arthur Fedie, 437 N.E. Longfellow, Fridley, Minnesota,
appeared before the Commission regarding his application for
a variance of the rear yard set-back from fifty feet to twenty
eight feet at 745 140th Lane Nfl, Grow Township (also knoVlll as
Plat 65936 Parcel 3190). Fedie stated that the lot was staked
out attempting to save as many of the trees as possible; sixty
percent of the home was constructed when it was noted that the
rear yard set-back was twenty eight feet and not the required
fifty feet [Ordinance #$, Section 6.02, Minimum RequirementsJ.
Fedie stated that the twenty eight foot dimension was submitted
on the plot plan, approved by the Building Inspector, and a
Building Permit was issued. Walter Arntzen, Grow Building
Official, stated that the error in the set back was his
responsibility, that there was no intent on the part of the
home owner or builder, to violate the ordinance. Anntzen said
that the property owner to the north of the Fedie parcel,
Mrs Nehring, wanted some assurance that the descrepancy in the
rear yard set-back would not have an adverse effect on her
property. Commission agreed that no adverse effect on adjacent
property would result; the variance applies only to the Fedie
property, that all other lots, parcels, etc., would have to
meet the requirements of the ordinance.
It was moved by Rither, seconded by Newell, to
recommend to the Grow Township Board of Supervisors that the
application of Arthur Fedie to vary the rear yard set-back
from fifty feet to twenty eight feet at 745 140th Ave Nfl,
Grow Township [also known as Plat 65936 Parcel 3190J be
approved due to an administrative error on the part of the
Grow TOVlllship Building Official. Motion carried unanimously.
