A special meeting of the Grow Township Planning and Zoning Commission
was called to order on Wednesday, January Jrd, at 7140 P.M.
Chairman Jaworski noted the one item on agenda was the rewording of
Ordinance 8 to cover the Chapman subdivision. Chairman Jaworski opened
subject up for general discussion. Jones showed up at 7:50, leaving
only Dean Johnson not present. Winslow did not care for the wording and
thought there could be a better way to accomplish it. Jones thought it
could be unconstitutional. Chairman Jaworski noted that of the three
ways to accomplish the change, Mr. Babcock poin~ed out this as the best.
Holasek and Dutton, who attended Town Board Illeetinp;, tried to recall
other 2 ways. Clendening stated we should have left Chapman as R-I like
the motion he put forth. Holasek noted that would be fine but in all
probability not legal. Holasek thought it would be better at this time
to strike out the Grandfather clause and require all who had lots
registered to obtain a variance. Jones noted this could place a hardship
on some people. Holasek noted that the Menkfeld incident was covered
with a blanket variance. Jones stated we really could not make a decision
on striking the Grandfather clause or this r~ording without some legal
help. All Board members agreed. Chairman Jaworski noted that the
rewritten section was a legal opinion. Clendening made a motion to
recommend the Town Board of Supervisors leave R-J section as is and
strike Grandfather clause from Ordinance 8 as of March 1, 1973 if legally ""'-
possible and, if this item needs more work, would like the township '\
attorney present. Seconded by Jones. Carried unanimously.
Holasek handed out copies of Coon Rapids snowllIobile ordinance for
study before next regular meeting.
Clendening makes a motion to adjourn. Seconded by Jones at 8140 P.M.

SUBJECT. REWORDING OF ORDINANCE 8 TO COVER THE CHAPMAN SUBDIVISION
GENTLEMEN.
The following is submitted for your consideration.
(1) CommisSion feels re1(ording of R-J section of ordinance is not
permanent enough.
(2) Commission feels it needs legal c.unsel, to deal with changing
said ordinance further.
(3) Commission feels if legally possible it i. tiae to strike
Grandfather clause from ordinance.
Clendening made a .otion t. r.c....nd that the Town Board of Supervisors
strike the Grandfather clause from Ordinance 8 aa of March 1. 1973 and
require all future applications on l.ta of rec.rd t. use c the variance
prCDCedure. Seconded by Jones. Carried unaniaously.
(4) COllllission w.uld like Township attorney present if future work
on changing Ordinance 1s necessary.
