Commissioners Present: Mark Arnold, Ken Heil, Art Jaworski, Arleane Nehring, and Ken Orttel Commissioner Absent: Dean Johnson Also Present: from T.K.D.A.; Wally Arntzen, Andover Mayor, Richard Schneider, Rex Stockwell, Engineer Jim Thurston, Building Inspector (arrived at 8:00); Building Official (arrived at 9:45); and others Minutes ~ ~ Motion by Commissioner Heil, seconded by Commissioner Nehring, to accept the Minutes of December 9, 1975 as written. Vote on motion: yes- Jack, Jaworski, Heil, Orttel, Nehring; present - Arnold. Motion carried. Agenda Change of Order Norbert Tempel was not present at this time. Motion by Chairman Jack, seconded by Commissioner Heil, to place Agenda item #1 - Norbert Tempel - at the last of the Agenda in the event Mr. Tempel arrives late. Motion carried unanimously. Ed Fields Preliminary Plat Public Hearing (Comm. #10-75-1) \ \J Ed Fields and Rick Foste~ of John Oliver and Associates, presented the Preliminary Plat of Fields' Addition. A Variance is requested because Lot #1, Lot #2, and Lot #3 don't meet the Zoning width requirement of 300 feet; although, all of the lots meet the 2~ acre minimum requirement. Some of the items discussed were: 1) how much of this land (13.2 acres) is buildable; 2) the water table and how it would affect building; 3) 870' minimum elevation should be set as standard for first floor elevation; 4) width of roadway. 66' is minimum width required but Mr. Fields suggested the road might be widened to allow for future use. It was decided that all of South Coon Creek Drive would have to be widened, not just the portion in front of Fields' Addition. 5) park land dedication or money in lieu of land. Mr. Fields will pay rather than dedicate land. The Commission would suggest the Park Board ask for an easement for building setback so that buildings aren't built too close to the Creek. Planning and Zoning Commission Meeting Minutes - December 23, 1975 Page 2 Rex Stockwell presented a letter from T.K.D.A. dated December 22, 1975 in regard to a 100 year flood study. The reasonable estimate for a 100 year flood along Coon Creek is approximately seven feet above the low water elevation for the Creek. Engineer Stockwell discussed with the Commissioners a letter from T.K.D.A. of 12-17-75 and a letter in response from John Oliver dated 12-19-75 (copies attached). Item #10, Coon Creek Hatershed District review, must be complied with; and, also, item #11, soil borings and percolation tests, has not been done at this time. Motion by Commissioner Arnold that the Public Hearing on Fields' Preliminary Plat be closed. No second. Motion died. Motion by Commissioner Jaworski, seconded by Commissioner Heil, that the Public Hearing for the Preliminary Plat of Fields' Addition be continued until the Planning and Zoning Commission receives Soil Borings information. Amendment by Commissioner Jaworski, seconded by Commissioner Orttel, to include in the motion Engineer's comments on the Soil Borings, Park Board review and the Coon Creek Hatershed District review. Motion and amendment carried unanimously. This will be the first item of business on the Agenda of January 13, 1976. Parking Ordinance (Comm. #10-75-5) This proposed ordinance is referred back to the Planning and Zoning Commission from the City Council for further review and revision. The Commissioners received copy of a letter from Attorney William G. Hawkins dated 11-12-75 (copy attached) with his comments and ideas on the proposed ordinance. The Commissioners discussed Attorney Hawkins comments, the amount of snowfall to require vehicle removal, and Ordinance 8 covering truck parking. Motion by Commissioner Orttel, seconded by Commissioner Arnold, that the Planning and Zoning Commission amend the proposed parking Ordinance as per the Attorney's recommendations; under #1 of his letter to add to snowfall "1 inch or more", and 1f2 of his letter to replace that portion of Section 8 to read as he suggests; delete the wording in Section 4 of the proposed Ordinance and replace with "with reference to trucks see Ordinance 8.08 Section C 3 & 4; and we resubmit this to the City Council for their action. Motion carried unanimously. Planning and Zoning Commission Meeting Minutes - December 23, 1975 Page 3 Proposed Private Sanitary Sewer Ordinance (Comm. #11-75-3) Commissioners received a copy of a letter (copy attached) from Roger E. Machmeier, Extension Agricultural Engineer, which W$ sent to Hally Arntzen regarding Septic Maintenance. The Commissioners again discussed the maintenance portion of the Proposed Ordinance. Mr. Arntzen explained to the Commission how septic systems work and/or fail. He stated that there should be a regular, mandatory, monitored, maintenance program for septic systems and this proposed ordinance, as is, is his feeling on that matter. The Commission and Mr. Arntzen discussed 1) septic inspections _ how they are done, who can do them, how often they should be inspected, 2) pumping - how often it should be done, why pumping is necessary, 3) enforcing the ordinance, 4) penalizing people who maintain their systems by adopting this ordinance,S) sending out informational letters to home owners regarding inspections and maintenance, and 6) asking Ham Lake for a copy of their proposed Septic Ordinance. Motion by Commissioner Arnold, seconded by Commissioner Jaworski, that the Planning and Zoning Commission recommend to the City Council approval of the proposed Private Sanitary Sewer Ordinance with the following modifications: page 20 - Section 7A to be reworded as follows: each owner of property containing an existing sewage disposal system shall, within 24 months from and after the date of adoption of this ordinance and during each subsequent 24 month period, perform one of the following: #1 forward to the City, on prescribed forms, varification that said system has been pumped. #2 forward to the City an affidavit, signed by the Building Official or other designated representative, indicating that an inspection of such system has resulted in a deter- mination that pumping is unnecessary. A reasonable fee for such service shall be established by the City and charged to the individual requesting such inspection. #3 The City shall supply the appropriate forms. (This will be a substitute for Section 7A and 7B.) Mr. Arntzen stated the Commission should take another look at #2 because the City could have problems and perhaps be liable for septic failures after an inspection. Vote on motion: yes - Chairman Jack; no - Commissioner Jaworski, Commissioner Hei1, Commissioner Orttel, Commissioner Nehring, Commissioner Arnold. Motion defeated. Planning and Zoning Commission Meeting Minutes - December 23, 1975 Page 4 Motion by Commissioner Heil, seconded by Commissioner Jaworski, to continue this to the next meeting. Motion carried unanimously. Norbert Tempel - Lot Size Review (Comm. #12-75-3) Norbert Tempel presented a legal description, which was requested at the December 9th Planning and Zoning meeting, of the lot created by the Andover City Sewer Project. Motion by Commissioner Heil, seconded by Commissioner Jaworski, that the Planning and Zoning Commission recommend that the City Council waive platting by adoption of resolution as parcel was created by City Action - Sewer Project 75-1 - siting as set forth in Ordinance lOA Section 14.01 last paragraph. The '"l1owing are our comments regarding the proposed plat: \ ) South Coon Creek Drive has been designated as a Municipal State Aid Roadway within the urban planning area. The M. S. A. H. System within the urban planning area requires a right-of-way, width of 66 feet. The existing 661 right-of-way will be adequate for the future planned thoroughfare. 2. During di'lcussion of the sketch plan for the proposed plat the developer indicated that a realignment of the existing roadway right..of-way may be appropriate. There is no indication of this realignment on the Preliminary Plat. 3. The required lot width for R-l Zoning is 330 feet. Lots 1, 2, and 3 as pro- posed do not meet this requirement. The developer has requested a variance for lot width for the three lots. 4. The Preliminary Plat should indicate the total acreage to the nearest O. I acre within the plat excluding public lands. (8,02-b) 5. The location, width and lype of surfacing of the existing street should be indicated. The Preliminary Plat should indicate the surface drainage will be natu ral overland drainage. (8.03-h) -I. The Commission and Park Board must review park land or free dedication. . 'I, The proposed plat is located between South Coon Creek Drive and Coon Creek. A portion of the area is located with the flood plains of Coon Creek. Thl' elevated area fronting on South Coon Creek Drive will be adequate for j"csidential development as indicated in the "Inventory and Evaluation" pre- pared by the Anoka County Soil Conservation Service. We have contacted the SCS and Coon Creek Watershed District. The Coon Creek Watershed Engineer '-las indicated that the Board would like to review all proposed plats included lD the flood management area directly with the developer. '\ , ) II. Soil boring and precolation tests will be required for the proposed plat prior to plat approval. The location of these borings will be selected by the Engineer after field inspection of the site. We will review this letter with the Planning and Zoning Commission at the Decelnber 23, j 975 meeting. I. : . j'j,.:i :. j 1 December 19, 1975 Andover Planning & Zoning Commission Andover, Mn. 55303 Re: Proposed FIELDS' ADDITION Gentlemen: In response to the letter of December 17, 1975, from Mr. Rex Stockwell of TKDA regarding said plat, I have the following comments: 1. Requires no comment. , ) '- ./~ 2. When the Anoka County Surveyors Office first drew the half-section map for this area, they did so from an aerial photograph. At that time, the Township Road veered northerly before turning southwesterly, thus forming a "hump" in the alignment. Shortly after the half section was drawn, Grow Township straightened out this "hump" resulting in the existing alignment as shown on our preliminary plat. Shortly after the sketch plan meeting with the Planning Commission, Mr. Fields and I noticed that the "hump" was gone. After being informed of this, ~r. R. W. Anderson, Anoka County Surveyor, checked more recent photos and told me that he would up-date the half-section sheet so it would reflect the present alignment. The only realignment discussed at the Planning Commission meeting for the sketch plan was to eliminate this hump. Since this had already been accomplished, no other alignment changes are contemplated or expected. 3. I believe Mr. Fields filed the application for this variance several weeks ago. 4. The area excluding roads is 12.74 acres, more or less. I have added this on the drawing after the legal description. 5. Basically, the septic tank sepnrates the slljidf, from the liquids. Some solids float to the surface and remain in the fln:1ting scum layer while others settle to the bottom of the tank and acCUmUliJle,ll the sludge layer. During bacterial activity some of the solids do chnn;;'2 in density and move from the scum layer to the sludge layer or vice vcrs;]. I certainly agree that maintenance of a septic tank by periodic removal of the solids is highly desirable. It is also desirable that the home owner provide such maintenance on a voluntary basis because he understands its !rllllortance.
