Comm. #11-75-2 Obscenity Ordinance \ j Publish: December 5, 1975 , ) / f ) ,- ~ \,-/ CITY 01 ANDOVER " ) "\ REGULAR PLANNING AND ZONING COMMISSION MEETING , ,/ December 9, 1975 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:40 P.M. by Chairman Dave Jack, on December 9, 1975, at the Andover Community. Center, 1685 Crosstown Boulevard NH, Anoka, Minnesota 55303. Commissioners Present: Ken Heil, Art Jaworski, Dean Johnson, Arleane Nehring, and Ken Orttel Commissioner Absent: Mark Arnold Also Present: Rex Stockwell, Engineer from T.K.D.A.; Norman Herner, City Administrator; and others Minutes Chairman Jack read a portion of a letter from Mark Arnold, who was absent, in regard to the Minutes of November 25, 1975. Commissioner Arnold wrote that in the last paragraph of page 1, he didn't say "Building Official"; and, also, disagreed with paragraph 1, page 2, that the Public Hearing had been closed. The Commissioners concurred that the Minutes were acceptable as written. Motion by Commissioner Orttel, seconded by Commissioner Jaworski, to accept the Minutes of November 25, 1975, as printed. Motion carried unanimously. Audette Preliminary Plat (Comm. #9-75-1) Rex Stockwell presented a letter from T.K.D.A. dated December 9, 1975 (Copy attached). Mr. Stockwell reviewed the letter with the Commission and stated that all the requirements have been fulfilled and no additional information will be required from an Engineering standpoint. The Commissioners discussed the Variance request and, after Jack Audette explained more fully why the Variance was needed, agreed that everything has been taken care of in this regard. Some kind of a legal transfer of land should be made to create the new Hest boundary of the plat. Motion by Commissioner Orttel, seconded by Commissioner Heil, that the Andover Planning and Zoning Commission recommend the Preliminary Plat of the Audette Brothers to the City Council because it meets the requirements of Ordinance 10 and IDA. Note: that there should be some formal evidence of the property being transferred for the new Hest boundary of the Plat. Motion carried unanimously. This plat will be on the City Council Agenda for January 6, 1976. , , ) Planning and Zoning Commission Meeting Minutes - December 9, 1975 Page 2 Ransom Moving Permit (Comm. #12-75-1) The Commissioners looked over the request of Mrs. Gladys Ransom to move a garage from the New Brighton area to her home at 4640 - l65th Avenue NH. They examined the pictures she had provided and reviewed Ordinance 8 - Section 4.11 in regard to relocated structures. Mrs. Ransom stated that she plans to put cattle in the building now and James E. Thurston, Building Inspector, had looked over the site and had approved it. J Motion by Commissioner Jaworski, seconded by Commissioner Heil, that the Andover Planning and Zoning Commission recommend that the Andover City Council approve the garage moving permit of Mrs. Gladys Ransom as required under Ordinance 8 - Section 4.11, stating the following facts: 1) The provisions of Andover Moving Ordinance #4 will be waived being the structure will not be moved on any City streets per the Building Official, Walter L. Arntzen. 2) Pictures of the structure have been viewed and are agreeable. 3) The building will be moved onto an 11 plus acre site. 4) The building shall be used for Agricultural purposes. Motion carried unanimously. Since she would like to use the building as soon as possible, she was advised to go to Mr. Werner, City Administrator, and ask to be put on the next (December 16) City Council Agenda. This item would normally go on the first Tuesday meeting (January 6, 1976) Agenda of the City Council. Lawrence B. Carlson Sketch Plan (Comm. #12-75-2) Mr. Carlson presented 2 Sketch Plam for property (15+ acres) located at Valley Drive and Tulip Street. He would prefer using Plan #1, which has more lots but, if the Commission wished, Plan #2 would be satisfactory to him. Mr. Carlson was not aware of the fact that this property is zoned R-1. The Commission also brought to his attention page 168 of the Community Development Plan, which shows the south line of the property as a proposed "collector" street. The Engineers had previously proposed Tulip Street as a "Minnesota State Aid Highway". The County is requesting a 75' road easement for County Road No. 58. The Commission and Mr. Carlson discussed all the "proposed" roads. Direction was given to contact the County Engineer to find out what their future plans are for County Road No. 58. The Commission covered all the criteria for the Sketch Plan Stage. ..!' . , . . f ~ " .-.'1' ; , Planning and Zoning Commission Meeting Minutes - December 9, 1975 Pa ge 3 Norbert Tempel - Lot Size Review (Comm. #12-75-3) The City, by the action of putting in the City Sanitary Sewer, has created a buildable, but unplatted, lot which is owned by Mr. Tempel. The lot has 140' of lake frontage and is 300' in depth. Mr. Tempel wishes to sell it as one lot and is now having it surveyed. Chairman Jack would like this item on the next Planning and Zoning Agenda with the legal description provided. Private Sanitary Sewer Ordinance (Comm. #11-75-3) The Commissioners had previously received a letter (Copy attached) from T.K.D.A. dated 12-5-75. Items discussed include the following: 1) licensing of pumpers, 2) pumping requirements, 3) when and how often a system should be pumped, 4) manhole covers, 5) State Health Specifications, 6) Board of Appeals, 7) unfairness of making this Ordinance (Judy Berry), and 8) page 27 - B. 2. permits. The Commission recommended the following change: Page 25 -Section D. Item 1. - to add "with reasonable notification" to the end of the sentence. Motion by Commissioner Ortte1, seconded by Commissioner Jaworski, to carry this item, the Proposed Private Sanitary Sewer Ordinance, to the next agenda and have, at that time or prior to that time, a State Ordinance or information as pertaining to septic systems. Amendment by Chairman Jack, seconded by Commissioner Johnson, to request Halter L. Arntzen, the Building Official, to be at the next meeting. Motion and amendment carried unanimously. Obscenity Ordinance (Comm. #11-75-2) Judy Berry was given copies of ~he letters from City Attorney, William G. Hawkins (copies attached). Mrs. Berry and the Commissioners discussed various aspects of this item. Mrs. Berry appears to be primarily concerned with 'magazines with objectionable covers displayed where children might see them". The Commission and the letter from Mr. Hawkins advised her of the Minnesota Statute regulating this. Motion by Commissioner Jaworski, seconded by Commissioner Nehring, that the Andover Planning and Zoning Commission take no action on the Obscenity Ordinance at this time, noting that we do not have the problem at this time and our Attorney has stated in his letters of December 2, 1975 and December 5, 1975 that it would be unenforceable. Motion carried unanimously. Planning and Zoning Commission Meeting Minutes - December 9, 1975 Page 4 Commissioner Jaworski, Chairman Jack, and City Administrator Herner each "commended" Mrs. Berry for her beliefs and for bringing this to the City's attention. (012) 421-15llH December 5, 1975 Deloris Hanson Planning and Zoning Commission Clerk Andover City Hall 1685 Crosstown Blvd Anoka, Mn 55303 Re: Obscenity Ordinance Dear Deloris: \ _/ Pursuant to our telephone conversation of December 4, 1975, regarding my previous letter concerning distribution of obscene materials, it is my understanding that the Planning and Zoning Commission is also taking under consideration the adoption of an ordinance regulating the distribution and exhibition of obscene material to adults. As I am sure many of the Planning and Zoning Commission members are aware, this has been an area in the recent past which has been the subject of much litigation. A number of municipalities in the Twin City area have attempted to regulate the same situation and have met with little or no success. The U. S. Supreme Court in a recent decision struck down an obscenity ordinance as being vague and overly restrictive but stated that it may possibly uphold future ordinances based upon a community standard of conduct. It did not, specifically delineate what the community was to take into account in establishing these types of restrictions. While the U. S. Supreme Court did not completely eliminate the power of the municipality to regulate this area, it has indeed made this a nebulous area at best. Therefore, although the City of Andover may choose to adopt this type of an ordinance, it may encounter numerous problems in enforcing same against the adult population of the community. I assume that this request is in response to the citizen who raised the issue of her children being exposed to possible obscene literature in the community. Therefore, I am treating this matter as regulating the dissemination and distribution of obscene materials to minors. The Minnesota Legislat4re has already adopted regulations governing this situation. I have enclosed a copy of the statute which makes it a gross misdemeanor to involve minors in the sale and distribution of such materials. It is my belief that this state statute which is in force in the City of Andover should cover the situation raised.
