MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:35 P.M. by Chairman Dave Jack, on November 25,
1975, at the Andover Community Center, 1685 Crosstown Boulevard NW,
Anoka, Minnesota 55303.
Commissioners Present: Mark Arnold, Ken Hei1, Art Jaworski, Dean
Johnson (Arrived at 8 P.M.), Arleane Nehring, and Ken Orttel
Also Present: Rex Stockwell of T.K.D.A., and others

Motion by Commissioner Hei1, seconded by Commissioner Jaworski, to
accept the Minutes of October 28 as printed. Vote on motion: yes-
Chairman Jack, Commissioner Jaworski, Commissioner Heil, Commissioner
Orttel; present - Commissioner Nehring and Commissioner Arnold.

O'Briens Acres Preliminary Plat (Comm. #7-75-3)
The Commissioners were given revised maps of the Preliminary Plat.
Mr. Stockwell referred to his previous Engineer's report and stated
everything has been complied with except the Park Land dedication fee.
O'Brien's presented soil borings information for the Engineer to review.
Paul Ruud from the County Highway Department has agreed to two of the
lots having a common driveway.
Mr. Stockwell gave the Commissioners a letter from T.K.D.A. (Copy
attached) dated November 24, 1975. The two items requested have been
completed. Mr. Stockwell will look over the soil boring information
and discuss it with Wally Arntzen, Building Official.
Motion by Commissioner Orttel, seconded by Commissioner Arnold, to
close the Public Hearing. Motion carried unanimously.
Motion by Commissioner Arnold, seconded by Commissioner Orttel, that
the Planning and Zoning Commission recommend approval of the Preliminary
Plat for O'Brien's Acres based on the fact that the Plat as submitted
meets all requirements of Ordinance 10 and lOA. Amendment by Commissioner
Arnold, seconded by Commissioner Orttel, that final approval is subject
to the soil borings being accepted by the City Engineer and the Building
Official. Motion and amendment carried unanimously.

Audette Public Hearing and Variance Request (Comm. #9-75-1)
Lawrence J. and Jack Audette presented their Preliminary Plat. The
Variance is to correct a previous surveying error. The drainfield for
the present house is on the setback. The Commission agreed that their
recommendation to the City Council should state that the present house
plot should not be included in determining the park land dedication
fee. Since the Engineer didn't receive copies of the Preliminary Plat
and will need time to study it, further discussion will have to be
delayed. Motion by Commissioner Heil, seconded by Commissioner Arnold,
to close the Public Hearing. Motion carried unanimously. Motion by
Commissioner Jaworski, seconded by Commissioner Heil, to delay action
on the Plat until the next meeting, December 9, to give the Engineer
time to review and make a report on it. Motion carried unanimously.
Robert Pears (Bob's Auto) Variance (Comm. #11-75-1)
The Variance request has been withdrawn because the problem was corrected.
Obscene Literature Ordinance Proposal (Comm. #11-75-2)
Judy Berry told the Commission her reasons for requesting this type
of Ordinance. They think that if there is a need for this Ordinance
now that it should perhaps be changed to also include movies, etc.,
rather than just "literature". Motion by Commissioner Orttel, seconded
by Commissioner Arnold, to refer this (the Obscenity Ordinance) to the
City Staff and William Hawkins, City Attorney, for research, review,
opinions, comments, and information. Motion carried unanimously. This
will be on the Agenda for the next meeting.
Private Sanitary Sewer Ordinance (Comm. #11-75-3)
The Commissioners were given copies of a proposed Ordinance prepared
by T.K.D.A. Motion by Commissioner Heil, seconded by Commissioner Nehring,
to carry this to the next meeting and have Mr. Werner, Wally Arntzen,
Darrel Berkowitz, and/or a representative from T.K.D.A. present to
assist and explain the Ordinance. Motion carried unanimously. The
Commission would like the "Maintenance" portion on pages 20 and 21
revised before the next meeting. They disagreed with the yearly
pumping and inspection requirements proposed, in particular.

We have reviewed the above referenced plat as revised
October 29, 1975. Upon review of the revised plat, two
important items were noticed and reviewed with the surveyor of the plat for
further revision or investigation. These items include:

Additional county right-of-way dedication for a half width of 75 feet.
Further subdivision planning with a future proposed street from
County Road #58 to Quay Street N. W. on the north edge of Lots 2
and 3.
Upon completion of these two items the preliminary plat will conform to
all the engineering and design standards of the City of Andover. All
requirements of Ordinances 10 and lOA will have been complied with.
