MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission
W~6 callev to order at 7:35 P.M. by Chairman, Dave Jack, on August
12, 1975 at the Andover Conwlunity Center, 1685 Crosstown Boulevard

July 28 Minutes - Addition (Per request from Dean Johnson): Comments
and reasons for Dean Johnson's negative vote on Ogema Estate Preliminary
Plat are as follo~~s: 1) Doesn't relate to the Conlprehensive Plan.
2) Plat is very premature for the area. 3) General layout is a
hodgepodge. 4) Too many variances are needed. 5) Would be a detriment.
6) Would be disastrous. 7) Premature development creating problems
for future services. 8) Wouldn't be orderly growth.
Motion by JOhnson, seconded by Jaworski, to table the Minutes of July
28. Motion carried unanimously.
July 22 Minutes - Motion by Johnson, seconded by Jaworski, to accept
the July 22 Minutes as written. Motion carried unanimously.
O'Brien Variance (Comm. #7-JJ-31
Mr. and Mrs. Robert O'Brien presented their Variance Request, per
attached. The Commission advised the O'Briens that a Variance isn't
needed and if they ~li5h to redivide and sell these lots, they will
have to have the property platted. Motion by Jaworski, seconded by
Johnson, to table this Variance Request indefinitely. Motion carried
unanimously.
Kiowa Variance (Comm. #8-75-1)

The Commission received a letter from Walter L. Arntzen, Building
Official, regarding a Variance Request (Refer attached copy). Mr.
Arntzen explained the error that was made. Motion by Johnson, seconded
by Jaworski, that the Planning and Zoning Commission recommend the
City Council grant the Kiol~a Variance since it was a City Employee
who made an honest error. Motion carried unanimously.

At your request on July 26, 1975, we drilled a total
of nine (9) soils borings by means of a six (6) inch hand
auger and a six (6) inch power auger on the above subject
property. The soils encountered were visually classified
by our Technician at the time of the boring. The holes
were checked for water level on July 28, 1975.

28, 1975. The percolation rates were determined to be as

All of these percolation rates exceed the m1nlrnUm require-
ments for construction of an individual sewage disposal
system as specified by the Minnesota Department of Health.

Enclosed please find three copies of a location map
showing tho appr.oximate location of these test holos and
percolation tests.
A minimum of 4 feet must be provided between the
bottom of the seepage bed of an onsite disposal system
and the water table and a minimum of 4 feet must be pro-
vided between the basement floor and the water table.
Considering the above, we recommend that these lots with
a high water level be investigated more completely when
definite house locations are established.

Cedar Crest 4th (Comrn. gS-75-2)
Horace }myo, of Mayban, presented the new Cedar Crest 4th Plat to
the Commission. This is the bottom ~ of the old Cedar Cregt 4th
Plat that was approved by the Town Board in May, 1974. The top ~
of the Plat will be presented as Cedar Crest 5th. Mr. Mayo was
advised to go to the City Engineer to get his help in meeting all
the platting requirements for a Public Hearing on August 26.
Escrow Ordinance (Carom. #8-75-3)
Motion by Jaworski, seconded by Heil, that the Planning and Zoning
Commission recommends the City Council adopt the Escrow Ordinance
as submitted, per attached. Motion carried unanimously.
Weed Ordinance (Carom. #7-75-4)
The Commissioners reviewed a model Heed Ordinance. Mr. Jalvorski
stated he felt this model wasn't suitable for Andover. The Commission
directed the Clerk to ask the League of Municipalities for Weed
or Nuisance: Ordinances from other municipalities and also to request
the source of the materials already presented. Andover needs a
simpler fonl of Ordinance. This will be on the agenda for the
next regularly scheduled meeting.
Review of Ordinance lOB (Comm. #4-75-3)
The Commission discussed the "Park Section" they had received frOI:l
T.K.D.A. It was felt that it should be clarified in regard to park
dedication and market value. The Commission speculated that the
City should adopt a street standard and have the urban are~ be
Class 5 and the rural areas all be tarred. This would be very
practical because the roads would be easier to maintain in the
rural area and in the urban areas the utilities, etc., could be
installed without t-Irecking the blacktop. Re:: Stockwell, City
Engineer, suggested the word "Lanes" be removed from Page 15 -
lO.OSD - Street Improvement Standards. Motion by Orttel, seconded
by Heil, to table Ordinance lOB until the next meeting for review
by Park Board and clarification of comments on park dedication.
Motion carried unanimously. Motion by Johnson, seconded by Jaworski,
to bring back the item previously tabled. }wtion carried unanimously.
Mr. Stockwell asked the Commission if they wanted the Stret)t Standards
attached to. the Ordinance. He was advised to write a letter to
the City Council suggesting they adopt a street standard. Motion
by Johnson, seconded by Jawerski, that the Engineer pursue the street
problems by our next meeting and draft a paragraph inserting these
into Ordinance lOB and also review the street standard sec~ion for
the whole City to make everything cOI:lpatible. Motion carried unanimously.
Motion by H~il, seconded by Orttel, to table the review of Ordinance
lOB until A~gust 26. Motion carried unanimously.

Motion by Johnson, seconded by Heil, to direct Chairman Jack to
attend the next City Council meeting and see what they thi:'lk about
having a joint meeting to discuss the Comprehensive Plan. Motion
carried unanimously.

Motion by Jaworski, seconded by Heil. that the meeting adjourn.
Motion carried unanimously.

SUBJECT: VARIANCE - 15840 - 159th Avenue N. W.
This office is sued a Building Permit for construction of a home at the
above address. After construction was substantially in progress it
was noted that the structure did not comply with the square footage
requirements for R-2 Zoning as stated on Page 9, Zoning District
Classification, Ordinance No.8. The over-sight was on the part
of this office as a result of improper indentification of the area on
the Zoning Map that was used at the time the permit was issued.

/ After consulting with the City Attorney, I have been advised that
inasmuch as the error was on the part of the City, with no intent
to vary by the applicant, that it is the responsibility of the City
to process the proper variance. allowing completion of the dwelling.

STATE OF MINNESOTA
AN ORDINANCE TO PROVIDE FOR THE REIMBURSEMENT OF CONSULTANT
FEES ASSOCIATED WITH DEVELOP~ffiNTS OR PROPOSED DEVELOP}ffiNTS.
THE ANDOVER CITY COUNCIL DOES HEREBY ORDAIN:
D~FINITIONS:
(3) "Owner" means any person, firm or corporation.
(b) "Consultant Fees" means any charges billed to the City of
Andover for services performed by the Andover planner, engineer,
and attorney; exclusive of services performed as part of the

consultants' normal retainer or by special agreement between
the City of Andover and its consultants.
(c) "D2velopment" means any rezoning, subdivision, special use
permit, variance, building addition, or change in site plan;
o~ proposed rezoning, subdivision, special use permit, variance,
building addition, or change in site plan.
ESTABLISHMEI~r OF FEES. Any owner that causes the City of Andover to expend
monies for consultant fees on behalf of, or on account of, that owner,
associated ~dth a development or proposed development, shall reimburse
tpc City of Andover for the actual consultant fees expended by the City
on behalf, or on account of, said owner.
ESCROW FUND. The owner shall deposit with the City of Andover an amount,
as determined by the City Council, necessary to cover the total consultant
services as~ociated with the development or proposed development prior to
the performance of any such services by Andover's employed consultants.
However, if a development or proposed development and the related consultant
review is anticipated to span a period of time in excess of ninety (90)
days, the olmer will only be expected to deposit a sum, as determined by
the City Council, necessary for the City to pay consultant fees for ninety
(90) days. The owner will then be expected to maintain the escrow fund at
a balance eaual to one-third (1/3) of the original amount deposited.

The City of Andover will from time to timc providc an itemized
statement to the owner showing him the City expenditures for consultant
services associated with his development together with the current
balance in his escrow fund. This statement will be provided if additional
funds are required to maintain the established level.
The owner shall reimburse the escrow fund for any deficits caused
if the amount actually expended or billed to the City excee~s the escrow
balance.
The City of Andover shall refund any monies deposited in the escrow
fund not expcnded for consultant fees within thirty (30) days after
completion of a consultant's services associated with the development or
proposed development.
The City of Andover shall not pay interest on the monies deposited
in the escrow fund.
PENALTY. Any persons violating any provisi.on of this ordin3nce shall
be guilty of'a misdemeanor, and upon conviction thereof shall be punished
be a fine of not more than three hundred dollars ($300.00) or sholl bc
imprisoned for a period of time not to exceed ninety (90) days or both,
plus the costs of prosecution in either case.
This Ordinance shall be in full force and effect from and after its
adoption and publication according to law.
