HomeMy WebLinkAboutJuly 28, 1975 : ) \ ) '\ / \ / CITY 01 ANDOVER SPECIAL PLANNING AND ZONING COMMISSION MEETING \ / July 28, 1975 MINUTES The Special Meeting of the Andover Planning and Zoning Commission was called to order at 7:35 P.M. by Chairman, Dave Jack. on July 28, 1975, at the Andover Community Center. 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Commissioners Absent: Arnold, Jack, Jaworski. Johnson and Ortte1 Heil & Nehring O~ema Estates - Ron Smith (Comm. #3-75-2) The Commissioners received the Variance Request of Mr. Smith and copies of a letter from Suburban Engineers, Inc. regarding the Soil C:or('e.cJ ed. Borings and Percolation Tests requested at the last Planning and Zoning Meeting. The information requested from the City Attorney, Bill Hawkins, concerning the Cemetery was not available. Since it has been excepted on the Preliminary Plat and the legal report hasn't been presented, it was decided to disregard the Cemetery. Inc.. reviewed by the City Engineer, with a view toward designating those lots which would be unbui1dab1e so that this information can be recorded on the Preliminary Plat. No second. Motion denied. The Commissioners discussed the Variance request, particularly in relation to Ordinance 10, Section 17, 17.01. Motion by Arnold that the Planning and Zoning Commission recommend to the City Council the approval of the Plat for Ogema Estates as submitted by Mr. Ronald Smith for the following reasons: 1) The 2\ acre lot requirement has been met. 2) Hardships upon the land including the County's request that modifications to County Road 7 be provided for, as well as previous platting of land to the West of this addition have created hardships on the land which the developer has made an effort to compensate for in designing the Plat. 3) The Commission is in conjunction with this motion requesting that the City Engineer designate those lots which are unbui1dable at this point in time based on the soil data provided by Suburban Engeering. It meets the 2~ acre minimum lot size requirement for Ordinance 8, Section 6.02. 2. All additional information requested by the Commission has been supplied in good faith. 3. The legal question of the Cemetery should be determined as a separate entity to this platting. ~. All unbui1dab1e lots, as determined by the City Engineer, Roger Anderson of T.K.D.A., be made a permanent record on the Preliminary Plat and so noted. 5. This Plat meets all of Ordinance 10 & lOA, Section 8 and 9. 6. Variance procedure, as stated in 17.01 of Ordinance 10, have been applied for and arc noted on the Preliminary Flat in the form of lot widths, totaling 24 of 36 platted lots. 7. The Variances requested, as provided for in Ordinance 10, Section l7~Ol, seem to be legitimate in that a hardship has been placed on this land in that: 1) Previous Rezoning on the Stenquest Addition to 1 acre lots, thus creating difficulties in the planning of streets. 2) County right-of-tv.::lY requirements on the NE corner of the Plat for the possible rerouting of County Road 7. The developer has made every effort t}ithin the frm;lcllor:: of the City Ordin311ces and the ccononics of the development of this piece of prope=ty to accomodate the requests of the Planning and Zoning Commission and the City Engineer with regard to the Preliminary Plat. The Commissioners discussed the Motion. Amendment by Arnold, seconded by Orttel, to eliminate the last paragraph of the Hotion. Vote on J..rnendment - unanir.:ous yes. Amendoent approved. Vote on Motion: yes - Arnold, Orttel, Jaworski, Jack; no - Johnson. Motion carried. Cost of this Special Meeting will be a3sessed to Mr. Smith.
