REGULAR PLANNING AND ZONING COMMISSION MEETING
APRIL 29, 1975
MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission Meeting was
called to order by Chairman, Allan Miles, April 29, 1975, 7:30 P.M., at the
Andover Community Center, 1685 Crosstown Blvd. N. W., Anoka, Minnesota.
Commissioners Present: Jaworski, Johnson, Jack, and Heil
Commissioners Absent : None
Also Present: Appointed Commissioners to take office May 1, Arlene Nehring,
Mark Ar no ld, and Kenneth Orttel.
Chairman Miles introduced the newly appointed ,:::::ommissioners, and furnished them
with City Ordinances.
Chairman Miles noted that this would be his last meeting as a Commissioner and
Commission Chairman, and requested that the duties of this meeting be shared with
the incoming Chairman, David Jack.

Approval of Minutes
MOTION by Johnson, seconded by Miles, that the Minutes of April 8, 1975, be
approved as written. Motion carried unanimously.
Metropolitan Council Correspondence
Chairman Miles read a letter from John Boland of the Council, and requested that
copies be furnished to the Commission. It was also noted that a Public Hearing
held by the D. N. R. was coming up on May 5 in St. Paul. The Commission Members
were urged to attend.
Faddler's Fifth Addition (Comm. #11-74-1)
The Public Hearing on the Preliminary Plat of Faddler's Fifth Addition was reconvened.
Acting Chairman, Jack read comments received from T. K. D. A. in full, and noted that
Roger Anderson of T. K. D. A. was in attendance. General discussion ensued on
drainage and future traffic patterns, and the three different-types of v'ariances; with
Jaworski questioning the inclusion of three double frontage lots and three lots
requiring width variances. Commissioners Miles, Jack, and Johnson felt that
'\ these variances would not circumvent the Platting Ordinance.

/ Faddler' s Fifth Addition (Continued)
Commissioner Jack stated that he was not sure what the Commission action would
be until the City Council and the Developer worked out a solution to the different
road problems. Chairman Miles felt that three items should be resolved, ie,
1) Mr. Faddler should have some assurance that the Council would react favorably
to these variance requests, 2) the Planning and Zoning Commission should write
to the City Council on the problem of l69th Avenue and l69th Lane, 3) should the
Developer or the City be required to up-date l69th and 1 70th in Sylvester's Addition
for drainage, etc., Mr. Faddler, or Mr. Winner would be available at the Council
Meeting on May 20th for a short discussion on these matters. Engineer Anderson
agreed to put alternatives in writing for the Planning and Zoning Commission and
the City Council, with regard to the roads. MOTION by Miles, seconded by
Johnson, that the Public Hearing on Faddler' s Fifth Addition, Preliminary Plat,
be continued. Motion carried unanimously. Commissioner Jaworski emphasized
that the City Council must bear in mind the setting of a precedence in granting
so many variances, even if they are not serious.
D. R. Conger Variance (Comm. #4-75-1)
Mr. Conger explained the need for the variance, and noted they would be using the
, building for hay and equipment storage. After some discussion, Acting Chairman

)Jack, read a letter from Walter L. Arnzen, City Building Official, recommending
denial of the variance (Congers were furnished a copy). Acting Chairman Jack
advised the applicants of the legal problems they faced in conveying the 2 1/2 acre
parcel back to the 7 1/2 acres outstanding, thus making a 10 acre parcel. He
noted that this would have to be done by the Conger's own attorney.
Commissioner Miles took exception to Mr. Arntzen's reference to Ordinance 8,
Section 8.20 (Use of sheet metal). MOTION by Johnson, seconded by
to table the Variance Request for one month, thus giving the Congers time to
clear-up some of the items. Vote: Yes - Johnson, Jack, Jaworski, Miles;
Abstain - Heil.
The Oaks - Preliminary Plat (Comm. #6-74-5)
Acting Commissioner Jack called a Public Hearing for the Preliminary Plat of
The Oaks for Mr. & Mrs. Gerald Windschitl. Engineer Anderson read his comments
on the Plat. Item, to be corrected or changed wasc the extension of Partridge Street
70 feet further south. After full discussion, it was agreed that Mr. Windschitl
shall provide road and utility easements only to the property line. All other items
were met, with the exception of l-C on the soils report. Mr. Windschitl furnished
Engineer Anderson with additional information, however, time would be needed to
evaluate the reports :from the Soils and Materials Engineers. Mr. Windschitl
"agreed to the requirements of blacktop streets; but stated that the ordinance seems
/to be superceded by the Engineer's Standards. The Planning and Zoning Commission
pointed out Section 9.02 in Ordinance 20, which was verified by Engineer Anderson.

MOTION by Jack, seconded by Johnson, that the Planning and Zoning Commission
recommend to the Andover City Council, their approval of the Preliminary Plat,
"The Oaks", of Mr. and Mrs. Gerald Windschitl, subject to additional soil
evaluation by T. K. D. A. Reasons for recom.mendation as follows:
1. The Plat meets all criteria of Andover Platting Ordinances No. 10 and No. lOA.
2. Items included in T. K. D. A. Report, dated April 24, 1975, were discussed
and the Commission agreed that all items were met with the exception of I-C.
3. Patridge Street shall end in a cuI de sac 70 feet short of the property line,
but road and utility easements shall extend to the south property line.
Motion carried unanimously.
Ron Smith Sketch Plan (Comm. #3-75-2)
The Sketch Plan was reviewed by the Commission. It was noted that this was the
former "Hunt" farm on 7th Avenue. Engineer Anderson read his comments on
the Sketch. Discussion ensued on 1) the cemetary located in the proposed platted
area, and 2) park dedication problems (low land). Commissioner Jack noted that
low land was not acceptable to the City at this time, and advised Mr. Smith to meet
,with the Park Advisory Board on this matter. Further discussion was tabled until
, )May 13, 1975.
Platting Procedure (Comm. #4-75-3)
Engineer Anderson noted that he would like written comments on his suggested
platting procedures. Commissioner Miles requested that T. K. D. A. generate
workable changes on any ordinance they may be dealing with in relationship to the
Community Development Plan; said changes to be brought to the Commission for
discussion.

MOTION by Jaworski, seconded by Johnson, that the meeting adjourn. Motion carried
unanimously.

outlet to the major north- south transportation route.
We will review these comments with the Planning and Zoning Commission at the April 29, 1975
meeting.

We have reviewed the following sketch and preliminary plans as requested by the
Planning and Zoning Commission.
) 1) The Oaks - Preliminary Plat
a) The right-of-way for Partridge Street Northwest should be
extended to the southern boundary of the plat. The cul-de-sac
could remain as shown,or be brought to the end of the right-
of-way.
This right-of-way is necessary to allow for development south
of this area. Although this street may not be extended in the
near future, it appears a logical traffic route for future use.
b) The' soil information supplied indicates individual sewage disposal
systems will function satisfactorily in this area.
c) The soil report also indicated that a layer of peat approximately
two feet deep existed which may cause settlement under load. The
loading conditions in this situation include botl-. foundation loads and
proposed street vehicle loads.
We request further testing to determine the bearing capacity of these
soils and to evaluate the suitability of this area for home and street
construction.

d) It would appear that several lots east of Partridge Street North-
west will require fill to make them buildable lots. in which case
a special use permit will be required.
The street grade could be changed from lo/c to . 5o/c to gain additional
material for fill and still meet ordinance requirements.
e) The mean lot depth of Lots 1, 2, 3. Block 1 is less than the required
130 feet for R-4 zoning.
f) The proposed park land dedication is 15o/c of the total land area, and
meets ordinance requirments.

g) The adopted policy for street construction in this area is to require
an urban street section with blacktop surfacing and curb and gutter,
as is shown on the grading plan and street profile.
2. Faddler's Fifth Addition - Preliminary Hat
a) Variances will be required for the following lots:
Lot size variances;
Lot width variances;
Double frontage variances;
Lots 1...3. Block 2
Lots 3. 6, 7. Block 2
Lots 2. 5, 6, 7, Block 2
b) The future re- subdivision plan provides for logical future development.
c} The surface water drainage plan meets the engineering criteria of the
platting 0 rdinance. Ditching and cuI ve rts will be requi red on 170th
Lane Northwest in Sylvester's Addition to avoid water problems in this
area.
d) The following are comments regarding street construction in this area:
1. The Developer will construct to rural street standards ~he
roadways within the platted area. The existence of inter-
connecting streets in Sylvester Addition and the south edge

of the pIal) which does not meet the present City standards,
will cause difficulties in maintenance, traffic, and drainage.
2. The best solution to these problems is construct the streets
to present standards prior to final plat approval. Allowing
the developer to construct the platted streets only will result
in a piecemeal traffic system.
3. We recommeEd that a public hearing be held on the proposed
street construction,with notification to all affected property
owners on 169th Avenue Northwest, 170th Avenue Northwest,
170th Lane Northwest, and Tulip Street Northwest. The City
Council must authorize this public hearing.

4. Street construction costs would be proposed to be assessed against
abutting properties. The estimated cost for rural street con-
struction is $6. 25 per lineal foot
5. The public hearing will provide a means of discussing the street
construction,with all property owners and the City Council taking
part. The Council can then decide the City's course of action.
6. The alternative solution is for the developer to pay the costs of
street upgrading to provide appropriate street construction through-
out the area.
We will discuss this report with the Planning and Zoning Commission at the
April 29, 1975 meeting.
