MINUTES
PLANNING AND ZONING COMMISSION
March 25, 1975
The Regular Meeting of the Andover Planning and Zoning Commission was called
to order by Chairman Allan Miles, on March 25, 1975, 7:38 P. M., at the
Andover Community Center, 1685 Crosstown Boulevard N. W., Anoka, Minnesota.
Members Present: Miles, Jaworski, Jack, Johnson and Heil
Members Absent: None
Approval of Minutes of February 25, 1975
Corrections: Page I - Para. 6 -- Correct to half-street (singular)
Page 2 - Para. 7 -- End sentence #1 after (4-AGR 101-120) Begin
sentence #2 with "The Minnesota Statutes. .. "
Page 3 - para. 4 -- Correct Chairman Miles resignation date to
"May I, 1975"
MOTION by Jack, seconded by Johnson to approve the minutes as corrected.
Motion carried unanimously.
,j Ordinance No. liB
Ordinance No. II, An Ordinance Establishing a Planning and Zoning Commission
and Setting Out the Composition and Duties Thereof, passed April 11, 1972 by the
Grow Township Board of Supervisors, will in essence be amended to establish
two (2) monthly meeting dates. Chairman Miles read parts of his correspondence
to the Andover City Council. (Copy attached to this set of Minutes)
Faddler's Fifth Addition - Public Hearing (Comm. #11-74-1)
Chairman Miles invited comments on the Plat as presented. Correspondence
from the City Engineer, Toltz, King, Duvall, Anderson and Associates, dated
March 25, 1975, was read, and a copy of same furnished to LeRoy Winner.
A step-by-step reviewal of the above correspondence with reference to the Plat
was covered; the following items require a reply from the Engineer, R. Anderson:
I) Item (a) - The reason for this request.
2) Item (b) - Faddler, i. e., LeRoy Winner shall satisfy the engineer on
this.
3) Item (c) - Comments on these lots; do they meet the "scope" of the
ordinance?

After discussion, the Commission resolved that Block 2,
Lots 1,2, and 3 are under 2 1/2 acres. Block 2, Lots 6
and 7 are short on width. Lots 3 and 4 will use frontage
on 169th to attain width.

4) Item (d) - A copy of future resubdivision will be forwarded for
engineer I s comments.

9) Items Nos. 1,2, and 3 must be worked out with Mr. LeRoy Winner
before the April 29 meeting of the Planning and Zoning
Commission, with members receiving copies on this
at least one week prior to the meeting.
Motion by Heil, seconded by Jack, that the Public Hearing on Faddler's Fifth
Addtion be continued until April 29, 1975, 7:30 P. M. Motion carried unanimously.
Donald Wilber - Variance Request (Comm. #2-75-1)
This item was held over from the February 25 Planning and Zoning Commission
Meeting for lack of information. Chairman Miles read correspondence from the
City Attorney, which stated that the subdivision was illegally conveyed after adoption
of a Platting Ordinance by Grow Township.

After a full discussion it was decided that Mr. Wilber was not at fault in the matter.
Two motions were made by Jaworski, however, died for lack of second. (Both motions
required additional information. )
After additional discussion and suggested action, MOTION by Jaworski, seconded
by Heil, that the Planning and Zoning Commission recommend to the Andover City
Council, their approval of the Donald Wilber Variance Request (corrected) on lot
size, said lot being the East 1/2 of Lot 3, Watts' Garden Acres (4.87 Acres), for
the following reas ons:
1) Although the lot was conveyed illegally, Mr. Wilber was not a party
to this, therefore, this is due process.
2) The conveyance was duly recorded by the Register of Deeds, Anoka
County, on January 31, 1973; who apparently would not recognize, or
was not aware of the then Grow Township's Platting Ordinance. (This
conveyance of under five (5) acres also conflicts with State Law.)
3) Taxes have been paid for the past two years by Mr. Wilber.
4) The City should obtain legal advice, and if possible, prosecute
Carl Sorenson - 4615 University Avenue N. E., for the illegal
conveyance under Ordinance No. 10, Section 14.
Motion carried unanimously.

Round Oak Estates - Sketch Plan (Comm. #3-75-1
Chairman Miles read the City Engineer's reviewal and comments in full. Mr. Harstad
concurred with suggestions to alternate road alignments and larger lot sizes.
Mr. Harstad was advised that he could not include the streets in the 2 1/2 acre lots;
and that he could present a resketch or "Preliminary Plat". Chairman Miles
advised Mr. Harstad that platting is costly, and that he should be sure that he
wants to do this before coming in with the "Preliminary Plat".

Commissioner Jaworski noted an item missing was this Sketch Plan. Chairman Miles
explained that it had not been received early enough to be placed on the agenda.
The Commission was asked by Mr. Smith their opinion on the 2551 width of the lots,
when 330' is the minimum. He noted that the lots would all be 2 1/2 acres or more.
Chairman Miles stated that this would be a difficult piece to subdivide; and that he
thought Mr. Smith's efforts were the best yet and met with the spirit of the ordinance.
The Commission concurred with these sentiments. Mr. Smith was instructed to
submit the sketch to the engineer for comments and reappear at the April Meeting.
Upcoming Meetings
April 8, 1975, was set for the date to make the final changes on the Comprehensive
J Development Plan. Date to be posted at the City Hall.

April 17, 1975, was set for a meeting on Shoreland Zoning and indexing.
Discussion was initiated by Chairman Miles on the minutes of the Continued Public
Hearing on the Comprehensive Development Plan. He felt, along with the other
members of the Commission, that they were not complete. Motion by Jaworski,
seconded by Heil, that the last hour of the February 19, 1975 Public Hearing be
enlarged upon by Mrs. Kappelhoff, and be ready for the April 8, 1975 Meeting,
along with the tapes for said meeting. Motion carried unanimously.
Motion by Jack, seconded by Heil to adjourn. Motion carried unanimously.

SUBJECT: PLANNING AND ZONING COMMISSION MEETINGS
RE: YOUR LETTER, DATED MARCH 11, 1975.
In your above referenced letter, you proposed that the Planning and Zoning
Commission change their regularly scheduled meeting to the first Monday
of the month; per a request by the City Council. I would like to submit the
following alternative to this suggestion:
First, the Planning and Zoning Commission schedule two meetings
every month. These meetings could be held on the second and fourth
Tuesday of each month.

Second, the agenda items from the Planning and Zoning Commis sion
meeting held on the second Tuesday, be scheduled for the City Council
Agenda on their first Tuesday meeting of the following month. Also,
the items from the Planning and Zoning Commission meeting held on
the fourth Tuesday be scheduled for the City Council on the third Tuesday
of the following month.
The three-week time lag between items acted on by the Planning and Zoning
Commission and the City Council is required to permit I) agenda items to
be published in the legal newspaper, and 2) allow time for the motions to be
type d and approved by the Planning and Zoning Commission prior to City
Council action.
Any agenda item that has to be refer~ed back to the Planning and Zoning
Commission could be handled at their next scheduled meeting, providing
that the City Council questions, or requests can be prepared in advance of
the Planning and Zoning Meeting.
If the item referred back to the Planning and Zoning Commission requires a
further meeting with the originator of that item, I would suggest that such an
item be scheduled on the Planning and Zoning agenda three weeks after the
City Council action. This time lag would again allow for preparation of the
meeting minutes and publication of agendas, etc.

Gentlemen:
We have reviewed, at your request, the following sketch plans and pre-
liminary plats:
1.
Round Oak Estates - Sketch Plan
a. A minimum of the Right of way width of 66 feet would be desire-
able at this location.

b. All lots would require variances, as the sketch plan is drawn.
Lots 1-7 are 2.3 acres"'instead of 2.5 acres in size, and

Lot 8 - Blocks 1 and 2 do not meet the 330 feet minimum
lot width requirement. Dividing each tier of lots into seve n
parcels, instead of eight, would create lots of Z.5 acres., and
they would be the proper area.and width.
c. The street should be routed to connect the previously constructed
portion of 171 Avenue North west. The attached Figure/l shows
a method of providing this continuity to the street system.
d. Consideration should be given, at this time, to the overall street
plan for this area. to ensure development of ..:n or'ganized street
system.

The size of the park land dedication should be shown. The re-
quired park land dedication is 100/0 of 31.9 acres or 3.19 acres.
