Minutes of the REGULARLY SCHEDULED MEETING of the Andover Planning and Zoning
Commission, held January 2, 1975 at the Andover Community Center.
Attending were: Chairman Allan Miles, Commission members Dean Johnson, Dave Jack,
Ken Heil, Art Jaworski and Roger Anderson, Engineer of Toltz, King, Duvall and
Anderson.
Chairman Miles called the meeting to order at 7:35 p.m.
The Planning and Zoning Commission reviewed the minutes of October 1, 1974,
October 29, 1974 and November 26, 1974 and it was moved by Dave Jack, seconded
by Allan Miles that the minutes of October 1, 1974, October 29, 1974 and November
26, 1974 be accepted as written. Motion carried unanimously.
Chairman Miles stated that the last chance for input into the Metro Council
Development Framework would be taken at public hearings on January 14, 1975, at
the Bloomington City Hall, at 7:00 p.m., January 16, 1975 at the Metro Council
Chamber, St. Paul, Minnesota at 6:30 p.m., and January 21, 1975 at the Brooklyn
Center Civic Center, at 7:00 p.m., anyone requesting further information should
call the Metro Council at 227-9421.
The first agenda item, William Boughton Variance. Mr. Boughton of 1663 Andover
Boulevard N.W., had started to construct a hobby barn. Mr. Boughtons' barn was
"red tagged" by the Building Inspector Wally Arntzen because of construction without
a building permit; too close to the lot line (6 feet) and a roof line that would
exceed the height of the primary structure. Mr. Boughton appeared before the
Commission and explained the failure to obtain a building permit. The Commission
felt the section of Ordinance #8, Mr. Boughton must vary from in order to continue
was, page five (5), Section 4.05 - Band D, Assessory Buildings and Structures.
Jaworski pointed out to Mr. Boughton that the variance would not give him the right
to conduct business, i.e., cabinet shop or otherwise out of the structure.
Mr. Boughton explained that he is a carpenter and plans to keep his tools and saws
for building his own garage and to install a new roof on his house, that would
match the one on his barn, in this hobby barn. It was moved by Johnson, seconded
by Jaworski to recommend the Andover City Council approve the variance request of
Mr. William Boughton from Ordinance #8, Section 4.05 - Band D, for the following
reasons:
1. Six foot side yard set-back will not offend other property owners
or other properties.
2. Height problem was visual only because of slope of lot.
3. Mr. Boughton will purchase a building permit.
Motion carried unanimously.
Jaworski moved that the Commission adjourn at 10:30 p.m., because of inclement
weather, seconded by Jack. Motion carried unanimously.

11-74-1 Next agenda item, Faddler's Fifth Addition - second sketch plan. Roger Anderson
of Toltz, King. Duvall and Anderson read his written comments on this sketch plan
in full. Positions of the Planning and Zoning Commission were generally against
this lay-out because of too many double facing lots and too many substandard lot
sizes. An alternate lay-out was suggested to Mr. Faddler by the Planning and
Zoning Commission with the help of Roger Anderson. (A copy of Mr. Anderson's
written comments will be attached to the City copy of these minutes) The property
suggested for park dedication will be acceptable to the Park/Advisory Board.
Mr. Winner was directed to continue on the preliminary plat.
12-74-2 Chairman Miles by-passed the sketch plan of the Hughs' Industrial Park. Mr. Hughs
was not present.

Next agenda item was the sketch plan of Mr. Castner. The Commission was concerned
that no soil borings or topography were submitted and because of the large lots
(10 acres), the Planning and Zoning Commission leaned toward dropping the topography
requirement. Roger Anderson stated the reasons for a topography were to address
street profiles and drainage requirements. The Commission felt a topography would
need to be done again if this property were sub-divided into residential lots,
therefore, Ken Heil made a motion that the topography be waived. Motion dies because
of a lack of a second. Jack noted he is in favor of waiving topography, but noted
soil borings must be done. Heil again made a motion that the topography be waived
with the stipulation that soil borings (3) be taken at the direction of our engineer
to Winner and Associates. Second by Jack. Chairman Miles, for; Johnson, against;
Jaworski, abstained. Motion carried. A problem to be addressed to Attorney Hawkins
by Clerk Jaworski, was whether to accept street easement paralleling the North end
of Stenquist Addition to take advantage of the half street on the North end of
Stenquist Addition. This decision will be written by Attorney Hawkins and sent to
the Planning and Zoning Commission and Leroy Winner, Land Surveyor. Mr. Castner
was directed to continue with his preliminary plat.
Chairman Miles then called a public hearing for Nightingale Estates - second
addition. Kenneth Olson, subdivider appeared before the Commission. Roger Anderson
engineer of Toltz, King, Duvall and Anderson read his written comments on the plat.
(A copy will be attached to the City copy of this set of minutes) Chairman Miles asked
for comments from engineer Anderson on the preliminary plat. Mr. Anderson stated because
of the relating flat road area, (same level as some off street area) a drainage
easement must be provided off l54th, at the east end of the property. to the low
area on the property line and a soil boring must be provided on the high ground, at
the west end of the property, accompanied with a percolation test. Dean Johnson
made a motion to continue this public hearing on Nightingale Estates, second addition,
until January 28, 1975, with additional information to be provided at that time.
Second by Dave Jack. Motion carried unanimously.
Chairman Miles moved onto the Hughs' Industrial Sketch Plan. Mr. Winner will handle
this sketch. Mr. Hughs was apparently held up by the inclement weather. Engineer
Anderson read his written comments on this sketch plan. The Commission agreed with
the comments of Mr. Anderson and Jaworski stated that l62nd was accepted earlier this
year by the former Grow Town Board. Mr. Hughs will have to verify this because half ,
streets are not accepted. No other comments were forth coming on Hughs' Industrial
Park, as it apparently meets standards. Mr. Bughs can continue with his preliminary
plat at this time.

Chairman Miles noted he will consult with Attorney Hawkins on Shore land Zoning.
Jaworksi made a motion to direct the City Council to expedite the matter of
appointing new members to the Planning and Zoning Commission. Seconded by Johnson.
Motion carried unanimously.
Engineer Roger Anderson had some comments on Ordinance #10 that would cause
additional expense for the City if left as is. Miles directed Mr. Anderson to give
written direction to the Planning and Zoning Commission on unworkable section of
Ordinance's for action.
It was moved by Ken Heil, seconded by Jack that the meeting adjourn. Motion
carried unanimously.
Meeting was adjourned at 10:25 p.m.
