Commissioners Present: Don Jacobson, Ralph Kishel, Ted Lachinski, Larry Retzlaff Commissioners Absent: Dave Jack, Art Jaworski Also Present: Rex Stockwell, Engineer from T.K.D.A., and others Minutes of November 23, 1976 Correction: page 2 - add to legal description in Motion - "(Except part platted as Anoka County Right-of-way. Plat 2 dated 7-29-75)" ~.J Motion by Commissioner Jacobson, seconded by Commissioner Kishel, to approve the Minutes of November 23, 1976 with the change. Motion carried unanimously. Country Estates Preliminary Plat (Comm. #11-76-5) Chairman Orttel called the Public Hearing to order. Norbert Tempel, owner of the plat, was present. The Commission referred to a letter (copy attached) from T.K.D.A. dated November 30, 1976 and a letter (attached) from the Coon Creek Hatershed Board. None of the adjoining property owners were present. The Commission had reviewed this 4-acre preliminary plat in May, 1976, as a portion of a 6.87-acre plat which later was withdrawn. They discussed park dedication, previous Park Board action, and Ordinance definition of the park dedication section. Motion by Commissioner Jacobson, seconded by Commissioner Retzlaff, to close the Public Hearing. Motion carried unanimously. .' "- \J Motion by Commissioner Jacobson, seconded by Commissioner Retzlaff, that the Planning and Zoning Commission recommends to the Andover City Council that it approve the Preliminary Plat for Country Estates Addition for the following reasons: the plat, as presented to the Commission, meets the legal requirements for an R-4 zoning; and, it is of a nature consistent with the surrounding area. The Commission recommends waiving the requirements of the Andover City Ordinances as to resubdividing because the plat is so small in size as to make this provision useless. The Commission would also recommend to the City Council that money be accepted in lieu of dedicated C) : ) ( '\ \,j () ') ,,-,' Planning and Zoning Commission Meeting Minutes - December 14, 1976 Page 2 land for park purposes; and, would also recommend that the technical revisions be made to the plat as listed in the T.K.D.A. letter of November 30, 1976. Finally, that the Coon Creek Hatershed Board has recommended approval and they see no problems in their area of competency. Motion carried unanimously. This item will be on the City Council Agenda in January, 1977. Assemblies of God Church Special Use Permit (Comm. #12-76-1) Chairman Orttel opened the Public Hearing. Reverend Buschow and 2 members of the Church came forward to answer questions and explain their intention for the property. They explained that the lot - 15 acres with 495' of frontage on Bunker Lake Boulevard and 1320' deep, will have a church built that will include a auditorium that will seat approximately 800 people. The Sanitary Sewer is about 50' from the property at the NE corner. \ '-j Commissioner Lachinski, the only adjoining property owner present, expressed concern over traffic which may be created by extension of l35th Avenue into Meadow Creek by the Church. The Commission discussed the traffic problems that might arise if Mr. Adolphson developed the land between this property and Chapman's Addition with a possible extension of l35th Avenue - creating a long, straight street through residential areas. Suggestion would be ingress and egress only onto a service road on Bunker Lake Boulevard. Discussed extension of the sewer, future development and zoning in the area, parking facilities, traffic flow, and possibly a playground and parsonage on the property in the future. Motion by Commissioner Kishe1, seconded by Commissioner Jacobson, to close the Public Hearing. Vote on motion: yes - Commissioner Jacobson, Commissioner Kishel, Commissioner Retzlaff, Chairman Orttel; present - Commissioner Lachinski. Motion carried. ~ ) Motion by Commissioner Jacobson, seconded by Commissioner Kishe1, that the Planning and Zoning Commission recommend to the City Council approval of the Special Use Permit for Assemblies of God Church on the property described as: "The East 495' as measured along the North and South lines of the NE~ of the SE~ of Section 32, Township 32, Range 24, Anoka County, Minnesota"for the following reasons: the project should have a beneficial effect on the general welfare of the citizens of the City. The proposed project should have no adverse effect on surrounding properties or scenic values and is in harmony with the general purpose and intent of the City of Andover Ordinances. Because insufficient building details were available to the Commission, concern about the logical extension of :, ) , ) \ ~.. ) (J ,~ - ~ Planning and Zoning Commission Meeting Minutes - December 14, 1976 Page 3 l35th Lane NW to the East is expressed and possible future traffic flows which could be generated by the facility. Commission, however, finds this factor is not of a sufficient nature to deny the Special Use Permit. Vote on motion: yes - Chairman Orttel, Commissioner Retzlaff, Commissioner Kishe1, Commissioner Jacobson; present - Commissioner Lachinski. Motion carried. This will be on the City Council Agenda in January, 1977. Don Ha1lb1ade Rezoning (Comm. #12-76-2) Chairman Orttel opened the Public Hearing. This request for rezoning is because the present zoning does not allow zoning less than 2~ acres. This request is to rezone the property, Plat 65928 - Parcel 6370, to R-3 Zoning. It is presently zoned R-1. A recent request to rezone the entire area known as Green Acres was turned down, thus the request for spot zoning. John Noard, 14216 Heather Street NW, said, "My property adjoins Don' s and I have no objection to the rezoning". '. J The Commission discussed rezoning and the recent Council action. Motion by Commissioner Retzlaff, seconded by Commissioner Lachinski, to close the Public Hearing. Motion carried unanimously. Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff, that the Planning and Zoning Commission recommends the approval of rezoning for parcel 6370 of plat 65928 to R-3 for the following reasons: 1. the property has improvements in and has frontage on both front and back lot lines. 2. Mr. Hallblade's proposed subdivision meets the lot size requirements of R-3 and conforms to the surrounding existing land use. Motion carried unanimously. Lloyd Reimann Variance (Comm. #12-76-3) Mr. Reimann came forward and explained the reasons for asking for a Variance. He has put in a slab in order to build a garage and put the slab.too close to the property line. '\ \ ,_ ,J The Commission discussed zoning and setbacks. He is 13' from the street and should be 30'. Discussed definition of street and definition of right-of-way versus property line. He stated that he is not blocking anyone's view and the property across the street will not be developed the way it is now - low with a ditch, etc. (-") 'J ~ ) ( '\ ,--j CJ " Planning and Zoning Commission Meeting Minutes - December 14, 1976 Page 4 Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff, that the Planning and Zoning Commission recommends approval of the Lloyd Reimann Variance because no practical reason could be found to deny the request based on existing development in the area. Commissioner Retzlaff seconded the motion for purposes of discussion and brought Section 4.05 (c) of Ordinance 8 and also (d) to the Commission's attention. Discussed setbacks, reasons for setbacks on corner lots, and traffic control. The Motion was withdrawn. Motion by Commissioner Jacobson, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommends to the City Council denial of the Variance by Lloyd Reimann for the reason that it does not comply with the sideyard setback from street requirements as required under Ordinance 8 Section 6.02. Commissioner Lachinski stated that he didn't agree and that #1 - the sight distance would not be a problem and #2 - resubdivision of next lot would not be likely causing a problem with front lot line. , ) Vote on motion: yes - Commissioner Jacobson, Commissioner Kishel, Commissioner Retzlaff; no - Commissioner Lachinski, Chairman Orttel. Motion carried. This will be on the City Council Agenda in January, 1977. Adjournment Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff, to adjourn. Motion carried unanimously. HAMBLIN EDWARD J. BOOTH \ J We have reviewed the preliminary plat for proposed Country Estates Addition as revised on June 21, 1976. The proposed plat is located between Gladiola Street NW and Crooked Lake Blvd. south of l35th Lane NW. The plat consists of three lots with one lake shore lot. The following are our comments regarding the preliminary plat: 1. All of the lot characteristics required for R-4 zoning have been met as proposed. 2. 10' side yard setbacks for Lot 1, Block 2 should be indicated on the preliminary plat. 3. Generally when proposed lots are of sufficient size to be further sub- divided a resubdivision plan is required. In this case, once houses are built facing Gladiola Street and Crooked Lake Blvd. there will no longer be sufficient side yard to allow for any future resubdividing. We recommend waiving the resubdivision plan requirement. 4. The plat must indicate source of water supply, source of sewage dis- posal and single family residential development. , ) .1 \ ) ~ , J \ " ) '\ ) Planning and Zoning Commission , Andover, Minnesota November 30, 1976 Page Two 5. Some sanitary sewer construction will be required to serve the pro- posed lots. The construction will consist of sewer line extensions and service line installation. The developer should petition the City for these improvements at which time the City Council would authorize a feasibility study and cost estimates for the necessary construction. The developer would be required to provide a cash escrow or bond in the amount of 1500/0 of the estimated cost of the improvements. PHONE: 884-5371 .1- . i December 13, 1976 The Coon Creek Watershed Board c/o Mr. Loren Hentges, Chairman 11873 Northeast Raddison Road Minneapolis, Minnesota 55434 Re: Country Estates Addition, to the City of Andover Gentlemen: The proposed plat consists of three (3) lots, averaging approximately 1.2 acres per lot. It is intended as single family residential. Our recommendation to the Board is that this proposed plat be approved as pro- posed. The proposed plat is located in a residential area that is developed to a con- siderably higher degree than the proposed plat.
