November 9, 1976
MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:30 P.M. by Chairman Ken Orttel on November 9,
1976, at the Andover Community Center, 1685 Crosstown Boulevard NW,
Anoka, Minnesota 55303;
Commissioners Present: Dave Jack, Ralph Kishel, Ted Lachinski
Commissioners Absent: Don Jacobson, Art Jaworski, Larry Retzlaff
Also Present: Rex Stockwell, Engineer from T.K.D.A., and others

Motion by Commissioner Kishel, seconded by Chairman Orttel, to accept
the Minutes of October 26, 1976. Vote on motion: yes - Chairman Orttel,
Commissioner Kishel; present - Commissioner Lachinski, Commissioner
Jack. Motion carried.

Barnes' Rolling Oaks 2nd Add'n Preliminary Plat (Comm. #4-76-8)
The Commission received new plats 11-5-76 which show the temporary cul-
de-sac on Palm Street and also the additional soil borings. Rex
Stockwell reviewed the soil borings with the Commission. The water
level is the prime concern. The peat can be removed without too much
problem.
The developer may be required to fill the lots prior to final plat approval
and at the time of final plat approval, he would certify that the lots
have been filled and are at the proper elevation. Mr. Wicklund again
stated that the materials from constructing the roads can be used for
filling the lots. Discussed whether the developer would have to remove
the peat from the entire lot or just 39,000 square feet. Discussed
park land dedication. Commissioner Kishel advised that the park board
talked about purchasing the lots (Lot 3, Block 6 and Lot 3, Block 3)
adjacent to the proposed park. The land would have to be purchased
after final plat stage.
Motion by Commissioner Lachinski, seconded by Commissioner Jack, to close
the public hearing on Barnes' Rolling Oaks 2nd Addition Preliminary Plat.
Motion carried unanimously.

Motion by Commissioner Lachinski, seconded by Commissioner Kishel, that
the Planning and Zoning Commission recommends to the City Council to
approve the Preliminary Plat of Barnes' Rolling Oaks 2nd Addition subject
to: 1) the final approval of the Park Board on the park dedication.
2) the shading of all areas of peat removal and fill on the preliminary
plat as requested by the Engineer. 3) indicating the minimum basement
floor elevations as requested by the Engineer. The Preliminary Plat,
in all other ways, meets the criteria of Ordinance 10 and meets the
approval of the Engineer at this time. Motion carried unanimously.
The Preliminary Plat will be on the Park/Recreation Commission Agenda
of December 2nd and the City Council Agenda on December 7th.
City of Andover Variance Request (Comm. #11-76-1)

Chairman Orttel explained the Variance Request to the Commission.
The Variance is for construction in "The Oaks" plat. There are 9-15,000
square foot lots and the Ordinance (Section 7 of Ordinance 8 - R-4)
calls for "private sewer and water systems only on every third lot or
no more frequently than one system for each 39,000 square feet~' The
City Building Department has issued 3 building permits on 3 adjacent
lots. Chairman Orttel stated that since there are 9 lots in the plat
and only 3 lots are currently having dwellings constructed - there is
no ordinance violation - thus no reason for this Variance~ Also, that
the individual involved, his attorney, or the City ^ttQrHey do not feel

The Commissioners discussed the Ordinances concerning this matter

Motion by Commissioner Jack, seconded by Commissioner Kishel, that the
Commission table this item until it is further brought up by the Council.
Motion carried unanimously.
Ordinance #36 Amendment Discussion (Crnrrm. #8-76-4)
Chairman Orttel read letter from Patricia K. Lindquist of October 6, 1976
and referred to a letter from her of November 5, 1976. No word or information
has been received from the Attorney. The Commission discussed Ordinance
setback line requirements. It was suggested that the seller make sure
he has a certificate of buildability. Also suggested that Ordinance
36 be left as it is and the Planning and Zoning Crnrrmission start drafting
a new "disclosure ordinance". Chainnan Orttel will get a copy of the
Ordinance from Ham Lake and send it with a letter to Bill Hawkins.

Capital Improvements Program Discussion (Comm. #9-76-8)
Wes Hendrickson, planner from T.K.D.A., will be contacted so that a
meeting can be scheduled for information - price quote, various stages
of development, etc., - on a 5-year Capital Improvements Program._
It was suggested that the City Council be invited to this meeting.
Tom Cherny Sketch Plan (Comm. #11-76-4)
Mr. Cherney showed the Commission the land he owns in Red Oaks, approximately
2 acres at 140th and Raven Street. He said his assessment is over $10,000
and would like to split the land into 3 more lots. There is a 125'
NSP easement through there but in checking with NSP he found that NSP
no longer is interested in the land. Mr. Cherney needs a motion from
the City asking NSP to give back the right to the easement, an official
request, and also said that he will pay them $640. 3 Sanitary Sewer
stubs have been put in already. Discussed assessment costs, policies,
future improvements, etc.
Mr. Cherney will check further with a surveyor and begin preparation
of the preliminary plat.
Norbert Tempel Sketch Plan (Comm. #11-76-5)
Mr. Tempel presented a 4-acre plan with 3 lots in Section 33. Sanitary
Sewer stubs will be needed on the lake lot and also Lot 1, Block 1.
Engineer Stockwell estimated the cost for this at $2,000. The road
is currently class 5. Since this is a portion of land that Mr. Tempel
had previously reached the "preliminary plat" stage, the Commission
saw no problem with the sketch plan.

adjourn. Motion carried unanimously.
