REGULAR PLANNING AND ZONING COMMISSION MEETING
June 8, 1976
Minutes
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:30 P.M. by Chairman Ken Orttel on June 8, 1976,
at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka,
~innesota 55303.
Commissioners Present: Dave jack, Don Jacobson, Art Jaworski, Ralph
Kishel (arrived at 8:50 P.M.), Ted Lachinski,
and Larry Retzlaff
Also Present: Rex Stockwell, Engineer from T.K.D.A., and others
Minutes
May 25th Minutes - Corrections:
page 2 - line 10 - should be "Mr. Stockwell stated that the
City extended the existing 18" culvert a number of years ago".
page 2
line 13 - replace "Coon Creek Watershed" with "the developer".
page 3 - line 6 - should be "advised Chairman Orttel today that
a possible method the City may use would require a 20% escrow
deposit".
Motion by Commissioner Jacobson, seconded by Commissioner Lachinski,
to accept the Minutes of May 25th with the corrections. Motion carried
unanimously.
May 27th Minutes - Correction:
page 1 - Maple Glen ~states - item its - should be "possibly
straightening l59th or moving it South to the It; Section line".
Motion by Commissioner Jack, seconded by Commissioner Retzlaff, to approve
the Minutes of May 27th as changed. Vote on motion: yes - Chairman Orttel,
Commissioner Lachinski, Commissioner Jack, Commissioner Retzlaff; present -
Commissioner Jacobson, Commissioner Jaworski. Motion carried.
Barnes Rolling Oaks Preliminary Plat Continued Public Hearing (Comm. #1-76-3)
The Commission reviewed the Plat revised 6-2-76, and received 6-3-76.
All items on the letter from T.K.D.A. (copy attached) dated 6-2-76
have been complied with. Ham Lake was sent a copy of the revised plat
(6-2-76) since they were concerned with the culvert and run-off on University
Avenue but they have not replied. In regard to legal documentation
requested for construction of l46th Lane, it will be submitted at the
time of Final Plat. The park dedication will be $5,320.

Motion by Commissioner Jacobson, seconded by Commissioner Lachinski,
to close the public hearing. Motion carried unanimously.
Motion by Commissioner Lachinski, seconded by Commissioner Jack, that
the Planning and Zoning Commission recommends that the City Council approve
the Preliminary Plat of Barnes' Rolling Oaks 1st Addition as it complies
with Ordinance 10 (with the exception of one road every 1320') and changes
recommended by the Commission and the City Engineer have been made.
Said plat shall be subject to ditch improvements as indicated by the
City Engineer, to the 36" culvert on University Extension required by
the Coon Creek Watershed Board, and shall also be subject to construction
of l46th Lane in it's entirety from Evergreen Street to Prairie Road
and to money in lieu of land for park purposes. Motion carried unanimously.
Round Lake Shores - Trueman Hulegaard Motion (Comm. #2-76-1)

At the previous meeting, a motion was made to deny the rezoning and no
action was taken on the Preliminary Plat. The Commission discussed
the proper procedure necessary at this time. Motion by Commissioner
Jack, seconded by Commissioner Jaworski, that the Hulegaard Preliminary
Plat - Round Lake Shores - be scheduled for reopening of a public hearing
at our 1st meeting in July. Motion carried unanimously. The Commission
Clerk was directed to call Mr. Hulegaard to see if he wishes to proceed
with the Preliminary Plat at this time; and if he doesn't, the public
hearing would not be published or reopened.
Faddlers 5th Addition Preliminary Plat Public Hearing (Comm. #6-76-1)
Chairman Orttel called the public hearing to order and referenced the
letter dated 6-8-76 (copy attached) from Pat Lindquist, City Clerk,
regarding discontinuance of the platting by the current owner, Lloyd
Drahose. Motion by Commissioner Jaworski, seconded by Commissioner
Retzlaff, to close the public hearing. Motion carried unanimously.
Motion by Commissioner Jack, seconded by Commissioner Jaworski, to recommend
that the City Council reference letter dated June 7, 1976, addressed to
Andover Council from Mr. Drahose and also the letter of June 8, 1976
from the City Clerk to the Planning and Zoning Commission and to concur
with the Clerk's recommendation. Motion carried unanimously.
James H. Larson/Larson's Addition/Sketch Plan (Comm. #6-76-2)

Mr. Larson advised the Commission and Mr. Stockwell of his plan to subdivide
his land on Lily Street into 2 lots. Information discussed: sewer
stubs are already in place; access is from l29th in Coon Rapids; Coon
Rapids maintains Lily Street; Edsell Wicklund, adjoining property owner,
agreed to a cul-de-sac on his property; the road would be going through
land owned by Mrs. Marjorie Weiss; other adjoining property owners
involved should be included in the platting; the 2 East lots are R-4
zoning and the 2 proposed West lots are R-1, therefore he should ask ~ 6-.(:::).,)(.

Interim Moratorium Ordinance (Camm. #5-76-5)
The Commission discussed the letter from City Attorney, William G.
Hawkins, dated June 7, 1976 (copy attached). Also discussed was Section
6 in regard to public utilities construction or alteration. It was
agreed to make no more changes until Monday, June 14th, at 7:30 P.M.,
the Public Hearing for the Interim Moratorium Ordinance.
Ordinance 22A (Comm. #4-76-11)
The City Council has referred this item back to the Planning and Zoning
Commission for further action. The Commission felt the proposed draft
of 22A, the State Building Code, the fee schedule resolution and Ordinance
8 adequately covers everything.
Ad;ournment
Motion by Commissioner Jack, seconded by Commissioner Lachinski, to adjourn.
Motion carried unanimously.

Reference: FADDLER'S FIFTH ADDITION - WITHDRAWAL OF PLAT
Attached please find a copy of a letter from the developer of
Faddler's Fifth Addition, requesting that this Plat and all
related variances be cancelled.
We would recommend that the fees paid to date, less all
administrative, engineering, and legal costs, be refunded.
Mr. Drahos has paid those engineering fees incurred, but
\ not paid, by the previous developer Mr. Faddler; however,
,) I don't believe we can hold him responsibile if he withdraws
the Plat. Our only recourse would be, assuming Mr. Faddler
does not pay the costs incurred while he was owner, would be
Conciliation Court in a claim against Mr. Faddler.
We have not received all the engineering costs to date, therefore,
I cannot give you an exact figure on the refund due.

Re: Interim Moratorium Ordinance
Dear rlJr. Orttel:

Pursuant to your request, I have reviewed the revised Interim
Moratorium Ordinance. I would only make one comment regarding
the changes. This concerns your revision of the time period
during which the Ordinance shall be in effect. It would seem
to me to be more clear by stating a specific date on which the
moratorium would end rather than merely stating not to exceed
twelve months.
The remainder of the changes appear to be in order.
