July 13, 1976
MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:35 P.M. by Chairman Ken Ortte1 on July 13, 1976,
at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka,
Minnesota 55303.
Commissioners Present: Dave Jack, Don Jacobson, Art Jaworski (arrived
at 7:45), Ralph Kishel (arrived at 7:40), Ted
Lachinski, Larry Retzlaff
Also Present: Rex Stockwell, Engineer from T.K.D.A., and others
Minutes
Motion by Commissioner Retzlaff, seconded by Commissioner Jack, that
the Minutes of June 14, 1976 be approved. Vote on motion: yes - Chairman
Orttel, Commissioner Retzlaff, Commissioner Lachinski, Commissioner
Jack; present - Commissioner Jacobson. Motion carried.

Motion by Commissioner Jacobson, seconded by Commissioner Retzlaff, to
approve the minutes of June 22, 1976. Motion carried unanimously.
Trueman Hulegaard "Round Lake Shores" Rezoning & Preliminary Plat (Comm. 112-76-1)
Chairman Orttel opened the Public Hearing and explained the recent action
by the Planning and Zoning Commission and the City Council. The City
Council has referred it back to the Planning and Zoning Commission because
a number of items that had been reasons for denial previously were
corrected by the developer.
Lawrence Seiberlich, of Integrated Services, Inc., presented a plat that
shows a building size reduced to 8300 square feet, therefore the parking
would be reduced also. Soil Borings have been taken since the last meeting.
Mr. Seiberlich reviewed the previous recommendation dated June 7, 1976
(copy attached) and made the following comments: 111 - the reason or
reasons for the petition are not stated on the petition. 112 - A letter
was received from Paul Ruud, County Highway Engineer, stating (in summary)
that traffic wouldn't be a problem. 113 - not correct - It's Commercial
across the street and there are a number of other commercial uses along
Round Lake Boulevard. 114 - talked to the planner of the Community
Development Plan. The Plan is reacting to a "predicted" planning image -
a catchment projection. In talking to the Planner, of Nason, Wehrman,
Chapman Associates, Inc., he said that if conditions should change because
of nondevelopment, that may be some of these projections would be affected.
There would not be a conflict with other commercial areas that are proposed
in the Community Development Plan.

#5 - we have presented some more "drive-by" information. #6 - we feel
it doesn't necessarily have to be competitive with other businesses.
#7 - we have reduced the size of the building. #8 - soil borings were
taken. Amendment - "detrimental to the health, safety & welfare of the
residents" is very hard to respond to. This is not strip development.
The Community Development Plan tells what strip development is. Spot
zoning - there is spot ~oning all uver the City.
Engineer Stockwell reviewed letter (copy attached) from T.K.D.A. dated
7-13-76. The Commission and Mr. Seiberlich and Mr. Stockwell discussed:
commercial zoning - grangfathered in; traffic - letter from Highway
Engineer seems vague, when would Round Lake Boulevard be upgraded;
water table - percolation tests, elevation, septic system alternatives;
the City does not have a Capitol Improvement Program; Shore land Zoning -
the City should ask Dallas Felegy to review the plat; Coon Creek Hatershed
Board review; 100-year flood plan.

John Lofstrom, 3608 - l44th Avenue, "We got another petition with 67
names (copy attached). Rosella Sonsteby had a petition against her
request and I think that petition should be used in this case." He
also commented on the recent storm sewer project in the area and the
desire of the residents to stay in a residential zone.
Dan Schulist, 14319 Underc1ift, said, "I want to thank you very much for
advising us of this meeting and what is happening to us. No, I don't
want the Shopping Center here. One reason is the sewer situation. 3
septic systems in my neighbohood have had to be replaced. I am against
this complex until such time as we have some sewer project. Another
reason is the traffic problem."
Doris Lofstrom, 3608 - l44th Avenue, commented on the traffic hazard
and the many young children in the area.
Jim Olson, 14289 Underclift, "reference was made to the Sonsteby petition
and at that time we covered every problem. I believe there were 90%
against, 5% for, and 5% that we couldn't reach. He don't want children
enticed to a store and the traffic would be a problem."
James Guillet, 14516 Round Lake Boulevard, asked, "What keeps the business
use in the business for which it was rezoned?"
Melanie Morris, 3605 - l43rd Avenue, was opposed because of children and
traffic.
Motion by Commissioner Jacobson, seconded by Commissioner Lachinski,
to close the public hearing. Motion carried unanimously.

Motion by Commissioner Jacobson, seconded by Commissioner Kishe1, that
the Planning and Zoning Commission recommends to the City Council denial
of the rezoning based on the following facts: 1) local opposition -
petition with 67 names of area residents. 2) possible traffic hazards
which will possibly be accentuated by the rezoning. 3) rezoning is
inconsistent with the surrounding area. 4) rezoning is inconsistent
with the Community Development Plan. 5) the market feasibility study
presented was inadequate. 6) a presently zoned small neighborhood business
area is approximately one mile away. 7) it appears that by rezoning
for Neighborhood Business, the plans are in excess of the definition of
NB. 8) there may possibly be problems (reference paragraph 3 of the
T.K.D.A. letter dated 7-13-76) with the sewage disposal system and
problems with the water levels on the property. These may require
premature Sanitary Sewer extension to the area in the near future at a
considerable cost in public and private funds. 9) the proposed project
may be detrimental to the health, safety, and welfare of the residents
of the area.

Amendment by Commissioner Retzlaff that item #5 (the feasibility study)
be removed from the motion and Amendment by Commissioner Lachinski,
seconded by Commissioner Jack, to indicate that it does support item
#7 that the area included seems to be much greater than Neighborhood
Business and also that the parking lot and the development there will
provide additional runoff and create an additional pollution problem
for Round Lake.
Discussion on market feasibility study and water level/sewage disposal
systems.
Amendment by Commissioner Retzlaff, seconded by Chairman Orttel, to
delete item #8 of the proposed motion. Vote on amendment: yes - Commissioner
Jaworski, Commissioner Lachinski, Commissioner Retzlaff, Chairman Orttel;
no - Commissioner Kishel, Commissioner Jacobson, Commissioner Jack.
Amendment carried.
Vote on amendment to delete items 5 & 7: yes - Chairman Orttel, Commissioner
Retzlaff, Commissioner Lachinski, Commissioner Jaworski, Commissioner
Jack, Commissioner Jacobson; no - Commissioner Kishel. Amendment carried.
Vote on Motion: unanimous yes. Motion carried.
Discussion on Preliminary Plat: insufficient frontage, variance required,
Engineer's report, and whether the developer now wishes to plat.

Motion by Commissioner Lachinski, seconded by Commissioner Jacobson,
that the Planning and Zoning Commission recommends to the City Council
denial of this Round Lake Shores Preliminary Plat for Trueman Hulegaard
as he does not wish to continue with this particular plat because it
was to be combined platting and rezoning and the rezoning has been recommended
for denial and at this time it does not conform with design standards
in a R-1 area. Motion carried unanimously.

Barnes Rolling Oaks 2nd Addition Preliminary Plat (Comm. #4-76-8)
Chairman Orttel called the public hearing to order. Brad Hicklund presented
the Plat for Mr. Barnes. The Commissioners had each previously received
a copy of the plat but Mr. Hicklund revised that plat, according to
Engineer Stockwell's letter and gave the Commission 2 copies of it to
review. The Commission, Mr. Wicklund, & Mr. Stockwell reviewed the
letter (copy attached) from T.K.D.A. dated July 7, 1976. Some of the
comments were: 1) this is shown on the revised plat, although Fay Barnes'
home would be in the service road area. Discussed right-of-way, setback
dedication, construction, etc. The Planning and Zoning Commission
recommends dedication of service road right-of-way. #2) The Planning
Commission requested extension of Palm Street be shown. #3) Zoning
should be shown. #4) That will take some time and be shown on the revised
plat. #5) This has been done. #6) They are available. #7) They are
noted on the revised plat. #8 & #9) they will be done.

Discussed park land - Commissioner Kishel, Planning and Zoning liaison
to the Park and Recreation Commission, advised that the Park Commission,
at the regular July meeting held July 12, said they were in favor of
accepting the park as shown on the Preliminary Plat and would like to
know the price for the purchase of Lots 4 & 5 adjacent to the park.
The walkway that was previously discussed was not shown and will be
put on the revised plat.
Motion by Commissioner Kishel, seconded by Commissioner Jaworski, to
continue the public hearing until July 27th. Motion carried unanimously.
Grow Oak View Estates Preliminary Plat (Comm. #7-76-1)
Chairman Orttel opened the public hearing and Al Bullick, the developer,
presented the preliminary plat of Grow Oak View Estates. The letter
(copy attached) from T.K.D.A. dated 7-7-76 was reviewed: #1) should
be taken care of. #2) Engineer Stockwell stated that the street is
2 years old. We should require seal coating, the cul-de-sac needs to
be touched up and it isn't the size we require now, but it would be
covered in the construction contract. #3) discussed need for 2 catch
basins with an outlet to the South, low area could be filled, need an
easement thru Lot #1, underground telephone and electric should be shown
on the plat. Mr. Bullick stated that the drainage was okay at the time
of final approval. Discussed the history of the plat - the final plat
had been accepted but was never recorded which is the reason for this
preliminary plat. #6) discussed R-2 zoning and future resubdivision.

Rex Stockwell and Mr. Bullick will get together and go over the site.
In discussion of park land, Commissioner Kishelstated that the Park
and Recreation Commission will accept the park as shown on the plat.
Discussed access to the park, soil conditions and water table. Motion
by Commissioner Retzlaff, seconded by Commissioner Lachinski, to continue
the public hearing on Grow Oak View Estates to the next meeting. Motion
carried unanimously.

Dog Ordinance Review (Comm. #4-76-3)
This item is continued to the July 27th meeting.
Ronald Rehmann Variance (Comm. #7-7-62)
Mr. Russell and Dr. Rehmann came forward and explained to the Commission
the reasons for the variance request. Mr. Russell has sold all but
one lot. Discussed previous Ramsey variance, roads - Mr. Russell has
paid to upgrade them, Section 14.02, and that this item is on the City
Council agenda for next week - July 20.
Motion by Commissioner Jack, seconded by Commissioner Jaworski, that
the Planning and Zoning Commission recommends the City Council adopt a
resolution to waive platting requirements on this parcel in lieu of
granting this variance per 14.02. Vote on motion: yes - Chairman Orttel,
Commissioner Retzlaff, Commissioner Lachinski, Commissioner Jaworski,
Commissioner Jack, Commissioner Kishel; no - Commissioner Jacobson.
Motion carried.

Gentlemen:
We have reviewed the preliminary plat revised on May 19, 1976,
and soil investigations for proposed Round Lake Shores commercial
development. The following are our comments regarding the above:
L The preliminary plat conforms to the requirements and design stand-
ards of the City of Andover, as outlined in Ordinance lO, Subdividing
and Platting Ordinance.
2. The proposed Neighborhood Commercial Center will increase traffic
flow on l44th Avenue. NW immediately west of Round Lake Boulevard.
This street consists of a rural street section with traces of gravel
and inadequate drainage. The developer will be required to upgrade
this street surface adjacent to the proposed development with
increased width, Class 5 gravel and a bituminous approach along
Round Lake Boulevard.
3.
The soil borings and percolation test results have been reviewed with
the City Building Official, Mr. James Thurston. The soils encoun-
tered in the area of the proposed building and soil absorption system
appear to create no problem with development of the property as
proposed. We must, however, indicate that water table elevations
may fluctuate substantially from the date the soil borings were per-
formed. This would be accounted for in the design and construction

of the facilities and will playa major role in the design of the building
and absorption system as would any fill material encountered at these
locations.

We have reviewed the preliminary plat for Barnes Rolling
Oaks Second Addition in accordance with Ordinance 10.
The following are our comments regarding the proposed plat.
1. The City should require the dedication of service road right of way
(40' in width) at this time. The Commission should discuss con-
struction of this street. At the present time common driveways
could be used for lots fronting on Andover Boulevard. Construc-
tion of a service road would eliminate the need for common drive-
ways.
2. The developer should be required to dedicate right of way for Palm
Street North of l48th Lane NW between lots 14 and 15, Block 1.
This will allow for a future extension of streets to the north. This
will also require a rearrangement of lots north of 148th Lane NW to
meet minimum requirements.
3. All zoning classifications surrounding the plat should be identified.
4. Existing eastments and/or new easements for the natural gas pipe-
lines must be indicated. The easements should be submitted to
Northern Natural Gas Company for review.

5. Drainage and utility easements should be required between lots lO
and 11 of Block 1 and between lots 11 and 12 of Block 1 for adequate
street drainage. 'When street profiles are submitted by the developer,
additional easements may be required.
6. The preliminary plat must include existing and proposed profiles of
existing and proposed streets. The streets must be designed to ade-
quately drain the entire plat to natural drainage ways. This will
require several culverts, the invert elevations of which must be
indicated. A typical street section must also be included with the
plat. The rural street section is available from the engineers.
7. All set back widths should be listed including front yard, side yard,
back yard, etc.
8.
Minimum basement floor elevations should be indicated for each
proposed lot. The elevation is governed by ground water elevation
and street elevation. This can be determined following soils inves-
tigations.

9. Ten soil borings and percolation tests will be required for the sub-
division. The engineer will determine the locations of the tests to
be required.
We will discuss this letter with the Commission at the July 13, 1976 meeting.

We have reviewed the preliminary plat for Grow Oak View Estates in the
City of Andover. The following are our comments regarding the preliminary
plat:
1. I've have reviewed the report on soil investigation submitted with the
plat. The soils within the area do not appear to present any problem
for development of the property. Soil percolation tests have not been
conducted to this date and would be required for each lot at the time
a blIilding permit is issued for constrlIction of dwellings.
2. The condition of the bituminous roadway must be field inspected prior
to acceptance of the roadway. We will report to the Commission on
the condition of the street surface.
3. The storm drainage system is not complete as constructed and revi-
sions will include construction of additional catch basins and storm
sewers and dedication of additional drainage and utility easements. We
will report to the Commission on these requirements following a field
inspection of the system.

4. The street name, Navajo Street NVf does not totally conform to the
city street plan. Navajo Street north of the plat has been incorrectly
named. We, therefore, would suggest naming the proposed street
as indicated. A correction should be made on sheet 4 to indicate
Navajo Street rather than Eldorado Street NW.
5. No minimum basement floor elevations have been indicated as
required by Ordinance 10. The minimum elevations are governed
by two factors: 1) water table and 2) street elevation. The water
table does not govern in this case as indicated in the soils report.
I've, therefore, would suggest waiving this requirement on the pre-
liminary plat.
6. No future subdivision plan has been included with the preliminary plat.

We will review this letter and report with the Commission on Streets and
Storm Sewers at the July 13, 1976 meeting.
