Comm. #S-76-6 Discussion of Economic Development Program , Publish on August 20, 1976 '- .I ,- ') " i '\ !) \~ "- CITY 01 ANDOVER ,- ~ \, J REGULAR PLANNING AND ZONING COMMISSION MEETING \ / August 24, 1976 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Ken Ortte1 on August 24, 1976, at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Don Jacobson, Ralph Kishel, Ted Lachinski, and Larry Retzlaff Commissioners Absent: Dave Jack and Art Jaworski Also Present: Rex Stockwell, Engineer from T.K.D.A., and others Minutes Motion by Commissioner Jacobson, seconded by Commissioner Retzlaff, to accept the Minutes of August 10, 1976. Motion carried unanimously. ~,J Grow Oak View Estates Continued Public Hearing (Comm. #7-76-1) Al Bu1lick, developer, presented revised plats just prior to the meeting. Motion by Commissioner Jacobson, seconded by Commissioner Kishel, that we continue the public hearing on this plat until our next regularly scheduled meeting in order for the Engineer to look at the new plat map and make his recommendations to us and to allow members of the Commission time to review the plat and make their own comments. Motion carried unanimously. Round Lake Estates Continued Public Hearing (Comm. #6-76-7) James Lund, developer, and Glenn Shaw, of Programmed Land, were present to discuss the plat. Rex Stockwell discussed a letter (copy attached) from T.K.D.A., dated 8-19-76, with his review and comments of the revised plat received 8-13-76. Additional comments on the letter: 1) referred to a letter from Programmed Land dated 8-13-76 which is attached; 3) Mr. Stockwell felt it was a good idea that they extended the road; 4) Mr. Stockwell talked to Dallas Felegy and Rollie Anderson, County Surveyor, and they expressed concern about Lot 5, Block 4; discussed Ordinance 10 requirements that a lot not served by public sewer has to have at least 39,000 square feet of useab1e property; water elevation is 866.3' and one year ago it was 867.3'. The water table could fluctuate one to two feet. Suggested dividing lot 5 between lots 4 & 6. Glenn Shaw said they would put in fill to take care of the problem. \ , / () () (J C) \, Planning and Zoning Commission Meeting Minutes - August 24, 1976 Page 2 , Mr. Lund presented the soil boring information to Engineer Stockwell. Some of the items discussed were:l)the dedication of park land that is not included in the plat. There is more than the "required" park land dedicated in the plat so it perhaps would not be a problem. 2) discussed extension of l49th Avenue to 7th Avenue and thus creating a ~-Street. Mr. Shaw said that Jerry Lapham, the adjoining property owner, was unwilling to sell any land in order to meet road width requirements. After a number of alternatives were discussed, it was agreed that perhaps the best solution would be to barricade the existing narrow road onto 7th Avenue to prevent further use and construct a temporary cul-de-sac on the west line of lot 4. 3) Also discussed the extension of Guarani Street to the South. It was suggested that a temporary cul-de-sac be constructed on the south line of the plat on Guarani Street. 4) Mr. Shaw advised the Commission that Mr. Bruce Hay said that he had no plans for a trailer court to the South and would like to sell the property or maybe he would develop the land for single family dwellings. 5) Lots 5 and 8 of Block 4 - it is questionable whether there would be 39,000 square feet of useable land above the 875 elevation. Discussed requiring a letter before Final Plat stage stating that they will meet the 39,000 square feet requirement. " ') '---/ Mr. Allan Miles, adjoining property owner, expressed concern over the ~-street shown on the plat but thought everything else looked good. Motion by Commissioner Jacobson, seconded by Commissioner Lachinski, that the Planning and Zoning Commission continue the public hearing until the next regularly scheduled meeting of the Commission to allow the developer to make changes in the plat as per the discussion we have had tonight. Motion carried unanimously. Barnes Rolling Oaks 2nd Addition Continued Public Hearing (Comm. #4-76-8) Neither the developer nor the property owner were present. The Commission discussed what action to take. The developer called just prior to the Commission meeting of August 10, 1976 saying he would not attend, but the Engineer, the Chairman, or the City staff haven't heard from Mr. Wicklund since that time. It was suggested that the public hearing be continued and ask the City Attorney to write a letter to those concerned to take the appropriate action within a specific time frame or it will be considered closed. Chairman Orttel reopened the public hearing. Winslow Holasek, adjoining property owner, inquired about the County ditch regarding cleaning, etc. He had attended a Coon Creek Hatershed Board meeting the night before and they were concerned about the fullness of the ditch but otherwise there was no discussion of this plat. .' " I \J () (J C) ~) Planning and Zoning Commission Meeting Minutes - August 24, 1976 Page 3 Motion by Commissioner Jacobson, seconded by Commissioner Lachinski, that the Planning and Zoning Commission empower the Chairman of the Planning and Zoning Commission to issue a letter to Mr. Brad Wicklund with a copy to Mr. Fay Barnes stating that because Mr. Wicklund failed to appear at the public meeting of the Planning and Zoning Commission on August 24, 1976 that the Planning and Zoning Commission will schedule a special meeting on Barnes Rolling Oaks 2nd Addition within 30 days. Such meeting to meet all the notification requirements of Ordinance 10 pertaining to the notification of adjoining property owners and that all meeting expenses for this special meeting will be charged to the owner of Barnes Rolling Oaks 2nd Addition. After a discussion on procedure to follow, the motion was withdrawn. It was noted that adjoining property owners have been at every meeting and Brad Hick1und hasn't appeared and this time never called. Motion by Commissioner Jacobson, seconded by Commissioner Lachinski, that the Planning and Zoning Commission continue the hearing until September 28, 1976 and that the Chairman of the Planning and Zoning Commission write a letter to Mr. Hicklund and Mr. Barnes indicating our displeasure with nonappearances at scheduled meetings. Motion carried unanimously. ':J Meeting Date Because of the Primary Election on September 14, it was agreed that the next regularly scheduled meeting (the 1st bi-monthly meeting of September) of the Planning and Zoning Commission will be held on Wednesday, September 15, 1976. Ordinance 10 Amendment discussion (Comm. #8-76-3) Chairman Orttel explained the City Council's request for the Planning and Zoning Commission to review and amend Ordinance 10. The Commission referred to City Council Minutes of August 3, a letter from Pat Lindquist, and the August 3rd Agenda Materials from Pat Lindquist. Rex Stockwell will send the Commissioners a copy of the latest version of Ordinance lOB. Chairman Orttel will check further with Attorney Hawkins to see if a Public Hearing is needed and place this on the next agenda. Ordinance 36 Amendment discussion (Comm. #8-76-4) . ') '----' Discussed in particular the portion in Section 4 about 10 acre subdivision of land. It was suggested that it be changed to 5 acres and also suggested that the word subdivision be changed to platting. There will be a Public Hearing for this Ordinance amendment at the next regularly scheduled meeting. (J ~) (- ') '-- C) , Planning and Zoning Commission Meeting Minutes - August 24, 1976 Page 4 Ordinance 8 Amendment Continued Public Hearing (Comm. #7-76-5) The Commission reviewed the changes to the Ordinance which were discussed previously. Motion by Commissioner Jacobson, seconded by Commissioner Retzlaff, to close the public hearing. Motion carried unanimously. Motion by Commissioner Retzlaff, seconded by Commissioner Jacobson, that the Planning and Zoning Commission recommend that the City Council revise Ordinance 8 - Zoning Regulations - in Subsection 4.04 Lot Provisions (A) (insert in line 24) to change width "or" yard space to width "and" yard space. Also to recommend that Ordinance SA - Subsection 3.02 Definitions - (C) Agricultural Use, Rural - change the first line to "An area of five (5) or more contiguous acres" and also to amend (D) Agricultural Use, Urban - change the first line to read "An area of less than five (5) contiguous acres". The changes are for the reason of clarification of the Ordinance. Motion carried unanimously. Bingo Ordinance discussion (Comm. #8-76-5) Discussed reasons for the "Bingo Ordinance" and agreed to review further and place it on the next meeting's agenda. The plat has been revised in accordance with the letter from TKDA dated August 10, 1976. The following are our comments. regarding the p'roposed plat and '\ revisions. " " ."":' I < " I"~ ',;0: 1. The subdivider is not the owner of the property to be subdivided. Ordinance 10 requires that the developer submit the written consent of the owner to subdivide the property. 2. The majority of the proposed park land is designated as wetland during wet seasons of the year. The City Park Board has considered accepting the proposed park land and constructing a foot bridge to the island. The City should be careful to assure that the proposed walkway will be able to begin and terminate on dry land so access will always be available to the island. . 3. The developer is proposing to dedicate one half of l49th Avenue NW with the remainder to be donated by Programmed Land, Inc. Also included. in the donation is public area for a future parking area. This area would provide parking and access to the proposed park land. 4. The proposed plat is located on the shore of Round Lake. the preliminary plat be submitted to and reviewed by Mr. prior to acceptance. These revisions must be completed to include revisions made to the first page. 6. The street names on the street plan and profile sheets should be changed to be correctly indicated. All proposed culverts should be shown to include 15" CMP culverts with aprons and a 30" CMP culvert with aprons under l47th Lane NW between Lot 7, Block 3 and Lot 4, Block 4. 7. The proposed street section is very similar to the Andover Standard Rural Street Section, however, several minor revisions must be made to totally conform to these standards. We will review this letter with the Planning and Zoning Commission at the August 24, 1976 meeting. Moka, MN 55303 RE: Round Lake Estates, Plat Commission No. 6223-76 Gentlemen: In the August 10, 1976 memo, Rex W. Stockwell requested certain items on the above plat. Programmed Land, Inc. hereby agrees to the following: 1. We consent to the subdivision of the property by James Lund Contruction, Inc. or James Lund. \ ) 2. Concurrently with filing of the final plat, Programmed Land, Inc. will also donate an additional parcel of park land at the east end of the cul-de-sac on l49th Avenue N.W. as relocated in accord with item l5 of Rex W. Stockwell's memo. The additional park land will give the City park property to use for its foot bridge along with parking and will be shown on the revised preliminary plat. 3.
