" ) '\ / ~ ' \ , ./ "-) CITY 01 ANDOVER ~) \ J / REGULAR PLANNING AND ZONING COMMISSION MEETING SEPTEMBER 28, 1976 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:30 P.M. by Chairman Ken Orttel on September 28, 1976, at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Dave Jack, Don Jacobson, Ralph Kishel, Ted Lachinski, and Larry Retzlaff Commissioners Absent: Art Jaworski Also Present: Rex Stockwell, Engineer from T.K.D.A., and others Minutes ,_J Motion by Commissioner Retzlaff, seconded by Commissioner Lachinski, to approve the Minutes of September 15, 1976. Vote on motion: yes- Chairman Orttel, Commissioner Retzlaff, Commissioner Lachinski, Commissioner Kishel; present - Commissioner Jack, Commissioner Jacobson. Motion carried. Barnes' Rolling Oaks 2nd Addition Continued Preliminary Plat Public Hearing Comm. #4-76-8 Brad Wicklund, developer, and Fay Barnes, owner, were present. Mr. Wicklund, Mr. Barnes, Rex Stockwell (Engineer), and the Commission discussed: 1) Engineer's letter dated 9-23-76 (copy attached); 2) the 3 major areas of wetland - they could be handled by filling with materials from the construction of the roads - Lot 4, Block 5 seems to be the one of most concern; 3) soil borings - Test Hole #4 wasn't bored because of Mr. Barnes' corn crop. Mr. Stockwell would like 2 more soil borings and will review the borings with James E. Thurston, Building Official; 4) percolation tests were all pretty good; 5) ditch - cleaning and maintainance and the increased culvert required on Andover Boulevard. Mr. Barnes said the railroad had partially cleaned the ditch last winter and that the County agreed to install a culvert on Andover Boulevard; 6) Coon Creek Watershed Board has not responded to request for their comments on this plat; 7) Ordinance 10 - 9.04(a). Motion by Commissioner Lachinski, seconded by Commissioner Jack, to continue the Barnes Rolling Oaks 2nd Addition to the October 12 regular Planning and Zoning Commission meeting. Sketch Plan (Comm. #9-76-4) Bob DeGardner, representing DeMatt's, Inc. presented a sketch plan of 5 acres - 10 lots plus Outlot A and Outlot B~w ich was previously '. Dc. O-ran . Je..sl,t\e~ ln 1963 by Jacob Lundgren. Advised Mr. L ren gf the follow~ng: no outlots are allowed; lot 4 (81') is a little shallow; the assessment t~ hearing on October 7, 1976. Discussed assessments, how to divide, etc., ~.rr~?~ the land in outlot A. Mr. DeGardner will proceed with the platting IO"~ after getting more information at the assessment hearing. Don Hallblade Sketch Plan (Corom. #9-76-5) Mr. Hallblade owns 1.62 acres - parcel 6370 plat 65928 - in Green Acres between Ivywood Street and Heather Street and proposes 3 lots - 2 ~-acre lots and one larger lot where his house is. Discussed rezoning: to rezone all of Green Acres or to spot zone this parcel. It is on the City Council Agenda of October 5, 1976. The Planning and Zoning Commission will wait for the Council's decision. Discussed dimensions of Mr. Hallblade's property. With the exception of the zoning, the proposed plat seems to be in order. '\ ,) John Blomquist, Inc. Variance (Corom. #9-76-6) Robert Bement, representing John Blomquist, Inc., explained the request for a Variance to allow a house to be constructed on parcel 5800 plat 66094. Discussed: the road (Butternut Street), no one knew for sure if the City had accepted the 33' that this parcel is fronting on; when the lot was recorded. This item will be continued until the October 12th meeting to allow time to see who owns the road and when the lot was recorded. Bingo Ordinance discussion (Corom. #8-76-5) The Commission discussed the Champlin Ordinance, the Anoka Ordinance, the State Ordinance, and State Statutes they had received through Attorney Hawkins's office. Discussed: Chapter 349; license fee; alcoholic beverages - to allow or not; Chapter 261; auditing the books of those obtaining permits; supervising and personnel and paperwork involved; problems that could result; no people to get a permit since St. Patrick's moved out of the City. Commissioner Jacobson expressed concern over the problems and implications that the City could get into with an Ordinance similar to those reviewed. Discussed how the State might control Bingo if the City didn't adopt an Ordinance. \J Motion by Commissioner Jack, seconded by Commissioner Kishel, that the Planning and Zoning Commission recommend to the City Council the Bingo Ordinance form that the City Staff recommended with the following sentence in Section 2 - "All licenses shall be obtained from the Clerk of the municipality and must be approved by the City Council." - changed to ~) (J \J (~ \.J (\ " ~) o ,- ') / Planning and Zoning Commission Meeting Minutes - September 28, 1976 Page 3 read as follows: All licenses shall be obtained from the Clerk of the municipality only after approval by the City Council. Vote on motion: yes - Chairman Orttel, Commissioner Retzlaff, Commissioner Lachinski, Commissioner Kishel, Commissioner Jack; no - Commissioner Jacobson. Motion carried. This will be on the City Council Agenda for October 19, 1976. Housing Code Ordinance discussion (Comm. #9-76-3) Discussed rental units and annual review, the ordinances received from other communities, and that it seems that FHA or VA is the only way to restrict or enforce housing codes. Continued to the next meeting. Lot Suitability discussion (Comm. #9-76-7) Discussed the document the Commission received that the City of Ham Lake uses. It should be incorporated into the new Ordinance 10. Will discuss at the time of rewriting Ordinance 10. Capital Improvements Program discussion (Comm. #9-76-8) Dewey Kasma is working on sewer improvements study and feasibility studies now. Everyone agreed that the City Council should initiate work on the Capital Improvements Program. Ad;ourrnnent Motion by Commissioner Jack, seconded by Commissioner Lachinski, to adjourn. WEBER Planning and Zoning Commission Andover, Minnesota Re: Barnes' Rolling Oaks Second Addition Preliminary Plat Review Andover, Minnesota Commission No. 6223-76 Commission Members: GEORGE J. SCHROEPFER CLIFFORD w. HAMBLIN EDWARD J. BOOTH We have reviewed the preliminary plat for proposed Barnes' Rolling Oaks Second Addition. The following are our comments to the requirements of existing City ordinances and the proposed plat: related 1. Several areas within the proposed plat, unless graded and filled to provide proper surface drainage, may collect storm water and remain wetland during wet season of the year. The ground surface elevations in these areas should be altered to provide for proper surface drainage to proposed drainage ways. These areas should be shown on the preliminary plat by light shading of the area. We will discuss these areas with the Commission at the September 28, 1976 meeting. 2. The 10' drainage and utility easements along Palm Street north of 148th Lane NW have not been shown and are required on the preliminary plat. 3. We have determined nine locations where soil borings and percolation tests are required. These locations have been given to the developer. However, no test hole results have been received. 4. Following soil borings and determination of water tables, minimum base- ment floor elevations can be shown. \ , ) \ ; " , ) / Andover Planni ng and Zoning Commission September 23, 1976 Page Two 5. The standard rural street section should be revised to show a 32' gravel driving surface rather than the 34' width indicated. All other requirements of the Subdividing and Platting Ordinance have been complied with and included in the revised preliminary plat dated July 30, 1976.
