The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:35 P.M. by Chairman Ken Orttel on October 26,
1976, at the Andover Community Center, 1685 Crosstown Boulevard NW,
Anoka, Minnesota 55303.
Commissioners Present: Don Jacobson, Ralph Kishel, Ted Lachinski,
Larry Retzlaff
Commissioners Absent: Dave Jack and Art Jaworski
Also Present: Rex Stockwell, Engineer from T.K.D.A., and others

Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff,
to accept the Regular Planning and Zoning Commission Meeting Minutes of
October 12, 1976 with the one exception. Motion carried unanimously.
Rezoning of Green Acres (Comm. #10-76-2)
Chairman Orttel called the public hearing to order at 7:40 and stated
that the residents of Green Acres had been notified of the hearing.
He advised that the Planning and Zoning Commission had received direction
from the City Council to rezone the area known as Green Acres (The
South ~ of the SW~ of Section 28, Township 32, Range 24 and the NW~
of the NE~ of Section 33, Township 32, Range 24, Anoka County, Minnesota)
from R-1 to a zoning classification consistent with the size of lots
and sanitary sewer just installed. Green Acres was granted a blanket
variance at one time to be divided into small lots with metes and bounds
descriptions. A majority of the lots are already built on so it wouldn't
affect them, but the unbuilt on lots are in question. Chairman Orttel
explained the various zoning classifications.
After asking for comments from the audience, the following are some of

Tom Wolters, 14208 Ivywood Street NW, said, "I don't think the zoning
should be less than it is now. If the lots are smaller, then the homes
will be smaller. With more homes in the area, there are more kids.
The schools are now at full capacity. There is one street into the area.
I feel there shouldn't be less than 100' lots. I would go along with
R-3 zoning. The zoning is to protect people - leave it as it is.
Mrs. Tom Wolters, 14208 Ivywood Street NW, stated that she didn't want
any more traffic, doesn't want little houses, or more school problems.
Herb Lorentz, 3030 - l42nd Lane NW, said he preferred 2~ acre lots.
Kenneth W. Tschida, of Tschida Realty, said, "We purchased the property
of Gilbert Menkveld and had no intention of devaluing the area or your
neighborhood. We will build no ramblers, only splits. The property,
except for the middle area, is already platted into lots of record."
General discussion on types of homes, value and size of those existing
in Green Acres, buses, fire trucks, congestion, only one access to the
area.

General discussion on Mr. Tschida's plans for developing the property
formerly owned by Mr. Menkveld. Discussed the ditch going through the
area.
Rex Stockwell, Engineer from T.K.D.A., said that the developer could
put a street down the middle of it and would pay for Dahlia Street if
they wanted it completed. Assume it would be constructed similar to the
other Green Acres streets, although the type of road would be up to
the City Council.
About 26 residents in attendance for the public hearing. Discussed
R-1 zoning - dog kennels allowed and such.
Gilbert Menkveld, 745 East Main Street, "The builder nor myself did not call
for this rezoning."
Russell Lentz, 14222 Ivywood Street NW, "I asked Dewey Kasma when they
were going to build Dahlia Street and he said definitely not - that they
would have to dig out 14' of peat. I think the larger lot size would
be better."

John Noard, 14216 Heather Street NW, stated that he had thought about
developing or splitting his property. The assessments are large.
His house is situated on the lot so it could be split into 2 lots.
General discussion on the low land in the area.
Jan Pasche, 2950 - l42nd Lane NW, said that she thought there shouldn't
have been any houses built there in the first place.
Tom Wolters asked that the Planning and Zoning Commission explain what
the zoning areas are and let the people vote on it.
Chairman Orttel read minimums from Ordinance 8 - Section 6.02 - and
explained that the smaller lots have more restrictions.
Some one asked if the developer could change all the existing unbuilt
lots of record and was advised "yes".
Phil Rzeszutek, 14242 Ivywood Street NW, "Most of our lots conform with
R-3."

Motion by Commissioner Lachinski, seconded by Commissioner Kishel,
to close the public hearing on Green Acres Rezoning. Motion carried
unanimously.
Motion by Commissioner Lachinski, seconded by Commissioner Jacobson,
that the Planning and Zoning Commission recommends to the City Council
that the area known as Green Acres, as described in the public hearing
notice, not be rezoned at this time. No action is recommended at this
time because the residents in the area feel they want to base any future
rezoning on the merits of a definite proposal for developing the land.
Further, some of the existing lots in the area do not conform to R-3
zoning. It is the findings of the Planning and Zoning Commission that
by keeping the zoning R-1, that it currently is, it would not have an
adverse effect on the health, safety, and welfare of the occupants and
surrounding lands and would be for the betterment of the community.
Commissioner Retzlaff said, "14 people from the area of 55 homesites
or 26% of the people came and were heard tonight. All the input came
from the western section or the bigger more expensive homes." He asked
the Engineer about the construction material of additional streets in
the area, if studies had been made for another access to the addition,
and if the sanitary sewer and storm sewer was adequate to handle additional
homes.

Engineer Stockwell said that the storm sewer was put in to handle extra
homes in the unbuilt area. When that area is developed, the developer
would have to put in a pipe to take care of the homes that he would
put in. The sanitary sewer was put in to allow for further development.

The Commission discussed: 141st as only access to the area - the recent
proposal to extend Heather to South Coon Creek Drive - the residents
didn't want another access because of more traffic with a through street;
future rezoning - spot zoning.
Commissioner Kishe1 said, "We are looking at lots that were platted just
in excess of R-3 zoning. These lots are 110' frontage and depth of
200'. When sewer comes in, a person with a large parcel of land then
has land that would be more valuable and I believe that it is time for
rezoning."
Commissioner Jacobson asked about the City Council asking for the rezoning
and Commissioner Retzlaff again stated his opinion that the lots conform
to R-3.
Vote on motion: yes - Chairman Ortte1, Commissioner Lachinski, Commissioner
Jacobson; no - Commissioner Retzlaff, Commissioner Kishe1. Motion
carried.
This item will be on the City Council Agenda November 16th.

Michael Quinlan Special Use Permit (Dog Kennel) Comm. #10-76-3

Chairman Ortte1 opened the public hearing and Mrs. Quinlan came forward
and explained their reasons for the Kennel License. Mrs. Quinlan said,
"Most of the dogs are strays. We have between 8 & 12 dogs - currently
12. We are getting a kennel license to comply with City Ordinances.
We have had a fence on order for 4 months(because of a strike). We
are reinforcing and putting in cement in the existing kennel and putting
in cement in the basement so that we can have a kennel there also."
She cited the existing kennel on South Coon Creek drive and said they
(the Quin1ans) are not raising, selling or breeding dogs.
Motion by Commissioner Retzlaff, seconded by Commissioner Kishe1, that
the Andover Planning and Zoning Commission recommends to the City Council
the approval of the Special Use Permit for Michael L. Quinlan on the
grounds that the property is suitable for the kennel proposed and there
was no public objection to the request for the Special Use Permit.
Discussion: whether to include something about not selling dogs; to
limit the number of dogs in the kennel; Ordinance 8 covering R-1 zoning
and dog kennels. Mrs. Quinlan said that they have enough dogs but if
she saw a dog that really needed a home she would accept another animal.
Motion carried unanimously. This will be on the City Council Agenda
November 16, 1976.

Grow Oak View Estates Preliminary Plat (Comm. #7-76-1)
This item was referred back to the Planning and Zoning Commission because
of a problem with the streets in the plat. The paved streets that are
in have been in for several years and they are 30' wide and the City
now requires 32'. Mr. Stockwell gave a letter dated 10-26-76 to the
Commission from T.K.D.A. (copy attached). He advised that T.K.D.A.
wouldn't recommend widening the street because it would create more
problems.
Motion by Commissioner Retzlaff, seconded by Commissioner Kishel, that
the Planning and Zoning Commission recommends to the City Council the
approval of Grow Oak View Estates per the previous recommendations,
along with the recommendations of the City Engineer's (T.K.D.A.) letter
of October 26, 1976. The County is in the process of finalizing plans
for the construction of C.S.A.H. #7 for realigning it, so it would be
similar to C.S.A.H. #5, and it would alleviate the necessity of a collector
street. Motion carried unanimously. Will be on the City Council agenda
November 16, 1976.

Barnes' Rolling Oaks 2nd Add'n Continued Preliminary Plat (Comm. #4-76-8)

Fay Barnes and Brad Wicklund were present. Rex Stockwell gave the Commission
a letter (Copy attached) from T.K.D.A. dated 10-26-76. The letter was
reviewed and the Commission discussed some of the items still not completed
on this plat: temporary cul-de-sac not shown, no reply from Coon Creek
Watershed Board (Rex talked to Mr. Israelson, Engineer from the Watershed
Board), and additional soil borings must be taken.
Motion by Commissioner Jacobson, seconded by Commissioner Retzlaff,
to continue this to the next meeting to allow for the final revision
on the map indicating the temporary cul-de-sac on Palm Street and installation
of the new culvert and for the report on soil borings on Block 1 - Lot
7, Lot 8, and Lot 10. Motion carried unanimously.
Ordinance 36 Amendment (Comm. #8-76-4)
No information received. Will schedule for next agenda.

to adjourn. Motion carried unanimously. Meeting adjourned at 10:00 P.M.

Gentlemen:
The City Council at their October 5, 1976 meeting reviewed
the proposed plat of Grow Oak View Estates. During the
review, the Council expressed concern for the width of
the existing bituminous street, Navajo Street, and requested a clarification
on type of street, minor or collector.
The attached map shows the City's existing and proposed highway system
including county highways and MSAH roadways. Near the proposed development,
CSAH 7 serves as an existing collector street. At a point in time when the City
experiences ultimate development in the area of the proposed development, an
additional collector street may become necessary. This future street should
be constructed through the "heart" of the specific area to ultimately serve the
future residents. We have indicated a possible alignment of this collector
street on the attached map.

The existing bituminous street has been constructed to a width of 30 feet as
opposed to the adopted City Standard of 32 feet. To obtain a width of 32 feet,
an additional one foot width of bituminous would be required on each edge of
the street surface. This construction would be impractical and greatly increase
future maintenance costs for the roadway.

RECOMMENDA nON
We recommend designating the proposed street a minor street rather than a
collector street and not requiring additional width construction to a width of
32 feet.
We will discuss this letter with the Planning and Zoning Commission at the
October 26, 1976 meeting.

Gentlemen:
We are writing to report on two items regarding the pro-
posed Barnes' Rolling Oaks Second Addition in the City
of Andover.

The Commission has received a great deal of discussion regarding
the existing CMP culvert under Andover Boulevard. Since the ori-
ginal filing of the plat, the existing ditch north of Andover Boulevard
has been cleaned and shaped to provide drainage to the CMP culvert.
We contacted Mr. Cal Behr of the Anoka County Highway Dept. to
discuss modifications to the existing culvert. During the week of
October 18, 1976 the highway maintenance crew replaced the damaged
culvert with a new CMP culvert under Andover Boulevard.

2. We also contacted Mr. Harry Israelson, engineer for Coon Creek
Watershed, regarding the Board's recommendations and/ or comments
on the proposed plat. Mr. Israelson indicated he has never received
a copy of the plat to review. In checking further, we found the plat
was sent to Mr. Loren Hentges, chairman. However, our attempts
to contact him failed.
We will discuss this letter with the Planning and Zoning Commission
at the October 26, 1976 meeting.
