October 12, 1976
MINlITES
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:30 P.M. by Chairman Ken Orttel on October 12,
1976, at the Andover Community Center, 1685 Crosstown Boulevard NW,
Anoka, Minnesota 55303.
Commissioners Present: Don Jacobson, Ralph Kishel, Ted Lachinski,
Larry Retzlaff
Commissioners Absent: Dave Jack and Art Jaworski
Also Present: Rex Stockwell, Engineer from T.K.D.A., and others

Corrections: Page 2 - DeMatts, Inc. Sketch Plan - change the word
"platted" to "designed" and change "Mr. Lundgren" to "Mr. DeGardner".

Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff,
that the Minutes of September 28th regular Planning and Zoning Commission
Meeting be approved with the one exception. Motion carried unanimously.
Barnes' Rolling Oaks 2nd Add'n Continued Preliminary Plat Public Hearing
Comm. #4-76-8
Those present representing Barnes' Rolling Oaks were Faye Barnes, Brad
Wicklund, and Jim Haney. The Commission and Mr. Stockwell received
revised plats and a revised street section from Mr. Wicklund. Mr.
Stockwell was given the soil boring and percolation test information.
Discussion and comments: Minutes of 9-28-76, discussed previous things
that needed correcting; road changed from 34' to 32'; no response from
Coon Creek Watershed Board - Mr. Stockwell will contact Mr. Israelson,
the Engineer for the Board, to see if there are any comments or changes
desired; the ditch was cleaned to Andover Boulevard last week; Mr.
Stockwell will meet with the County Highway Department regarding the
culvert at Andover Boulevard; Palm Street, North of l48th Lane, should
be constructed as a temporary cul-de-sac; the additional borings and
percolation tests have been done; discussed soil types, water level,
and elevations; several of the lots should be rechecked to determine
the water level in previous years, since the extreme dry weather this
year perhaps doesn't reflect a true water level.

Lengthy discussion on buildable and unbuildable lots - whether the
ordinance requires only buildable lots on a plat, the problems incurred
by the City and by someone buying a lot and then being turned down for
a building permit because the lot is unbuildable, determining what
is an unbuildable lot, either combining lots to eliminate unbuildable
lots or fill them. Discussed filling - dumping fill on the surface
or removing the peat and replacing it and adding fill and then compacting.
Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff,
to continue the Barnes' Rolling Oaks 2nd Addition Preliminary Plat
to the October 26th regular Planning and Zoning Commission meeting to
allow time for the developer to take additional soil borings, to allow
for revision of the plat to include the cul-de-sac on the North end
of Palm Street, to readjust the lots and whatever revisions are necessary
to make the lots buildable.

in purchasing the land were present. Items mentioned in discussion
of the above Variance: 33' accepted City road; size of lot - 160 x
330; this lot was recorded prior to the ordinance; high in front -
lot of trees - drops down toward back; fronts on public street; 1.21

Motion by Commissioner Retzlaff, seconded by Commissioner Lachinski,
that the Planning and Zoning Commission recommends to the City Council
that the John Blomquist, Inc., variance be accepted because it was a
lot of record prior to the ordinance and that the lot does front on
an accepted public right-of-way. Motion carried unanimously.
This will be on the City Council Agenda for October 19, 1976.
Vacation of l33rd Avenue (Comm. #10-76-1)
Chairman Orttel opened the Public Hearing and explained the background
for this item. The portion is from Crooked Lake to Gladiola Street
and is the boundary between Coon Rapids and Andover. The City of Coon
Rapids received a petition for vacation, held a public hearing, and
vacated their ~ of the street. The City of Andover has now received
two petitions - one for and one against. It seems that everyone in
the area had bought in the area with the idea that they had a public
access to the Lake in their immediate neighborhood.

Don Taylor, 13306 G1adio1a Street NW, stated, "My property abutts this
property. Our family maintains and takes care of this property. It
is not a road now. There is a parcel of land at 136th Avenue and G1adio1a
to get access to the lake, the City land on the North side of the lake,
and also the City of Coon Rapids has a park to the South of this area.
There is no parking so people have to park in the intersection. If
it was vacated, it would be put on the tax rolls and that would be
money put into the City. It is mainly used by snowmobilers and people
carrying canoes or rubber rafts."
Norman Shequen, 13317 Gladio1a Street NW, said, "There should be no
parking problem because the City has an Ordinance against it. I use
it for snowmobile access to the lake in the winter and would not ride
across other people's property. At the North end of the lake,
there is a 40' lot with no parking facilities and you can't launch
anything at the public beach of Coon Rapids; and you also have to get
a license from Coon Rapids to ride snowmobile in Coon Rapids." Mr.
Shequen explained the situation this summer where someone left a boat
parked there, which he feels brought on this whole "vacation" situation.
Mr. Taylor stated, "The City of Coon Rapids has already vacated their
~ of the street."

Forest Medin, 13316 Gladiola Street NW, mentioned that there is a potential
problem, an attractive nuisance, and it would be easier to abandon it
now before it becomes a problem. He thought that the City should consider
the capability of Crooked Lake and that Coon Rapids thought there is
already too much boat traffic.
Mrs. Don Randall, 13256 Gladiola Street NW, who lives on the Coon Rapids
side of the street, said, "We have been here for 15 years. There is
getting to be more and more use and abuse. People are leaving junk
and trash and, in general, doing a lot of littering. The City of Coon
Rapids didn't feel that with the large Park Department they have that
it would be feasible to maintain 33' so they vacated it and we were
able to purchase it."
Scott Schwen, 13339 Eide1weiss Street NW, stated, "We just purchased
a home and were told there was an access for cross country skiing and
canoeing. It seems to be more of a neighborhood usage and then parking
shouldn't be a problem. I don't want to see boats running on the lake,
but I feel that rubber rafts, canoes, snowmobiles, or cross country
skiing is a good, justified use. I feel that a good usage by the City
would be to designate the area to the lake as a right-of-way by posts
and install trash barrels and signs so that only this strip of land
could be used."

Ted Wilson, 13232 Gladiola Street NW, said, "I live 3 doors South of
the area spoken of and have lived there 8 years. There is another access
on the North side of the lake and across the lake. There is loud partying,
trash, and the City doesn't maintain the property. You can drive a snowmobile
on the lake at l36th."
Mr. Shequen, said, "If this is approved, then the access at l36th, and
also the North end and pretty soon there would be no access to the lake."
After being asked how many people use l33rd as an access, the residents
generally agreed that not very many people use it.
Mr. Wilson, said, "It seems to me that the people who are against it
don't live near to have the problems with parking and such."
Chairman Orttel, "I am getting the impression that we are talking about
two different things. Number one - has the problem existed to warrant
taking it out of public ownership? Number two - if we leave it as a
public access, what is going to happen in the future?"

The Commission discussed the problems that other Cities have had over
the years with selling lake access and then wishing to buy it back
at a later date. They agreed that the park board should look at all
the accesses on the lake and determine future park use.
Dick Larson, 2849 - l34th Avenue NW, said that he has lived there for
some time, uses the access to walk down to the lake in the winter, and
suggested the Park Department should have the land and save these people
from all the headaches and problems in taking care of it. Maybe a
trail system for hiking or cross country skiing could be started.

Motion by Commissioner Jacobson, seconded by Commissioner Kishel, that
the Planning and Zoning Commission recommends to the City Council that
l33rd Avenue NW, from Gladiola Street to Crooked Lake, not be vacated
and this roadway easement be used for public access for local residents
and for the enjoyment of the citizens of the City of Andover; and, that
the Commission also would recommend to the City Council that this be sent
to the City Park Board for their consideration of the area for possible
maintainance. We make this recommendation based upon citizen input
at the public hearing and also upon signed petitions of people in the
area. Motion carried unanimously.
The two remaining items on the Agenda will be taken care of at a later
date.

to adjourn. Motion carried unanimously.

RESOLUTION NO. 76-67
RESOLUTION VACATING STREET
WHEREAS, by Resolution dated July 20th, 1976, the Council of
the City of Coon Rapids, ordered a public hearing on the vacation of the
street described as follows:
That certain portion of the South Half of 133rd Avenue
N.W. between Gladiola Street on the east and the
shoreline of Crooked Lake on the west, in the City of
Coon Rapids, County of Anoka7 State of Minnesota.
WHEREAS, notice of said public hearing was duly published in
the Coon Rapids Herald on July 30, 1976, and August 6, 1976, and notice of
said Public Hearing was duly posted, all as provided by City Charter
Section 1-1206, and as evidenced by exhibits attached hereto and made a
part hereof, and,
WHEREAS, said hearing was duly held on the 17th day of
August, 1976, at 8:00 P.M. at the City Hall, 'and all r:ersons so desiring to

be heard were then heard,
NOW, THEREFORE, BE IT RESOLVED, that the Council of
the City of Coon Rapids finds that it is in the public interest to vacate the
street described as:
That certain portion of the South Half of 133rd Avenue
