REGULAR PLANNING AND ZONING COMMISSION MEETING
July 27, 1976
MINUTES
The Regular Meeting of the Andover Planning and Zoning Commission was
called to order at 7:35 P.M. by Chairman Ken Orttel on July 27, 1976,
at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka,
Minnesota 55303.
Commissioners Present: Don Jacobson, Ralph Kishel, Ted Lachinski,
and Larry Retzlaff
Commissioners Absent: Dave Jack and Art Jaworski
Also Present: Richard Schneider, Andover Mayor, and others
Minutes
Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff,
that the July 13, 1976 Minutes be approved. Motion carried unanimously.

Country Estates Sketch Plan (Comm. #7-76-3)
No one at the meeting to present the sketch plan at this time.
Richard Gabrish Variance (Comm. #7-76-4)
Mr. Gabrish came forward and told of his reasons for the Variance. He
has built his house with a corner of it 2 to 3 feet onto his neighbor's
property. Mr. Allen Luebke, 16019 Swallow Street, the adjoining property
owner, explained that he wishes to build a detached garage so therefore
would be willing to sell only enough land to meet the Ordinance requirements.
The Commission, Mr. Gabrish, and Mr. Luebke discussed: zoning (R-l),
Mr. Gabrish's house is 80' from the street, the lot runs at a 330 angle
to the street, a Variance is the proper procedure, whether it should be
surveyed now or after it has gone before the Council, this is a metes
and bounds subdivision, rear and sideyard setback requirements (Ordinance
8 - 6.02), combining Mr. Gabrish's existing property - parcel 5650 -
and the new addition of land into one common parcel or description, and
a proper legal description to accurately describe the land requested.

Motion by Commissioner Jacobson, seconded by Commissioner Lachinski,
that the Planning and Zoning Commission recommends to the City Council
the granting of a variance for Mr. Richard Gabrish's property located
at 16011 Swallow Street NH. The variance would be to convey the amount
of land necessary to meet the requirements of Ordinance 8 - Section 6.02
and as shown on the sketch submitted with the variance request. Subject
to the two individual parcels being combined into one common description.
Motion carried unanimously.

Grow Oak View Estates Continued Public Hearing (Comm. #7-76-1)
This will be on the August 10, 1976 Agenda because the developer is not
ready with the requested revised plats.
Barnes Rolling Oaks 2nd Addition Continued Public Hearing (Comm. #4-76-8)
This will be on the August 10, 1976 Agenda because the developer is
not ready with the requested revised plats.
Dog Ordinance (Comm. #4-76-3)
This has, once again, been sent back to the Planning and Zoning Commission
by the City Council for further action on primarily the following items:
tagging of dogs, licensing of kennels, and rabies shots.
Tagging - discussed the weakness of the tags the City uses now and the
fact that people have said the tags wear out and falloff; the owners
of show dogs would not put a collar or tag on their animals; tattooing;
all agreed that each and every dog should have a tag.

Licensing of kennels - discussed the paperwork, etc., for issuing individual
licenses; discussed an animal hospital or kennel where dogs from other
areas would be boarded; all agreed that each dog in a kennel should be
licensed in addition to the fee for the kennel license.
Rabies shots - discussed the fact that many owners administer shots
to their animals; discussed the cost of having a Vet give shots; talked
about how the City would know if an owner had actually given a shot;
discussed legal document an owner might be required to submit verifying
the rabies shot.
Motion by Commissioner Lachinski, seconded by Commissioner Kishel, that
the Dog Ordinance, as attached, be approved by the City Council with
no change as the last time presented for the following reasons: 1)
we feel that the animal must have a tag and be licensed in some City
(refer 1st sentence in Section 3); 2) fee scheduling for kennels -
(refer back to Section 3 - no person shall keep any unlicensed dog)
every dog must be licensed and it is the feeling of the Commission that
no break be given to the owner of over a certain number of dogs; 3)
shots - there would be loopholes and the City would be unable to control
because soon everyone would have show dogs and everyone would be giving
shots. Vote on motion: yes - Commissioner Retzlaff, Commissioner
Lachinski, Commissioner Kishel, Commissioner Jacobson; no - Chairman
Orttel. Motion carried.

Ordinance 8 (Comm. #7-76-5)
Chairman Orttel explained to the Commission the City Council's request
for a Public Hearing by the Planning and Zoning Commission and several
of the items in Ordinance 8 that should be changed or corrected. Some
of the sections mentioned were: 3.02, 4.04, 4.30, 4.06, and 7.01. A
Public Hearing will be held on August 10, 1976 for the purpose of amending
Ordinance 8 although the Commission felt the hearing was premature in
that Metro Council should be providing information regarding the Community
Development Plan in September or October which will affect Ordinance 8.
County Highway Building Site (Comm. #7-76-6)
This item was not on the published Agenda was brought up because the
Commissioners had received a letter from the County. Based on the fact
that a ma~which was to have been included with the letter to the Commission,
was not attached and the letter was a little vague, it was suggested
that Chairman Orttel check with Commissioner Ed Fields for further
information.
