Commissioners Present: Dave Jack, Don Jacobson, Art Jaworski, Ralph Kishe1, Ted Lachinski, and Larry Retzlaff Also Present: Rex Stockwell, Engineer from T.K.D.A., and others Minutes Motion by Commissioner Jack, seconded by Commissioner Retzlaff, to approve the Minutes of May 3, 1976. Vote on motion: yes - Chairman Ortte1, Commissioner Retzlaff, Commissioner Lachinski, Commissioner Kishe1, Commissioner Jacobson, Commissioner Jack; present - Commissioner Jaworski. Motion carried. '- / Motion by Commissioner Retzlaff, seconded by Commissioner Lachinski, to approve the Minutes of May 11, 1976. Vote on motion: yes - Commissioner Jack, Commissioner Jacobson, Commissioner Kishel, Commissioner Lachinski, Commissioner Retzlaff, Chairman Orttel; present - Commissioner Jaworski. Motion carried. City Wide Properties Variance (Comm. #5-76-1) Per letter (copy attached) from City Wide Properties, the matter has been resolved so that a Variance is no longer necessary. E. V. Builders Variance (Comm. #5-76-2) Chairman Ortte1 talked with the City Attorney today regarding the 30' requested and also combining the 2 parcels into one. The Commission and Mr. and Mrs. Beaudry discussed the letter (copy attached) from James Neilson, of Babcock, Locher, Neilson, & Mannella dated 5-25-76. Motion by Commissioner Kishel, seconded by Commissioner Jaworski, that the Planning and Zoning Commission recommends the City Council approve the Variance of E. V. Builders because of the fact that the property is improved with the home and the additional portion of land attached to the lot would be more in conformity with the existing Ordinance - specifically the setback (Ordinance 8 - 6.02) - together with the recommendations that we have received from our Attorney. Amendment by Commissioner Jack, seconded by Commissioner Kishel, to request the petitioners of the Variance to combine the parcels and arrive at one common description as suggested in the letter from James Neilson dated 5-25-76. Motion and amendment carried unanimously. This will be on the City Council Agenda June 15, 1976. \ , ) -- ./ -fh- ~ '\ , ) , , ) ) \ / , ) '- ) (J , ) '-J Planning and Zoning Commission Meeting Minutes - May 25, 1976 Page 2 Barnes Rolling Oaks Preliminary Plat Continued Public Hearing (Comm. #1-76-3) Brad Wicklund brought a revised plat and gave one copy to the Engineer, Rex Stockwell, and one copy to the Commission. He has changed the angle of l46th Lane and eliminated Goldenrod Street. He reported that Coon Creek Watershed Board said they wouldn't be able to pass a Resolution on the drainage ditch because they didn't know where it empties. They have requested an affidavit from everyone below this drainage ditch saying that it would be adequate. Goldenrod has been eliminated and they have increased the width on 4 lots. The setback line has been indicated. , Discussed the culvert on University Avenue that might be overloaded. ~~isJ,~~ Mr. Stockwell stated that the City extended thel"Ctilvert to 18" a number \ of years ago, so it should be looked at to see if anything needs to be done. Discussed the need for a letter of intent regarding the construction 1- d of l46th Lane. Mr. Stockwell stated that the City should require ~ ~b CFed( lJatersaed- to upgrade the ditch and he would like to see the profile of the ditch and how they would clean it. Mr. Wicklund said they were planning to have a profile shot on the ditch, but are waiting to hear from the Watershed Board. Chairman Orttel will call Loren Hentges to clarify the Watershed Board's position. Discussed the reasons to provide the Commission with individual copies of a revised plat with adequate time prior to the meeting to review. The following are items pending that should be taken care of: 1) notation on width of future service road. 2) Housing setbacks in regard to distance from future service road. 3) Coon Creek Watershed report. 4) Profile on existing and proposed drainage depth with a 300' addition on either end of the drainage field as shown on the Preliminary Plat. 5) Legal documentation in regards to a guarantee to the completion of l46th Lane. 6) park dedication. Motion by Commissioner Jacobson, seconded by Commissioner Jaworski, to continue the Public Hearing until the June 8th meeting. Motion carried unanimously. 11 P.M. Adjournment and Special Meeting Motion by Commissioner Jack, seconded by Commissioner Jaworski, to close the meeting at 11 P.M. or item #7 on the Agenda; and to hold a Special Meeting at 7:30 P.M. on Thursday, May 27, 1976. Motion carried. , ) I \--./ ,- ) .~,) (J ) \.... / '\ ,__..J Planning and Zoning Commission Meeting Minutes - May 25, 1976 Page 3 Country Estates Preliminary Plat Public Hearing (Comm. #9-75-2) Mr. Hoium presented copies of a revised plat to the Commission. Rex Stockwell reviewed his letter to the Commission dated 5-19-76 (copy attached). The renaming of the existing l35th Avenue should be done by the City Council. Regarding item #9 (streets, storm sewer, and sanitary -t;.J t,jgj l: sewer) of Mr. Stockwell's letter, Willi~G. Ha~i~ _ City Attorney- ~. 1 advised Chairman Orttel today that,11~e'sdit)}. <<C;;'iid \es.uire a 20% escrow deposit by the developer for the gross amoun~~~~e job and then bonding for the remainder. The Attorney will ask that the City establish a policy that new construction would payoff their assessments quicker than the existing houses. Discussed:the corrections made by Mr. Hoium, Gladiola Street construction, County requirements and road easement for Crooked Lake Boulevard, lot alignment, 105' depth on lots - 130' ordinance requirement, corner lot requirement (Ordinance 10 - 9.06 (c)). ;/ \ \J Motion by Commissioner Kishel, seconded by Commissioner Lachinski, to close the Public Hearing. Motion carried unanimously. Motion by Commissioner Kishel, seconded by Commissioner Jack, that the Planning and Zoning Commission recommend to the City Council the Preliminary Plat of Country Estates Addition be approved because it conforms with the design standards of Ordinance 8 and Ordinance 10 with the exception of minimum lot depth (Ordinance 8 - 6.02) not meeting the full 130' but due to the fact that it is in the sewered area and R-4 zoning. Amendment by Commissioner Jaworski, seconded by Commissioner Kishel, that the Plat was fully reviewed by the Engineering Firm of T.K.D.A. and has met with their approval. Discussed park dedication and that the developer is willing to dedicate money in lieu of land. Amendment by Commissioner Jacobson, seconded by Commissioner Lachinski, to include that the City accept money in lieu of land because of the size of the proposed plat. Motion and amendments carried unanimously. Pankonin Addition Preliminary Plat Public Hearing (Comm. #4-76-10) The Public Hearing was called to order and Mr. Hoium presented a revised plat and explained the following to the Commission: there are 2 existing and 2 proposed driveways, showed the future subdivision with a service road, soil borings were taken and presented to the City 5-25-76, Lot 4 - the developer will build a new tire shop. The Commission, Rex Stockwell, and Mr. Hoium discussed: soil borings, should be 70' instead of 50' setback on Bunker, road easements on Jay Street - Hanson Boulevard - Bunker Lake Road, not residential use - must be GB, the developer has complied with all of the requests of 5-19-76 from T.K.D.A., and Park dedication. Motion by Commissioner Lachinski, seconded by Commissioner Jacobson, that the Planning and Zoning Commission recommends to the City Council to approve the Pankonin Addition subject to a building setback from Bunker Lake Road of 70' and money in lieu of land for park donation. Hulegaard Round Lake Shores Preliminary Plat & Rezoning Public Hearing (Corom. 1f2-76-1) Chairman Orttel called the Public Hearing to order and Jim Whipkey of Integrated Services - representing Trueman Hulegaard - presented the Plat to the Commission. Mr. Whipkey showed a number of graphics and explained them. 1) location on aerial photo, 2) closer view of the property, 3) possible South Coon Creek Drive extension, 4) on-site drainfields, soils, and general engineering data,S) showed photos of the property and surrounding area. The request is for NB zoning on Lot 1 and Lot 2 to remain as is. The plat received at this meeting has been revised by Mr. Hoium to follow Rex Stockwell's letter (copy attached) of 5-20-76. Comments by adjacent property owners: :- \ '.....J James Guillet, 14516 Round Lake Boulevard, "I am definitely opposed to the rezoning of this property. I just moved from Roseville (last fall) to get away from the commercialism that existed there and now this is trying to be put in my back yard. The type of business that the applicant runs across the street is quite an eyesore and I have no reason to believe that if this application is approved that it would not be another eyesore. I don't appreciate the additional traffic." John Lofstrom, 3608 - l44th Avenue, pointed out the traffic hazard because of the dip in the road North on Round Lake Boulevard and stated, "I have asked to have the proposed park fenced, but all that has happened is that "keep-off" signs were put up. This could never be a park. The traffic moves excessively on Round Lake Boulevard. I am definitely against the rezoning and there is other shopping near." He presented a petition with 56 names against the rezoning (copy attached). Clinton Anderson, 3607 - l44th Avenue, stated, "I am against the rezoning due to the noise it will create, increased traffic to contend with, and the cars would be coming out of the exit on l44th into my driveway." Joyce Sipe, 14462 Round Lake Boulevard, stated, "When this was brought up several years ago, it was mentioned that within 1000' of the lake you could not have any commercial development. I don't mind having to drive a mile to Kemps, something should be done about the waterhole, and I am very much opposed to it." ') \. ./ Mr. Whipkey advised the adjoining property owners of the proposed types of businesses that would be in the center, which would be in keeping with the Community Development Plan. ,- , '-- ) / '\ '- ) \ ) ~ ) f \ ) Planning and Zoning Commission Meeting Minutes - May 25, 1976 Page 5 " j Larry Morris, 3605 - l43rd Avenue, stated, "I would not want it to be rezoned for various reasons - basically what everyone else has already said. I am against it." Items discussed: Rezoning and Platting at the same time; Shoreland Zoning; allowable uses; NB Zoning to the South; the ponding area; previous letters and action between Building Official, City Attorney, and Mr. Hulegaard regarding the pond, junk, etc.; the various items in Mr. Hulegaard's yard being "grandfathered" in; parks; parking for vehicles at the center; Ordinance 8 - 8.08 and page 10; service area - loading dock; Community Development Plan; entrances and exits; adjacent property is screened except on the North side; septic system required depending on the type of use; a complete market analysis and feasibility study was not submitted per Ordinance requirement; the County Engineer told Commissioner Kishel that he didn't oppose the entrance onto Round Lake Boulevard with the turn lanes and the acceleration lanes being provided; definition of NB; Ordinance 8 - 4.33; much of the discussion is the same as before made by the same people; should be developed when the sewer is available; premature use; water level; building site elevation. , '\ '- ) Motion by Commissioner Jaworski, seconded by Commissioner Kishel, to close the Public Hearing. Motion carried unanimously. Motion by Commissioner Jacobson, seconded by Commissioner Jack, that the Planning and Zoning Commission recommend to the City Council denial of the rezoning based upon the following facts: 1) Local opposition - petition with 56 names of area residents. 2) Possible traffic hazards which may be accentuated by the rezoning. 3) Rezoning is inconsistent with the surrounding area. 4) Rezoning is inconsistent with the Community Development Plan. 5) The market feasibility study presented was inadequate. 6) The presently zoned business area is approximately one mile away. 7) It appears that by rezoning a neighborhood business the plans are in excess of the definition of "Neighborhood Business". 8) There may possibly be problems with sewage disposal and problems with water levels on the property. Amendment by Commissioner Jaworski, seconded by Commissioner Jack, that the proposed project may be detrimental to the health, safety, and welfare of the residents in the area; and the proposed rezoning could be construed as strip development or spot zoning. Motion and amendment carried unanimously. Robert K. Snyder Variance (Comm. #5-76-4) 1 "'- _/ Robert Snyder explained to the Commission his reasons for requesting the Variance. Robert Rylander, who lives next door, would also like to request a Variance to extend his property. The Commission and Mr. Snyder discussed: Ordinance 10 - Section 14.01, the expansion of an unapproved plat, the seller trying to circumvent the platting Ordinance by requesting the buyer to ask for a Variance, and acreage requirements in the Rural area. \ ~~ /-) ,~ ,_J i , '\ J \ : ) ~ \ ) /\ \) () Planning and Zoning Commission Meeting Minutes - May 25, 1976 Page 6 Motion by Commissioner Jaworski, seconded by Commissioner Retzlaff, that the Planning and Zoning Commission recommend that the City Council waive the platting requirements for Bob Snyder to allow him to increase his metes and bounds (Plat 65909 - Parcel 4830) 2~ acres to 10.8 acres for the following reasons: 1) Section 14.01 - last paragraph _ Ordinance 10. 2) It complies with the intent of the Community Development Plan as regards to planned large lot zoning in the Rural area. 3) It complies with Section 5.04 Ordinance 8 - The governing body may grant the variance if it finds that a hardship has been created by the shape or condition of the parcel in Question; granting the variance is necessary to the reasonable use of the land and granting the variance will not adversely affect the existing or potential use of adiacent land. Subject to the two parcels being combined into one parcel of 10.8 acres. Motion carried unanimously. Adiournrnent Motion by Commissioner Kishel, seconded by Commissioner Jaworski, to adjourn. This letter is sent to you in reference to the application by E V Builders, Inc. for a variance from Ordinance No. 10-A in order to permit a conveyance of the following described property: \ / The South 30 feet of the East 250 feet of the Northwest Quarter of the Northwest Quarter, Section 17, Township 32, Range 24, Anoka County, Minnesota. Hoium and Associates, Inc. dated November 21, 1972, the home on the property was constructed in such , a manner that the roof overhangs the North line of the property in ) one point by 1.35 feet. Hawkins Page 2 of the Northwest Quarter of Section l7, Township 32, Range 24 and was originally owned by Clarence Atkins and spouse and subsequently conveyed to E V Builders, Inc. Due. to the overhanging roof, E V Builders, Inc. has been negotiating with Lester Hughes since November 22, 1972, in order to correct this problem. We originally proposed to purchase a tract of land 614 feet North and South by 426 feet East and West together with an easement to County Road No. 58. This would have been a six acre tract of land with access to a public road so that the same would have been a buildable lot and E V Builders, Inc. could have then added to the lot in the South Half of the Northwest Quarter of Section l7 in order to correct that problem. Subsequently, negotiations were had on obtaining from Mr. Hughes a tract of land 200 feet on the North line, 400 feet on the South line 614 feet on the East line. However, both of the above negotiations fell through due to the fact that Mr. Hughes did not want to give access to the property and, secondly, did not want to convey such a large tract of land. '\ ) Finally, as of January 16, 1976, Mr. Hughes agreed to sell the tract of land 30 feet by 250 feet for a total price of $l,930.00 and all expenses being paid by E V Builders, Inc. The tract involved is .1721 acres, and thereby the sale price would amount to $11,214.4l per acre. You have requested that the legal description of the property presently in the South Half of the Northwest Quarter of Section l7 be combined into one legal description with the property being obtained from Lester Hughes in the Northwest Quarter of the Northwest Quarter of Section 17. This is not possible due to the fact that based upon the legal description that E V Builders, Inc. presently owns we do not know where the Southeast corner of the Northwest Quarter of the Northwest Quarter of Section 17 is in relation to the North line of the tract presently owned by E V Builders, Inc. \ ) The legal description that E V Builders, Inc. presently owns is a description which starts at the Southeast corner of the Southeast Quarter of the Northwest Quarter and proceeds in a West direction along the 'South line of the South Half of the Northwest Quarter to the intersection with Vintage Street and then proceeds in a North and Westerly direction to the intersection with Xenia Street and then proceeds in a Northwesterly direction to the intersection with the North line of the Southwest Quarter of the Northwest Quarter, which is the most Westerly corner of the subject tract as shown on N. Therefore, we are not able to make one simple legal description. We would, however, be able to have the Hughes' convey to E V Builders, Inc. the South 30 feet of the East 250 feet of the Northwest Quarter of the Northwest Quarter, Section l7, Township 32, Range 24, and subsequently have E V Builders convey this tract, together with the long legal description it presently owns in the South Half of the Northwest Quarter of Section 17 to a straw person and the straw person to reconvey both tracts in one deed back to E V Builders, Inc. If you want this done, please let me know.
