Corom. #4-76-12 Robert Slinkman Garage Moving Permit Publish on April 23, 1976 \ ) ~ ) ) " / I ) , / /- \ ) CITY 01 ANDOVER " ) REGULAR PLANNING AND ZONING COMMISSION MEETING April 27, 1976 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:35 P.M. by Chairman Ken Ortte1 on April 27, 1976, at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Dave Jack (Arrived about 8 P.M.), Don Jacobson, Art Jaworski, Ralph Kishe1, Ted Lachinski, and Larry Retzlaff Also Present: Mayor Richard Schneider, Councilman Winslow Ho1asek, Councilman Jerry Windschit1, and many others Minutes , ) Motion by Commissioner Kishe1, seconded by Commissioner Retzlaff, to accept the Minutes of April 13, 1976. Vote on Motion: yes - Chairman Orttel, Commissioner Retzlaff, Commissioner Lachinski, Commissioner Kishel, Commissioner Jacobson; present - Commissioner Jaworski. Motion carried. Amendment to Community Development Plan (Comm. #4-76-5) Chairman Ortte1 opened the Public Hearing. his comments and thoughts on the Community that the City Council be given copies of a attached) for their analysis. Commissioner Lachinski stated Development Plan and asked report he submitted (copy Councilman Jerry Windschitl, 2312 South Coon Creek Drive, came forward to give his comments and answer some of the Commissioner's questions. Some of his statements and answers are as follows: The Physical Development Committee doesn't feel they have a ten-acre requirement. Marsha Bennett made the motion for a favorable A-95 review; and also stated that the Ham Lake Plan is the best plan they have seen yet although it has a 2~ acre minimum. The Metro Council would go along with a smaller lot size if a study and report is made regarding the ability to provide Urban services in the Rural area. Discussed Ramsey, Ham Lake, and Andover getting together and share the costs of a lower lot size requirement study. Jerry felt that Ham Lake is going ahead on their own and probably wouldn't be interested in a joint effort. The Planning Bill requires each Community to have low-income housing. After asking, once again, what Metro would do if the ten acres restriction was litigated, Jerry stated that he didn't really get an answer, but they would provide legal assistance. Metro must establish a committee, with some elected and some appointed members, by July 1, 1977 in order to have everything ready to screen all Cities. i '1 , / \ , ) / \ , j ) Planning and Zoning Commission Meeting Minutes - April 27, 1976 Page 2 '- , ) After being asked if Metro is still desiring our Plan with 10 a~res since we now have a favorable A-95 review, he stated, "The Council has to have 10 acres. We should work with the 10 acres for a short period of time and see what we need to get a favorable review for less than 10 acres. The Staff is saying one thing and the Metro Council is saying another." Motion by Commissioner Jaworski, seconded by Commissioner Retzlaff, to close the Public Hearing. Motion carried unanimously. Motion by Commissioner Jacobson, seconded by Commissioner Kishel, that we delete Sections 1 and 2 as passed by the City Council and combine them into the following statement: That residential, commercial and industrial development in the Rural Planning District shall be consistent with guidelines to be developed by the Metropolitan Council for a Master Community Development Plan. \ ) / Chairman Orttel stated, "That ideally is what we have to do eventually but we need something to go on until then". Commissioner Jacobson feels that we can go ahead with what we have in the mean time. Commissioner Jaworski stated, "We have room for our Plan to work and it can be stricter than Metro Council. First adopt the Plan, then prepare the Ordinances to back up the Plan." Commissioner Jack referred to page 17 of the Development Framework Guide and expressed concern that it be done the way Metro Council wants. Mayor Richard Schneider, 1343 Andover Boulevard NW, stated, "They did send out a position paper sometime before the Council acted on it and that paper did state that they recommended 10 acres but it was not signed by anybody. They stated it was an official position paper that they are going to follow and it was the general feeling that they would pass the A-95 review on the strength of the resolution passed on April 5, 1976 City Council Meeting. If we differ from that, I don't know what they will do. Did we ever ask the staff of Metro what we wanted? We repeatedly asked the Staff members "What do you want?". Even on March 11 when we decided to have 2~ acres as minimum lot size in the Rural area, Jim Barton was out here and he would not make any statement, recommendation, or comment on it. I must say, Don, that was an excellent Motion, but I would say they would frown on it. According to the new Land Use Bill that was passed, they have until July 1, 1977 to get a System Statement out. The whole trouble here was we jumped into something 3 years ahead of time that shouldn't have been done. That is really where the whole problem really is. There doesn't have to be any Comprehensive Planning done. 4 years from now is when it has to be done. They have one year in which to get the Systems Statement out to tell you what to do and then each community has got 3 years time to get their Plan into them and we started 3 years ago, 7 years too soon. That is why we are in this bind right now." '. -, j , , ) '\ ) F , ) i \ ) Planning and Zoning Commission Meeting Minutes - April 27, 1976 Page 3 \ , j After being asked what the Metro Council position would have been if Andover had no Plan, Mayor Schneider replied, "I don't think they would have done anything. I asked Jim Barton if we withdraw the Plan since we have 3 years time to get it ready, and he said it's unfortunate, the Plan was submitted and does not conform with our framework development guide plans." Councilman Winslow Holasek, 1159 Andover Boulevard NW, said, "I feel the position paper came from the Staff and it's true that the Staff serves at the will of the Council, however that does not mean the Staff can't make recommendations; same as the Planning Commission serves at the will of the City Council so to speak, you are still free to make recommendations. I believe that is all this was and I think that the biggest mistake that the City Council made was when they were challenged with "you do it our way or else" sort of situation was not attending that meeting down there and present their side of the story. I talked to Metro Council members since who are not exactly sympathetic with the way that it was handled. Probably we would have gotten a different reaction if we had gone to that Thursday meeting instead of passing this Resolution." The Commission discussed alternatives, the question of forcing Metro to adopt guidelines, and possible changes in wording in Motion. " It was suggested that the Motion be changed to state: The Planning and Zoning Commission recommends the City Council amend the Community Development Plan to the following: residential, commercial, and industrial development in the Rural Planning District shall be consistant with guidelines to be developed by the Metropolitan Council for a Master Community Development Plan. Vote on motion: yes - Chairman Orttel, Commissioner Retzlaff, Commissioner Lachinski, Commissioner Kishel, Commissioner Jacobson; no - Commissioner Jaworski, Commissioner Jack. The amendment will be sent to Metro Council and then back to the City Council. / Galen Ferrian Special Use Permit Public Hearing (Comm. #4-76-6) Chairman Orttel opened the Public Hearing and asked Mr. Ferrian to explain his reasons for requesting this Special Use Permit. The operation will consist of selling auto parts, disassembling of cars, a towing service, sale of repaired cars, storing of 10-15 wrecked but repairable cars awaiting his restoring of them, and will be a small private business. He will operate his business on a bare lot with plans for a building next year, and will live in the house next door. He is currently running a towing service known as "A-l Towing Service". Mrs. Harold Wilber, 13634 Jay Street, said, "I believe that if it just be for repairing cars, fine, but there are enough junkyards. have 2 houses there, we moved there before the junkyards and it's for kids playing." would I dangerous , , ) Mrs. Gerry Wagner, 13425 Jay Street, stated, "Bunker Lake Boulevard is solid junk cars, there are a lot of houses in the area, it is only bringing property values down, the traffic has picked up considerably, and where will the junk cars sit if he doesn't have a building." \ j \, '- ) '--- / : ) ( ) / \ . I , / '\ , ) Planning and Zoning Commission Meeting Minutes - April 27, 1976 Page 4 Tamara Maxwell, 2223, Monroe Street NE, replied, "The home that sits right next to the said lot will be occupied by the owner. The whole thing will be fenced in, so it would be safe for children." Kay Olson, 13435 Jay Street NW, said, "My husband and I are very much opposed to another land site filling up with junk cars and feel it would devalue the land." Marilyn Gas1in, 13440 Jay Street NW, said that they have lived there for 25 years, the area has filled with junkyards now, they are all burning, she has a health problem because of it, and could get a doctor's certificate to prove it. The Commission discussed: 1) no immediate plans to build a building. 2) the problems in issuing an open permit to an open piece of land. 3) Ordinance 8 and 9. 4) fencing, parking requirements for 10-15 cars, building space, setbacks, and as a result - too small a lot to carry on all those uses. 5) too many uses on one Special Use Permit form. 6) he must have a building for selling used auto parts and operating a body shop; but fencing is required for a junkyard. Motion by Commissioner Jacobson, seconded by Commissioner Jack, to close the Public Hearing. Motion carried unanimously. Discussion on: he is asking for too many items on this one form, too vague to act on, should determine the major use of the property. Motion by Commissioner Jack, seconded by Commissioner Jaworski, that the Galen Ferrian Special Use Permit request for towing service, automotive repair, disassembling of cars, sale of used parts, as defined in the application has been found to be limited in scope, we recommend denial of this Special Use Permit in this form due to the findings in Ordinance 8 - Sections 8.19, 8.20, 6.02, and 8.08; and also the provisions in Ordinance 9 if applicable. Vote on motion: yes - Commissioner Jaworski, Commissioner Jacobson, Commissioner Jack; no - Chairman Ortte1, Commissioner Retzlaff, Commissioner Lachinski, Commissioner Kishe1. Motion defeated. Motion by Commissioner Lachinski, seconded by Commissioner Kishe1, to table the request for Special Use until Mr. Ferrian has an opportunity to clarify his desires. Vote on motion: yes - Commissioner Kishe1, Commissioner Lachinski, Commissioner Retzlaff, and Chairman Ortte1; no - Commissioner Jack, Commissioner Jacobson, Commissioner Jaworski. Motion carried. After a discussion on "procedures" and the options open to Mr. Ferrian, Motion by Commissioner Jack, seconded by Commissioner Jacobson, to bring back from the table to discuss. Motion carried unanimously. Motion by Commissioner Lachinski, seconded by Commissioner Retzlaff, to continue the Public Hearing until May 11. More discussion on procedures and facing the same application with the same 3 problems. Vote on motion: yes - Chairman Ortte1, Commissioner Lachinski; no - Commissioner Retzlaff, Commissioner Kishel, Commissioner Jaworski, Commissioner Jacobson, Commissioner Jack. Commissioner Jaworski pointed out, again, that they must act on what is on this Special Use Permit, no other hypothetical uses. Vote on motion: yes - Commissioner Jack, Commissioner Jacobson, Commissioner Jaworski, Commissioner Kishel, Commissioner Lachinski, Commissioner Retzlaff; no - Chairman Orttel. Motion carried. Motion by Commissioner Jack, seconded by Commissioner Jacobson, that the Planning and Zoning Commission recommend the City Council deny the Galen Ferrian Special Use Permit request for towing service, automotive repair, disassembling of cars, sale of used parts, as defined in the application has been found to be limited in scope, in this form due to the findings in Ordinance 8 - Sections 8.19, 8.20, 6.02, and 8.08; and, also the provisions in Ordinance 9, if applicable. Discussed amended Special Use Permits. Motion carried unanimously. Advised Mr. Ferrian that he will be on the City Council Agenda May 18. Robert Pears Special Use Permit Public Hearing (Comm. #4-76-7) \ Chairman Orttel opened the Public Hearing and referred to a letter dated April 27, 1976 (copy attached) from Pat Lindquist. Mr. Pears explained that he built a building to operate a body shop and garage to work on cars and now he is applying for a permit to operate an auto salvage yard. This building is located ~mile South from Bunker on Jay Street. , ) Mrs. Gerry Wagner, 13425 Jay Street, stated, "It would be solid cars! I would not ,like to see this. I have nothing against a body shop or repair shop, but object to the acres and acres of cars." Mrs. Marilyn Gaslin, 13440 Jay Street, stated, "I don't object to the building, but I object to the junk. Cecil Heidelberger has 40 acres of junk already." Kay Olson, 13435 Jay Street, said, "All I see is cars out my window. I object to his parking cars and the lot is really packed with cars." Motion by Commissioner Jaworski, seconded by Commissioner Retzlaff, to close the Public Hearing. Motion carried unanimously. The Commission discussed the following: fencing, the number of operations of this type in the area already, the effect the business will have on adjoining property owners, Ordinance 8, and Ordinance 9. \ , ) Motion by Commissioner Kishel, seconded by Commissioner Jaworski, that the Special Use Permit be denied. because of the following reasons: 1) Another salvage use in this area would be detrimental to the public health, safety, and welfare of the residents and, also, of the City of Andover. 2) Mr. Pears obtained the building permit for business use that was defined at the time and now he is enlarging upon permissible use by way of the Special Use Permit. 3) The Public portion of the Public Hearing was negative on all accounts. 4) The property adjoins residential area that is established. Motion carried unanimously. \ / / ) / \ , J , , ) , Planning and Zoning Commission Meeting Minutes - April 27, 1976 Page 6 / Barnes Rolling Oaks Preliminary Plat Continued Public Hearing (Camm. #1-76-3) Refer letters from T.K.D.A. dated 4-26-76 and 4-19-76 and letter from Pat Lindquist dated 4-2-76 which are attached. The Commission and Brad Wicklund discussed the following: unbuildable lots, soils information, soil borings, the extension of 147th, making l47th a cul-de-sac, no Coon Creek Watershed Board reply, and parks. Jerry Carlson, 14744 Evergreen, stated, "I don't feel that I should have to pay for this road. It is not to my benefit. I already have a way . into my property. Smith should have paid for the road." Ken Voss, 14704 University Avenue, expressed concern over the lowering of the water table in the area by cleaning the ditch. Charles Kampa, 155 Andover Boulevard NW, discussed with the Commission and Mr. Wicklund the lack of park area for the children to the East of the proposed plat, increased traffic, and the lack of benefit derived from the imposition of this plat. / Chairman Orttel will seek information from the City Attorney regarding the donating of cash versus land for park purposes. Commissioner Kishe1 will contact the Auditor's office for verification on the combining of Parcels 2400, 600, 4200, and 1200 into one parcel of land. Motion by Cammissioner Jacobson, seconded by Commissioner Lachinski, to continue the Public Hearing to allow time to correct the necessary items in the Engineer's letter of 4-26-76, obtain park clarification, and water table level information in the area. Motion carried unanimously. Barnes Rolling Oaks Second Addition Sketch Plan (Comm. #4-76-8) A Special Meeting is requested by Mr. Wicklund for Monday, May 3, 1976 at 7:30 P.M. to discuss the Sketch Plan. Noon Construction Variance (Camm. #4-76-9) No one representing Noon Construction was in the audience at 12:30 so the item will be on the next agenda. Pankonin Addition Sketch Plan (Corom. #4-76-10) Mr. Hoium, of N. C. Hoium & Associates, Inc., briefly went over the Sketch Plan. It is Lot 16 of Watt's Garden Acres to be divided into 4 parcels and zoned GB. He proposes a 2-acre parcel on the West, a one-acre parcel around the existing house (which has a driveway), a 2-acre parcel in the center, and the rest of the land under the high1ine in one parcel. One \ lot is 37,000, less than the 30,000 minimum required for an unsewered , / lot according to Ordinance 10, Section 9.06. Mr. Hoium will widen the lot to eliminate this problem. / ') / \ '- / \ ) Planning and Zoning Commission Meeting Minutes - April 27, 1976 Page 7 '\ , ) '- ) \. , j There also poses a problem with driveway access on County Road 16. Mr. Hoium will move the proposed driveway to a common driveway between Lot 3 and Lot 4 and will contact Mr. Ruud, County Highway Engineer, about the County Road requirements. Mr. Hoium will correct the few problems and bring the Preliminary Plat before the Commission on May 25, 1976. Ordinance #22 Amendment (Comm. #4-76-11) Considering the late hour, this proposed amendment will be on the next agenda. Robert Slinkrnan Garage Moving Permit (Comm. #4-76-12) / Mr. Slinkrnan showed the Commission pictures of the garage to be moved by Ernst Movers, purchased from Anoka County, and which must be moved before June 1st. The Commission read a memo (Copy attached) from James E. Thurston, Building Official. Motion by Commissioner Kishel, seconded by Commissioner Jack, that the Andover Planning and Zoning Commission recommends the City Council approve the request of Robert Slinkrnan to move the garage. Reference the Building Official's correspondence dated April 21, 1976, and request the applicant comply with the Building Official's suggestions regarding the bonding and also insurance requirements. HULEGAARD ADDITION Barnes Addition Per Ordinance lOA, Section 9.07, the City can request "land only", inasmuch as the average lot frontage is in excess of 300 feet. The land dedication would amount to 6.1 acres. If Mr. Barnes would refuse to dedicate land, he would have the option of paying a cash , dedication, however, we cannot request it. 100/0 of the land value J is $3,699. I believe it has been mentioned by Mr. Barnes that he is considering the dedication of land for park purposes w~st of Prairie Road. In order to suffice for this plat, it would have to be contiguous to it and a part of it. Also mentioned was the possibility of dedicating the 6.1 acres within the plat at this time on a contingency that should he plat the area west of Frairie Road at a later date, this parkland would become part of the dedication on the new plat. This could not only pre sent a legal problem, but it would prohibit the City from developing this park with any permanent im pr ovements. Hulegaard Addition There seems to be a question here of whether Mr. Hulegaard is going to rezone the property to Neighborhood Business, for which no park dedication is required; or plat it for the sole purpose of donating the pond area to the City. SCHROEPFEI; SL!FFCRD W. HAMBLI"" '.. ,,;' We are writing to report on the problem of street construction required for the platting of Barnesl Rolling Oaks Plat in the City of Andover. Background The previous platting of Smithls Rolling Oaks included dedication of 146th Lane NW from University Ave Extension to a point approximately 370' West of Evergreen Street NW. That portion of 146th Lane NW, west of Evergreen Street has never been constructed, yet all streets in Smith's Rolling Oaks were accepted by Grow Township on June 29. 1971. With'the acceptance of streets in Smith's Rolling Oaks, 146th Lane NW has become the responsibility of the City of Andover. The extension of 146th Lane NW to Prairie Road is included in the proposed Barne's Rolling Oaks Plat. Construction of 146th Lane NW, therefore, will be required for through traffic and access to all properties in Barne's Rolling Oaks. The 370' of 146th Lane NW directly west of Evergreen Street NW and previously accepted by Grow Township must be constructed if Barnels Rolling Oaks is approved. The preliminary project cost estimate consisting of a rural street section with a Class 5 gravel base and complete ditches is $6100, A detailed cost estimate is attached to thi s letter. (2) City assess the costs to the adjacent property owners under standard City improvem ent methods. Da t e : Apri 1 26 1976 Reference: Barnes' Rolling Oaks Preliminary Plat Review Andover, Minnesota Commission #6223-76 Commission Members: We have reviewed the revised Preliminary Plat of Barnes' Rolling Oaks. Please refer to the previous memo dated April 13, 1976. The following are our comments regarding the proposed plat: , ) 1. The developer is proceeding with combining existing parcels 2400, 600, 4200, and 1200 into one parcel of land. This must be required to conform with the platting requirements of the City. The City must require proof of this action prior to final approval of the Preliminary Plat. 2. The traveled width of all existing streets has been indicated. 3. The width and type of surfacing of l46th Lane NW in Smith's Rolling Oaks has been indicated. 4. The existing and proposed profile of l46th Lane NW to the East edge of the Plat has been indicated. In a letter from T.K.D.A. dated April 19, 1976, we commented on the construction of a portion of l46th Lane in Smith's Rolling Oaks. The City Council, at the time of their reviewal, must determine the appropriate action for construction of this street. This street must be constructed if the plat is approved. 5. The Preliminary Plat has been submitted to the Coon Creek Watershed District for reviewal. Ditch reconstruction or cleaning may be required to establish proper' drainage of the area. The plat should be approved only upon the contingency of receiving recommendations from the Watershed Board. 6. All setback lines have been shown. The setback lines are as listed in the memo dated April 13, 1976. '- j 7. The existing and proposed profile of Goldenrod Street has been included on the plat. A 24-inch culvert and invert elevation has been indicated on the profile. The culvert elevation is subject to change when Watershed Board comments are received. , I \. We would recommend that Goldenrod Street be constructed during the rest of the street construction. This would provide for access from Lot 5, Block 1 and Lot 6, Block 2. 9. The proposed common driveway for Lots 5 and 4 of Block 2 has been indicated. 10. The typical rural roadway section has been revised to conform to City standards. 11. Lot 4, Block 1 and Lots 1 and 2, Block 2 have been indicated as unbuildable. Lot 3 of Block 2 should also be indicated as an unbuildable lot. This is required from the review of soils information. The developer may sell these lots only as unbuildable unless sufficient proof has been provided at the time of sale to prove otherwise. This can occur at anytime following recording of the plat. 12. 146th Lane NW on the original Preliminary Plat has been revised to 147th Avenue NW to conform with City street designation patterns. 146th Lane NW would begin at the West line of Smith's Rolling Oaks. Slinkman I recommend approval of the request to move the garage to 16765 Valley Drive NW. I also recommend that all the provisions of the Andover Moving Ordinance #4 that cover security requirements _ bonding, cash deposits, etc., be waived in this situation because the structure will not be moved along any City roadways, only County roads. I would suggest that the Slinkman's be directed to supply the City with copies of permits and bonding requirements which were submitted to the County. / A Building Permit is required for the construction that is necessary to stabilize the building. A Building Permit will be issued subject to the building being located as indicated to me at the rear of the primary structure. Also subject to providing drainage away from said building.
