Comm. 113-76-2 Double Garage Ordinance Publish on March 19, 1976 " , / \ , / () ,) 0 OTYoIANDOVER ( ) \ REGULAR PLANNING AND ZONING COMMISSION MEETING ) MARCH 23, 1976 MINUTES The Regular Meeting of the Andover Planning and Zoning Commission was called to order at 7:50 P.M. by Chairman Ken Orttel on March 23, 1976, at the Andover Community Center, 1685 Crosstown Boulevard NW, Anoka, Minnesota 55303. Commissioners Present: Ken Heil, Dave Jack, and Art Jaworski Also Present: Ralph Kishel and Ted Lachinski, newly appointed Commissioners as of April 1, 1976, and others Minutes Motion by Commissioner Jack, seconded by Commissioner Jaworski, to approve the Minutes of March 9, 1976, as presented and typed. Vote on motion: yes - Chairman Orttel, Commissioner Jack, Commissioner Jaworski; present -,Commissioner Heil. Motion carried. Steve Slyzuk Special Use Permit (Comm. #3-76-1) , \ ~ The Commissioners discussed the motion made at the March 9th Meeting and agreed with the statements made in it. This item will be on the City Council Agenda for April 6, 1976. The Commission advised Mr. Slyzuk to contact James E. Thurston, Building Inspector, regarding the State Building Code on Mobile Homes. Gary Anderson - Special Use Permit Public Hearing (Comm. #3-76-3) Gary Anderson reported to the Commission that he wishes to construct a service station on Lot 1, Block 1, Hughs' Industrial Park, at Round Lake Boulevard and l62nd Lane NW. The station would consist of 2 banks of gas pumps, a 5-stall service area, and a retail parts carry out also. The building would be 30' by 150' on a 123' by 400' lot. \ The Commission, Mr. Anderson, Mr. Kishel, and Mr. Lachinski discussed the following: 1) Setback requirements of Ordinance 8. Mr. Anderson had intended to front the station on Round Lake Boulevard but should turn the building to face l62nd to meet minimum depth requirement of ISO'. In checking the remaining setback minimums - side yard setback of 30' - major arterial setback of 50' - front yard setback of 40' - rear yard setback of 40' - it was agreed by everyone that this lot is not large enough to accomodate a building of this size. 2) LI Zoning is the right designation for a service station. 3) l62nd Lane is dedicated 66' wide. 4) The primary use would be gas sales. 5) The Building Code is very strict on septic systems for this type of building. 6) Section 8.08 Parking, of Ordinance 8. 7) No adjacent property owners present. / Planning and Zoning Commission Meeting Minutes - March 23, 1976 Page 2 8) The purchase of Lot 1, Block 1, is contingent on the approval by the City Council of this special use permit. 9) Ordinance 8 - Special Use Permits. Annual review by the City Council and possible problems in the future. 10) There would be no truck or car wash. 11) Page 11 of Ordinance 8. 12) Section 4.29 of Ordinance 8. 13) Commissioners Jack and Jaworski both stated their belief that it would seem more logical to put a station in the Urban, more developed, portion of the City rather than in this Rural area. 14) The City must be careful to avoid strip development. Motion by Commissioner Jack, seconded by Commissioner Jaworski, to close the Public Hearing. Motion carried unanimously. Motion by Commissioner Jaworski, seconded by Commissioner Jack, to carry this Special Use Permit request to the next Agenda. Motion carried unanimously. The Commission recommended that a separate page be typed and sent to them and Mr. Anderson regarding the specific Ordinance Sections discussed. A copy is attached to these minutes. Trueman L. Hulegaard Sketch Plan (Comm. #2-76-1) Mr. Larry Seiberlich, of Integrated Services, Inc., presented basically the same plan as the one he brought in under the Agenda heading of "Proposed Rezoning" on February 26, 1976. He primarily discussed a division of the property in order to give park land to the City. One drawing showed a possible road going through which could be put in by the County if the Rum River Crossing, discussed in 1975, was extended. Mr. Seiberlich was told that if the land is dedicated park land, a road cannot be built on it. Mr. Hulegaard and Mr. Seiberlich were advised to present their plan to the Park and Recreation Commission on April 5th to see if the City would accept this possible park land. If the Park and Recreation Commission is interested in the land, the parcel would be split and, therefore, have to be platted. If they feel it is unsuitable for park, platting would be unnecessary and the next step would be to apply formally for a rezoning. Double Garage Ordinance (Comm. #3-76-2) The double garage Ordinance was tabled to the next meeting in order to give the entire new Planning and Zoning Commission an opportunity to review the materials available. Planning and Zoning Commission Meeting Minutes - March 23, 1976 Page 3 Other Business Ralph Kishe1 volunteered to be the liaison for the Planning and Zoning Commission to the Park and Recreation Commission for the next year. Adjournment Motion by Commissioner Jack, seconded by Commissioner Hei1, to adjourn. Motion carried unanimously. Meeting adjourned at 9:40 P.M. \ / \ ) \ \ ~ ) Gary Anderson Special Use Permit Request March 23, 1976 '\ I Page 9 of Ordinance 8 - Section 6.02 Minimum Requirements Lot Width at Front Setback Line - 100' Side Yard Setback from Street - 30' Rear Yard Setback - 40' Lot Depth - 150' Front Yard Setback - 40' Any Yard Setback along a Major Arterial Street - 50' Page 6 Of Ordinance 8 - Section 4.29 Service Stations A drainage system subject to approval by the governing body shall be installed. A box curb not less than six (6) inches above grade shall separate the public right-of-way from the motor vehicle service areas, except at approved entrances and exits. No driveway at a property line shall be less than forty (40) feet from the intersection of two street right-of-way lines. No vehicles shall be parked on the premises other than those utilized by employees or awaiting service. All areas utilized for the storage, disposal, or storage of trash, debris, discarded parts, or similar items shall be fully screened. No vehicle shall be parked awaiting service longer than 30 days. Exterior storage shall be limited to vehicles of employees, vehicles awaiting service, service equipment and items offered for sale on pump islands; all other exterior storage shall be limited to items offered for sale provided they are within yard requirements and are located in containers such as tire racks, metal trays, and similar structures designed to display merchandise. The entire site other than that taken up by a structure or planting shall be surfaced with asphalt, concrete, or other material approved by the governing body. All structures and grounds shall be maintained in a neat, orderly, clean and safe manner. Pump islands are subject to yard requirements.
