Consider Application for Scheduled Use of Recreational Facilities/Constance Free Church for February 12th DATE: January 20, 2011 INTRODUCTION This item is in regard to considering approving the attached Application for Scheduled Use of Recreational Facilities for use of the hockey rink as requested by Constance Free Church. DISCUSSION The day that has been requested is as follows: . Saturday, February 12, 2011 from 10:00 am- Noon at Prairie Knoll Park. Note: Since rinks don't open until 1 pm on that day, the church will need to check out the necessary keys. Keys are required for the warming house portion of the building and a deposit for the key is required. Since this is a one-day request, the Commission may want to consider waiving the requirements that are to be submitted as part of the Guidelines to use the facility. Also attached is the proposed revised 2010-2011 hockey rink schedule. ACTION REOUIRED The Park & Recreation Commission is requested to approve the Application for Scheduled Use of Recreational Facilities for use of the hockey rink at Prairie Knoll Park as requested by Constance Free Church. It is the policy of the City of Andover to try to meet the recreational needs of its citizens. The goal of the Park and Recreation Commission in scheduling is to allot the limited number of recreational facilities in a fair and equitable manner, using compromise when necessary to accommodate the maximum number of requests possible. The Guidelines for Field Usage by Youth Associations may be used to determine field allocation (see attached). Facility requests submitted by the due date with this completed form will be given the highest priority. Subsequent requests will be filled on a first-come, first-served basis if facilities are available. The sequencing of scheduling will be considered with City youth associations having first priority. Consider 2011 Softball/Baseball Tournament Applications DATE: January 20, 2011 INTRODUCTION This item is in regard to considering the attached softball/baseball tournament application forms for the upcoming 2011 softball/baseball season as requested by the Andover Athletic Association, Andover Baseball Association and Andover High School. DISCUSSION The earliest the associations can submit is December 15th for the following summer. The City has received applications from the Andover Athletic Association and Andover Baseball Association for tournaments for the upcoming season along with a one day request from Andover High School. All fees must be submitted with the application no later than eight weeks prior to the tournament date. For any late application, the late fees must also be submitted with the application, including the penalty fee. Late applications must be approved by the Park and Recreation Commission at least two weeks prior to the date of the tournament. The sequencing of scheduling will be considered with City Youth Associations having first priority. Consider Donation to Eveland Fields (South Field) Scoreboards/lO-21 DATE: January 20, 2011 INTRODUCTION The Park Commission is requested to consider the scoreboard funding request as directed by the City Council for the scoreboard located at the south field of Eveland Fields. DISCUSSION Attached are the City Council meeting minutes of December 21,2010 regarding the discussion of outstanding athletic funding projects. Refer to the motion requesting the Park Commission to the original recommendation to fund the $3500 towards the scoreboard, The original request was made in October of2008, On February 19,2009 the Park & Recreation Commission recommended to the City Council that $3,500 be allotted toward the scoreboard, A letter was sent to the School District notifYing them that funding was not available. The donation of the scoreboard came before the City Council on April 20, 2010 and the meeting minutes reflect that at that time the City Council had never made the offer to contribute. Refer to the attached documents for timeline and details. The scoreboard has been placed and all construction related work was provided by the School District. BUDGET IMP ACT If the Park and Recreation Commission does recommend the funding of the scoreboard, the $3500 will be funded from the 2011 misc. park improvement fund. There is a $15,000 fund balance that is currently in the Miscellaneous Park Improvement Fund, ACTION REOUIRED The Park and Recreation Commission is requested to reconsider a recommendation to the City Council to help fund the purchase of the scoreboard at Eveland Fields. Mr. Dickinson discussed the information with Council. Part of this item was discussed with Item 24. The Council discussed the scoreboards and the request from the Andover High School Activities Director. Councilmember Jacobson asked if they did not get the $3,500 will the High School not allow the City to use them. Mr. Berkowitz stated the City Council did not approve matching funding for the score boards and the boards are already installed, The City does maintain and use the fields in the summer. Mr. Dickinson reviewed the correspondence to the High School Activities Director from the City regarding the score board, Councilmember Bukkila thought they should postpone the decision until the end of the of the 2011 park season for the Park Commission to evaluate it and see ifthere are any funds available to donate. Councilmember Trude thought it would be a good idea to wait. Park Chairman Butler stated the Park Commission did recommend this a couple years ago and ended up at a point where they did not have any money in the park improvement funds so the City Council decided not to proceed with the contribution to the score boards. After discussion at the most recent Park Commission meetings the Commission still felt this was a worthwhile cause and thought the School District misunderstood what had taken place earlier but out of a goodwill gesture the Park Commission decided to go ahead with the donation for the scoreboards, The original arrangement was that the school would pay $4,000, Andover would pay $3,500 and Andover Athletic Association would contribute $500.00. He did know that the school ended up paying for the entire cost. He stated if the Council wanted to send this back for further discussion at the Park Commission he would be open to that. Mr. Dickinson explained how the donation ofS12,000 would come about. Councilmember Bukkila asked if the $12,000 will be subtracted from the skateboard park budget total amount. Mr. Dickinson stated the total amount will be in equivalency costs, there will still be a firm $70,000 but if the donation is $12,000 the actual cash paid out will be less, the actual amount paid out will be $58,000 for the skate park if a $12,000 donation is received. Councilmember Trude thought the budget amount should be reflected more accurately once the concrete is poured so the Parks Commission does not think there is more out there to spend than what they have budgeted. The Council discussed with staff the skate park budget and how it should be reflected to the Park Commission, Councilmember Bukkila asked how the City contributed to the work effort of the hockey rinks. Mr. Berkowitz reviewed the layout with the Council and explained the City did the fine grading, provided and placed the class five in the driveway entrance and parking area. They also fme graded both hockey rinks, free skate, placed class five in both rinks and also seeded. Councilmember Bukkila asked if the City did the full grading at other parks. Mr. Berkowitz noted at Hawkridge Park the City did full grading to get it ready in time, ~ ~ Motion by Jacobson, Seconded by Trude, to concur with the Park Commission on the recommendation for the skate board park per the discussion section of agenda number 6. Councilmember Jacobson stated the Hockey Association paid for the lumber, erection of the two rinks, the base for the warming house and putting up the warming house and when completed it will become City property and is a huge donation by the Hockey Association to the City. Berkowitz, Director of Public Works/City Engineer SUBJECT: Consider ParkCommission RecommendationIPubHc Works Campus Rinks Projectl09-16 - Engineering DATE: October 5, 2010 INTRODUCTION The City Council is requested to consider the Park and Recreation Commissions recommendation to allocate funds from the Park ImpIovement Fund to assist in the completion of the Public Wotks Campus Rinks warming house. DISCUSSION Park Improvement funds that would be allocated include the $15,000 from the "annual miscellaneous . project" fund for 2010 which has not been used to date, $8,000 of available fund balance plus a proposed donation amount of $12,000. The budget total not to exceed $35,000. The donation that is proposed would be for labor provided to pour the concrete pad for the 2011 Skate Park. The donation would need to be formally approved prior to funds being released above the $23,000 amount listed in the Park Improvements Fund Projected Cash Flow Analysis. . BUDGET IMPACT An updated cash flow analysis identifying how this funding recommendation will impact the Park Improvement Fund is attached and will be reviewed with the Council at the meeting. Mr. Haas indicated this item is in regards to considering a request from Andover High School for scoreboards for the south field at Eveland Fields. Acting Chair Lindahl asked if there has been any contact with the Andover Softball Association for part of this because it would be nice to share the burden but they do not.' have any money at this time to help out He thought the youth association may be another avenue to approach on this, If the City could contribute some staff time and equipment that may be helpful but he did not know if they had funding to approach this in 2009, Commissioner Butler stated he did not know that they had four thousand dollaIs right now. Commissioner Hupp agreed with the others in regards to assisting with time and equipment but did not know if they could afford it at this time, Mr. Haas indicated they received Hickory Meadows Park dedication fee, which was around $40,000 to $45,000. 0 Commissioner Kowalewski asked how much the softball team uses the area in the . summer months. Mr, Haas indicated the fast pitch girls use the fields. Acting Chair Lindahl thought this would be great for the fields as well as the participllIits but he thought there might be some other areas that could be looked at but they do not have the funds at this time and he would be hesitant to commit to it at this time, . Acting Chair Lindahl asked Mr. Haas to contact Mr. Lattola and the association to see if there is anything there and then they will revisit this if there are no other resources. ANOKA COUNTY SHERIFF'S DEPARTMENT 3RD QUARTERLY REPORT Mr. Haas reviewed the 3rd Quarter Anoka County Sheriff's Department Report with the Commission. Commissioner Kowalewski asked if they had any idea what the pennit was used for through November on item 9/26. Fund with money in and the'Park Commission does have the ability to recommend spending money out of that fund for these types oftbings. Commissioner Lindahl thought they needed to do it because there is no indication the School District will have the D;1oney next year to do this, Commissioner Hupp thought because of the economy the association should try to come up with some type of fundraiser to try to help pay for the scOreboard and hold offuntil the end of the season to see how much is raised seeing that the board will not go up in time for the 2009 season. This will give them the opportunity to go out and raise money for a bigger buy in. Commissioner Lindahl thought they needed to commit to this either now or never and if they can get mo/."C money raised through the association through the year they can donate it to the Park Commission. He did not think they bad time to try to raise funds. DISCUSSION There are a couple items that staff would like to update the Commission on. First, the City Council has authorized staff to order the equipment from American Ramp Company (ARC). Attached is the current layout of what is approved (the Dragon Back and Marble Bench) have been added to show that there is adequate room if the both pieces are purchased). Two of the pieces are ramps that will be refurbished by ARC. The City Council did approve $58,000 for the improvement of the park including the concrete slab, equipment and other miscellaneous items (garbage cans, benches, etc.). Second item is the Park Commission will need to decide which additional piece equipment to purchase (either the Dragop Back or the Vegas Marble Bench or both). The Commission does still have some time to make a determination of which piece to purchase as long as the equipment early enough so that the City can take advantage of the free shipping. If the Commission would like to order both items, it appears at this point that there may be enough to purchase both pieces. ARC quote to buy both pieces is $6875.94 (see attached quote). The other item is Commissioner Hupp did not reapply to serve another term on the Commission. Therefore the Commission will need to appoint a Commissioner to serve on the Skate Park Task Force with Commissioner Kowalewski. Commissioner Van Vark has expressed interest in serving on the Task Force. At this point, this is what is being has been approved for now: . Landmark Concrete, Inc, $17,558.32 . Abusive Language; Noisy Conduct: Persons engaged in offensive, obscene or abusive language or boisterous and noisy conduct tending reasonably to arouse alarm, anger or resentment will not be allowed. B. Advertising, Selling And Solicitation: No advertising, unapproved selling or solicitation is allowed. An Exclusive Use Permit may be approved by the City Council and issued by the City Clerk for the selling of food, alcoholic or nonalcoholic beverages as established by City Council resolution. C. Alcoholic Beverages: Consumption or possession of alcoholic beverages is not permitted unless a permit is obtained under Subsection B of this section. D. Fires 1 : It shall be unlawful to build or attempt to build a fire except in areas designated for such purpose. No person shall drop, throw, or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco, paper or other flammable material. E. Firearms And Explosives: No firearms (as defined by city ordinance) 2 or explosives shall be present or used unless approved by the City Council. Authorized law enforcement officials shall be exempt from this regulation. F. Gambling: Gambling shall not be allowed. G. Golfing: No person shall be allowed to golf or practice golf. H. Hours: City parks, recreation areas, and open space shall not be occupied or used, nor may any motor vehicles be parked therein, between eleven o'clock (11 :00) P.M. and six o'clock (6:00) A.M., except when participating in an activity for which a permit has been granted by the city. Operation Of Motor Vehicles: 1. No person shall ride or drive a vehicle at a rate of speed exceeding that posted in city parks or fifteen (15) miles per hour. 2. It shall be unlawful for any self-propelled vehicle, including, but not limited to, "motor vehicles" as defined in Minnesota Statutes Chapter 169, other self-propelled vehicles, go- carts, and snowmobiles, to travel within city parks, recreation areas, or open space, except on established roadways, trails, or other areas designated for such purpose. Authorized emergency vehicles, city vehicles and wheelchairs for the handicapped or disabled are exempt from this regulation 1 . J. Damage To Park or open space Property: It shall be unlawful to mark, deface, disfigure, injure, tamper with or dispose of or remove any buildings, bridges, playground equipment, tables, benches, fireplaces, railings, paving or paving materials, public utilities or parts or appurtenances thereof, signs, notices (temporary or permanent), monuments, stakes, posts, equipment, facilities or park property or appurtenances, whatsoever, either real or personal. K. Pets And Animals: 1. Leashed Animals: All domestic animals (such as dogs, cats and similar animals) must be kept leashed 2 . Excention: DOl!s are allowed to be nnleashed in a desif!Dated and/or authorized municinal or countv dOl! nark area. 2. Removal Of Excrement: Owners are required to clean up and dispose of their pet's excrement 3 . 3. Horses shall not be allowed in any park or open space area including the city trail system. 4. SUMMARY AN ORDINANCE AMENDMENT TO CITY CODE 8-4 PARKS AND RECREATION AREAS STATUTORY AUTHORIZATION AND POLICY Statutory Authorization This ordinance amendment is adopted pursuant to the authorization and policies contained in Minnesota Statute 462. Policy The purpose of these regulations is to protect the public health, safety and welfare as well as to provide consistent regulations for parks, recreation and open space areas. GENERAL PROVISIONS AND DEFINITIONS Jurisdiction The provisions of this ordinance shall apply to the City of Andover. Enforcement The City Administrator or his/her designee shall have the authority to enforce the provisions of this ordinance. Interpretation Interpretation of the provisions ofthis ordinance shall be held to be the minimum requirements and shall be liberally construed in the favor of the governing body. A printed copy of this ordinance is available for inspection by any person during regular hours of the City Clerk. Upon arrival a deputy observed 3 juvenile males leaving on bikes. He stopped the kids who stated that a kid who had just left the park punched one of them in the face. Another deputy located the other juvenile who also claimed assault. It turns out they met at the park to fight. Neither party was cooperative and did not want to pursue charges. 10.07 12:27 Crooked Lake 10231426 A deputy on routine patrol heard 911 state that two theft suspects that were being watched were leaving from the boat landing. The deputy located the suspects and detained them. 10.10 17:38 City Hall 10234106 A deputy responded to a call of a child falling off some playground equipment. The deputy administered oxygen until Allina arrived. 10,15 15:26 City Hall 10238334 A city employee requested a phone call regarding an expired license plate. The employee was given the information she needed. 10.16 13:54 Terrace 10239159 A caller advised two teenage males appeared to have grabbed something under a garbage can and was reporting the behavior as suspicious. The deputy located two males matching the description and made contact with them. The males stated they were not at the park and refused to a consent search. The caller did not want to be seen. 10,17 02:21 Andover Station North 10239760 A caller reported vehicles rewing engines in the parking lot. The deputy located the vehicles and made contact with the occupants. They advised they were just sitting there talking. They were advised the park was closed and they left. 10,19 01:09 Crooked Lake 10241097 A caller reported she had dropped her car keys in the lake and wanted help looking for them. The deputy arrived and located the caller, and a friend, who were wet from being in the lake. They were warned about being at the location after the park was closed. The deputy transported them to their home being they could not find their keys. 10.21 21:47 Prairie Knoll 10243623 A caller reported loud music coming from the park. The deputy arrived and located some high school students talking and advised them to keep the music down. They complied, 10.23 15:43 Andover Lions 10244963 A caller reported finding an abandoned bike near the railroad bridge. The CSO located the bike and brought it to the Found Property storage at ACSO. 10.30 12:47 Crooked Lake 10250524 A woman was trying to transport her husband to the hospital for a medical emergency. She was unable to get him there safely and stopped and the boat landing to call 911. 11.02 14:50 Northwoods East 10252982 A caller wanted a suspicious vehicle at the park checked. Before the deputy arrived, the vehicle left. 11.04 17:38 Hawk Ridge 10254709 A caller reported a vehicle in the lot tearing up the new road. The caller had gotten the license plate and the deputy went to the home it was registered to in Andover. While speaking with the parents, the kid that was in the car called and his father told him to return home. The deputy confronted the kid who admitted what he had been doing and the father advised he would deal with the punishment. 11.05 15:53 Green Acres 10255494 A deputy was called to a park due to 20 juveniles gathering to have a "smoking party". When the deputy arrived he located about 10 juveniles playing football and 6 older looking males sitting at a picnic table. He made contact with the 6 males who advised they were just handing out and not smoking, None of the males had cigarettes on them and provided the deputy with identifications. 11.06 19:00 Oak View 10256380 A caller reported her grandson told her that he thought there was someone shooting airsoft BB Guns at the park. The grandson did not see who was shooting the guns but the caller wanted to report the incident. 11.07 13:14 Tower 10256915 On routine patrol, a CSO observed a vehicle parked on the grass next to a "no parking" sign. The driver was issued a citation. 11.09 15:42 Crooked Lake 10258508 A caller reported his vehicle at the landing was broken into and a bag of tools were stolen. The suspects broke a window. 11.24 22:13 Hawk Ridge 10270150 A deputy was dispatched to a jeep doing doughnuts in the parking lot. Upon arrival the jeep was gone. 11.26 19:35 Crooked Lake 10271299 A caller reported a female at the location waving her arms in the air. A deputy arrived and made contact with two people who were watching a movie in the back seat of a vehicle. Both occupants provided identification and were told to leave. They complied. 11.28 00:47 Hawk Ridge 10272273 On routine patrol a deputy observed a vehicle parked in the lot after closing. The shelter posts are in and the completion of the shelter will be worked on the weather is a little nicer, The rest of the items (restoration, sidewalk, etc) will be completed in the spring. The Parks Department maintenance staff did a very nice job, If you get a chance, stop by and take a look at it. ON-HOLD PROJECTS- . Hartfiel's Park- The project is on hold until the property owner considers their option, but the city at this time does not have the funds to buy the property. . Hills of Bunker Lake West Park - Need to meet with the neighborhood this winter to discuss the idea of a security light at the park. Could do this at the next meeting in February if you like. OTHER ITEMS OF INTEREST - . Hidden Creek North Park and Rose Park - Nothing new to report. The City Council has approved the installation of wireless internet service tower at both locations. Installation of the wireless internet services (Clear Wireless) has been completed at Rose Park on the water tower, Note: Staff has been recently notified that the tower at Hidden Creek North Park and Water Tower #2 are on hold until further notice. Clear Wireless is focusing their efforts trying to complete service towers that are under construction to get the system operational. . Shadowbrook East Park and Andover Station North - Nothing new to report, Clear Wireless has received approval from the City Council for the installation of the wireless internet service at Shadowbrook East Park. Clear Wireless has also received approval for the installation of the wireless internet service at Andover Station North facility. Again both of these locations on hold until further notice, . Prairie Knoll Park - Nothing new to report. The City Council has approved the location of the cell tower which will be located on the east side of the park near Prairie Road and just north of the southeast field. Construction is still pending. . Community Garden Plots - 19 renters have already signed up to renew their plot for 2011, The 2010 plots were tilled up the week of October 25th. The Parks Maintenance crews did mentioned to staff that some of the plots were not cleaned out as required (fencing, stakes, etc) by the deadline date after they were reminded to do so in a written letter that was sent by staff. Next year we will track those plots that did not clean up and they will not be able to rent a plot for the following year, . DOl!: Park - To date, staff has not heard recently from Dog Park Committee, One $100 donation has been received by the City recently. It is our understanding that they are looking at becoming a non- profit organization. Staff recently attended the National Recreation and Park Association (NRPA) that was held this past fall at the Minneapolis Convention Center and picked up some good literature on dog parks that will be useful for staff and the Dog Park Committee.
