INTRODUCTION
The City Attorney has advised that according to State Statute, the EDA must hold a public hearing
prior to any land sales in the redevelopment area known as Andover Station North. Lot 2, Block 3,
and Lot 3, Block 3, Andover Station North are being sold to Dynamic Sealing Technologies, Inc.
The City had purchase agreements prepared (and are signed) and are pending a closing date on the
parcels. The legal notice has been published at least ten days prior to this meeting (on 11119/1 0).
ACTION REOUESTED
The EDA is requested to open the public hearing and request public comment. If no public comments
are made, then the EDA may close the public hearing and discuss the proposed resolution. The City
Attorney has also advised that the EDA should pass a resolution indicating it is in the public interest to
sell these properties and that the specified intended use of the parcels is in keeping with the interest of
the City of Andover EDA to further the redevelopment of Andover Station North (see attached
resolution). Staff recommends the land sales be completed as they meet the original objective of
redeveloping the area with a diversity of different uses that will meet the needs of the broader
community. All proposed buildings shall conform to the design guidelines that were established for
Andover Station North and will compliment the entire Andover Station redevelopment area. The site
plan of the Dynamic Sealing Technologies, Inc. building expansion is attached to show how it will
connect to the existing Dynamic Sealing Technologies, Inc. building. The architectural design of the
proposed building expansion will match the existing building.
ACTION REOUIRED
The EDA is asked to hold a public hearing and take public comment on the proposed land sale; and
review the attached resolution. If the EDA agrees with the findings in the resolution, a motion to
approve the resolution and allow the land sales would be in order.

STATE OF MINNESOTA
The Economic Development Authority of the City of Andover will hold a public hearing
at 6:00 p.m., or as soon thereafter as can be heard, on Tuesday, November 30, 2010 at
Andover City Hall, 1685 Crosstown Blvd NW, Andover. This public hearing is to
discuss land sales of Lot 2, Block 3, Andover Station North; and Lot 3, Block 3, Andover
Station North. The land sales will be reviewed to determine if the land sales are in
keeping with the intent outlined in Minnesota State Statute 469.105. All written and
verbal comments will be received at that time and location. A copy of the proposed land
sale information will be available for review prior to the meeting at City Hall. Please

SUBJECT: Approve LMCIT Liability Coverage - EDA

INTRODUCTION
The League of Minnesota Cities Insurance Trust (LMCIT) requests that participating EDA's
annually decide whether or not to waive the statutory tort liability limits established by
Minnesota Statutes 466.04.
DISCUSSION
Attached is the "LMCIT Liability Coverage - Waiver Form" provided by the LMCIT, which
provides a description of the options available to the City of Andover EDA. Currently the City
of Andover EDA DOES NOT WAIVE the monetary limits on municipal tort liability
established by Minnesota Statutes 466.04. I am recommending continuing with the past
practice.
BUDGET IMPACT
No budget impact if the EDA does not waive limits.
ACTION REOUESTED
The City of Andover EDA is requested to not waive the monetary limits on tort liability
established by Minnesota Statutes 466.04.
SECTION I: LIABILITY COVERAGE WAIVER FORM
Cities obtaining liability coverage from the League of Minnesota Cities Insurance Trust must decide
whether or not to waive the statutory tort liability limits to the extent of the coverage purchased. The
decision to waive or not to waive the statutory limits has the following effects:
0 If the city does not waive the statutory tort limits, an individual claimant would be able to recover no
more than $500,000. on any claim to which the statutory tort limits apply. The total which all claimants
would be able to recover for a single occurrence to which the statutory tort limits apply would be
limited to $1,500,000. These statutory tort limits would apply regardless of whether or not the city
purchases the optional excess liability coverage.
0 If the city waives the statutory tort limits and does not purchase excess liability coverage, a single
claimant could potentially recover up to $1,500,000. on a single occurrence. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would
also be limited to $1,500,000., regardless of the number of claimants.
0 If the city waives the statutory tort limits and purchases excess liability coverage, a single claimant
could potentially recover an amount up to the limit of the coverage purchased. The total which all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would
also be limited to the amount of coverage purchased, regardless of the number of claimants.
Claims to which the statutory municipal tort limits do not apply are not affected by this decision.
This decision must be made by the city council. Cities purchasing coverage must complete and
return this form to LMCIT before the effective date of the coverage. For further information, contact
LMCIT. You may also wish to discuss these issues with your city attomey.
